SP-742-92 r SPOKANE COUNTY HEARING EXAMINER COMMITTEE FINDINfzS ()F FACT, CONCLUSInNS A.ND ORDER INTRODUCTION This matter has come before the Hearing Examiner Committee on June 27, 1991. The members of the Corn.mittee present are Phi1 Harris, Chairperson, Verona Southern and Jane Myers. PROPOSAL The sponsor, Mike Senske, requests approval of a Rezone No. ZE-18-91; Urban Residential-3.5 (UR-3.5) to Urban Residential-7 (LTR-7). FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located along the east side of Dishman Mica Road and approximately 1400 feet southeast of the intersection of Dishman Mica Road and Bowdish Road in Section 33, Township 25 N., Range 44 EWM, Spokane County, Washington. ' 2. The committee adopts the Planning Department Report as a part of this record. 3. The exisring land uses in the area are industrial, residential, and a private golf course. 4. The Comprehensive Plan designates this site as Urban. The Urban category is for the purpose of residential development, including residential densities of 1 unit per acre to 17 units per acre. 5. The Arterial Road Plan designates Dishman-Mica Road as a principle arterial with a recommended right of way width of 100 feet, and an existing right of way width of 64 feet. The County Engineer has recommended 16 foot Future Acquisition Area. 6. The existing zoning of the property described in the application is (Urban Residential-3.5) UR-3.5, previously established in 1991. 7. The provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with and a Determination of Nonsignificance was issued. 8. The legal requirements for public notice have been fulfilled. 9. The owners of adjacent lands expressed neither approval nor disapproval of the proposed use. - 10. The proposed zone reclassification is compatible with existing uses in the area. 11. The proposed zoning dces implement and conform to the Comprehensive Plan by providing a variety of housing types. f ~ H EC Order for ZE-18-91 Page 2 12. The applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed zone reclassificarion is justified. 13. The proposed use wi11 not be detrimental to the public health, safety, morals or welfare. 14. The Committee additionally finds/concludes: a. The proposed development is located in a designated flood plain, and all federal, state, and locals regulations must be met for development of this property. b. The golf course is intended to provide a recreational use for residents of the proposed residential development. The required landscaping/buffering for the north, east and south boundary lines would detract from the intended use. The existing golf course landscaping provides an adequate buffer to adjacent . residential uses. c. Short platting the property will allow the recommended conditions to be . attached only to the requested rezone and not encumber the entire golf course. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the - "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The following Conditions of Approval apply to the real property described below: Commencing at the intersection of the easterly right of way line of Dishman Mica Road C.P.H. No. 53 and the South line of the Southeast Quarter of Section 33, Township 25 North, Range 44 East, W.M. in Spokane County, Washington lying S 89° 1524" W, 1085.65 feet fi-om the Southeast corner of said quarter; thence Northwesterly along said right of way line on a curve whose center lies S 75° 04' 36" W, 1138.95 feet, Central Angle = 17° 32' 37", a distance of 348.74 feet; thence N 32° 28' O1" W, along said right of way line, 135.00 feet to the point of beginning of this description; thence continuing along said right of way line, N 32° 28' 0 1" W, 600.00 feet; thence N 57° 31' 59" E, 160.00 feet; thence S 32° 28' O1" E, 600.00 feet; thence S 57° 31' 59" W, 160.00 feet to said point of beginning. EXCEPT the Westerly 4.00 feet for additional right of way for said Dishman Mica Road and containing 2.15 acres. HEARING EXAMINER COMMITTEE 1. Fences along Dishman-Mica Road shall be set back five feet from the Future Acquisition Area. . ► . ~ H EC Order for ZE-18-91 Page 3 2. The applicant/owner is not required to install buffering along the site's common boundaries with the golf course. . SPOKANE COUNTY PLANNING DEPARTMENT 1. The proposal shall compl,y with the Urban Residenrial-7 (UR-7) zones as amended. 2. Approval is required by the Planning Director/designee of a specific lighting and signing plan for the described property prior to the release of any building pernuts. 3. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 4. The Spokane Counry Planning Department shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisirion area Title Notice shall be released, in full or in part, by the Planning Department. The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least 16 feet of reserved future acquisirion area for road right-of-way and utilities, in addition to the existing and/or newly dedicated right-of-way along Dishman Mica Road. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. 5. The Planning Department shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in quesrion is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same rime frame as allowed for an appeal and shall only be released, in full or i.n part, by the Planning Department. The Title Notice shall generally provide as follows: The parcel of property legally described as [ ] is the subject of a land use action by a Spokane County Hearing Body or Administrative Official on June 27, 1991, imposing a variety of special development conditions. File No. ZE-18-91 is available for inspection and copying in the Spokane County Planning Department. HEC Order for ZE-18-91 Page 4 6. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed along Dishman-Iviica Road and mai.ntained so that sight diszance at access points is not obscured or impaired. 7. The subject parcel shall be short platted prior to issuance of a building permit. All conditions of approval for ZE-18-91 shall only apply to the property as described for this proposal. SPOKANE COUNTY ENGINEER'S OFFICE Prior To The Issuance Of A Building Permit Or Use Of The Propertv As Pronosed: 1. Access permits for approaches to the county road system shall be obtained from the Spokane County Engineer. 2. The applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans. . 3. The applicant sha11 submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project, or portion thereof, if the development is to be phased. 4. A parlang plan and traffic circulation plan shall be submitted and approved by the Spokane Counry Engineer. The design, location and azrangement of parking stalls shall be in accordance with standard traffic engineering pracrices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 5. To construct the roadway improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be willing to parricipate in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement, pursuant to RCW 36.88, as amended. Spokane County wi11 not participate in the cost of these improvements. 6. As an alternative method of constructing the road improvements stated herein, the applicant may, with ttle approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required improvement. Spokane County will not participate in the cost of these improvements. 7. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 8. The County Engineer has designated Typical Roadway Section Number One, Major Arterial standard for the improvement of Dishman-Mica Road, which is adjacent to the proposed development. This will require the addition of approximately 13-15 feet of asphalt along the frontage of the development. The construction of curbing . and sidewalk is also required. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. . 10. Applicant shall construct a paved and delineated approach(es) to meet the exisring pavement on Dishman Mica Road. 11. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Com.rrussioners Resolution No. 80-1592 as amended and are applicable to this proposal. 12. This subdivision or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's office as having stormwater runoff problems. Since this plat or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and unplementation of a future basinwide stormwater management system. The owner(s) or successor(s) in interest agree to join in any Counry-approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintai.ning or operarion of stormwater control faciliries. 13. The regulations of the National Flood Insurance Program shall be observed since the proposed plat is affected by a flood hazard zone. A development permit shall be obtained from the County Engineer before construction or development begins within any area of the special flood hazard zone (reference Spokane County Ordinance No. 88-0521). 14. No -constniction work sha11 be performed within the existing or proposed public right-of-way until a pennit has been issued by the County Engineer. All work within the public road right-of-way is subject to inspection and approval by the County Engineer. 15. All required construction within the existing or proposed public right-of-way is to be completed prior to the release of a building pernut, or a bond in an amount estimated by the County Engineer to cover the cost of construction of improvements shall be filed with the County Engineer. 16. All required construction within the existing or proposed public right-of-way is to be completed prior to the release of a building pennit, or a bond in an amount estimated by the County Engineer to cover the cost of construction of improvements shall be filed with the County Engineer. 17. The County Arterial Road Plan identifies Dishman Mica Road as a Principal Arterial. The exisring right-of-way width of 64 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way ded.icarion, a strip of property 16 feet in width along the Dishman Mica Road frontage shall be set aside in reserve. This property may be ~ t HEC Order for ZE-18-91 Page 6 acquired by Spokane County at the tim%-. when arterial improvements are made to Dishman Mica Road. 18. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocarion regarding these utiliries. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to determine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 19. The applicant shall demonstrate that a safe site distance can be obtained which shall provide for safe ingress and egress from Dishman Mica Road to the proposal. 20. Since this proposal is within the Chester Creek Flood Zone, in addition to the standard flood plain condition of approval aforementioned, the Spokane County Flood Zone Ordinance Section 3.20.450 specifically addresses the Chester Creek Flood Zone and requires the following add.itional conditions of approval should this application be approved. a. Paved driveways are prohibited in the 100-year flood zone. b. No more than 5% of the 100-year,flood zone area shall be covered by impervious surfaces or fill. c. The applicant sha11 provide for in-kind replacement of floai plain absorption area with property owned or to be purchased which is currently above the 100-year Chester Creek Floai zone. This replacement shall be equal to 100% of the area to be raised above the 100-year flood plain for this proposal. The area currently owned or to be purchased above the 100-year flood plain shall be graded so as to allow the property to be within the 100-year flood plain. d. The County Engineer strongly recommends that a short plat for the parcel be reviewed and approved prior to issuance of any building pernuts being approved. This will provide for the encumbrance of the entire property bei.ng utilized by the applicant to attain the 5% of the 100-year flood zone requirement within the Chester Creek Flood zone. SP4KANE COUNTY UTILITIES DEPARTMENT 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further condirioned and subject to specific applicarion approval and issuance of pernuts by the Health District. 2. The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' I HEC Order for ZE-1 8-91 Page 7 property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objecring to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolurion method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4. Each new dwelling unit shall be double-plumbed for connection to future areawide collection systems. SPOKANE COUNTY HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. A public sewer system will be made available for the plat/project, and individual service will be provided to each lot/tract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized. 5. Use at private wells and water systems is prohibited. SPOKANE COUNTY BUILDING AND SAFETY DEPARTMENT 1. T'he applicant shall contact the Department of Building and Safety at the earliest possible stage of design/development in order to be informed of code requirements administered/enforced by the department, e.g., State Building Code Act regularions, such as requirements for fire hydrantlflow, fire apparatus access roads, street address assignment, barrier-free regularions, energy code regularions and general coordination with other aspects of project implementation. 2. Requirements of Fire District No. 1 need to be satisfied during the building permit process. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regularions must be met. This includes but is not limited to the following: 2. Air pollution regulations require that dust emissions during demolirion, construction and excavarion projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads c . HEC Order for ZE-18-91 Page 8 should be treated, and emissions from the transfer of earthen material must be controlled,,as well as emissions from all other construction-related activiries. 3. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. , 4. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 5. Debris generated as a result of this project must be disposed of by means other than burning. SP-742-92 ) CONCLUSIONS AND DECISION THIS MATTER, an application for subdivision of land, from Michael Senske has been ' d and decided upon, pursuant to Spokane County Subdivision regulations, on the 7Wday of September 1992. FYNDZNGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide 86 acres into 31ots shown as parcels A, B and C on the _ preliminary plat of record. Parcels A and B are 1.06 acres each and are proposed for development with six townhouse units per parcel. Parcel C, consisting of approximately 84 acres, is the Painted Hills Golf Course. 3. The proposal is located adjacent to the east side of the Dishman-Mica Road and approximately 1,400 feet southeast of the intersection of Bowdish Road and Dishman- Mica Road in Section 33, Township 25 North, Range 44 EWM, Spokane County, Washington. 4. The current zoning of the property is Urban Residential-7 for parcels A and B and Urban Residential-3.5 for pa7-cel C. The proposed lot sizes, frontage and intended uses are allowed within this zone. 5. The Spokane County Comprehensive Plan designates this area as Suburban. The development and uses proposed are generally in accord with this category. 6. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 7. No one in the area commented on the proposal. 8. The Spokane County Arterial Road plan identifies the Dishman-Mica Road adjacent to the proposal as a principal arterial with a recommended future right of way width of 100 feet. The existing right of way width is 64 feet. The Spokane County Engineer has required that a strip of land 16 feet wide along the proposals Dishman-Mica Road frontage be set aside as a future acquisition area to be acquired by Spokane County at some future date as road improvement needs dictate. 9. Recognizing the recommended conditions and Spokane County development standards, the proposed subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. 10. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-742-92 is hereby APPROVED until October 1, 1995, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent wi.dl adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest to property. 1 1 FINDINGS AND DECISION SP-742-92 Page 2 PLANNING DEPARTMENT CONDITIONS 1. The preliminary plat o£ record approval is for the property legally described in the applicarion for this proposal. 2. The proposal shall comply with the Urban Residential-7 and Urban Residential-3.5 zones as applicable and as amended. 3. The final plat shall be designed substantially in confonnance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 4. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 5. Appropriate road name(s) shall be indicated. 6. The preliminary plat is given conditional approval for three (3) years, specif'ically to October 1, 1995. The applicant may request an extension of time by submitting a written request approximately forry-five (45) days prior to the above expirarion date. 7. Appropriate utility easements shall be ind,icated on copies of the proposed final plat. Written approval of utility easements by appropriate urility companies shall be received with the submittal of the final plat. 8. Three (3) current certificates of title shall be furnished to the Planning Department prior to filing the final plat. 9. The Spokane County Planning Department shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Planning Depai-tinent. The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least 16 feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing and/or newly dedicated right-of-way along Dishman-Mica Road. NOTE: The County Engineer has required 0 feet of new dedication. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No requixed landscaping, parking, '208'-areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drai.nfield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocafing such "interim" ' improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition area. 10. The final plat map shall indicate by a clear, dasheti line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building pernuts are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 11. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Building & Safety Department and County Health District. The agencies will certify on the Water Plan, prior to the filing of a final plat, that the plan is in conformance with their FINDINGS AND DECISION SP-742-92 Page 3 respective needs and regulations. The Water Plan and certification shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. , 12. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspecrion by the appropriate health authorities prior to application for building permits within the final plat. The arrangements or agreements shall include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a build.ing permit due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 13. The final plat dedication shall contai.n the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Building & Safety Department and water purveyor, shall be installed within this subdivision, and the applicant shall provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building pernut for each lot." 14. No building permit will be issued for any lot within the final plat until certified by a Washington state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for-the final plat" including a signed license stamp. The certif'ication may be in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system. 15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan . may be waived by the Planning Director/designee upon receipt of letters from the appropriate water purveyor and fire protecrion district stating that simple connections to an existing, approved water system will provide adequate domestic and fire protection water to ensure the public health, safety and general welfare. 16. A survey is required prior to the filing of a final plat. COUNTY ENGINEER'S DEPARTMENT CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. 2. Drainage plans and design calculations showi.ng the alignment of drainage facilities shall be submitted to the County Engineer for approval prior to construction and/or the filing of the final plat. Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. The regulations of the National Flood Insurance Program shall be observed. A development pemut shall be obtained from the County Engineer before construction or development begins within any area of special flood hazard (reference Spokane County Ordinance No. 81-0726). The following statement shall appear within the dedicatory language of the plat: "Development within this subdivision shall conform to the requzrements of the National .Flood Znsurance Program and the Spokane County Flood Zone Ordinance. Purchasers of the property within this subdivision are warned of possible flooding or ponding and the potential requirement to purchase flood insurance. This warning shall be carried in each and every deed drawn to transfer ownership of any and all property within the plat in the area of special flood hazard. This condifion is applicable to driveway approaches, driveways and private roads constructed on the site for access." 4. No construction work is to be perfonned within the existing or proposed public right- of-way unril a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 5. All construction within the existing or proposed public right-of-way is to be completed prior to filing each final plat, or a bond in the amount estimated by the County Engineer . FINDINGS AND DECISION SP-742-92 Page 4 to cover the cost of construction of improvements, construction certificati.on, "as-built" plans and monumenring the street centerlines shall be filed with the County Engineer. 6. Ind.ividual driveway access permits are required prior to issuance of a building pennit for driveway approaches to the county road system. 7. A statement shall be placed in the plat dedicarion providing for future slope easements as required by Spokane County along Dishman-Mica Road. 8. Existing county roads providing direct access to the plat shall be paved andJor curbed to Spokane County standards. 9. SidewaLks are required along the arterial(s) on Dishman-Mica Road. 10. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 11. To construct the road impzovements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the unders-igned owner(s), their heirs, grantees and assigns. Thi.s provision is applicable to Dishman-Mica Road. . 12. As an alternarive method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvements. At such tinne as an RID is created or any Road Improvement Project is sancrioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Dishman-Mica Road. 13. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which perition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is formed by either the petition or resolutio-n method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) . that the improvement(s) or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements cal.led for in conjunction with the formation of an RID by either petirion or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affirming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement Project is sancrioned by Spokane County, the improvements required (curb, sidewallc, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without participation by Spokane County. a FYNDINGS AN.D DECISION SP-742-92 Page 5 The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to Spokane County the then estimated cost of the required improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement) providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to Dishman-Mica Road. 14. The County Engineer has designated Typical Roadway Section Number One, Major A.rterial standard for the unprovement of Dishman-Mica 12oad, which is adjacent to the proposed development. This will require the addition of approximately 13-15 feet of . asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 15. The proposed subdivision shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regulatians for roads, approaches, drainage and fees in new construction. 16. The County Engineer has examined this development proposal and has deternzined that the impact of this proposal upon the existing counry road system warrants the dedication of additional right-of-way and the roadway improvements herein specif'ied. 17. The followi.ng statement shall be placed i.n the final plat ded.ication: "The private road as shown hereon is an easement which provides a means of ingress and egress for those lots within the subdivision having fronta.ge thereon." 18. The County Arterial Road Plan identifies Dishman-Mica Road as a Principal arterial. The existing right-of-way width of 64 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of- way ded.ication, a strip of property 16 feet in width along the Dishman-Mica Road frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial unprovements are made to Dishman-Mica Road. 19. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to deterrnine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessazy work. 20. The applicant shall demonstrate to the satisfaction of the County Engineer that site distance and stopping/braking distance criteria can be met from the ingress/egress access from this development. 21. Since this proposal is within the Chester Creek Flood Zone, in addition to the standard flood plain condition of approval aforementioned, the Spokane County Flood Zone Qrdinance Section 3.20.450 specif'ically addresses the Chester Creek Flood Zone and requires the following addirional conditions of approval. a. Paved driveways are prohibited in the 100 year flood zone. b. No more than 5% of the 100 year flood zone area shall be covered by impervious surfaces or fill. c. The'applicant shall provide in-kind replacement of flood plain absorption area with property owned or to be purchased which is currently above the 100 year Chester Creek Flood Zone. This replacement sha11 be equal to 100% of the area to be raised above the 100 year flood plain for this proposal. The area currently owned or to be purchased above the 100 year flood plain shall be graded so as to allow the property to be within the 100 year flood plai.n. ~ FINDTNGS AND DECISION SP-742-92 Page 6 d. The required area within the proposed plat shall be encumbered through recorded document, which is being utilized by the applicant to attain the 5% of the 100 year flood zone requirement within the Chester Creek Flood Zone. COUNTY HEALTH DISTRICT CONDITYONS 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preluninary plat of record for distribution by the Planning Department to the utility companies, Spokane County Engineer and the Spokane County Health District. Written approval of the easements by the uri.lity companies must be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utiliries, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane Counry. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 7. A public sewer system will be made available for the plat/project, and individual service will be provided to each lot/tract prior to sale. Use of individual on-site sewage disposal systems sha11 not be authorized. 8. A statement shall be placed in the dedication to the effect that: "A public sewer system will be made available for the plat, and individual service will be provided to each tract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized." 9. The dedicatory language on the plat shall state: "Use of private wells and water systems is prohibited." 10. The plat dedication shall contain a statement to the effect that: "The public water system, as approved by county and state health authorities, the local fire district and water purveyor, shall be installed within this plat, and the applicant shall provide for individual domestic water service as well as fi~'"e protection to each tract prior to sale of each lot/tract and prior to sale of each tract." COUNTY UTILITIES DEPARTMENT CONDITIONS 1. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the fonnation of ULID by petition method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formation of a ULID by resolurion method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PRQVIDED, this condition shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94." 2. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 3. Applicant shall make connecrion to public sewer system. Sewer connection permit is required.
