FINOINGS AND ORDER
A. INTRODUCTIOH
Th1 s matter havf ng come before the Ioni ng Heari ng Exami ner Comi ttee on
August 6, 1987, and the members of the Committee present being Ron Odell,
Chairman, and Gary N. Anderberg and John W. Skadan.
B. PROPOSAL
The sponsor, Prokey Arger, is requesting approval of a zone
reclassification, F11e No. ZE-30-87 Agricultural and Two-Family
Residentlal to Urban Residential-22 (UR-22) Zone, for the purpose of
developing professional offfces.
C. FINDINGS OF FACT
1. That the existing land use in the area is single family residential,
bank, apartments, and open area.
2. That the Comprehensive Plan designates this area as appropriate for
MAJOR COMMERCIAL and URBAN development.
3. That the existing zoning of the property described 1n the application
is Agricultural and Two-Family Residential.
4. That the provlsions of RCw 43.21C (The State Envlronmental Policy
Act) have been complied with, and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fu1f111ed.
6. That the land in thls area is suitable for the proposed use, or
uses withln the propvsed tone Classification.
7. That the applicant has demonstrated that condltions have
substantially changed since the original zoning of this area and
accordingly. tfie proposed rezone is justified.
8. That the proposed use fs compatible with exlsting uses in the
area.
9. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.

10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a) That the a pplicant has developed this area into high quality,
aesthetically pleasing office complexes that has positively
effected this community.
b) That the applicant work with the Zoning Administrator to
determine if adequate on-site parking can be provided to allow
for medical offices within this project.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
HEARING EXAMINER COMMITTEE
1. Amend Planning Department Condition #5 to read as follows:
"That due to lack of a sufficient on-site parking area, medical
offices shall not be allowed on this site unless strict
compliance with parking standards on-site is demonstrated."
a) COUNTY PLANNING OEPARTMENT
STANDARO:
1. The specific development plan will be submitted for Planning
Department review and approval prlor to lssuance of building
permits.
2. All current standards of the Urban Residential-22 (UR-22) Zone,
as amended, shall be complied with in the development of this
site.
3. Applicant shall cocnply with '208' recommendations concerning
stormaater runoff and provide necessary landscaping for runoff.
4. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 56-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.

landscaping and parking as required by the Spokane County Zoning
Code.
b) COUNTY EN6INEERING DEPARTMENT
Prior To The Issuance Of A Building Perrnit:
STANDARD:
1. Access permits for approaches to the County Road System shall be
,obtained from the County Engineer.
2. Applicant shall submit for approval by the Spokanetounty
Engineer road, drainage and access plans.
3. The applicant shall submit for approval by the Spokane'County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project o r portion thereof if the
development is phased.
4. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design,
1ocation and arrangement of parking stalls shall be in
accordance wlth standard engineering practices. Paving or
surfacing as appr,oved by the County Engineer wi'll be required
for any portion of the project which is to be occupied or
traveled by vehicles.
5. All required improvements shall conform the the current State of
Washington Standard Specifications for Road and Bridge
construction and other applicable county standards and/or
adopted resolutions perta9ning to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Englneer.

b) COUNTY ENGINEERING DEPARTMENT (continued)
6. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Conanissioners
resolution 80-1592 as amended and are applicable to this
proposal.
7. No construction work is to be performed within the existin9 or
proposed right of way until a permit has been issued by the
County Engineer. All work within the public road right of way
is subject to lnspectlon and approval by the County Engineer.
8. All required construction within the existing or proposed public
right of way is to be completed prior to the release of a
building permit or a bond in an amount estimated by the County
Engineer to cover the cost of construction of improvements shall
be filed with the County Engineer.

9. A plicant shall dedicate five feet on willow Road for right of
ay.
10. The County Engineer has designated Typical Roadway Section
Number One, Access Street standard for the improvement of Willow
Road whlch is adjacent to the proposed development. This will
requlre the addition of approximately 10 to 12 feet of asphalt
along the frontage of the development. Curbing and sldewalks
must also be constructed.
c) COUNTY UTILITIES DEPARTNENT
STANOARD:
1. Any water service for this project shall be provided in
accordance with the Coordinated 4later System Plan for Spokane
County, as amended.
SPECIAL:
2. That this project is required to connect to the area-wide sewer
system.
d) COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer and Spokane County
Health Dlstrict prior to the issuance of any on-slte sewage
disposal permit or building permit for this project.
2. Sewage disposal method shall be as authorized by the 0lrector of
Utllities, Spokane County.
3. aater service shall be coordinated throu9h the 0lrector of
Utilitles, Spokane County.

4. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
SPECIAL:
5. A public sewer system will be made available to this project.
Use of individual on-site sewage disposal systems shall not be
authorized.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
STANDARD:
1. The si te i s 1 ocated i n F1 re Di stri ct #1.
2. F1re hydrants shall be located so as to be accessible to fire
apparatus and not be obstructed by any structure or vegetation
or have the visibility impaired for a distance of fifty feet in
the direction of vehicular approach to the hydrant.
3. Specific location of hydrants shall be determined by the fire
district.
3. Commercial dumpsters and containers with an individual capacity
of 1.5 cubic yards or greater shall not be stored or placed
withln five feet of combustible walls, openings or combustlble
roof eave lines.
4. The applicant shall provide Yeriflcation from the fire distrlct
to the Department of Bullding and Safety that provisions have
been made for adequate fire protection prior to the release of
building pernnlts.
f ) WATER PURVEYOR
1. Mater Purveyor is Modern Electric Water Company, and they aill
supply the site with adequate water for domestic, fire and
irrigation uses.
g) COUNTY AIR POLLUTION CONTROL AUTNORITY
All air pollution regulations must be met. This includes but is not
limited to the following:
STANDARD:
1. Air pollutlon regulations requlre that dust emissions during
demolition, excavation and constructlon pra3ects be controlled.
This may requi re use of water sprays, tarps, spri nkl ers, or
suspension of activity during certain weather conditlons. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related act1v1t1es.

2. Measures must be taken to avoid the deposition of 41rt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors wi11 likely result during the
construction phase of the project and from motor vehicles using
the site following completion of the pro3ect and from occupants
of the proposed project.
SPECIAL:
5. Demolition and renovation projects must comply with the
requirements of CFR 40 Pa rt 61, Subpart M. Intent to Demolish
and Renovate forms are avallable at the SCAPCA office.

The Zoning Hearing Examiner Committee, pursuant to the aforementioned,
finds that the application of Prokey G. Arger, for a zone reclassification
as described in the application should be APPROVED.

SCOPB/PROJECT DESCRIPTION:
I. General Overview - Proposed is the construction of an
additional phase to the Center Point Business Park on Mullan
Road, becominq approxi.mately 90,000 square feet of under-roof
area. This project will be a two story 85' x 110' office
building, vr 16,499 square feet. In order to blend with the rest
of the Park, this building will be of the same construction type
as the others, Type VN Construction, with cedar sidinq.
The applicant stated that there has been a good tenant lease
history with the other buildings, maintaining an occupancy rate
of approximately 97%.
II. Construction Schedule - The apglicant has requested an early
start permit for the project in order to begin construction
immediately.

SUMMARY OF DEPA.RTMENTAL •REf,?UIREMENTS :
I. Planning Department (456-2205)
A. Discussion/Requirements
1. The site is zoned UR-22, and is the condition of a
zone change, #ZE-30-87. One of the conditions of the zone
change is that medical offices are nat permitted. Should
the owner of the building wish to lease space for that type
of use, a Change of Conditions will need to be requested and
filed with the Planning Department. (The applicant stated
that he spoke with Steve Horobiowski of the Platining
Department at an earlier date regardinq this matter. Steve
stated that the main reason for the condition on medical
offices is that additional parking is required, however
those conditions are being changed somewhat and, if the
building meets all the parking requirements, allowing this
type of use would be academic. John Pederson asked that the
applicant obtain something in writing from Steve Horobiowski
and maintain that in his files should this type of tenant
wish to lease space in the building.)
2. Any signs constructed or placed on this site will
require permits, conforming with the sign standards for that
zone. This can be done through a separate permit.
3. The initial landscape plan was previously reviewed
and discussed with the applicant with a new/revised
landscape plan submitted at the meeting. Items requiring
revision were with regards to setbacks, parkinq, and
landscape type and planting size. From the brief review of
this revised plan at the meeting, it appears the items have
been addressed, but further review is required. The
promissory letter to install the landscaping has been
received.
There was discussion on the difference between
requiring the Type 3 landscaping and tbe requirement for
screening, fencing and/or berming along adjacent parking
areas. John Pederson stated that per landscape requirements,
Type 3 landscapinq for this project is needed along Mullan
and Willow Roads - however parking standards require that
the parking be shielded from adjacent streets either through
screening, fencing, or berming. Therefore, both are
required, but there are options in how to go about screening
the parking.

B. Permit Release-Requtirements
l. The revise3 site plan subn.itted at the maeting
needs to be reviewed and approved prior to permit release by
the Planning Department.
II. Engineering (456-3600)
A. Discussion/Requirements
1. A copy of written comments were given to and
discussed with the applicant several days ago discussing tbe
items needing correction which include a revised drainage
plan, street plans and a hond for road improvement.
2. An additional itent needing attention which was not
discussed at their earlier meeting is the need for an
RID/CRP Agreement. The owner needs to bring in a copy of
the property deed in order for the Engineer's Office to
prepare the Agreement.
B. Permit Release Requirements
1. In addition to the RID/CRP Agreement, a revised
drainage plan and calculations, as indicated previously,
needs to be submitted for review and approval prior to
release of the permit.
2. For an early start release, the drainaqe plans
will need to be approved. Prior to actual construction of
the buiding, the RID/CRP Agreement and road improvement bond
shall be filed.
III. Health District (456-6040)
A. Discussion/Requirements
l. The Health District has no record of a previous
on-site sewage system, therefore there should be rto problems
wit,h running in to an old system during construction.
2. Should any tenant leasing space in the building be
critical materials users, such as a print shop, etc., a
critical materials list needs to be filed with Building and
Safety.

B. Permit Release Requirements
l. Because the project will be connected to sewer ard
public water, the Health District released their portion,
and the IItilities Department's portion of the penait.
IV. Building and Safety (456-3675)
A. Discussion/Reguirements
l. The initial set of plans have been reviewed and
discussed with the applicant, however interior plans still
need to be submitted for review and approval. There doesn't
appear to be any problems with the construction of the
building as shown by the plans, however Ken Jeffrey pointed
out that the exitinq layout on the second floor may be a
groblem in the future, should one tenant wish to lease the
entire space and remove the corridor. Due to area
calculations for exiting, there is a required corridor
separation on the second floor. Some other exiting
solution, however, may be acceptable.
B. Permit Release Requirements
1. Two sets of interior glans needs to be submitted
for review and approval grior to release of the permit.
2. Ken Jeffrey is ready to release the permit for an
early start on the project.
APPLICANTIS COMMENTS/ACRNOWLBD(3EMENT:
The applicant acknowledged that all comments/requirements were
understood and harl no further questions at this time reqarding
permit requirements.
CORRECTIONS:
To minutes or changes from what appears in the minutes, we should
be notified within one day of your receipt of these minutes.
To site plans as required by any or all of the above-listed
departments shall be submitted to Building and Safety who will
then distribute accordingly to those departments.
