Enclosed is the latest version the the Short Plat
for Mrs. Beck. She asked that the drainfield easement
be put on the plat. As you can see it would be difficult
to build on. This would make it also di.fficult to sell.
Therefore I have put an optional for the drainage from the
septic tank - a leach bed.
If thisjsatisfactory, please let me know and I will
give her the plat to sign off on and turn in to the
planning office.

SHORT PLAT NO. SP-744-92 ) CONCLUSIONS AND
DECZSION
THIS MATTER, an application for subdivision of land, from Robert Bass has beer eceived
and decided upon, pursuant to Spokane County Subdivision regulations, on the Zy ay of
April, 1992.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane Counry Director of Planning.
2. The proposal is to divide approximately .89 acres into 2 lots for the development of
single family residences or duplexes.
3. The proposal is located south of and adjacent to Alki Avenue, approximately 1,200 feet
west of Bowd.ish Road in the SW 1/4 of Section 16, Township 25 North, Range 44
EWM, Spokane County, Washington.
4. The current zoning of the property is Urban Residential-3.5 (UR-3.5). The proposed lot
sizes, frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban T'he
development and uses proposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.
7. No one in the area commented on the proposal.
8. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
9. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-744-92 is hereby APPROVED until May 1, 1995, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The prel.ixninary plat of record approval is for the property legally described in the
application for this proposal.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone(s) as
amended.
3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.

4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preli.minary plat is given conditional approval for three (3) years, specif'ically to
May 1, 1995. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expirarion date.
7. Appropriate utiliry easements shall be ind.icated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be receiveri
with the submittal of the final plat.
8. Three (3) current certif'icates of title shall be furnished to the Planning Department prior
to filing the final plat.
9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be deternlined at the tinae building pennits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
10. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County Bui.lding &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in confornlance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
11. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building pernaits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a build.ing permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
12. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, Counry Building & Safety
Department and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for individual domestic water service as well as fire protecrion to
each lot prior to sale of each lot and prior to issuance of a building pennit for each lo!_,~
13. No building permit will be issued for any lot within the final plat unril certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
cerdfication may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
14. The Water Plan and the above four (4) cond.itions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protecrion
water to ensure the public health, safety and general welfare.
15. A survey is required prior to the filing of a final plat.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.

2. No construction work is to be performed wrthin the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer. ,
3. No di.rect access from lots to one-half (1/2) rights-of-way until such roads are
constructed to County standards and established as County roads.
4. No direct access from lots to stub road connections until such roads are constructed to
County standards and established as counry roads.
% Road design, construction, and drainage control for one-half (1/2) rights-of-way and
stub road connections are the responsibility of the owner, developer or applicant.
6. Appropriate provision shall be made that the following-described property be held in
trust until the continuation of the streets be dedicated or deeded: a one (1)-foot strip at
the ends or edges of all streets that ternunate or border the subdivision boundary.
(Temporary cul-de-sacs are required when streets terminate at the subdivision
boundaries.)
7. Individual driveway access pennits are required prior to issuance of a building permit
for driveway approaches to the county road system.
8. Dedication of 25 feet of addirional right-of-way along Olive Avenue is required.
9. Existing county roads providing direct access to the plat shall be paved andJor curbed to
Spokane County standards.
10. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
11. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participa.nt in any perition or resolution
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sancrioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Olive Avenue and Allci. Avenue.
12. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CR.P) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Olive Avenue and Allci Avenue.
13. The following statement shall be placed in the plat dedication:
The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a pebtion for the formation of a Road Improvement District
(RID) by the pedtion method pursuant to Chapter 36.88 RCW, which peation
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolution includes the owner(s)' property. If an RID is
formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposeti
RID is feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of fonnation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.

Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called for in conjuncrion with the
formation of an RID by either petition or resolution method under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners affimling the final assessment roll.
It is fu.rther agreed that at such time as an RID is created or any Road
Improvement Project is sancrioned by Spokane County, the improvements
required (curb, sidewalk, dra.inage control and pavi.ng) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said RID waiver expires without construction of the required
improvements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvements to enable the County to
complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement)
providing for or securing to the County the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
bincling upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to Olive Avenue and Alki Avenue.
14. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the improvement of Olive Avenue, which is adjacent to the
proposed development. This will require the addition of approxunately 30 feet of
asphalt along the frontage of the development. The construction of curbing is also
required.
15. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the improvement of Alla Avenue, which is adjacent to the proposed
development. This will require the addition of approximately 8- 10 feet of asphalt
along the frontage of the development. The construction of curbing is also required.
16. The proposed subd.ivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolurion No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
17. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specif'ied.
18. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these urilities. Applicant(s) should check with the applicable urility purveyor
and the Spokane County Engineer to detemzine whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
19. The twenty feet of ownership for the southern lot shall be considered a driveway from
the southem lot to A.lki Avenue. To be considered a driveway only the southern lot
may use this approach for access, if more than one lot accesses Alki Avenue from the
20 foot access, the ingress and egress shall be considered a private road and road plans
shall be submitted for review and approval of the County Engineer. At such rime, as
Olive Avenue is constructed to County Road Standards the southern lot can access
Olive Avenue.
COUNTY HEALTH DISTRICT CONDITIONS
. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.

2. Appropriate udlity easements shall be indicated on copies of the preliminary plat of
record far distribution by the Planning Deparnnent to the utility companies, Spokane
County Engineer and the Spokane County Health DistricL Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated th.rough the Director of Utilities, Spokane County
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to fili.ng the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health Disrrict that a suitable site for an on-site sewage disposal
system is available on the vacant tract. 8. Prior to filing the final plat, the sponsor shall demonstrate to the sarisfacrion of the
Spokane County Health District that the existing on-site sewage disposal system(s)
servi.ng the residence at 11106 East Alki is wholly located vvithul the boundaries of the
tract.
9. Subject to speciic application approval and issuance of permits by the health officer,
t.he use of i.ndividual on-site sewage disposal system(s) may be authorized.
10. The dedicatory language of the plat will state: Subject to specific application approval
and issuance of pennits by the Health Officer, the use of individual on-site sewage
systern(s) may be authorized." '
11. The dedicatory language on the plat sha11 state: "Use of private wells and water
systems is prohibited."
12. The plat dedication will contai.n a sta.tement to the effect that: "The publzc water system,
as approved by county and state health authorities, the local fire district and purveyor,
will be instal,led within this plat, and the subdivider will provide for individual domesric
watez service as well as fize protection to each tract prior to sale of each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is cond.itioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
pennits by the Health District.
2. The dedication shall state:
"The owner(s) or successor(s) in intexest agree to authorize the County to place their
name(s) on a petiaon for the formauon of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a ULID by zesolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a ULTD by either petition or resolution method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
r.onnection to future areawide collection systems."
