SP-772-92 } DECYSION 4THZS MATTER, a request for YiODIFiCA"i'ION TO A PREVIOUSLY APPROVEU short subdivision of land, from Carl Moore of 3-M Enterprises, has been received and decided upon, pursuant to Spokane County Subdivision regulations, on the q'141 day of December, 1992. FINDYNGS OF FACT AND CC)NCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal was originally approved for the divisioil of approximately 1.3 acres into ° four (4) lots for residential uses and thase uses pernutted in the underlying zone. The Planning Deparrment received a letter, dated November 19, 1992, fronl the applicant requesting an Llpdated decision based on a new short plat design which reduced the number of lots from foux (4) to tliree (3). "I he Plwlning Department circulated the proposed change to those agencies which commented on the previous proposal and incorporated the changes into this docwlient. 3. The proposal is generally located at the southeast corner of Guthrie Drive and 28th Avenue in the SF 1/4 of Section 27, Township 25 North, Range 44 E.W.M., Spokane County, Washington. 4. The current zoning of the property is Urbari Residential-22 (UR-22). The application for the proposed short plat indicated that duplexes and/ot- multi-family would be constnicted on the proposed lots. Duplexes a.re not a permitted use in the underlying zone. Multi- family units are the only residential uses perniitted ir1 the zone. 5. The Spokane County Comprehensive Plan designates this area as Urban 'I'he development of multi-family uses are benerally in accord with this category. 6. Surrounding uses a.re single family residences to the north and multifamily to the west. The parcel to the south is undeveloped. 7. The requu-ed public notice was provided for this proposal and agencies having a potential interest in the project were notified and reeommendations solicited. New or additional conditions were not recommended fron1 other agenciesldepartments. 8. Comments from adjoining property owners wCre not solicited since the oribinal notification in July of 1992. 'C'he Plannin(y .Deparmient considered the redesign as an insignificant change and determined thlt additional public riotice was not necessary. 9. Recognizing the recommended conditions and Spokane Cotinty development standards, the proposed subdivision makes appropriate pi'ovisions for the public health, safety and general welfare and that the public use and intei-est will be served by platting the sLlbdivision. 10. GLithrie Drive 1nd 28th Avenue are ciesionated as Loczll Access streets with existing right of way widths of 60 feet. The Gount), F-ngineer has not requested dedication of additional right of way. 1 1. 'I'he proposed short plat will be servecl by a public water sysrem. DECISIUN Based upon the above noted Findings of Fact and Conclusions, Short Plat Applicarion SP-772-92 as modified, is hereby APPROVED Lmtil August 1, 1995, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the shon subdivision. This decision is final unless appealed in writizig, consistent with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest to property. PLANNZNG DEPARTMFN'I, CONDITIONS 1. All conditions imposed by the Planning Department shall be binding on the . "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residential-22 (UR-22) zone as amended. Each lot shall meet all dimensional requirenlents of the zone. 3. 7'he final plat shall be designed substanti111y in confol-inance with the preliminary plat of record. No increase of density or number of lots shall occur wiChout a change of condition application submittal and approval. 4. The Planning Dixector/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 5. Appropriate road name(s) shall be indicated. 6. The preliminary plat is given conditional approval for three (3) years, specifically to August 1,1995. The applicant may request an extension of time by submitting a written request approximately .f.orty-five (45) days prior to the above expiration date. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utlliry companies shall be received with the submittal of the fina.l p]at. 8. Three (3) current certificates of title shall be flirnished to the Planning Deparnnent prior to fUxn g the fin al pl at. 9. The final plat shall indicate yard setback arc lengths on any proposed or required cul- de-sac lots which meet or exceed the minimum frontage of the underlying zone of the final plat. 10. The final plat map shall indicate by a clear, dashed line the required ya.rd setbacks from all private, "Tract X" or public roads. "r'he dedication shall contain the following statement: "Side yard dnd rea.r ya.rd setbacks shdll be deten~nined at the time build.ing pemiits aI-e requested unless theSe setbaeks aue specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 11. A plan for water faciliaes adequa.te for domestic service and fire protection shall be approved by the water ptirveyor, approprilte fire protection district, County Building & Safety Department and Caunty Health District. 'r'he agencies will certify on the Water Plan, prior to the filing of a. final plat, that the plan is in conformanee with their respective needs and regulations. The Water Plan and certificatlon shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. 12. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for constnicrion of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building permits wlthin the final plat. The arrangements or agreements shall include a provision hold-ing Spokane County and the purveyor i I , , . : rhNDTNGS AND DECISION SP-772-92 Page 3 harmless from claims by any lot purchaser refused a building pernut due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 13. The final plat dedicarion sha11 cocitaidl tfle followinb statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Building & Safety Department and water purveyor, shall be installed within this subdivision, and the applicant shall provide for ind.ividual domestic water service as well as fire protection to each Iot.prior to sale of each lot and prior to issuance of a building pennit for each lot." 14. No building pennit wrll be issued for any lot within the final plat until certified by a Washington state-licensed engineer tlat "the water system has been installed pursuant to the approved Water Plan for the final plat" including a signed license stamp. The certificarion may be in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system. 15. The Water Plan and the above four (4) conditions of approval regarding the Water Plarl may be waived by the planning Director/deaignee upon receipt of letters from the appropriate water purveyor and fire protection district stating that simple connecrions to an existing, approved water system will provide adequate domestic and fire protection water to ensure the pLiblic health, safety and general welfare. 16. A survey is requi_recl prior to the filing of a final plat. COUNTY ENGINErR'S DEPARTMENT CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. 2. Plans, profiles, and cross-sections as dESigned Co CoLinty standards showing proposed street centerlule and curb grades shall be submitted to the County Engineer for approval prior to construction and/or the filing of each final plat; road plans to be prepared under - the direction of a licensed Professional Civil Engineer. 3. Drainage plans and design calculations showing the alignment of drainage facilities shall be submitted to the County Engineer for approval prior to construction and/or the filing of the final plat. Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 4. Construction within the proposed public streets and easements shall be performed under the direct supervision of a licensed engineer/surveyor, who shall furnish the County Engineer with "as-built" plans and a certificate in writing that all improvements were installed to the lines and grzdes shown on the approved construction plans and that all disturbed monuments have been replaced. 5. No construction work is to be performed within the eaisting or proposed public right- of-way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 6. A11 construction within the existing or proposerl public right-of-way is to be completed prior to filing each final plat, or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements, construction certification, "as-built" plans and monumenting the Street centerlines shall be filed with the County Engineer. 7. Individual driveway access permits are required prior to issuance of a building permit for driveway approaches to the county road system. 8. Existing county roads providino, direct access to the plat shall be paved and/or curbed to . Spokane County standards. 9. The word "applicant" sha.ll include the owner or owners of the property, his heirs, assigns and successors. 1. The County Engineer has designated Typical Roadway Section Number One, Local Access standard for the improvement of 28th Avenue and Guthrie Drive, which is adjacent to the proposed development. The construction of sidewalk is also required. FINDINCS AND DECISZON SP-772-92 Page 4 11. 1'he proposed subd.ivision shal.l be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which . . resolution establishes regulations for roads, approaches, drainage and fees in new construction. 12. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of additional right-of-way and the roadway improvements herein specified. 13. There may exist uti.lities, either underground or overhead, affecting the subject property, inclucling property to be dedicated or set aside for future acquisition. Spokane Caunty assumes no financial obliL~ltion for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utiliry purveyor and the Spokane County Engineer to detemune whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arranbements for any necessary work. 14. Highway 27, adjacent to this proposal, is a State facility. Any access or required improvements to this road shall bc reviewed and approved by the Washington State Department of Transportation.0 15. The storm dr.-cdnage easement as designated on the preliminary plat appears to have been relocated per the building pernut application. The final plat shall be designed as indicated on the preliminary plat o.f record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicar.ed on copies of the preliminary plat of record for distributYon by the Planning Department to the urility companies, Spokane County Engineer and the Spokane County Health District. Written approval of the easements by the utility companies must bc received pi-ior to the submittal of the final plat. 3. Sewage disposal nlethod shall bc as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated throu~h the Director of UtYliries, Spokane County. 5. Water service shall be by an existing public water supply when approved by the . Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the Final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that ail adequate and potable water supply is availahle to each tract of the plat. 7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 8. A public sewer system will be made available for the platiproject, and individual service will be provided to each lotJtract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized. 9. A statement shall be placed in the dedication to the effect that: "A public sewer system will be made available for-the plat, and individuAl service will be provided to each lot/tract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized." 10. The dedicatory language on the plat Shetll State: "Use or private wells and water systems is prohibited." ~ 11. The plat dedication will contain a st'atement to the effect that: "The public water system, as approved by county and state he,-~ith authorities, the local fire district and purveyor, will be installed within this plat, and the subcl.ivider will provide for individual clomestic watPr service as well as fire protection to each lot/tract prior to sale of eacli lot/tract." ► / ► F.LNnINGS AND DECXSION SP-772-92 Page 5 . COUNTY UTILITIES DEPARTMENT CUNDITIONS . 1. Any water serviee for this project shall be provided in accordance with th-e Coordinated Water System Plan for Spokane County, as amended. 2. Applicant shall make connecrion to public sewer system. Sewer connection pemzit is required. Plans and specifications are to be reviewed and approved by the Utilities Department. The County of Spokane is hereby granted the right of ingress and egress to all drainage easements adjacent to the public right of way. SP-772-92 ) CONCLUSIONS AND DECISION THIS MATTER, an application far subdivision of land, from 3-M Enterprises has been received and decided upon, pursuant to Spokane County Subdivision regulations, on the -aa day of July, 1992. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibi.lity for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide approxirnately 1.3 acres into four (4) lots for residential uses and those uses permitted in the underlying zone. 3. The proposal is generally located at the southeast corner of Guthrie Drive and 28th Avenue in the SE 1/4 of Section 27, Township 25 North, Range 44 E.W.M., Spokane County, Washington. 4. The current zoning of the property is Urban Residential-22 (UR-22). The application for the proposed short plat ind.icated that duplexes and/or multi-family would be constructed on the proposed lots. Duplexes are not a pernutted use in the underlying zone. Multi- family units are the only residential uses perm.itted in the zone.The proposed lot sizes meet the dimensional requirements of the zone except for Parcel B which may not meet the 100 foot minimum depth requirement. 5. The Spokane County Comprehensive Plan designates this area as Urban The development of multi-family uses are generally in accord with this category. 6. Surrounding uses are single family residences to the north and multi family to the west The parcel to the south is undeveloped. There is one apartment build.ing under consrruction on Parcel A. The remainder of the site is vacant. 7. The requixed public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 8. No comments were received from adjoining property owners. 9. Recognizing the recommended conditions and Spokane County development standards, the proposed subdivision makes appropriate provisions for the public health, safery and general welfare and that the public use and interest will be served by platting the subdivision. 10. Guthrie Drive and 28th Avenue are designated as Local Access streets with existing right of way widths of 60 feet. The County Engineer has not requested dedication of additional rights of way. 11. The proposed short plat will be served by a public water system. Connecrion to the county-wide sanitary sewer system is required. 12. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-772-92 is hereby APPROVED until August 1, 1995, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. FINDINGS AND DECISION SP-772-92 Page 2 These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest to property. PLANNING DEPARTMENT CONDITIONS 1. All conditions imposed by the Planning Department shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residential-22 (UR-22) zone as amended. Each lot shall meet all dimensional requirements of the zone. Net density for each lot, excluding private roads, shall be shown on the final plat. 3. The final plat shall be designed substantially in confonnance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condirion application submittal and approval. 4. The Planning Director/designee shall review any proposeri final plat to ensure compliance with these Findings and Conditions of Approval. 5. Appropriate road name(s) shall be indicated. 6. The prel.iminary plat is given conditional approval for three (3) years, specifically to August 1, 1995. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expirarion date. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies shall be received with the submittal of the final plat. 8. Three (3) current certificates of title shall be furnished to the Planning Deparnnent prior to filing the final plat. 9. The final plat shall indicate yard setback arc lengths on any proposed or required cul- de-sac lots which meet or exceed the minimum frontage of the underlying zone of the final plat. 10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, "Tract X or public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be deterniined at the time building permits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 11. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Build.ing & Safety Department and County Health District. The agencies will certify on the Water Plan, prior to the fili.ng of a final plat, that the plan is in conformance with their respective needs and regulations. The Water Plan and certification shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. 12. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate health authoriries prior to application for building permits within the final plat. The arrangements or agreements shall include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building pemut due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 13. The final plat dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Building & Safety Department and water purveyor, shall be installed withi.n this subdivision, and the FINDINGS AND DECISION SP-772-92 Page 3 applicant shall provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building pemut for each lot." 14. No building pernut will be issued for any lot within the final plat until certified by a Washi.ngton state-licensed engineer that "the water system has been installed pursuant to the approved Watez Plan for the final plat" including a signed license stamp. The certification may be in the fozm of a letter, but is prefenred to be certified on a copy of . the Water Plan as a schematic map showing the "as-built" water system. 15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan may be waived by the Planning Dizector/designee upon receipt of letters from the appropriate water purveyor and fire protection d.istrict stating that simple connections to an existing, approved water system will provide adequate domestic and fire protection water to ensure the public health, safety and general welfare. 16. A survey is required prior to the filing of a final plat. COUNTY ENGINEER'S DEPARTMENT CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. 2. Plans, profiles, and cross-sections as designed to County standards showing proposed street centerline and curb grades shall be submitted to the County Engineer for approval prior to construction andJor the filing of each final plat; zoad plans to be prepared under the du-ection of a licensed Professional Civil Engineer. 3. Drainage plans and design calcularions showing the alignment of drainage facilities shall be submitted to the County Engineer for approval prior to construction and/or the filing of the final plat. Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 4. Construction within the proposed public streets and easements shall be performed under the duect supervision of a licensed engineer/surveyor, who shall furnish the County Engineer with "as-built" plans and a certificate in writing that all improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. 5. No construction work is to be performed within the existing or proposed public right- of-way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 6. All construction within the existing or proposed public right-of-way is to be completed prior to filing each final plat, or a bond in the amount estimated by the County Engineer to cover the cost of construcrion of improvements, construction certification, "as-built" plans and monumenting the street centerlines shall be filed with the County Engineer. 7. Individual driveway access permits are req.uired prior to issuance of a building pernut for driveway approaches to the county road system. 8. Existing county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 9. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 10. The County Engineer has designated Typical Roadway Section Number One, Loca1 Access standard for the improvement of 28th Avenue, which is adjacent to the proposed development. The construction of sidewalk is also required. 11. The County Engineer has designated Typical Roadway Section Number One, Local Access standard for the improvement of Guthrie Drive, which is adjacent to the proposed development. The construcrion of sidewalk is also required. 12. The proposed private road(s) as shown on the preliminary plat serving 4 lots with no extension possible is approved by the County Engineer. FINDINGS AND DECISION SP-772-92 Page 4 13. Private road shall be improveci to Spokane Counry sta.ndard for a private road Urban/Suburban standard serving 4 lots, and are subject to approval under Section 10.207 of the Spokane County Fire Code. 14. All vested owners shall sign and record private road documents as prescribed by the Spokane County Engineer. These documents shall be reviewed and approved by the Spokane County Engineer prior to recording with the Spokane County Auditor. Recording numbers shall be referenced in the dedicatory language of the plat. 15. The followi.ng statement shall be placed in the plat dedicarion: "WARNING: 'Spokane County has no responsibiliry to build, improve, maintain or otherwise service the private roads contained within or provide service to the property described in this plat. By accepting this plat or subsequently by allowing a building pernut to be issued on property on a private road, Spokane County assumes no obligation for said private road, and the owners hereby acknowledge that the County has no obligation of any kind or nature whatsoever to establish, exainine, survey, construct, alter, repaix, improve, xnaintain or provide drainage or snow removal on a private road. This requirement is and shall run with the land and shall be binding upon the owner(s), theix heirs, successors or assigns, including the obligation to participate in the maintenance of the private road as provided herein." 16. The proposed subdivision shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 17. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of additional right-of-way and the roadway improvements herein specified. 18. The following statement shall be placed in the final plat dedication: "The private road as shown hereon is an easement which provides a means of ingress and egress for those lots within the subdivision having frontage thereon." 19. There may exist utilities, either underground or overhead, affecring the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regard.ing these utilities. Applicant(s) should check with the applicable utility purveyor . and the Spokane County Engineer to determine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 20. The applicant shall construct a cul-de-sac or acceptable turn around approved by the applicable Fire District at the terminus of the private road. 21. Highway 27, adjacent to this proposal, is a State facility. Any access or required improvements to this road shall be reviewed and approved by the Washington State Deparnnent of Transportation. COUNTY HEALTH DISTRICT CONDITXONS 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Planning Department to the utility companies, Spokane County Engineer and the Spokane Counry Health District. Written approval of the easements by the utility companies must be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Ualzties, Spokane County. 5. Prior to filing the final plat, the sponsor shall demonstrate to the satisfacrion of the Spokane County Health District that an adequate and potable water supply is available to each tract of the plat. 7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 8. A public sewer system will 'oe rnade available for the plat/project, and individual service will be provided to each lot/tract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized. 9. A statement shall be placed in the dedication to the effect that: "A public sewer system will be made avai]able for the plat, and individual service will be provided to each lot/tract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized." 10. The dedicatory language on the plat shall state: "Use of private wells and water systems xs prohibited." 11. The plat dedication will contain a statement to the effect that: "The public water system, as approved by county and state health authorities, the local fire district and purveyor, will be installed within this plat, and the subdivider will provi.de for individual domesric water service as well as fire protection to each lot/tract prior to sale of each lot/tract." COUNTY UTILITIES DEPARTMENT CONDITIONS 1. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 2. Applicant shall make connection to public sewer system. Sewer connection permit is required. Plans and specifications are to be reviewed and approved by the Utilities Department. As you probably know, the plat sponsor, Carl Moore, has recently built a 4-unit apartment on Parcel "A" and has submitted a request for a building permit on Parcel "B". Since perimeter streets serving this proposal are existing with drainage improvements completed, we would like to propose that the building permit applications and plans meet the preliminary plat conditions requiring drainage plans and design calculations. I have shown drainage easements on Parcel "C" as shown on the building permit plans for Parcel "B" and included some proposed language concerning these easements in the plat dedication. Any drainage easements required for drainage from Parcel "C" could be created by separate documents. Sidewalks have already been constructed alonq the south side of 28th Avenue and northerly 100 feet of the east side of Guthrie Avenue, as required by the building permit for Parcel "A". We would like to propose that the plat dedication include some language requiring construction of sidewalks along Guthrie Avenue and let the building permit process enforce the provision.
