36.32.120(6), the Board of County Commissioners of Spokane Counky has the care of
County property and the management of County funds and business; and
WHEREAS, Spokane County ia the owner of Sprague Avenue right of waq, RF 2312,
located in the Southeast Quarter (SB 1/4) of Section 14, Township 25 North, Range
44 East, W.M.; and
WREREAS, Alvin J. Wolff, Jr. and Eugenia E. Wolff desire to utilize a certain
portion of Sprague Avenue right of way for the purpose of installing, operating,
and maintaining drainage swales and drainage facilities to dispoae of runoff.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Board of County Commissioners of
Spokane County that the Chairmaa of the Board of Countp Commissioners or a majority
of the Jioard is hereby authorized to execute at other than an open meeting the

by and betweea Spokane County, a political subdivision of the State of Washington,
having offices for the transaction of business at West 1116 Broadway Avenue,
Spokane, Washington 99260, hereinaf ter referred to as the "County", and Alvin J.
6Jo1ff, Jr. and Eugenia E. Wolff having offices for the traneaction of business at
East 9016 Indiana, Suite 100, Spokane, Washington, 99212 hereinafter referred to as
the "Licensee", jointly, hereinaf ter referred to as the "Parties".

WHLRF.AS, pursuant to the provisiona of the Reviaed Code of Washington, Section

WHEREAS, Spokane County is the owner of Sprague Avenue right of way, RF 2312,

WHEREAS, Alvin J. Wolff, Jr. and Eugenia E. Wolff desire(s) to utilize a
certain portion of said Sprague Avenue for the purpose of installing, operating,
and maintaining drainage swales and drainage facilities to dispose of runoff
described on Attachment "A".
NOW, THEREFORE, for and in consideration of the mutual promises set forth
hereinafter, the parties hereto do mutually agree as follows:
- SECTION 1 - PURPOSE
Beginning November 21 , 19 89, the County hereby grants the Licensee a
license to use the following deecribed real property hereinafter referred to as the
"premisee" for the purpoee of inetalling, operating, and maintaining drainage
swales and drainage facilities to dispose of runOff;

That portion of Lot 3 in Block 3 of VLRADALE HOMES SUBDIVISION OF TRACT 61
OF VERA, as per plat thereof recorded in Volume 2 of Plats, Page 41;
TOGETHER WITH that, portion of vacated Sprague Avenue, 40 feet wide, that
Iies North of the old Great Northern Railroad right of way adjoining said
lot on the South; described as follows:
The North 10 feet oF the South 80 feeL of the East 95 feet of the Weat 125
fept of the SnuthPn4t Quarter (SE 1/4) of Section 14, Township 25 North,
Range 44 Eas t, W.M.
Situated in the County of Spokane, State of Washington.
SECTION 2- CONSIDERATION AND TERM
For and in consideration of the privilege to use the premises for the purpose
of installing, operating, and maintaining drainage swales and drainage facilities
to dispose of runoff.

The Licensee shall install and maintain drainage swales and drainage facilities
in accordance with a ptan approved by the County.
The license is revoeable at will and non-assignable and does not exclude
possession, either wholly or partially by the County of the premises subject to the
license. The privilege given herein is not exclusive and the County reaerves the
right at any time to grant other or similar privileges to use and occupy the
premises.
SECTION 3- LEASEHOLD EXCISE TAX
The Liceneee hereby acknowledges to the extent that this licenee is subject to
L1ie Leasehold Excise Tax" as set .Eorth in Chapter 82.29A RCW as now or hereafter
amended the same shall promptly be paid by the Licensee.
SECTION 4- COMPLIANCE WITH LAWS
The Licensee shall comply with and abide by ALL federal, state, county,
municipal and other statutes, ordinances, laws and regulations effecting the
premises, including but not limited to the Spokane County Zoning Ordinance.
SECTION 5- MAINTENANCE OF RECORDS
The Licensee shall make available to the County or the Washington State Auditor
or their duly suthorized representativea, at aay time during their nonoal operatiAg
houre, all recorde, booke or pertinent infortnstion which the Liceneae shall have
kept in conjunction with this agreement and which the County may be required by law
to include or make part of ita auditing proceduree, an sudit trial or which map be
required for the purpose of funding the services contracted for herein.
SECTION 6 - MODIFICATION
No modification or amendment to this agreement shall be valid until the same is
reduced to writing and executed with the same Eormalities as this present agreement.
SECTION 7 - VENIJE STIPULATION
This agreement has and shall be constructed as having been made and delivered
in the State of Washington, and the laws of the State ot Washi.ngton shall be
applicable to its construction and enforcement. Any action at Iaw, suit in equity
or judicial proceeding for the enforcement of this agreement of any provision
hereto shall be instituted only in the courts ot competent jurisdiction within
Spokane County, Washington.
SECTION 8 - WAIVER
No officer, employee, agent or otherwise of the County, has the power, rfght or
authoriCy Co waive any of the conditions or provisions to this agreement. No
wafver of any breach of this agreement shall be held to be a waiver of any other or
eubsequent breach. All remedies afforded in thie agreement or at law shall be
talcen and constructed ae cumul.ative, that is, in additioo to every other remedy
provided herein or by law. Failure of the County to enforce at any time any of the
provisions of this agreernent or to require at any time performance by the Licensee
of any provision hereof, shall in no way be construed to be a waiver of such
provieions, nor in any way affect the validitq of this agreement or any part
hereof, or the rig}it oE the County to hereafter enforce each and every sucli
provision.

SECTION 9 - LIABILITY
Use of the gremiaes under this agreement wi11 be eatirely $t the Licensee's owm

County and alZ its vfficers, agents, emplayees or otherwise, f rom any and all
1iab3lity, loss ar damage that they may suf€er as a result of claims, demands,
aatiarim, dumag■s or injuriea of svery kind or naturQ wtatsoever by or to any► And
all persons or property oc judgmente againet t]tem which raeult fram, ariee out af,
or are in a-ay way cannected with the use of the premises bp the Licensee under the
terms of this agreeraent.
3ECTION 10 - NOTICES
A1I noCices called for or gravided fot iA this agreement sha1l be in writing
and mugt be served on any of the paxties either personallq or by certified mail
sent to the parties at their respeetive addre$ses heref.n.a.bove given. Notices sent
by certified mail shall be deemed served when depos#.ted in the [Tnited States mai1,
postage prepaid.
SECTION 11 - HEADIN6S

I. General Overview - Proposed is the construction of a 6,000
square foot building. Half of the proposed will be used as a
storage warehouse and the other half will be used for retail sales.

A. Discussion/Requirements
1. The proposed is located over the Aquifer Sensitive
area.
2. Please submit an updated critical materials listing to
Building a-nd Safety for review.
3. Parking for the proposed is adequate.

1. An estimate from a nursery, including size, type and
quantity alonq with a promissory letter from the owner
stating the landscaping will be installed shall be
submitted.
II. Engineering Department (456-3600)
A. Discussion/Requirements
l. Comments were given to the applicant and Building and
Safety by Bob McCann.
2. Please subZait a drainage plan for the proposed, at a
minimum the plan shall contain the following: drainage
calculations for stormwater volumes generated on site,
calculations for total impervious surfaces contained
within the site, finished grade elevations for structures
to be constructed on site, finished grade elevations at
the top and bottom of the 208 swale, a typical cross
section of the 208 swale, calculations to justify the
number and type of drywells proposed and elevation of
drywell inlets where applicable.
3. The property is subject to zone change ZE-77-78.
4. Please submit road and drainage plans for street
improvements on Adams Road.
5. Approach permits must be obtained for driveway
approaches to Sprague Avenue and Adams Road.
6. The drywell can not be placed in the loading ramp, all
drainage must go to approved 208 swales.
7. Bob McCann informed the applicants of the new fee
schedule.
B. Permit Release Requirements
1. Please submit a drainaqe plan as described above for
review and approval.
2. Please submit road and drainaqe plans for street
improvements on Adams Road for review and approval.
3. Loading dock plan shall be submitted for review and
approval.

III. Health District (456-6040p ~
« A. Discussion/Requirements
1. The proposed will be connected to the Valley Sewer
System.
2. Daryl Way recommended that the applicants contact
valley garbage to insure that the location of the dumpster
at the proposed site is adequate.
B. Permit Release Requirements
1. The Health District is ready to release their portion
of the building permit.
IV. Fire District No. 1(928-2462)
A. Discussion/Requirements
1. One fire hydrant is required for the site and is to be
located on the corner of Sprague Avenue and Adams Road.
V. Building and Safety (456-3675)
A. Discussion/Requirements
1. Plan review has been completed on preliminary plans
and a letter was given to the applicant by Tom Postlewait.
2. The proposed east wall shall be constructed of
one-hour fire-resistive material from foundation to top of
30 inch parapet.
3. Fire flow for the proposed is 3000 g.p.m.
4. Please submit an updated critical materials listing to
Building and Safety for review.
5. The proposed must meet requirements of the Washington
state Requlations for Barrier-Free Facilities.
B. Permit Release Requirements
1. Two complete revised sets of plans addressing the
items discussed durinq and after the meetinq and other
items from the plan review letter needs to be submitted
for review and apgreval.
2. The removal of the existinq house requires a separate
permit.

submitted in areas where fill may be placed to support
footing and foundations of the proposed building. (For
example: structural fill in basement area)

departments shall be submitted to Building and Safety who will then
distribute accordingly to those departments.

the applicant and the departments for their participation and
reminded all that he should be contacted if there are any unforeseen
problems which may arise.
