Dear Bill:
This letter concerns stormwater runoff for Short Plat
No. SP-746-92. Included with this letter are a
quadrangle map and more detailed topographical map.
This plat will contain four lots, with Lot "D" being
approximately 18 acres.
Lots "q", " g", and "C" conta i n aPProx imatelY 1 acre
of land each. There are no obvious drainage channels
on either of these, with runoff being distributed
more or less evenly across the lots. The construction
of homes will not substantially increase runoff.
Shallow ditches along Farr Road and 44th Avenue
currently handle the runoff. Offsite runoff from the
south will be minimal and is not concentrated.
The large Lot "D" contains a draw to the northwest
which may cause some concern when developed. This
lot has been designed to accept a long plat at some
future time. We propose to create any drainage way
or easement at that later date when we have a better
idea of improvement locations.
We see no need for stormwater improvements within the
plat boundary at this time. We would appreciate your
comments.

DECISION
THIS MATTER, an application for subdivision of land, from Fay Johnstone has been
received and decided upon, pursuant to Spokane Counry Subdivision regulations, on the
10'1-h day of June, 1992. FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide 23 acres into four (4) lots for residential uses and those uses
pernoitted in the underlying zone.
3. The site is currently undeveloped. Surrounding uses include single family homes on
small acreage lots. Adjacent property ownership is located to the west as a single 20 +
acre lot
4. The proposal is generally located between Farr and Schafer Road, south of 44th Avenue
and north of Holman Road in NW 1/4 of Section 5, Township 24 North, Range 44
E.W.M., Spokane County, Washington.
5. The current zoning of the property is Suburban Residential-1 (SR-1). The proposed lot
sizes, frontage and intended uses are allowed within this zone. The Suburban
Residential-1 zone does allow duplexes for lots which are twice the minimum area _
required for single fam.ily units, or 2 acres net area.
6. The Spokane County Comprehensive Plan designates this area as Suburban +(S+). The
development and uses proposed are generally in accord with this category.
7. The required public norice was provided foz this proposal and agencies having a potenti.al
interest in the project were notified and recommendations solicited.
8. Written comments were received from an adjoining property owner. The main concerns
expressed were additional traffic and method of waste water disposal.
9. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The Arteria]. Road Plan designates 44th Avenue as a Collector Arterial with an elc.isting
right of way width of 60 feet and a proposed width of 70 feet. To ixnplement the plan the
County Engineer has requested a 5 foot Future Acquisition Area along 44th Avenue.
Building setbacks are to be measured from the Future Acquisition A,rea.
11. Two Certif'icates of Exemption were issued for this parcel. CE-227-92 segregated the
property into separate 25 acre parcels. CE-284-92 adjusted boundary lines between
one of the previously created parcels and an adjacent platted lot. The above actions are
exempt from lacal and state platting regulations under RCW 58.17.040.
12. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of tJtilities and the Spokane County Health District.
13. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-746-92 is hereby APPROVED until Jttly 1, 1995, subject to conditions noted

below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors. .

2. The proposal shall comply with the Suburban Residential-1 (SR-1) zone as amended.
3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
4. The Planning Directoridesignee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specif~ically to
July 1, 1995. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
8. Three (3) current certificates of tide shall be furnished to the Planning Department prior
to filing the final plat.
9. The Spokane County Planning Department shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way
and urilities. The reserved future acquisition area Title Norice shall be released, in full
or in part, by the Planning Departnaent. The notice should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 5 feet of reserved future acquisition area for road right-of-way and
utilities, i.n addition to the existing and/or newly dedicated right-of-way along
44th Avenue. b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. If
any of the above vnprovements are made within this area, they shall be relocated -
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, unril acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaging,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway i.mprovements after
acquiring said future acquisition area.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement: '

"Side yard and rear yard setbacks shall be determined at the ti.me buil.ding pernuts are
requested unless these setbacks are specifically drafted on this final plat. T'he setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
11. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropri.ate fire protection district, County Building &
Safety Department and County Health District The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
12. The water purveyor shall certify that appropriate contractual arrangements and schedule
of unprovements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The anrangements or
agreements sha11 include a provision holdi.ng Spokane County and the purveyor
hannless from claims by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
13. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Building & Safety
Departnnent and water purveyor, shall be installed within this subdivision, and the
applicant shall provi.de for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a build.ing pernzit for each lot."
14. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engi.neer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certif'ication may be in the form of a letter, but is preferred to be cemfied on a copy of
the Water Plan as a schematic map showi.ng the "as-built" water system.

15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to
an existing, approved water system will provide adequate domesric and fire protection
water to ensure the public health, safety and general welfare.
16. A survey is required prior to the filing of a final plat. .
COUNT'Y ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of recozd.
2. Drainage plans and design calcul.ations showing the alignment of drainage facilities
shall be submitted to the County Engineer for approval prior to construction and/or the
filing of the final plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
3. No construction work is to be performed within the existing or proposed public right- '
of-way unti.l a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
4. Individual driveway access permits are required prior to issuance of a building permit .
for driveway approaches to the county raad system.
5. Existing county roads provid.ing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
6. Sidewalks are required along the arterial on 44th Avenue. 7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.

8. To construct the road i.mprovements sta.ted herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution
, which purpose is the fonnation of a Road Impzovement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sancrioned by Spokane County, the
improvements requi.red (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heus, grantees
and assigns. This provision is applicable to 44th Avenue and Farr Road.

9. As an alternative method of constructing the road improvements sta.ted herein, the
applicant may, with the approval of the County Engineer, accomplish the road
unprovements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to 44th Avenue and Farr Road.
10. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their na.me(s) on a petition for the formation of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' property, and fiuther not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolution includes the owner(s)' property. If an RID is
fonned by either the petition or xesolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the i_mprovement(s) or constTUCtion contemplated within the proposed
RID is feasible; .
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID; and ~
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the unprovements called for in conjunction with the
formation of an RID by either petition or resolution method under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners aff'u-ming the final assessment roll.
It is further agreed that at such tune as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole '
expense of the undersigned owner(s), their heirs, grantees and assigns
" without participation by Spokane Counry.
The RID waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said RID waiver expires without construcrion of the required
improvements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvements to enable the County to
complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) .
providing for or securing to the County the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to 44th Avenue and Farr Road.
11. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the improvement of Farr Road, which is adjacent to the proposed

development. This will require the addition of approximately [5-7 feet of asphalt along
the frontage of the development. The construction of curbing is also required.
12. The County Engineer has designated Typical Roadway Section Number Two, Collector
Arterial standard for the improvement of 44th Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 10-12 feet of
asphalt along the frontage of the development. The constructi.on of curbing and
sidewalk is also required.
13. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
constniction. 14. The County Engineer has examined this development proposal and has deternuned that
the impact of this proposal upon the existing county road system warrants the
ded.ication of additional right-of-way and the roadway i.mprovements herein specif'ie,d.
15. The County Arterial Road Plan identifies 44th Avenue as a Collector arterial. The
existing right-of-way width of 60 feet is not consistent with that specif'ied in the Plan.
In order to irnplement the Arterial Road Plan, in addition to the requued right-of-way
ded.ication, a strip of property 5 feet in width along the 44th Avenue frontage shall be .
set aside in reserve. This property may be acquired by Spokane County at the time
when arterial improvements are made to 44th Avenue.
16. There may exist utiliries, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regard.ing these utilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant(s) or the utility is
responsible for adjusunent or relocation costs and to make arrangements for any
necessary work.
COUNTY HEALTH DISTRICT CONDI'Z'IONS •
1. The final plat shall be designed as indicated on the preli.minary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preli.mi.nary plat of
record for d.istribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County. ,
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat
7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane Counry Health District that a suitable sites for on-site sewage disposal systems
are available on all tracts.
8. Subject to specific application approval and issuance of pemuts by the health officer,
the use of (an) individual on-site sewage disposal system(s) may -be authorized.
9. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of permits by the Health Officer, the use of (an) on-site sewage system(s)
may be authorized."
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."

11. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by county and state health authorities, the local fire district and purveyor,
will be installed within this plat, and the subdivider will provide for individual domestic

COUNTY UTILITIES DEPARTMENT CONDITIONS
' 1. Pursuant to the Board of County Comm.issioners Resolution No. 80-041 S, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regularions of the Spokane County Health Disrrict and .
is further conditioned and subject to specific application approval and issuance of
permits by the Health District-
2. The dedicarion shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signi.ng of a protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the ownez(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Lots A, B, and C shall be double-plumbed for connection
to future areawide collecrion systems."
BUILDING AND SAFETY DEPARTMENT CONDITIONS •
1. Requirements of Fire District No.8 need to be satisfied during the building pennit
process.
