West, Jr., has been received and decided upon, pursuant to Spokane County Subdivision regulations, on the 4Q-t'~7 day of November, 1992. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Di.rector of Planning. 2. The proposal is to divide approximately 1/2 acre into two (2) lots for one existing residence and one new residence and those uses pernutted in the underlying zone. 3. The proposed lot area for "Lot B" is not consistent with the minimum requirements of the zone. The applicant has submitted a concurrent applicarion for aii Administrative Exceprion (AEE- 108-92) for lot frontage (Section 14.506.020 (7)) which will be reviewed and may be approved by the Department. 5. The Spokane County Coniprehensive Plan designates this area as Urban. The development and uses proposed are genera.lly in accord with this category. 6. Surrounding uses are primarily single family residences. 7. The required public notice was provided for this proposal and agencies having a potential interest in the project were norified and recommendations solicited. 8. No comments were received from any adjoining property owners. 9. Recognizing the reconzmended conditions and Spokane County development standards, the proposed subdivision makes appropriate provisions for the public healdl, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regtilations, promoting the public'health, safety and general welfare in accordance with standards established by the state and Spokane County. The proposal as condiaoned does provide adequate public facilities as cited in RCW 58.17.110 (2). Broadway Avenue is designated as a Principal Arterial with an existing width of 55 feet and a proposed width of 100 feet. The County Engineer has requested dedication of an . additional 10 feet of right-of -way and a 15 foot reserve strip designated as a Future Acquisition Area on Broadway Avenue. Springfield Avenue provides access along the proposal's south property line and is designated ds a Loc:al Access Street. The County Engineer has not request additional dedication along Springfield Avenue. 11. The proposed short plat will be served by a public water system. The water purveyor has indicated on the application that a water plan is not required 12. Connection to public sewer is required. 13. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-787-92 is hereby APPROVED until DECember 1, 1995, subject to conditions noted below. The County Engineer has designated Typical Roadway Section Number Two, Local Access standard for the improvement of Springfield Avenue, which is adjacent to the proposed development. The proposed subdivision shall be improved ta the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regularions for roads, approaches, drainage and fees in new . construction. 12. The Counry Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedicaaon of additional right-of-way and the roadway improvements herein specified. 13. The County Arterial Road Plan identifies Broadway Avenue as a Principle arterial. The existing right-of-way width of 55 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way , dedication, a strip of property 15 feet in width along the Broadway Avenue frontage shall be set aside in reserve. This property may be acquired by Sgokane County at the time when arterial improvements are made to Broadway Avenue. _ 14. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocarion regarding these urilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to determine whether applicant(s) or the utility is responsible for ad}ustment or relocation costs and to make arrangements for any necessary work. COUNTY HEALTH DISTRICT CONDITIONS 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted. 2. If The final short plat solution is to allow 1 lot to be 10,000 square feet (the legal minimum lot size), the remainder lot would be 9,248 square feet, a substandard lot. Such a lot size would require approval through the formal variance process, which the applicant may opt to do prior to filing the final short plat. Alternatively, this Administrative Exception approval recognizes that a 5% reduction in minimum lot size to 9,500 square feet, is acceptable to be achieved at the delineation and filing of the final plat. OFFICE OF THE COUNTY ENGINEER Spokane County, Washington January 20, 1994 MEMORANDUM TO: FROM: Development Engineering Services RE: Standard Drainage Language for Plat Dedication Project # 1) Drainage easements, as platted and shown hereon, which are for the purpose of installing, operating aud maintaiuing drainage swales aud drainage facilities, as conditions of plat approval, are hereby granted to the public. 2) The property owners wittun tlus Plat shall be held responsible for keeping open and niaincaining the surface patli of natural or man-made drainage flow over and across their respective properties. 3) The property owners witlun this Plat shall maintain the drainage swale witli a permauent live cover of lawn turf, with optional shrubbery and/or trees, which do not obstruct the flow and percolation of storm drainage water in the drainage swale, as indicated by the current approved plans on file with the County Engineer's Office. 4) The property owner or lvs representative shall inform each succeeding purchaser of all draiuage easements ou the property and of lvs responsibility for maintaining surface drainage paths and swales within said easements. 5) Spokane County does not accept the responsibility of maintaining the drainage course oll private lots within drainage easewents or floodplain areas, nor tlie respoasibility for any damage, whatsoever, including, but not limited to, inverse condenuiation to auy properties due to deficient construction and or maintenance of drainage courses in drainage easemeuts on private property. 6) Spokane County and its autliorized agents are hereby granted the right of ingress and egress to, over, and from saici easemeots for the purpose of inspection and emergency maintenance of drainage swales and other drainage facilities, if not properly maintained by the property owner. Spokaue County does not accept the responsibility to inspect or maintain the drainage easements or drainage swales, nor does the County accept any liability for any failure by the lot owner(s) to properly maintain such areas. 7) If the property owner fails to maintain the surface padi of tiatural or maii-made drainage flow, or the drainage swale, a notice of such failure may be given to tlie property owner. If not corrected within the period indicated on said notice, Spokane County has the right to conect the maintenance failure, or have it corrected, at the experise of the property owner.
