1) Drainage easements, as platted and shown hereon, which are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities to dispose of runoff, are hereby
granteri. The County of Spokane is hereby granted the right of ingress and egress to all drainage
easements adjacent to the public right of way. The property owner shall,maintain die drainage
swale with a permanent live cover of lawn turf, with optional shrubbery and/or trees, which do
not obstruct the flow and percolation of storm drainage water in the drainage swale as indicated
by the approved plans.
2) The owners of Lots & , of Dlock , and Lots
, , & , of Block , shall be held responsible for
keeping open and maintaining the path of the natural or man-made drainage flow over and across
the property.
3) The property owner or his representative shall inform each succeeding purchaser of all drainage
easements on the property and his responsibility for maintaining drainage facilities within said
easements. '
4) Spokane County does not accept the responsibility of maintaining the drainage course on private
lots wichin drainage easements or floodplain areas, nor the responsibility for any drainage,
whatsoever, including but not limited to inverse condemnation to any properties due to deficient
constructian andlor maintenance of drainage courses in drainage easements on private property.
• ) The lowest building opening, including basement opening, for any building on Lot;(_A ,
am fttuck shall be high enough to allow a minimum slope of 3%
away from the building in 10 feet. AU drainage shall be routed away from the building to natural
drainages or other lawful drainage features.
6) Development within this subdivision shall conform to the requirements of the National Flood
Insurance Program and Chapter 3.20 of the Spokane County Code. The lowest floor, including
basement floor, for any structure shall be constructed according to the requirements of the
Spokane County Flood Zone regulations in effect at the time a building permit is issued. Purchasers of property in this subdivision are warned of possible flooding or ponding and the
potential requirement to purchase Flood Insurance. This warning shall be carried in each and
every deed drawn to transfer ownership of any and all property within this plat in the Area of
Special Flood Hazard.
7) An approved lot grading plan exists for Lots and

Grading must conform to said plan on file in the County Engineer's Office.
8) Spokane County shall not be responsible to maintain ingress or egress across the flood plain area.
9) The owner(s) or successor(s) in interest agree to join in any County approved Stormwater
Managernent Program and to pay such rates anci charges as may be fixed through public hearings
for service or benefit obtained by the planning, design, constructing, maintaining, or operation
of stormwater control facilities.
10) A statement must appear in the dedicatory language of the plat that individual driveway access
permits be required prior to issuance of a building permit for driveway approaches to the County
road systern. This approach shall be constructed in accordance with the approved plan on file
in the County Engineer's office.

That the individuals and parties named herein as having an interest in the above described properry or
project agree to the following:
1. Reimburse Spokane County for project review and inspection fees as specified in
- Chapter 9.14 of the Spokane County Code. The fees will bc based on actual salary
costs incurred by Spokane County for project reviews and / or inspections plus a ten
percent administrative charge, and will he billed monthly as accrued. Any final
bilting amounts, to include any late fees or any other expenses incurred in the collection of an overdue account must be paid prior to the County's acceptance of
the project for filing.
2. The undersigned agrees that these fees are due and payable upon receipt of the
billing as specified above.
3. Any invoices not paid within 30 days of the invoice date will be subjected to a late
fee charge of 1% per month (12% per year) on the unpaid balance of the account
and any accrued late fee charges. In addition, if any outstanding balance on the
account for this project is not paid within 30 days of the invoice date, no further
reviews of the project documents will be conducted until the entire account balance
is paid. Any balance on the account for this project not paid within 65 days of the
invoice date may result in legal action or the initation of other collection procedures,
including referral to a collection agency. 1'he Sponsor will be liable for any and all
expenses incurred by the County for the collection of overdue accounts.

SHORT PLAT NO. SP-784-92 ) CONCLUSIONS AND
DECISION
'Z'HIS MATTER, an application for subdivision of land, from Verona Southern has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the
day of October, 1992.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 1 acre i.nto two (2) lots for residential uses and
those uses permitted in the underlying zone.
3. The proposal is located north of and adjacent to Sprague Avenue and approximately 650
feet west of Barker Road in Section 18, Township 25 North, Range 45 E.W.M.,
Spokane County, Washington.
4. The current zoning of the property is Urban Residential-3.5 (UR-3.5). The proposed lot
sizes, frontage and intended uses are allowed within this zone. The Urban Residential-3.5
zone does allow duplexes for lots which are twice the minimum lot size required for single
family units, or 20,000 square feet.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. Surrounding uses are prirnarily single family residences. There is also industrial uses
located to the northwest of the site.
7. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notif"ied and recommendarions solicited.
8. Two letters were received from property owners who requested that this site be
developed for single family residences only.
9. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisxons for the public health, safery and
general welfare and that the public use and interest wi.ll be served by platting the
subdivision.
10. Sprague Avenue is a Minor Arterial street with an existing width of 60 feet and a planned
width of 80 feet. The County Engineer has requested dedicarion of an additional2 feet of ,
right-of -way and 8 feet to be set aside for Future Acquisition adjacent to Sprague
Avenlle.
11. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Unlities.
12. Lot A of this short plat has 30 feet of road frontage whereas the Spokane County Zoning
Code section 14.616.315 requires 80 feet of road frontage in the UR-3.5 zone.
13. Prior to finalization of this short plat, the applicant is required to receive approval of an
Administrative Exception for Lot A pursuant to the Spokane County Zoning Code
Section 14.506.020 (#7) for having less than the requued amount of road fronta.ge in the
UR-3.5 zone.
14. The project is exempt from environmental review under the State Environmental Policy •
Act pursuant to WAC 197-11-800 (6) (a).

DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-784-92 is hereby APPROVED until November 1, 1995, subject to conditions noted
below. Most of the cond.irions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
,
1. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. Prior to finalizarion of this short plat, the applicant is required to receive approval of an
Administrative Exception for Lot A pursuant to the Spokane County Zoning Code
Section 14.506.020 (#7) for having less than the required amount of road frontage in
the UR-3.5 zone.
3. The proposal shall comply with the Urban Residential 3.5 (UR-3.5) zone as amended.
4. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
5. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
6. Appropriate road name(s) shall be indicated.
7. The preliminary plat is given conditional approval for three (3) years, specifically to
November 1, 1995. The applicant may request an extension of time by submitting a
written request approxunately forry-five (45) days prior to the above expirarion da.te.
8. Appropriate uti.lity easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
9. Three (3) current certificates of title shall be furnished to the Planning Depamnent prior
to filing the final plat.
10. The Spokane County Planning Department shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way •
and utilities. The reserved future acquisition area Title Notice shall be released, in full .
or in part, by the Planning Department. The notice should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 8 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Sprague Avenue. NOTE: The County Engineer has required 2 feet of new
dedication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisirion area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. If
any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,

parldng, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area. 11. The final plat map shall indicate by a cleaz, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building pernuts are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
12. A plan for water facilities adequate for domestic service and fire pratection shall be
approved by the water purveyor, appropriate fire protection district, County Building
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor. ,
13. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for consm.iction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
hannless from claims by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to sarisfactorily complete the approved water system.
14. The final plat dedication shal.l contain the following statement: "1'he public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, Counry Building & Safety
, Department and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for ind.ividual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building pelmit for each lot."
15. No building permit will be issued for any lot within the final plat until certified by a
Washin,gton state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
16. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protecrion d.istrict sta.ting that simple connections to
an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general welfare. ~
17. A survey is required prior to the filing of a final plat.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record. *
2. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
.
3. Individual driveway access permits are re,quired prior to issuance of a building permit
for driveway approaches to the county road system.
4. Dedication of 2 feet of additional right-of-way along Sprague Avenue is required.

5. Existing county roads providing direct access to the plat shall be paved andJor curbed to
Spokane County standards.
6. Sidewalks are required along the arterial(s) on Sprague Avenue. 7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
8. To construct the road unprovements sta.ted herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Sprague Avenue.
9. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CR.P) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the improvements required. (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. T'his provision is applicable to Sprague Avenue.
10. T'he following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the fornaation of a Road Improvement District (RID) by the
petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)'
property, and further not to object, by the signing of a ballot, to the formation of an
RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution
includes the owner(s)' property. If an RID is formed by either the perition or resolution
method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the fonnation of the RID by the property
included therein, together with the amount of any County participarion, exceed the
cost and expense of formation of the RID; and .
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the property
as a result of the improvements called for in conjunction with the fonnation of an
RID by either petirion or resolution method under Chapter 36.88 RCW, and to •
appeal to the Superior Court the decision of the Board of County Commissioners
affinning the final assessment roll.
It is further agreed that at such ti.me as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole expense
of the undersigned owner(s), their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from
the date of execurion below. However, the owner(s) or successor(s) agree that if
said RID waiver expires without construction of the required improvements, the
. owner(s) or successor(s) agree to construct the required improvements at their
own expense, pay to Spokane Counry the then esrimated cost of the required
improvements to enable the County to complete the same, or fumish a bond or r
other secure method suitable to the County (which may include the execution of
another RID waiver agreement) providing for or securing to the County the actual
construction of the improvements.

All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision is
applicable to Sprague Avenue.
11. The County Engineer has designated Typical Roadway Section Number Two, Minor
Arterial standard for the improvement of Sprague Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 12 - 14 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required.
12. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
zesolution establishes regularions for roads, approaches, drainage and fees in new
construction.
13. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
ded.ication of additional right-of-way and the roadway improvements herein specif'ied.
14. The County Arterial Road Plan idenrifies Sprague Avenue as a Minor arterial. The
existing right-of-way width of 60 feet is not consistent with that specif'ied in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way •
dedicarion, a strip of property 8 feet in width along the Sprague Avenue frontage shall
be set aside in reserve. This properry may be acquired by Spokane County at the ti.rne
when arterial i.mprovements are made to Sprague Avenue.
15. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane Counry assumes no financial obligation for adjustments or relocation
regarding these utiliries. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
16. Access to Lots A and B shall be considered driveways provided that they serve one lot
only.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Deparmnent to the utility companies, Spokane
County Engineer and the Spokane County Hea.lth District. Written approval of the ,
easements by the utility companies must be received prior to the submittal of the final
plat.
3. A combined surface water and sewage disposal detailed plan shall be approved by the ~
Spokane Counry Engineer and the Spokane County Health District prior to the issuance
of any on-site sewage disposal permit or building permit for this project.
4. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
5. Water sernice shall be coordinated through the Director of Utilities, Spokane County
6. Water service shall be by an existing public water supply when approved by the
. Regional Engineer (Spokane), State Department of Health.
7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.

8. Disposal of sewage effluent beneath paved surfaces is currently prohibited.

9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that a suitable site for on-site sewage disposal system
is available on tract A.
10. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane Counry Health District that the existing on-site sewage disposal system
serving the residence located on tract B is wholly located within the boundaries of the
tract.
11. Subject to specific applicarion approval and issuance of pernuts by the health officer,
the use of individual on-site sewage d.isposal systems may be authorized.
12. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of pemuts by the Health Officer, the use of individual on-site sewage .
systems may be authorized."
13. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
14. The plat dedication shall contain a statement to the effect that: "The public water
system, pursuant to the Water plan approved by county and state health authorities, the
local fire district, County Building and Safety Department and water purveyor, shall be
installed within this plat, and the applicant shall provide for individual domestic water
service as well as fire protection to each tract prior to sale of each tract and prior to
'issuance of a building permit for each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. "The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formarion of ULID by petition method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition aga.inst the formation of a tJLID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction -
with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. "Each new dwelling unit shall be double-plumbed for connecrion to future areawide
collection systems." ~
BUILDING AND SAFETYDEPARTMENT CONDITIONS
1. Requirements of Fiz-e District No. 1 need to be satisfied during the builcli.ng permit
process.
2. Proposed east property line of Lot B may effect the need for a fire resistive exterior wall
for the garage. The applicant should contact the Deparnnent of Buildings for a
determination.
