Gentlemen:
As you have directed, a formal written easement has been acquired
from Vera Irrigation District No. 15, a municipal corporation,
authorizing use of 24th Lane as ingress, egress, and utility
installations for the property described in Short Plat No. 792-92.
The easement was recorded as Spokane County Auditor's Document No.
9306220604, Book 1446, page 1855. The description of 24th Lane is
described as follows:
The South 25.00 ft of the West 2676.00 ft of the North Half
of Section 25, T 25 N, R 44 E.W.M. lying East of the east
line of Vera Crest Drive.
The roadway section now constructed within this newly recorded
easement has existed for many years and serves as access for the
subject property and the adjacent Vera Irrigation water tank
property. Present Spokane County Road Standards for Urban/
Suburban Private Street Design, for streets serving 1 to 2 Lots,
require a minimum 12-ft wide gravel cross section, maximum 12%
grade, minimum 150-ft radius horizontal curves, and 20 m.p.h.
design speed.
I have inspected 24th Lane, and do hereby certify that to the best
of my knowledge and belief, the roadway as now constructed, and
used, satisfies the requirements and is acceptable under the
current Spokane County Road Standards for Private Roadways serving
1 to 2 lots.

EASEMENT AND MAINTENANCE AGREEMENT
This agreement made and entered into this LQ~"day of June,
1993 by VERA IRRIGATION DISTRICT NO. 15, a municipal corporation,
as grantor for and in consideration of the mutual benefits to the
parties, receipt of which are hereby acknowledged, granting to
CECIL CLEVELAND and BEVERLY A. CLEVELAND, husband and wife, their
successors and assigns, a non-exclusive easement over, upon and
across for purposes of ingress, egress, and the installation and
maintenance of telephone,, cable television, water and electric
utilities for the benefit of land known as Short Plat No. 792-2.
EASEMENT DESCRIPTION
This non-exclusive easement is for ingress, egress, the
utilities specifically indicatated above and the installation
thereof, being on, over and across that unplatted property on the
easterly extension of 24th Avenue, as more fully described:
The South 25.00 feet of the West 2676.00 feet of the
North half of Section 25, Township 25 North, Range 44,
E.W.M., lying East of the East line of Vera Crest Drive,
Spokane County, Washington.
MAINTENANCE OF EASEMENT
Maintenance of the easement area covered by this easement
shall be by the grantees described above. Neither VERA IRRIGATION
DISTRICT N0. 15 nor Spokane County shall have responsibility to
maintain or otherwise service the private road constructed hereon.
This Easement and Maintenance Agreement shall run with the
land and shall be binding upon the owners, their heirs, successors,
or assigns.
This Easement and Maintenance Agreement will terminate upon a
formal dedication and acceptance by Spokane County or its
successors should it occur that this road will be dedicated and
accepted as a public right of way.

SUBJECT: Standard Drainaee Language for the Dedication on cS P 7 9a
1) Drainage easements, as platted and shown hereon, which are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities to dispose of runoff, are hereby
granted. The County of Spokane is hereby granted the right of ingress and egress to all drainage
easements adjacent to ihe public right of way. The property owner shall maintain the drainage
swale with a permanent live cover of lawn turf, with optional shrubbery and/or trees, which do
not obstruct the flow and percolation of storm drainage water in the drainage swale as indicated
by the approved plans.
2) The owners of Lots & , of Block

keeping open and maintaining the path of the natural or man-made drainage flow over and across
the property. 3) The property owner or his representative shall inform each succeeding purchaser of all drainage

e The lowest building opening, including basement opening, for any building on bets ,

This letter will serve as my drainage report for Short Plat No.
792-92. This 2-acre site is located a East 16223 24th Avenue in
the North Half of Section 25-T25N-R44E.W.M. Tax Parcel No.
45255.9038.
The attached calculation sheet for the Runoff Coefficients for the
property, indicates no change in the total Storm Water Runoff for
this site.
CONCLUSION: The development of this property at the proposed
1-Dwelling Unit per Gross Acre creates no additional stormwater
runoff or additional hazard from this site.

THIS MATTER, an applicarion for subdivision of land, from Cecil Crawford has been
re~ ceived and decided upon, pursuant to Spokane County Subdivision regulations, on the
day of November, 1992.
FINDINGS UF FACT AND CONCLUSIONS
7. The individual signing below has furthcr beeci properly delegated the responsibility for
rendering the decision by t1e Spokane County Director of Planning.
2. The proposal is to divide approximately 2 acres into 2 lots for one existing single family
residence and one new single flmily residence along with those uses permitted in the
underlying zone.
3. The proposal is generally located north of and adjaceclt to 24th Avenue approximately 1/2
mile east of Sullivan Road in the NW 1/4 of Section 25, Township 25 North, Range 44
E.W.M., Spokane County, Washington.
4. The existing zoning of the property described in the application is Suburban Residential-1
(SR-1), previously established as Agricultural (1\) zoning in 1942 (ZE-60-42) and
reclassified to Suburban Residential-1 (SR-1) on January 1, 1991 pursuant to the
Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195
the proposal does confonn to the requirements of the existing Suburban Residential-1
(S R-1) zone. 5. The Spokane County Comprehensive Plan designates this area as Suburban. The
Suburban Category is primarily an area for low density residential development with lot
sizes ranging from 1/2 acre to 2 1/2 acres. The development and uses proposed are
generally in accord with this category.
6. Surrounding uses are primarily residential uses to the north and west, a water reservoir to
the east, and agricultural to the south.
7. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recon.-imendarions solicited.
8. No comments were received from any adjoining property owners.
9. Recognizing the recommended condiCions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health, safety
and general welfare and that the public use and interest will be served by platting the short
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in .
accordance widl standards established by the state and Spokane County. The proposal as
conditioned does provide adequate public facilities as cited in RCW 58.17.110 (2). More
specifically:.

b. drainage ways
c. public and/or private rights-of-way
d. potable water
e. sanitary waste disposal
f. parks and recreation facilities
g. playgrounds

respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
11. The water purveyor shall certify that appropriate contractual arrangements and schedule '
of improvements have been made with the plat sponsor for construction -of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
. prior to application for building pernuts within the fina.l plat. The arrangements or
agreements shall include a pxovision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a building permit due to the failure of the subdivision sponsor to satisfactorily complete the approved water system.
12 The final plat dedication shall contazn the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authoriries, the local fire protection district, County Building & Safety
Department and water purveyor, shall be installed within this subdivision, and the
applicant sha11 provide for individual domestic water service as well as fixe protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."
13. No building permit will be issued for any loC within the final plat unCil certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the fomi of a leCter, but is preferred to be cerrified on a copy of
the Water Plan as a schemaric map showing the "as-built" water system.
14. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection disrrict stating that simple connections to
an existing, approved water system will provide adequate domesric and fire protection
water to ensure the public health, safety and general welfare.
15. A survey is required prior to the filing of a final plat. '
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The cond.itional approval of the plat is given by the County Engineer subject to _
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards showing proposed
street centerline and curb grades shall be submitted to the County Engineer for approval
prior to construction andJor the filing of each final plat; road plans to be prepared under
the direction of a licensed Professionai Civil Engineer. '

3. Drainage plans and design calculations showing the alignment of drainage faciliries
shall be submitted to the County Engineer for approval prior to construchon and/or the
filing of the final plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
4. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
5. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
6. Existing county roacls providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
8. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any perit-ion or resolution
which purpose is the formation of a Road Improvement District (RIID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the

improvements required (curb, sidewal_k, drainage control and paving to existing
pavement) will be at the sole expense of the undersibned owner(s), their heirs, grantees
and assigns. This provision is applicable to Vera Crest Drive. .
9. As an alternative method of construcring the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road .
improvements stated herein by joining and participaring in a County Road .Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Vera Crest Drive.
10. The following statement shall be placed in the plat dedication:
"The owner(s) or Successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formarion of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an R.ID by the resolution method pursuant to Chapter
36.88 RCW, which resolution includes the owner(s)' property. If an RLD is
formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) rhat the improvement(s) or construction contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the forrnation of the RID by the property
included therein, together with the amount of any County participarion,
exceed the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the
formation of an RTD by either petition or resolution method under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners affi.rming the final assessment roll.
It is further agreed that at such tirbe as an RIID is created or any Road
Ymprovement Project is sanctioned by Spokane County, the improvements
required (curb, szdewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participation by Spokane County. The RZD waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said R.I:D waiver expires without construction of the re,quired
improvements, the owner(s) or successor(s) agree to construct the required
improveroents at their own expense, pay to Spokane County the then estimated cost of the required improvements to enable the County to
complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RTD waiver agreement)
providing for or securing to the County the actual construcfion of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is aPplicable to Vera Crest Drive.
11. The proposed private road(s) as shown on the preliminary plat serving 21ots with to
extension to serve eight (8) or less lots is approved by the County Engineer.
12. Private road(s) shall be improved to Spokane County standard for a private road
standard serving 21ots, and are subject to appzoval under Section 10.207 of the
SPokane County Fire Code.

13. All vested owners shall sign and record private road documents as prescribed by the
Spokane County Engineer. These documents shall be reviewed and approved by the
Spokane County Engineer prior to recording with the Spokane County Auditor. .
Recording nurnbers shall be referenced in the dedicatory language of the plat. 14. The following statement shall be placed in the plat dedication:
"WARNXNG: Spokane County has no responsibility to build, improve, maintain or
otherwise service the private roads contzined within or provide service to the property
described in this plat. By accepting this plat or subsequently by allowing a building
permit to be_issued on properry on a private road, Spokane County assumes no
obligation for said private road, and the owners hereby acknowledge that the County
has no obligation of any kind or nature whatsoever to establish, examine, survey,
construct, alter, repair, improve, maintain or provide drainage or snow removal on a .
private road. This requirement is and shall run with the land and shall be binding upon
the owner(s), their heirs, successors or assigns, including the obligation to participate
in the maintenance of the private road as provided herein."
15. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
16. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existi_ng county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified.
17. The following statement shall be placed in the final plat dedication: "The private road as
shown hereon is an easement which provides a means of ingress and egress for those
lots within the subdivision having frontage thereon."
18. An appropriate turn-around for vehicles at the terminus of the private road shall be approved by the applicable Fixe Dist-rct, and constructed by the applicant.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Du-ector of L`tilities, Spokaile
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
' Spokane County Health District that an adequate and potable water supply is available
. to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that a suitable site for an on-site sewage disposal
system is available on Tract B.
9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health Disrrict that the existing on-site sewage disposal system
serving the residence located on Tract A is wholly located within the boundaries of the
lot.
