The following "Conditions of Approval" for the above referenced zone
change are submitted to the Spokane County Hearing Examiner Committee
for inclusion in the "Planning Report" and "Findings and Order" of
the public hearing scheduled Auqust 22, 1991.
Prior to issuance of a building permit or at the request of the
County Engineer in conjunction with a County.Road Project/Road
Improvement District, whichever action comes first:
E36 Applicant shall dedicate 2 feet on Bowdish Road for right of way
purposes.
Prior to release of a building permit or use of the property as
proposed:
E40 Access permits for approaches to the County Road System shall be
obtained from the County Engineer.
E93 Applicant shall submit for approval by the Spokane County
Engineer road, drainage and access plans.
E94 The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface wa ter disposal
plan for the entize project or portion thereof if the
development is phased.
E45 A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design,
location and arrangement of parking stalls shall be in
accordance with standard engineering practices. Pa ving or

The Company, recognizing the current effect of inflation on real property valuation and intending to provide
additional monetary protection to the insured owner named in the policy, hereby modifies the policy, as follows:
1. Notwithstanding anything contained in the policy to the contrary, the amount of insurance provided by
t6e policy, as stated in Schedule A thereof, is subject to cumulative annual upward adjustments in the
manner and to the extent hereinafter specified.
2. "Adjustment date" is defined, for the purpose of this endorsement, to be 12:01 a.m. on the first January
1 which occurs more than six months after the date of policy, as showa in Schedule A of the policy to
which this endorsement is attached, and on each succeeding January 1.
3. An upward adjustment will be made on each of the adjustment dates, as deElned above, by increasing
the maximum amount of insurance provided by the policy. The coverage will increase by the same
percentage change by which the annual "ENR-20-cities Building Cost Indek" has increased, (as published
in the "4th Quarter Roundup" December issue of Engineering News Record, a weekly McGraw Hill
publication). All upward adjustments in the aggregate shall not exceed a 50% total rise in the amount
of insurance, so that the ma3dmum amount of insurance in force shall never exceed 150% of the amount
of insurance stated in Schedule A of the policy, less the amount of any claim paid under the policy
which, under the terms of the conditions and stipulations, reduces the amount of insurance in force.
There shall be no annual adjustment in the amount of insurance for years in which there is no iacxease
in the Buildi.ng Cost Index.
4. In the settlement of any claim against the Company under the policy, the amount of insurance in force
shall be deemed to be the amount which is in force as of the date on which the insured claimant first
learned of the assertion or possible assertion of the claim, or as of the date of receipt by the Company
of the 5rst notice of the claim, whichever shall fust occur.
Nothing herein contained shall be construed as extending or cbanging the effective date of the golicy.
- This endorsement is made a part of the policy and is subject to the schedules, exclusions, conditions and
sdpulations therein, except as modified by the provisions hereof.

BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-780-92 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subd.ivision of land, from Ted Arnold has been received
and decided upon, pursuant to Spokane County Subdivision regularions, on the
day of August, 1992. FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 11,700 square feet into two lots for a divided
duplex and those uses pernutted in the underlying zone.
3. The proposal is located south of and adjacent to 24th Avenue and approximately 114 feet
west of Bowd.ish Road in the SW 1/4 of Secrion 28, Township 25 North, Range 44
E.W.M. Spokane County, Washington.
4. The current zoning of the property is Urban Residential-7 (UR-7). The proposed lot
sizes, frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban The
development and uses proposed are generally in accord with this category.
6. Surrounding uses are primarily a mix of duplexes and single family residences.
7. The required public notice was provided for this proposal and agencies having a potenrial .
interest in the project were notified and recommendations solicited.
8. No comments were received from any adjoining property owners.
9. Recognizing the recommended condirions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The Spokane County Arterial Road Plan designates 24th Avenue as a Collector Arterial.
The exisring width of 70 feet is adequate to satisfy the Plan.
11. The proposed short plat will be served by a public water system. Connecrion to the
county-wide sewer is required.
12. Divided duplex lots are authorized under Chapter 14.818 of the Spokane County Zoning
Code.
13. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-780-92 is hereby APPROVED until September 1, 1995, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.

PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with the Urban Residential-7 (UR-7) zone(s) as amended
and Chapter 14.818 of the Spokane County Zoning Code for divided duplex lots.
Minimum lot sizes for duplex units shail be 11,000 square feet with each lot of a
divided duplex having a minimum of 5,500 square feet.
3. The final plat shall be designed substantially i.n conforrnance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condirion application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
September 1,1995. The applicant may request an extension of time by submitting a
written request approximately forry-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be furnished to the Planning Departrnent prior
to filing the final plat.
9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
10. No water plan is required, and a simple tap is needed at the time of building pennit
release.
11. A survey is required prior to the filing of a final plat.
12. The final plat dedication shall include: "No detached single-family dwellings or manufactured homes are allowed on any lot.
All tracts with any lot line designated Center Duplex Lot Line shall be restricted to one
common-wall dwelling unit (one-half [1/2] duplex), provided the duplex common wall
is aligned over or with the Center Duplex Lot Line, and provided that each duplex unit
(hal fl is totally on its side the of center lot line when said lot line is extended vertically
beyond the roof line."
13. The final plat is to identify the duplex common-wall lot line as center duplex lot line,
and the line is to be drafted as a continuous "dash-dot-dash."

COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
deciication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.

2. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. .
3. Individual driveway access permits are required prior to issuance of a build.ing permit
for driveway approaches to the county road system.
4. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
5. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
6. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regularions for roads, approaches, drainage and fees in new
construction.
7. There may exist urilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make an-angements for any
necessary work.
8. The applicant shall comply with all conditions of approval applicable to these parcels of
•ZE-31-91, an approved zone change.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the prelimuiary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health DistricG Written approval of the
easements by the utility companies rrlust be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, 5pokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. A public sewer system will be made available for the plat/project, and individual service
will be provided to each tract prior to sale. Use of individual on-site sewage disposal
systems shall not be authorized.
9. A statement shall be placed in the dedication to the effect that: "A public sewer system
will be made available for the plat, and individual service will be provided to each tract
prior to sale. Use of individual on-site sewage disposal systems shall not be
authorized."
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."

11. The plat dedication will contain a statement to the effect that: "The public water system,
pursuant to the Water Plan approved by county and state health authorities, the local fire
district, County Building and Safety Department and water purveyor, shall be installed
within this plat, and the subdivider shall provide for individual domestic water service
as well as fire protection to each tract prior to sale of each tract and prior to issuance of
a building pernut for each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Applicant shall make corinection to public sewer system. Sewer connection pemut is
requ.ired. Plans and specifications are to be reviewed and approved by the Utilities
Department.
2. Ind.ividual service should be provided to each lot, but if a single stub is to be shared, a
maintenance agreement must be approved by the County.
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Applicant shall contact the Department of Buildings for Building Code requirements.
Fire rated wall assembly is required between units. Structural mod.ificarions may be
necessary.
