SHORT PLAT NO. SP-760-92 ) CONCLUSIONS AND
. DECISION
THIS MATTER, an application for subdivision of land, from John Frandsen and Ted Odell
has been received and decided upon, pursuant to Spokane County Subdivision regulations, on
the day of May, 1992.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning.
2. The proposal is to di.vide approximately .86 acre into three (3) lots for an existing single
family home and one divided duplex for a total of three units. 3. The property is generally located between IZth and 13th Avenues, approxi.mately 550 feet
west of Blake Road SE 1/4 of Section 22, Township 25 North, Range 44 E.W.M.
Spokane County, Washington. ,
4. The current zoning of the properry is Urban Residential-3.5 (UR-3.5). The proposed lot
sizes, frontage and intended uses are allowed within this zone. The Urban Residential-3.5
zone does allow duplexes for lots which are twice the minimum lot size required for single
family units, or 20,000 square feet. Additional land use actions may be required for lots
that do not meet manimum standards of the zone.
5. Divided duplex lots are authorized under Chapter 14.818 of the Spokane County Zoning
Code.
6. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
7. S unrounding uses are primarily residential with a mix of single family homes and duplexes. _
8. The required public notice was provided for this proposal and agencies havi.ng a potential
interest in the project were notified and recommendations solicited. The public notice of
record incorrectly stated two duplexes were applied for as part of this proposal. Phone
calls from adjacent property owners informed the Department of the nlistake and the
correct information was provided over the phone.
9. No written comments were received from adjoining property owners.
10. Recognizing the recommended conditions and Spokane County development standards, '
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision. 11. Twelfth Avenue is a Local Access street with an existing width of 40 feet The County
Engineer has requested dedication of an additional 5 feet of right-of -way on Twelfth
Avenue.
12. The proposed short plat will be served by a public water system. Connection to the
county-wide sewer is required.
13. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECZSION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-760-92 is hereby APPROVED unril June l, 1995, subject to cond.itions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or

sponsor prior to finalization of the short subdivision. This deciszon is final unless
. appealed in writing, consistent with adopted appeal procedwres.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or ' any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property lega.lly described in the
application for this proposal.
2. All conditions imposed by the Plaruling Department shall be binding.on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
3. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone(s) as
amended and Chapter 14.818 of the Spokane County Zoning Code for divided duplex
lots. Minimum lot sizes for duplex units shall be 20,000 net square feet with each lot
of a divided duplex having 10,000 square feet. The required lot sizes may be varied
from if proper zoning approvals are obtained.
4. The final plat shall be designed substantially i.n conformance with the preluninary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
5. The Planning Directoridesignee shall review any proposed fi.nal plat to ensure
compliance widl these Find.ings and Conditions of Approval.
6. Appropriate road name(s) shall be indicated.
7. The preliminary plat is given conditional approval for three (3) years, specifically to . . June 1, 1995. The applicant may request an extension of time by submitting a written '
request approximately forty-five (45) days prior to the above expiration date.
8. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by apprqpriate utility companies shall be received
with the submittal of the final plat.
9. Three (3) current certificates of title shall be furnished to the Planning Department prior
. to filing the final plat.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following statement:
"Side yard and reaz yard setbacks shall be detexmined at the rime building perm.its are requested unless these setbacks are specifically drafted on this final plat. T'he setbacks
indicated on this plat may be varied from if proper zoning approvals are obtai.ned." 11. No water plan is required and a simple tap is needed at the time of building permit
release. .
12. A survey is required prior to the filing of a final plat.
13. The final plat dedication shall include:
"No detached si.ngle-family dwellings or manufactured homes are allowed on any lot.
All tracts with any lot line designated. Center Duplex Lot I.ine shall be restricted to one
common-wall dwelling unit (one-half [1/2] duplex), provided the duplex common wall
is aligned over or with the Center Duplex Lot Line, and provided that each duplex unit
.(half) is totally on its side the of center lot line when said lot line is extended vertically
beyond the roof line."
~ 4. The final plat is to identify the duplex cammon-wall lot line as center duplex lot line,
~ and the line is to be drafted as a continuous "dash-dot-dash.

, COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the . .
preliminary plat of record. ' 2. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engi.neer.
3. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
4. Dedication of 5 feet of additional right-of-way al.ong 12th Avenue is required.
5. Existing county roads providing direct access to the plat shall be paved and/or curbed to
. Spokane County standards. -
6. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
7. To construct the road i.mprovements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the formati.on of a Road .Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to 12th and 13th Avenues.
8. As an altemative method of constructing the road unprovements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewallc, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to 1-2th and 13th Avenues.
9. The following statement shall be placed in the plat dedication:
The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of a Road Improvement District
(RID) by the petition rnethod pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
. 36.88 RCW, which resolution includes the owner(s)' property. If an RID is -
folmed by either the petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together wi.th the amount of any County participation,
exceed the cost and expense of fonnation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) sha11 retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the unprovements called for in conjunction with the
formation of an RID by either perition or resolution method under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road.
Improvement Project is sanctioned by Spokane County, the improvements

expense of the undersigned owner(s), their heirs, grantees_ and assigns
without participation by Spokane County.
The RID waivei contained in thi.s agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s) .
agree that if said RID waiver expires without construction of the required
improvements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvements to enable the County to
complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement)
providing for or securing to the Counry the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), theu successoz(s) or assign(s)." This provision
is applicable to 12th and 13th Avenues. 10. The County Engineer has designated.Typical Roadway Section Number Two, Local
Access standard for the improvement of 12th Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 10-12 feet of
asphalt along the frontage of the development. The construction of curbing is also
required.
11. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the inaprovement of 13th Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 10-13 feet of
asphalt along the frontage of the development. The construction of curbing is also
_ required.
12. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
13. The County Engineer has examined this development proposal and has detennined that
the impact of this proposal upon the existing county road system wairants the
dedication of additional right-of-way and the roadway improvements herein specif'ied.
14. There may exist utiliries, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acqui,sition.
Spokane County assumes no financial obligation for adjustments or relocation
regard.ing these urilities. Applicant(s) should check with the applicable utility purveyor ,
and the Spokane County Engineer to determine whether applicant(s) or the utiliry is
responsible for adjustrnent or relocation costs and to make arrangements for any
necessary work.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted.
C2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane Counry Health District. Written approval of the
easements by the utiliry companies must be received prior to the submittal of the fi.nal
plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
- 4. Water service shall be coordinated through the Director of Urilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), S tate Department of Health.

6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
- Spokane Counry Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. A public sewer system will be made available for the platlproject, and individual service
will be provided to each lot/tract prior to sale. Use of individual on-site sewage
disposal systems shall not be authorized.
9. A statement shall be placed in the dedication to the effect that: "A public sewer system
will be made available for the [platlproject], and individual service will be provided to
each tract prior to sale. Use of individual on-site sewage disposal systems shall not be
authorized." •
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited." ,
11. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by county and sta.te health authorities, the local fire district and purveyor,
will be installed within this plat, and the subdivider will provide for individual domestic
water service as well as fire protection to ea.ch tract prior to sale of each tract" COUNTY UTILITIES DEPARTMENT CONDITXONS
l. . Applicant shall make connection to public sewer system. Sewer connection permit is
required. Plans and specifications are to be reviewed and approved by the Utilities
Departmenf_
2. Two sewer stubs are available to serve this three lot short plat. Easements and
agreements for connection and maintenance of the sewer lines are to be reviewed and
approved by the Utilities Deparmlent.
BUILDING AND SAFETY DEPARTMENT CONDITIONS 1. Requirements of Fire District No.l need to be sarisfied during the building pemait
process.
2. The applicant is advised that the private road shall be named and signed in accordance
with the provisions of Spokane County Road Standards. This condition may be
waived in the event that the Deparnnent of Buildings determines addressing on the
private road is not acceptable. However, at such time as the Departrnent of Buildings
feels the need for the road to become a private, named road, the applicantlowner shall
participate and cooperate in this process. .
