As you have directed, I have revised my street plan for
Valley Way between Park Road and Ella Road. Changes
included adding the 5-ft strip of reserved future
right-of-way acquisition, changed County Standard Plan
references to new numbers, added two new notes, extended
North Curb Line Profile to Sta. 11+00, changed the sidewalk
width to 6.0-ft, and added Spokane County required asphalt
tapers, with 4-inch wide white paint fog-lines at each end
of the project .
This should complete the requirements of Short Plat 748-92
for street and drainage. Each individual Parcel will be
responsible for its' site drainage as it develops. Driveway
locations will also be determined at the time of building
permit applications. Dick Main, L.S., will submit the final
plat for filing early next week. If there is any other
questions, please call immediately.

In further discussion of the condition to build Valle3ivay after our phone conversation, Pat explained the
circumstance of the agreement. As he explained it to me, the improvements are not able to be broken up
per parcel. This is due to the fact that the condition of the Short Plat was to build the improvements at
time of finalization. Since the bonding and construction of the improvements were postponed until time

THIS MATTER, an application for subdivision of land, from Gene Lilenquist has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the
day of May, 1992.
FINDZNGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 8.5 acres into 4 lots for industrial purposes.
3. The proposal is located adjacent to the north side of Valley Way and approximately 360
feet east of Park Road in Section 18, Township 25 North, Range 44 EWM, Spokane
County, Washington.
4. The current zorv.ng of the property is Light Industrial (I-2). The proposed lot sizes,
frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive PXan designates this area as Industrial. The
development and uses proposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and reconunendations solicited.
7. No one in the area commented on the proposal.
8. The proposal fronts on Valley Way which is designated as a Collector Arterial in the
Spokane County Arterial Road Plan. The plan calls for a future right of way width of 70
feet. The exisring right of way width is 40 feet. The County Engineer has required
dedication of a 10 foot wide strip along the site's Valley Way frontage. In addirion, the
County Engineer has required that a 5 foot wide future acquisition area be set aside along
the site's Valley Way frontage.
9. Recognizing the recommended conditions and Spokane Counry development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a). .
DECZSION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-748-92 is hereby APPROVED until June 1, 1995, subject to condirions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITYONS
. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. The proposal shall comply with the Light Xndustrial (1-2) zone(s) as amended.

3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condirion application submittal and approval.
4. The Planning Director/designee shall xeview any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
June 1, 1995. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indi.cated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be furnished to the Planning Department prior
to filing the final plat.
9. The Spokane County Planning Department shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way
and utilities. The reserved futtire acquisition area Title Notice shall be released, in full
or in part, by the Planning Department. The notice should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 5 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Valley Way. NOTE: The County Engineer has required 10 feet of new
dedication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measuzed from the reserved future acquisition area.
c. No required landscaping, parlang, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
11. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County Building &
Safety Department and Counry Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproducrion and be signed by the plat sponsor.
12. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The rime schedule shall provide
for completion of the water system and inspection by the appropriate health authoizties

prior to application for bui.lding permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harrn,less from claims by any lot purchaser refused a builcling permit due to the failtue
of the subdivision sponsor to satisfactorily complete the approved water system.
13. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Bui.lding & Safety
Department and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."
14. No bui.lding permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been i.nstalled pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certif'ication may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
15. The Water Plan and the above four (4) conditions of approval regardi.ng the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general welfare.
16. A survey is required prior to the filing of a final plat.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards showing proposed
. street centerline and curb grades shall be submitted to the County Engineer for approval
~ prior to construction and/or the filing of each final plat; road plans to be prepared uncier
the direction of a licensed Professional Civil Engineer.

3. Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the County Engineer for approval prior to construction and/or the
filing of the final plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
4. Construction within the proposed public streets and easements shall be performed
under the direct supervision of a licensed engineer/surveyor, who shall furnish the
County Engineer with "as-built" plans and a certificate in writing that all improvements
were installed to the lines and grades shown on the approved construction plans and
that all disturbed monuments have been replaced.
5. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
6. All construction within the existing or proposed public right-of-way is to be completed
prior to filing each fina.l plat, or a bond in the amount estimated by the County Engineer
to cover the cost of constY-uction of improvements, const-uction certi.fication, "as-built"
plans and monurnenting the street centerlines shall be filed with the County Engineer.
7. Individual driveway access pernuts are requi.red prior to issuance of a building perrnit
for driveway approaches to the county road system.
8. Dedication of 10 feet of additional right-of-way along Valley Way is required.
9. Dedication of 5 feet of additional right-of-way along Ella Street is required.
10. Exisring county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.

11. Sidewalks are required along the arterial(s) on Valley Way.
12. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
13. To construct the road i.mprovements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Ella Street.
14. As an alternative method of consrructing the road ixnprovements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CR.P) to the extent of the requirerl road improvements. At such tune as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to exisring
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Ella Street.
15. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the fonn.ation of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which perition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolurion includes the owner(s)' property. If an RID is
formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID; and
(c) that the properry within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
properry as a result of the improvenlents called for in conjunction with the
formation of an RID by either petition or resolurion method under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Comnvssioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drauiage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participarion by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said RID waiver expires without construction of the required
unprovements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvements to enable the County to
. complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement)
providing for or securing to the County the actual construction of the
improvements.

All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to Ella Street.
16. The County Engineer has designated Typical Roadway Section Number One Local
Access standard for the improvement of Ella Street, which is adjacent to the proposed
development. This will require the addition of approximately 9- 11 feet of asphalt
along the frontage of the development. The construction of curbing and sidewalk is
also required. '
17. The County Engineer has designated Typical Roadway. Section Number One, Collector
Arterial stand.ard for the improvement of Valley Way, which is adjacent to the proposed
development. This will require the ad.dition of approxinlately 9-11 feet of asphalt
along the frontage of the development. The construction of curbing and sidewalk is
also required.
18. The proposed subdivision shall be unproved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
19. The County Engineer has examined this development proposal and has determi.ned that
the impact of this proposal upon the existing county road system warrants the
dedication of addirional right-of-way and the roadway unprovements herein specified.
20. The County Arterial Road Plan identifies Valley Way as a Collector arterial. The
existing right-of-way width of 40 feet is not consistent with that specified in the Plan.
In order to i.mplement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of prope et in width along the Valley Way frontage shall be set
aside in reserve. This property may e acquire by Spokane County at the time when
arterial unprovements are made to Valley Way.
21. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable uriliry purveyor
and the Spokane County Engineer to deternune whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. A combined surface water and sewage disposal detailed plan shall be approved by the
Spokane County Engineer and the Spokane County Health District prior to the issuance
of any on-site sewage disposal permit or building pernut for this project.
4. Sewage disposal method shall be as authorized by the Director of Utiliries, Spokane
County.
5. Water service shall be coordinated through the Director of Utilities, Spokane County
6. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
7. Prior to filing the final plat, the sponsor shall demonstrate to the sarisfaction of the
Spokane County Health District that an adequate and potable water supply is available
. to each tract of the plat.

8. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
9. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
10. Prior to filing the final plat, the sponsor shal.l demonstrate to the satisfaction of the
Spokane County Health District that a suitable site(s) for on-site sewage disposal
system(s) are available on all tracts.
11. Subject to specific application approval and issuance of pernuts by the health officer,
the use of (an) individual on-site sewage disposal system(s) may be authorized.
12. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of permits by the Health Officer, the use of individual on-site sewage
system(s) may be authorized."
13. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
14. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by county and state health authoriries, the local fire district and purveyor,
wi11 be installed within this plat, and the subdivider will provide for individual domestic
water service as well as fire protection to each tract prior to sale of each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer d.isposal systems is hereby authorized. This authorization is condirioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The dedication shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of tJLID by peririon method pursuant to RCW ,
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the fonnation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94."
3. Any water service for ihis project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Requirements of Fire District No. 1 need to be satisfied during the building pemlit
process.

Conditions and Stipulations
1. The term "mortgage," when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If ihe proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other
matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown
in Schedule 6 hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be
relieved from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company
is prejudiced by failure to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to
the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien, encumbrance,
adverse claim or other matter, the Company at its option may amend Schedule B of this Commitment accordingly,
but such amendment shall not reliev2 the Company from liability previously incurred pursuant to paragraph 3 of
these Conditions and Stipulations.
3. Liabilitv of the Companv under this Commitment shatl be only to the named proposed Insured and such parties
included under the definition of Insured in the form of policy or policies committed for and only for actual loss
incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof, or (b) to
