BEFORE THE SPOKANE COtJNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-766-92 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land, from Robert Whitney has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the
day of June, 1992.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide a 34,000 square foot lot into two (2) lots for one existing single
family residence and and one new residence and those uses permitted in the underlying
zone.
3. The proposal is located south of Valley Way approximately 600 feet west of Adams Road
in the SW 1/4 of Section 14, Township 25 North, Range 44 E.W.M. Spokane County,
Washington.
4. The current zoning of the property is Urban Residential-3.5 (UR-3.5). The proposed lbt
sizes, frontage and intended uses are allowed within this zone. The Urban Residential-3.5
(UR-3.5) zone minimum lot size is 10,000 square feet with 80 feet of road frontage
required.
5. The Spokane County Comprehensive Plan designates this area as Urban The
development and uses proposed are generally in accord with this category.
6. Suirounding uses are primarily single family residences with urban lot sizes interspersed
with small acreage lots.
7. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.
8. No comments were received from any adjoining property owners.
9. Recognizing the recommended condirions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The Arterial Road Plan designates Valley Way as a Collector Arterial with a proposed
right of way of 70 feet and an existing width of 40 feet. To implement the Plan the
County Engineer has requested dedication of an add.itional 15 feet of right-of -way and a
S foot set aside to be designated as a Future Acquisition Area.
11. The proposed short plat will be served by a public water system. Both the Fire District
and Water Purveyor have indicated that the exisnng system is adequate to serve the
proposal and a Water Plan will not be required. Waste water disposa] will be as
authorized by the Director of Urilities.
12. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISTON
• Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-766-92 is hereby APPROVED until July 1,1995, subject to conditions noted below.
Most of the condirions of approval shall be accomplished by the applicant and/or sponsor

prior to finalization of the short subdivision. This decision is final unless appealed in
writing, consistent with adopted appeal procedures.
These Conditions of Approval appIy to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone(s) as
amended. 3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No inerease of density or number of lots shall occur without a change of
condition application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
July 1, 1995. The appLicant may request an extension of time by submitring a written
request approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utiliry companies shall be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be fulnished to the Planning Department prior
to filing the final plat.
9. The Spokane County Planning Department shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way
and urilities. T'he reserved future acquisition area Title Notice shall be released, in full
or in part, by the Planning Department. The notice should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 5 feet of reserved future acquisiaon area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
. Valley Way. NOTE: The County Engineer has required 15 feet of new
dedication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. T'he future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
iinprovements at the time Spokane County makes roadway improvements after
acquiri.ng said future acquisition area.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:

"Side yard and rear yard setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
11. No water plan is required, and a simple tap is needed at the time of building pennit
release.
12. A survey is required prior to the filing of a final plat.-
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspecrion and approval by the County Engineer.
3. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
4. Dedication of 15 feet of additional right-of-way along Valley Way is required.
5. Existing county roads providing direct access to the plat shall be paved andJor curbed to
Spokane County standards.
6. Sidewalks are required along the arterial on Valley Way.
7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
8. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any geririon or resolution
which purpose is the formation of a Road Improvement District (RID) for said
inzprovements, pursuant to RCW 36.88, as amended. At such rime as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
' improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heixs, grantees
and assigns. This provision is applicable to Valley Way.
9. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Enganeer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an R,ID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drai.nage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is appllcable to Valley Way.
10. The following statement shall be placed in the plat dedicarion:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RXD by the resolution method pursuant to Chapter
36.88 RCW, which resolurion includes the owner(s)' property. If an RID is
formed by either the petirion or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed
. RID is feasible;
(b) that the benefits to be derived from zhe formation of the R1D by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID; and
.

(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
properry as a result of the i.mprovements called for in conjunction with the
formation of an RID by either petition or resolution method under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners aff-irming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participarion by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if sa.id RID waiver expires without consrruction of the required
improvements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane Counry the then
estimated cost of the required improvements to enable the County to
complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement)
providing for or securing to the County the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to Valley Way.
11. The County Engineer has designated Typical Roadway Section Number Two, Collector
Arterial standard for the unprovement of Valley Way, which is adjacent to the proposed
development This will require the addition of approximately 10-12 feet of asphalt
along the frontage of the development. The construction of curbing and sidewalk is
also required.
12. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
13. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified.
14. The County Arterial Road Plan identifies Valley Way as a Collector Arterial. The
existing right-of-way width of 40 feet is not consistent with -that specif~ied in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of property 5 feet in width along -the Valley Way frontage shall be set
aside in reserve. This property may be acquired by Spokane County at the time when
arterial improvements are made to Valley Way.
15. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be ded.icated or set aside for future acquisition.
Spokane County assumes no financial obligaaon for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to deternune whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane

County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final '
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County. -
4. Water service shall be coordinated through the Director of Ualities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the sponsar shall demonstrate to the satisfaction of die
Spokane County Health District that a suitable site for on-site sewage disposal system
is available on tract 1.
9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that the existing on-site sewage disposal system
. serving the residence located on tract 2 is wholly located within the boundaries of the
tract.. 10. Subject to specific application approval and issuance of permits by the health officer,
the use of (an) individual on-site sewage disposal system(s) may be authorized.
11. The dedicatory language of the plat will state: "Subject to specific applicaeon approval
and issuance of permits by the Health Officer, the use of an individual on-site sewage
system may be authorized."
12. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorizaaon is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The dedication shall state:
"T'he owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a perition for the formation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the fonnation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended. 4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."
