THIS MATTER, wl application for subdivision of land, from Le Roy F. West, Jr., has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the
4Q-t'~7 day of November, 1992. FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Di.rector of Planning.
2. The proposal is to divide approximately 1/2 acre into two (2) lots for one existing
residence and one new residence and those uses pernutted in the underlying zone.
3. The proposal is located between Springfield and Broadway Avenues approximately 350 feet west of McDonald Road in the SW 1/4 of Section 15, Township 25 North, Range 44
E.W.M. Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5) and redesxgnated in 1991 under the County's Program to Zmplement the Zoning
Code from Agricultural Suburban (AS)( file number ZE-99-55). Pursuant to RCW ,
58.17.195 the proposal generally confornis to the requirements of the existing zone but
must provide adjustment as noted below.
The proposed lot area for "Lot B" is not consistent with the minimum requirements of the
zone. The lot line s ' g Lots A and B will need to be adjusted northward to adjust
each lot area to th 1.0,000 quare foot minimum. Any proposed parcels less than the
minimum area requ' ay be administratively adjusted pursuant to the procedures .
stated in Section 14.506.020 (4) for a S% maximum lot area adjustment.
The proposed lot frontages on Broadway and Springfield Avenues do not meet the
minimum $0 foot frontage requirement however, the existing parcel established under the
previous Agricultural Suburban (AS) zone only required 65 feet of road frontage. The applicant has submitted a concurrent applicarion for aii Administrative Exceprion (AEE-
108-92) for lot frontage (Section 14.506.020 (7)) which will be reviewed and may be
approved by the Department.
5. The Spokane County Coniprehensive Plan designates this area as Urban. The
development and uses proposed are genera.lly in accord with this category.
6. Surrounding uses are primarily single family residences.
7. The required public notice was provided for this proposal and agencies having a potential
interest in the project were norified and recommendations solicited.
8. No comments were received from any adjoining property owners.
9. Recognizing the reconzmended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public healdl, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regtilations, promoting the public'health, safety and general welfare in
accordance with standards established by the state and Spokane County. The proposal as
condiaoned does provide adequate public facilities as cited in RCW 58.17.110 (2). More .
specifically:

c. public and/or private rights-of-way
d . transit
e. potable water

i. schools and schoolgrounds j . sidewalks on arterials The above improvements are either existing facilities or will be provided by the applicant
upon finalizarion of this short subdivision as conditioned by the Committee and
implemented by the various County agencies.
10. Broadway Avenue is designated as a Principal Arterial with an existing width of 55 feet
and a proposed width of 100 feet. The County Engineer has requested dedication of an .
additional 10 feet of right-of -way and a 15 foot reserve strip designated as a Future
Acquisition Area on Broadway Avenue.
Springfield Avenue provides access along the proposal's south property line and is
designated ds a Loc:al Access Street. The County Engineer has not request additional
dedication along Springfield Avenue.
11. The proposed short plat will be served by a public water system. The water purveyor has
indicated on the application that a water plan is not required
12. Connection to public sewer is required.
13. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-787-92 is hereby APPROVED until DECember 1, 1995, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subd.ivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest ta property.
PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department sha11 be binding on the "Applicant", which term shall incltide the owner or owners of the property, heirs,
assigns and successors.

2. The proposal sha11 comply with the Urban Residenrial-3.5 (UR-3.5) zone as amended.
3. The final plat shall be designed substantially in conforniance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
conciition application submittc-d and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance witll these Fi.ndings and Conditions of Approval.
5. flppropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
December 1, 1995. The applicant may request an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiratio►i date.
7. Appropriate urility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate uti.liry companies shall be received
with the submittal of the final plat.

be located within the future acquisition area for road right-of-way and utilities. If -

created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Springfield Avenue. 8. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such rime as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to exisring
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Springfield Avenue.
9. The following statement shall be placed.in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petirion for the formation of a Road Improvement District
(RID) by the petirion method pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter ' °
36.88 RCW, which resolution includes the owner(s)' property. If an RID is
formed by either the petirion or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed
RID is feasible; (b) that the benefits to be derived from the formadon of the RID by the property
included therein, together with the amount of any County participarion,
exceed the cost and expense of formadon of the RID; and (c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the
formaaon of an RID by either petition or resolution method under Chapter '
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said RID waiver expires without constr-ucrion of the required
improvements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County the then
estimated cost of the required im.provements to enable the County to
complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement)
providing for or securing to the County the actual construcrion of the
improvements.
All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to Springfield Avenue.
10. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the improvement of Springfield Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 30 feet of
asphalt along the frontage of the development. The consmiction of curbing is also .
required.

11. The proposed subdivision shall be improved ta the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regularions for roads, approaches, drainage and fees in new . construction.
12. The Counry Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedicaaon of additional right-of-way and the roadway improvements herein specified.
13. The County Arterial Road Plan identifies Broadway Avenue as a Principle arterial. The
existing right-of-way width of 55 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way ,
dedication, a strip of property 15 feet in width along the Broadway Avenue frontage
shall be set aside in reserve. This property may be acquired by Sgokane County at the
time when arterial improvements are made to Broadway Avenue. _
14. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocarion
regarding these urilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant(s) or the utility is
responsible for ad}ustment or relocation costs and to make arrangements for any necessary work.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utiliry companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat. .
3. Sewage disposal method sha11 be as authorized by the Director of Utilities, Spokane
County. ,
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply system when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. A public sewer system will be made available for the plat, and individual service will be
provided to each lot prior to sale. Use of individual on-site sewage disposal systems
shall not be authorized. _
9. A statement shall be placed in the dedication to the effect that: "A public sewer system
will be made available for the plat, and individual service will be provided to each lot
prior to sale. Use of individual on-site sewage disposal systems shall not be
authorized." '
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."

as approved by county and state health authorities, the local fire district and purveyor,

residential use. The subject parcels have 74 feet of frontage on a public road; whereas,
section 14.616.315 of the Zoning Code for Spokane County requires 80 feet of frontage
in the UR-3.5 zone. Proposed lot "A" will have frontage (74 feet) on Broadway Avenue
and proposed lot "B" will have frontage (74 feet) on Springfield Road.
3. This property is generally located between Springfield Road and Broadway
Avenue approximately 350 feet west of McDonald Road in the SW 1/4 of Section 15 ,
Township 25 N, Range 44 EWM, Spokane County, Washington.
4. The current zoning of the property is UR-3.5; which zone has a minimum
lot size of 10,000 square feet. The preliminary short plat identifies the entire parcel
as having 19,988 square feet at the present time, prior to any right of way dedications
on Broadway. With an estimated 740 square feet of right of way dedication on ihe
Broadway Avenue frontage, the residual parent parcel is approximately 19,248 square
feet. If The final short plat solution is to allow 1 lot to be 10,000 square feet (the legal
minimum lot size), the remainder lot would be 9,248 square feet, a substandard lot.
Such a lot size would require approval through the formal variance process, which the
applicant may opt to do prior to filing the final short plat. Alternatively, this
Administrative Exception approval recognizes that a 5% reduction in minimum lot size
to 9,500 square feet, is acceptable to be achieved at the delineation and filing of the
final plat. That is, the appiicant may optionally create, pursuant to the authority
granted in this Adminisirative Exception, Lot A and Lot B at any size greater than 9,500
square feet. If either lot is drafted and sized below 9,500 square feet, the formal
variance process is required as stated above.
5. In compliance with RCW 36.70.450, the Planning Department has
determined that this proposal is generally consistent, as conditioned, with the Urban
category.

6. The project is exempt from the State Environmental Policy Act, pursuant
to WAC 197-1 1-800(6)(b).
DECISION
BASED UPON THE ABOVE Findings of Fact and Conclusions, the Administrative
Exception application is hereby APPROVED, as follows.
CONDITIONS OF APPROVAL
1. GENERAL
1. The following conditions shall apply to the applicant, owner and successors
in interest and shall run with the land.
2. Failure to comply with any of the conditions of approval contained in this
decision, except as may be relieved by the Planning Department, shall constitute a
violation of the Zoning Code of Spokane County and be subject to such enforcement as is
appropriate.
3. The Planning Department may administratively make minor adjustments
to site plans or the conditions of approval as may be judged to be within the context of
this approval.
II. PLANNING DEPARTMENT
1. This parcel shall not be further subdivided unless consistent with RCW
58.17, the county subdivision regulations, the Zoning Code and the Comprehensive Plan.
2. The final plat of SP-787-92 may be approved with 74 feet of lot width
frontage on both Broadway Avenue and Springfield.
3. Lots A and B, when delineated on the short plat document. may be as small
as 9,500 square feet, after Broadway Avenue right of way dedication. The Planning .
Department shall have discretion in the approval of the short plat to adjust lot sizes and
shapes, as long as the minimum lot size is 9,500 square feet.

MEMORANDUM
TO:

RE: Standard Drainage Language for Plat Dedication
Project #
1) Drainage easements, as platted and shown hereon, which are for the purpose of installing, operating aud
maintaiuing drainage swales aud drainage facilities, as conditions of plat approval, are hereby granted to
the public. 2) The property owners wittun tlus Plat shall be held responsible for keeping open and niaincaining the surface
patli of natural or man-made drainage flow over and across their respective properties.
3) The property owners witlun this Plat shall maintain the drainage swale witli a permauent live cover of lawn
turf, with optional shrubbery and/or trees, which do not obstruct the flow and percolation of storm drainage
water in the drainage swale, as indicated by the current approved plans on file with the County Engineer's
Office.
4) The property owner or lvs representative shall inform each succeeding purchaser of all draiuage easements
ou the property and of lvs responsibility for maintaining surface drainage paths and swales within said
easements.
5) Spokane County does not accept the responsibility of maintaining the drainage course oll private lots within
drainage easewents or floodplain areas, nor tlie respoasibility for any damage, whatsoever, including, but
not limited to, inverse condenuiation to auy properties due to deficient construction and or maintenance of
drainage courses in drainage easemeuts on private property.
6) Spokane County and its autliorized agents are hereby granted the right of ingress and egress to, over, and
from saici easemeots for the purpose of inspection and emergency maintenance of drainage swales and other
drainage facilities, if not properly maintained by the property owner. Spokaue County does not accept the
responsibility to inspect or maintain the drainage easements or drainage swales, nor does the County accept
any liability for any failure by the lot owner(s) to properly maintain such areas.
7) If the property owner fails to maintain the surface padi of tiatural or maii-made drainage flow, or the
drainage swale, a notice of such failure may be given to tlie property owner. If not corrected within the
period indicated on said notice, Spokane County has the right to conect the maintenance failure, or have
it corrected, at the experise of the property owner.
