The site is located to the south of 21st Avenue, which is a gravel, unimproved road with 6-inch vertical curbing on the north side; on the east by Evergrecn Roacl, which is a paved road without curb and gutter tirithin the site boundary; on the west and south by undeveloped land. The existing gravel road of 21st Avenue is approximately 2'h-3 feet below the eaisting project. The project has a gentle slope flowing from the north to the south. The site currently exusts at approximately 1.6 acres with a residence located on the easterly portion of the site. The projected development is for short platting to create four lots. The three westerly lots vNrill be approximately 10,000 square feet each, or approximately 0.23 acres. The remaining land will stay with the existing residence. The owners have agreed to participate in future R.I.D.'s, thereby eliminating any possibility of future drainage coming onto the site. As previously stated, the site along 21st Avenue rises about three feet and then gently slopes at approximately one percent to the north, thereby eliminating any offsite drainage onto the project. SP-741-92 ) CONCLUSIONS AND DECISION ' THIS MATTER, an application for subdivision of land, from Lyle Clark has been received and decided upon, pursuant to Spokane Counry Subdivision regulations, on the day of March, 1992. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide approximately 1.6 acres into 41ots for one existing single - family dwellings and three new single family dwellings. 3. The proposal is located south of and adjacent to 21st Avenue, between Evergreen and Mamer Roads in the NE 1/4 of Section 27, Township 25 North, Range 44 EWM, Spokane County, Washington. 4. The current zoning of the property is Urban Residential-3.5 (UR-3.5) The proposed lot sizes, frontage and intended uses are allowed within this zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category. . 6. The required public notice was provided for this proposal and agencies having a potential interest in the project were notif'ied and recommendations solicited. 7. One person in the area commented on the proposal. The chief concern expressed was that of improving the existing gravel surface of 21st Avenue. 8. Recognizing the recommended conditions and Spokane County development standards, the proposed subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. 9. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-741-92 is hereby APPROVED until April 1, 1995, subject to conditions noted below. The Planning Director/desigrtee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 5. Appropriate road name(s) shall be indicated. b. The preliminary plat is given conditional approval for three (3) years, specifically to April 1, 1995. The applicant rriay request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiration date. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of urility easements by appropriate utility companies shall be received with the submittal of the final plat. 8. Three (3) current certificates of title shall be furnished to the Planning Department prior to filing the final plat. 9. The final plat map shall indi.cate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be detemzi.ned at the rime building permits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 10. No water plan is required, and a simple tap is needed at the time of building permit . release. 11. A survey is required prior to the filing of a final plat. . COUNTY ENGINEER'S DEPARTMENT CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. 2. Drainage plans and design calculations showing the alignment of drainage facilities shall be submitted to the County Engineer for approval pnor to construction and/or the filing of the final plat. Drainage plans ta be prepared under the direction of a licensed Professional Civil Engineer. 3. No construction work is to be performed within the existing or proposed public right- of-way until a pernut has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 4. Individual driveway access permits are required prior to issuance of a building permit for driveway approaches to the county road system. 5. Dedication of 4 feet of additional right-of-way along Evergreen Road is required. 6. A statement shall be placed in plat dedication that no direct access be allowed from lots to Everg;reen Road. 7. Existing county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 8. Sidewalks are required along the arterial(s) on Evergreen Road. 9. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 10. To construct the road i.mprovements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petirion or resolution which purpose is the forrnation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. This provision is applicable to Evergreen Road and 21 st Avenue. • 11. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvements. At such time as an RID is . created or any Road Improvement Project is sancrioned by Spokane County, the improvements required (curb, sidewallc, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Evergreen Road and 21st Avenue. 12. T'he following statement sha11 be placed in the plat dedicarion: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which perition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the fonnarion of an RID by the resolurion method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is formed by either the perition or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement(s) or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RJD; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjuncrion with the formarion of an RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners aff'u-ming the final assessment roll. . It is further agreed that at such rime as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvenaents required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without participation by Spokane County. The RID waiver contai.ned in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to Spokane County the then estimated cost of the required improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement) providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to Evergreen Road and 21st Avenue. 13. The County Engineer has designated Typical Roadway Section Number Two, Local Access standard for the improvement of 21st Avenue, which is to be constructed within the proposed development. This will require the installation of 18 feet of asphalt. The construction of curbing is also required. 14. The County Engineer has designated Typical Roadway Section Number Two, Major Arterial standard for the improvement of Evergreen, which is adjacent to the proposed . FINDINGS AND DECISION SP-741-92 Page 4 development. This will require the addition of approximately 4- 6 feet of asphalt along the frontage of the development. The construction of curbing and sidewallc is also required. 15. The proposed subdivision shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regularions for roads, approaches, drainage and fees in new construction. 16. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of addirional right-of-way and the roadway improvements herein specified. 17. The County Arterial Road Plan identifies Evergreen Road as a Principal arterial. The existing right-of-way width of 60 feet is not consistent with that specifie,d in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way dedication, a strip of property 16 feet in width along the Evergreen Road frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to Evergreen Road. 18. There may exist utiliries, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regard.ing these utiliries. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to deternune whether applicant(s) or the utility is -sponsible for adjustment or relocation costs and to make arrangements for any necessary work. 19. pplicant shall request dedication of Lot 1, Block 2, of South Evergreen Addirion along 21 st Avenue frontage only for roadway purposes. CQUNTY HEALTH DISTRICT CONDITIONS 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distriburion by the Planning Department to the utility companies, Spokane County Engineer and the Spokane County Health District. Written approval of the easements by the utility companies must be received prior to the subrruttal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane . County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), Sta.te Department of Health. 6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat- 7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that suitable site(s) for on-site sewage disposal systems are available on tracts 1- 3. 8. Subject to spec~c applicadon approval and issuance of permits by the health officer, the use of individual on-site sewage disposal system(s) may be authorized. ~ 9. The dedicatory language of the plat will state: "Subject to specific application approval and issuance of permits by the Health Officer, the use of (an) on-site sewage system(s) may be authorized." 10. Pursuant to the Board of County Commissioners Resolurion No. 80-0418, the use of on-site sewer disposal systems is hereby authorized.
