DECISION THIS MATTER, an application for subd.ivision of land, from Bobbie Swanson has been received and decided upon, pursuant to Spokane County Subdivision regulations, on the ~.~C~'*_Iday of July, 1992. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane Counry Director of Planning. 2. The proposal is to divide approximately 1.12 acres ulto 21ots for the development of single family dwellings. 3. The proposal is located south of and adjacent to 12th Avenue approximately 400 feet west of Adams Road, in Section 23, Township 25 North, Range 44 EWM, Spokane County, Washington. 4. The current zoning of the property is Urban Residential-3.5 (UR-3.5) The proposed lot sizes, frontage and intended uses are allowed within this zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category. 6. The requued public notice was provided for this proposal and agencies having a potential interest in the project were noaf'ied and recommendations solicited. 7. No one in the area commented on the proposal. 8. Recognizing the recommended condirions and Spokane County development standards, the proposed subdivision makes appropriate provisions for the public health, safety and . general welfare and that the public use and interest will be served by platting the subdivision. 9. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-774-92 is hereby APPROVED until August 1, 1995, subject to conditions noted , below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest to property. PLANNING DEPARTMENT CONDITIONS 1. The preliminary plat of record approval is for the property legally described in the application for this proposal. 2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) and Aquifer Sensitive Area (ASA) zone(s) as amended. • FZNDINGS AND DECISION SP-774-92 Page 2 3. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application subnuttal and approval. 4. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 5. Appropriate road name(s) shall be indicated. 6. The preliminary plat is given conditional approval for three (3) years, specifically to August 1, 1995. The applicant may request an extension of time by submitting a written request approxi.mately forty-five (45) days prior to the above expiration date. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies shall be receiveri with the submittal of the final plat. 8. Three (3) current certificates of ritle shall be furnished to the Planning DeparmZent prior to filing the final plat. 9. The final plat map shall indi.cate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedicarion shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 10. No water plan is required, and a simple tap is needed at the time of building pennit release. 11. A survey is required prior to the filing of a final plat. COUNTY ENGINEER'S DEPARTMENT CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approvdl of the road system as indicated in the preliminary plat of record. 2. No consh-uction work is to be performed within the exisbing or proposed public right- of-way until a pernut has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 3. Individual driveway access permits are required prior to issuance of a building pernut for driveway approaches to the county road system. 4. Dedication of 10 feet of additional right-of-way along 12th Avenue is required. 5. Existing county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 6. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 7. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Ymprovement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required. (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to 12th Avenue. 8. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sancrioned by Spokane County, the ~ . . FINI)INGS AND DECISION SP-774-92 Page 3 improvements requu-ed (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to 12th Avenue. 9. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a perition for the formation of a Road Improvement_District (RID) by the petition method pursuant to Chapter 36.88 RCW, which perition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is formed by either the petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement(s) ox construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the formarion of the RID by the property _ included therein, together with the amount of any County participation, - exceed the cost and expense of formation of the R.ID; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the unprovements called for in conjunction with the formation of an RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners aff'irming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to Spokane County the then estimated cost of the required improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement) providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to 12th Avenue. 10. The County Engineer has designated TypicaJ. Roadway Secrion Number Two, Local Access standard for the improvement of 12th Avenue, which is adjacent to the proposed development. This will reqture the addition of approximately 8- 10 feet of asphalt along the frontage of the development. The construction of curbing is also required. 11. The proposed subdivision shall be improved to the standards set forth in Spokane County Board of Connmissioners Resolurion No. 80-1592, as amended, which resolution establishes regulations for roads, approaches,. drainage and fees in new construction. 12. The County Engineer has examined this development proposal and has deternuned that the impact of this proposal upon the existing county road system warrants the dedication of additional right-of-way and the roadway improvements herein specified. 13.
