SP-793-92 ) CONCLUSIQNS AND DECISION THIS MATTER, an application for subdivision of land, from Juanita Johnson and Myrla Walty has been received d decided upon, pursuant to Spokane County Subdivision regulations, on the '2 0'~ay of March, 1993. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has fiu-ther been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide approximately .76 acres into 2 lots for division of an existing duplex and those uses pemnitted in the underlying zone. 3. The proposal is generally located between Eleventh Avenue and Twelfth Avenue approximately 220 feet east of Dollar Road, in the SW 1/4 of Section 24, Township 25 North, Range 45 E.W.M., Spokane County, Washington. 4. The existing zoning of the property described in the application is Urban Residential-7 (UR-7), previously established as Two-Family Residential (R-2) zoning in 1976 and redesignated to Urban Residential-7 (UR-7) on January 1, 1991 consistent with the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposa.l does conform to the requirements of the existing Urban Residential-7 (tTR-7) zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are/are not generally in accord with this category. 6. Surrounding uses are primarily duplex and single family residences. 7. The required public notice was provided for this proposal and agencies having a potenrial interest in the project were notified and recommendations solicitecl. 8. No written comments were received from any adjoining property owners. 9. Recognizing the recommended conditions and Spokane County development standards, the proposed short subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. The Planning Department has considered the provision of public facilities as cited in RCW 58.17.110 (2). More specifically: _ a. open spaces b. drainage ways c. public and/or private rights-of-way d . Transit e. potable water f. sanitary waste disposal g. parks and recreation facilities h . playgrounds i. schools and schoolgrounds The above improvements are either existing facilities and services or will be provided by the applicant upon finalization of this short subdivision as cond.itioned by the Pla.nning Department and inlplemented by the various County agencies. , ' • . : FINDINGS AND DECISION SP-793-92 Page 2 10. Eleventh Avenue is a local access street with an existing right of way width of 50 feet. Eleventh Avenue is improved and provides primary access to this property. Twelfth Avenue is south of and adjacent to the site. Twelfth Avenue is not established (unimproved) with an existing right of way width of 30 feet.. 11. The proposed short plat will be served by a public water system. Waste water disposal will be as authorized by the Director of Utilities. 12. The project is exempt from environmental reaiew under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact ca1d Conclusions, Short Plat Application SP-793-92 is hereby APPROVED until April l, 1996 subject to condirions noted below. Most of the conditions of appzoval shall be accomplished by-the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in wriring, consistent with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest to property. PLANNING DEPARTMENT CONDITIONLo' 1. All cond.itions imposed by the Planning Department shall be binding on the "Applicant", which term shall include the owner or owners of the property, heu-s, assigns and successors. 2. The proposal shall comply with Urban Residential-7 (UR-7) zone as amended. 3. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approvaZ. 4. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Condidons of Approval. 5. Appropriate road name(s) shall be indicated. 6. The preliminary plat is given conditional approval for three (3) years, specifically to.April l, 1996. The applicant may request an extension of time by submitting a written request approxirnately forty-five (45) days prior to the above expiration date. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utiliry easements by appropriate utiliry companies shall be received with the submittal of the final plat. 8. Three (3) cunent certificates of title shall be furnished to the Planning Department prior to filing the final plat. 9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, "T'ract X" or public roads. The ciedicarion shall contain the following statement: "Side yard and rear yard setbacks shall be d,°termined at the rime building permits are requested unless these setbacks are specifically drafted on this final plat. T'he setbacks indicated on this plat may be varied from if proper zoning approval.s are obtained." 10. No water plan is required., and a simple tap is need.ed at the time of building pennit release. ~ 11. A survey is required prior to the filing of a final plat. . ~ FINDINGS AND DECISION SP-793-92 Page 3 12. The final plat dedication shall include: No detached single-famuly dwellings or manufactured homes are allowed on any lot. All tracts with any lot line designateti Center Duplex Lot Line shall be restricted to one common-wall dwelling unit (one-half [1/2] duplex), provided the duplex common wall is aligned over or with the Center Duplex Lot Line, and provided that each duplex unit (hal fl is totally on its side the of center lot line when said lot line is extended vertically beyond the roof line." . e final plat is to idenrify the duplex common-wall lot line as center duplex lot line, and the line is to be drafted as a continuous "dash-dot-dash." 14. The final plat dedication shall include: "The owners, heirs or assigns of divided duplex lots do hereby agree to equally share the responsibility and cost of maintaining and operating that portion of the septic tank and drainfield systern that is jointly shared until each duplex unit (half) is separately connected to a public sewer system." - 15. The final plat dedication shall include: - "Enforcement of the water and sewer systems agreement is a civil matter between each duplex unit owner(s) and not enforced by Spokane County." COUNTY ENGINEER'S DEPARTMENT CONDITIONS 1. The cond.itional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. 2. The regulations of the National Flood Insurance Program shall be observed. A development permit shall be obtained from the County Engineer before construcrion or development begins within any area of special flood hazard (reference Spokane County Ordinance No. 81-0726). The following statement shall appear within the dedicatory language of the plat: "Development within this subdivision shall conform to the requirements of the National Flood Insurance Program and the Spokane County Flood Zone Ordinance. Purchasers of the property within this subdivision are warned of possible flooding or ponding and the potential requirement to purchase flootl insurance. This warning shall be carried in each and every deed drawn to transfer ownership of any and all property wi.thin the plat in the area of special flood hazard. This condition is applicable to driveway approaches, driveways and private roads constructed on the site for access. 3. No construction work is to be performed within the existing or proposed public right- of-way until a permit has been issued by the Counry Engineer. All work is subject to inspection and approval by the County Engineer. 4. Individual driveway access perrnits are requ.i.red prior to issuance of a building permit for driveway approaches to the county road system. 5. A statement shall be placed in plat dedication that no direct access be allowed from lots to Twelfth Avenue. 6. Existing county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 7. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 8. The proposed subdivision shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regularions for roads, approaches, drainage and fees in new construcrion. • , , FINDINGS AND DECISION SP-793-92 Page 4 9. The Counry Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of addirional right-of-way and the roadway improvements herein specified. 10. The aforementioned conditions of approval are based on a 2 lot plat/division of duplex. Further subdivision of the property would warrant addirional condirions of approval. COUNTY HEALTH DISTRICT CONDITIONS 1. The final plat shall be designed as indicated on the prelim.inary plat of record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distriburion by the Planning Department to the utility compani.es, Spokane County Engineer and the Spokane County Health District. Written approval of the easements by the utility companies must be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. An on-site sewage management system shall be created and approved by the Spokane County Health District prior to fiiing the final plat. Dedicatory language of the plat shall include statement: Each lot ownership shall be a member of the on-site sewage management association unril said association is dissolved with the consent and approval of SCHD." 5. A sewer maintenance agreement shall be created/maintained for this project and shall include: 1) Purpose: the purpose of this agreement is to provide for the utilization and maintenance of a common on-site sewage disposal system consisting of a singular septic tank and/or drainfield. It is the intent of the parties to provide for the joint continuation and maintenance of these facilities upon the segregation of the duplex structures into two independent single-family residences with a common wall; 2) Financial Assurance: The owners of the lots, tracts, parcels using the sewage system sha11 agree fo equally share the total costs of the needed repair, replacement, reconstruction, or other procedure necessary to restore the sewage system. Failure of the property owners to perform the work necessary to restore the system will result in Spokane County Health District ordering the work to be completed with all costs associated therewith to be shared among property owners using the sewage system. 6. Water service shall be coordinated through the Director of Utilities, Spokane County. 7. Water service shall be by an existing public water supply when approved by the Regional engineer (Spokane), State Department of Health. 8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that an adequate and potable water supply is avai.lable to each tract of the plat 9. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. . 10. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that the existing on-site sewage disposal system serving the structure located on tracts A& B is wholly located within the boundaries of the tract. 11. Subject to specific application approval and issuance of permits by the health officer, the use of individual on-site sewage disposal systems may be authorized. 12. The dedicatory language of the plat will state: "Subject to speci.fic application approval and issuance of permits by the Health Officer, the use of individual on-site sewage systems may be authorized." FINDLNGS AND DECISION SP-793-92 Page S 13. The derlicatory language on the plat'shall state: "Use of private wells and water systems is prohibited." 14. The plat dedication shall contain a statement to the effect that: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection d.istrict, County Building and Safety Department and water purveyor, shall be installed within this plat, and the applicant shall provide for individual domestic water service as well as fire protection to each tract prior to sale of each tract and prior to issuance of a building pernut for each tract" COUNTY UTILITIES DEPARTMENT CONDITIONS 1. Pursuant to the Board of County Commissioners Resolution No. $0-0418, the use of on-site sewer disposal systems is hereby authorized.. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of pernuts by the Health District. 2. The dedication shall state "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULTD by petition method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED, this condition shall not prohibit the.owner(s) or successor(s) from objecring to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94." 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for connection to future areawide collection systems." BUILDING AND SAFETY DEPARTMENT CONDITIONS 1.
