PROJECT LOCATlON: This site is generally located in the Spokane
Valley, more specifically lying between the
Argonne-Mullan Corridor and lying south of
and adjacent to Main Avenue.
II. SITE PLAN INFORMATION

SITE SIZE: Approximately 43,874 square feet
SITE CHARACTERISTICS: The site contains one single family res,dence
and garage. The property is somewhat unique in that it is bordered by
three (3) streets; i. e. , Argonne on the West, Main Avenue to the Nvrth,
and Mullan Road tv the East. The County Engineer has requested access
permits be obtained prior to release of building permits.
NEIGHBORHOOD CHARACTER: The neighborhood is changing from
older residential to recent zone changes along the Argonnz-Mullan
Corridor - including Locai Business, Multiple Family Suburban, Residentiai
4ffice, and some Commercial.
AGRICULTURAL SUMMARY. This has been committed to an "Urban
Use" by the Soil Conservation Service.

111. BACKGROUNDiANALYSIS
A. COMPREHENSIVE PLAN - The Spokane County Generaliied Compre-
hensive Land Use Plan designates this site as well as all lands within
the Argonne-Mullan Corridor from Sprague Avenue north to Trent
Avenue as being within the Commercial category. The proposed zone
change is consistent with the Comprehensive Plan Map.
8. SITE CONSI DERATIONS - The sponsor is requesting a Commercial
zone change of approximateiy 1.03 Acres; however, he has not sub-
mitied a site plan for review. The Zoning Administrator requests a
detailed review of this project at Lhe time of building permits for
compliance with the Zoning Ordinance for the Commercial Zone -
including lighting, parking, landscaping, setbacks and permitted
uses.
tn addition, Staff does request a six (6) foot sight-obscuring fence
along the south property iine to buffer the existing Residential Office
Zone and its use from this Commercial zone change and its variety of
uses that are permitted and which could cause land use conflicts.
C. HISTORY OF OTNER LAND USE ACT{ONS - This site has been
zoned Agricultural since 1947, while other properties in the area have
requested ione changes to those of a higher intensity type of use.
D. CONCLUSION - This zone change request appears to be consistent
with existing land uses in the area, past tone change approvals, and
the Comprehensive P(an. The sponsor should discontinue use of the
existing residence should this zone change be approved, prior to
buiiding ar occupancy permit release

IV. AGENCIES RECOMMENDED CONOITlONS, IF APPROVED
a) COUNTY PLANN I NG DEPARTMENT
1. The Zoning Administrator shall approve a specific exterior Iight-
iiig plan for the approved area prior to installation of such
lighting. (Such plan shall attempt to confine itlumination to the
area with full consideration to adjacent properties).
2. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits to include landscaping, parking, building location, and
signage.
3. All current standards of the Commercial Zone, as amended, shall
be complied with in the development of this sjte.
4. The applicant shall comply with RCW 58-17 and the Spokane
County Platting Ordinances priar to issuance of building permits.
5. That the provisions of SEPA's NOTICE OF ACTiON pursuant to
Chapter 43.21C.080 RCW and the 6oard of Spokane County
Commissroners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements.
6. Pursuant to the pravisions of Chapter 43 21 C RCW, the SEPA
Guidelines (1NaC 197-10) and the Spokane Couniy Environmental
Ordinance (SCEO), a proposed declaration of nan-significance
has been issued at least fifteen (15) days prior to this date; the
official file, written comments and/or public testimony contain
information regarding assessment of the proposal`s adverse
impacts to the physical enviranment; a finding is hereby made
that no potentially significant adverse impacts upon the physical
environment are anticipated as a result of the project; and a
final declaration of non-significance is hereby to be issued.
7. Applicant shall comply with 1208' recommendations concerning
stormwater runoff and provide necessary grassed percolation
area for runoff.

8. That a six (6) foot sight-obscuring fence be constructed prior to
~w occupancy permit release along the south property Iine to be
consistent with setback requirements.
b) COUNTY ENGINEERING DEPARTMENT
1. Access permits shall be obtained from the Spokane County
Engineer prior ta the issuance of a building permit or any use of
the property.
2. Appiicant shali submit for approval by the Spokane County
Engineer road, dra+nage, and access plans prior 1.o the issuance
of a building permit on the property.

b) COUNTY ENGINEERING DEPARTMENT (continued)
3. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed com-
bined on-site sewage system p(an and surface water disposal plan
for the entire project prior to the issuance of any building
permit on the property.
c) COUNTY UTILITlES DEPARTMENT
1 Pursuant to Board of County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance with
all rufes and regulations of the Spokane County Health District
and is further conditioned and subject fio specific application
approval and issuance of permits by the Health District.
2. The owner, his heirs or successors shal{ join and participate rn
any petition or resolution which purpose is the formation of a
utility focal improvement district (ULID) pursuant to RCW,
Chapter 36.94, as amended The owner, his heirs and success-
ors shall further agree not to oppose or protest any legat assess-
ments for any utility tocal improvement district (ULID) estab-
iished pursuant to RCW Chapter 36.94, as amended.
3. Any water service for this project shall be provided in accord-
ance with the Coordinated 1Nater Systern Plan for Spokane
County.
d) CQUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorried by the Director of
Utilities, Spokane County.
2. Water service shatl be coordinated through the Director of
Utilities, Spokane County.
3. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department
of Sociai and Health Services.
4. Disposal of sewage effluent benealh paved surfaces is currently
prohibited.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District #1.

THIS MATTER, Being the consideration by the Board of County
Commissioners of Spokane County, hereinafter referred to as the "Board" of
an appeal of Spokane County Zoning Hearing Examiner Cortlmittee Decision of
April 8, 1982, approving the zone reclasslfication (ZE-153-81), Agriculturat
to Commercial, for the purpose of general commerciai use, hereinafter re-
ferred to as the "Proposal", and the Board of County Commissioners of
Spokane County having held a pubiic hearing on May 25, 1982, and having
fully considered all testimony presented thereat, and further having indi-
vidually visjted with the site and vicinity in question, and having rendered
a decision on the 1st day of June, 1982, approving said proposal, does
hereby make the following:
FINDINGS OF FACT
.
1. That the proposal is generatty located in the Spokane Valiey,
more specifically lying between the Argonne-Mullan Corridor, lying south of
and adjacent to Main Avenue.
2. That the proposai consists of a general Zone change request
with deveiopment plans to be submitted when a specific use of the property
is identified.
3. That the adopted Spokane County Generalized Comprehensive
Land Use Plan indicates Major Comrnercial usage of the area encompassed by
the proposa!.
4. That the provisions of RCW Chapter 43.21C, (St"ate Environ-
mental Policy Act) have been comptied with and the Board concurs with the
Hearing Examiner Committee's issuance of a declaration of non•significance
and adopts a declaration of non-significance for this proposal.
5. That the Spokane County Hearing Examiner Committee held a
public hearing on Aprii 8, 1982, concerning the proposal, subsequent to
which by Findings of Fact.. Decision and Order dated April 15, 1982, they
approved the proposal subject to certain condit'rons.

6. That the existing land uses in the area of proposal inctude
single family residences, professional offices, apartments, retail store, and
undeveloped land.

8. That the proposal is not detrirnental or otherwise harmful to

9. That the applicant has demonstrated changed conditions since
the origirtal zone change warrantrng a zone change from Agricultural to
Commercial, including, but not linnited to: adoption of the Major Commercial
classification of the subject property as part of the overaii County Compre-
hensive Plan, development of commercial uses in the vicinity, and, addition-
ally, development of office and multi-famity residential facilities in the area.
10. That the proposal is totally consistent with the surrounding
land use classifications and does not grant a special privilege or rights to
the appiicant djfferent than those enjoyed by adjacent property owners.
11. That sufficient review of future development proposals can be
made by the Spokane County Zoning Administrator consistent with the pubtic
heafth, safety, and generai welfare.
12. That the property owner to the South submitted a written
request that the applicant not establish a fence between their properties,
and such fencing requirement would serve no useful purpose.
13. That the proper legal requirements for advertising of the
hearing before the 6oard of County Commissianers of Spokane County have
been met.
14. That on the 'I st day of June, 1982, the Board of County
Commissioners of Spokane County at a regular meeting did approve the
proposal subject to certain conditions.
From the foregoing Findings, a review of the Ptanning Oepartment
Staff Report dated Aprit 8, 1982, and the Staff presentation of File No.
ZE-153-81, the Board hereby in approving the proposal does make the follow-
ing conditions:
1. That the condjtions set forth in the Spokane County Zoning
Hearing Examiner Findings and Order dated April 15, 1982, on pages 1
through 4 are hereby adopted as conditions of approval subject to the follow-
ing amendments:
