SHORT PLAT NO. SP-757-92 ) CONCLUSIONS AND
DECISION
THIS MATTER, an applicarion for subdivision of land, from Washington Water Power has
been received and decided upon, pursuant to Spokane County Subdivision regulations, on the
a&4"Iiay of May, 1992.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 3.7 acres into 3 lots for two existing single
family residences and one parcel for the VVWP substation.
3. The proposal is located north of and adjacent to Broadway Avenue 650 feet east of Pines
Road in Section 15, Township 25 North, Range 44 EWM, Spokane County,
Washington.
4. The cuirent zoning of the property is Urban Residential-3.5 (tJR-3.5). The proposed lot
sizes, frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.
7. No one in the area commented on the proposal.
8. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platring the
subdivision.
9. The project is exernpt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-757-92 is hereby APPROVED until June 1, 1995, subject to conditions noted
below. Most of the conditions of approval shall be acconzplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone(s) as
amended.
3. The final plat shall be designed substantial.ly in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.

4. The P"lanning Dizector/designee shall. review any praposed final plat to ensure
compliance with these Findings and Conditions of Approval.

with the submittal of the final plat.

dedication.

3. Tle water purveyar sha11 eertify that app-ropriate contractual arrangements and schedule

system in accordance with the approvedWater Plan. The time schedule shall provide
for campletian of the water system and inspection by the appropriate health authon'tics

harniless from claims by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to sarisfactorily complete the approved water system.
14. The final plat dedicarion shall contain the following statement:
"T'he public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Build.ing & Safety
Department and water purveyor, shal.l be installed within this subdivision, and the
applicant shall provide for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."
15. No building permit will be issued for any lot withi.n the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. T'he
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
16. 1'he Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general welfare.
17. A survey is required prior to the filing of a final plat.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road systenz as indicated in the
preliminary plat of record.
2. No construction work is to be perfoimed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
. 3. Individual driveway access permits are required prior to issuance of a building pernut
for driveway approaches to the county road system.
4. Ded.ication of 4 feet of additional right-of-way along Broadway Avenue is required.
5. Existing counry roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
6. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
7. The County Engineer has designated Typical Roadway Section Number Two, Major
Arterial standard for the improvement of Broadway Avenue, which is adjacent to the
proposed development.
8. The proposed subdivision shall be improved to the standards set forth in Spokane .
County Board of Commissioners Resolurion No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
9. The County Engineer has examined tlus development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified.
10. The County Arterial Road Plan idenrifies Broadway Avenue as a Principal arterial. The
existing right-of-way width of 55 feet is not consistent with that specif'ied in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way
dedicarion, a strip of property 16 feet in width along the Broadway Avenue frontage
shall be set aside in reserve. This property may be acquired by Spokane County at the
time when arterial improvements are made to Broadway Avenue.
11. There may exist utiliries, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.

Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
12. The access easement to Tract A shall be considered a driveway provided that the access
easement serves only Tract A. This access easement shall be a minimum of 12 feet in
width. If more than 1 tract uses any portion of the access easement as a means of
primary access, the easement shall meet all private road standards of the Spokane
County Road Standards. Width of the private road shall be 30 feet and engineered road
. and drainage plans drawn by a licensed civil engineer for the private road shall be
reviewed and approved by the County Engineer.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as ind.icated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Deparmlent to the utility companies, Spokane
County Engineer and the Spokane Counry Health District. Written approval of the
easements by the utility companies must be received prior to the subnuttal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfacrion of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat. ,
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that the existing on-site sewage disposal system
serving the residence located on Tract C is wholly located within the bound.aries of the
tract.
9. A public sewer system will be made available for the plat within one year of finalization
of this short plat. Use of individual on-site sewage disposal systems shall be
authorized until such rime.
10. A statement shall be placed in the dedication to the effect that: "A public sewer system
will be made available for the plat within one year of finalization of this short plat. YJse
of individual on-site sewage d.isposal systems shall be authorized only until such time."
11. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
12. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by counry and state health authoriries, the local fire d.istrict and purveyor,
will be installed within this plat, and the subdivider will provide for individual domestic
water service as well as fire protection to each tract prior to sale of each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Tracts B and C will make connection to Public Sewer System. Sewer Connection
permit is required.. Connection is to be made within one year of finalizarion of this
short plat.
