FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
February 6, 1986, and the members of the Committee present being
Kathleen M. Carstens. Chairperson. Jane E. Myers and Ron Odell.
B. PROPOSAL
° The sponsor. Prokey G. Arger, is requesting approval of a zone
reclasslfication. File No. ZE-103-85, Agricultural and Two-Family
Residential (R-2) to Local Business and Residentlal Office, for the
purpose of developing an office building.
A Change of Conditions request. ZE-57A-83, 1n existin9 Local Business and
Resi denti al Of f i ce Zones for the purpose of revi ewi ng a new si te
development plan.
Also, a Variance request, VE-164-85, to allow an off-street parking area
to be withln 5-feet of the east property line, whereas the Spokane County
~ Zoning Ordinance, Section 4.07A.110-(a) requires a 20-foot front yard
landscaped setback.

C. FINDINGS OF FACT
1. That the existing land use fn the area 1s residential, office
complex, and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
Major Commercfal and Urtian development.
3. That the existing zoning of the property described in the applicatlon
is Agrlcultural and Two-Family Resldential (R-2).
4. That the provislons of RCM 43.21C (The State Envlronmental Policy
Act) have been complied w1th, and the Conmittee concurs with the
Determination of Non-Signlficance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in thls area is suitable for the proposed use, or
uses within the proposed Zone Classlfication.

accordingly, the proposed rezone and change of conditions are

parking sltuations and safety, and that the applicantihas agreed to
provide as manylparking spaces as can be made available.

resolve street parking within the area,
e} That a11 three reQuests are consistent with past actions wlthin
this immediate area, and if properly buffered to the~residences
to the east, the proposal can be consistent with the

a) COUNTY PLANNING DEPARTMENT
1. Approval by the Zoning Administrator of a specific 1lghting and
stgning plan for the described property prior to the release of
any bui 1 di ng permi ts.
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or lmpaired.
3. The applicant shall develop subject property generally tn
accordance withln the concept presented to the Hearing Examiner
Conmittee.• Yariations when approved by the Zoning Administrator
•ici 11. be permi tted, 1 ncl ud1 ng, but not 1 imi ted to the fol l ow1 ng
changes: Building locatton, landscape plans, and general
alloKable uses of the permltted =one. A11 variations must
conform to regulations set forth 1n the Spokane County Zoning
Ordinance. The origirtal intent of the development plans shall
be maintained.
4. The specific development plan w111 be submitted for Planning
Department review and approval prior to issuance of building
perml ts.
5. A11 current standards of the Loca1 Business and Residential
Office Zones, as amended, shall be complled with in the
devel opment of thi s si te.
Legal descrfptions of the proposed zones are as follows:
Resi denti a1 Office: The East 94 feet of Lot 1. B1 ack 141,
bpportunity #n tection 17-25-44.
Local dusiness: The west 186.5 feet of Lot 1. Block 141,
'Opportuni ty in Section 17-25-44.
6. That the project is subject t4 Section 4.16a.050, the Aquifer
Sens/tive Area Overlay Zone of the Spokane County Zoning
Ordinance, which sets forth various measures for Aqulfer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.

stormwater runoff and Provide necessary landscaping for runoff.
8. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Ccxnmissioners Resolution #77-1392 be initiated by the project
applicant wlthin thirty (30) days of final disposition of this
application, and prior to any on-site improvements.
b) COUNTY ENGINEERING DEPARTMENT
Pri or To The Issuance Of A 6ui 1 di ng Permi t:
1. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Englneer.
2. Applicant shall improve willow Road in a manner consistent with
Spokane County TYPICAI. roadway section No. 1 minimum paving
width Access Standard.
3. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior La the issuance
° of a bui 1 di ng penai t on the property.
4. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health Oistrict a detailed •
combined on-slte sewage systen plan and surface water disposal
plan for the entire pro3ect prior to the issuance of any
bui 1 di ng permi t on the property.
5. A parki ng pl an and traffic ci rcul ation pl an shal l be submi tted
and approved by the Spokane County Engineer prior to the
issuance of a building pemit on the property. The deslgn,
locatlon, and arrangement of parking stalls shall be in
accardance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
requi red for any portion of the project which i s to be occupied
or traveled by vehicles.
6. ?he wcrd "applicant" shall include the owner or owners of the
property, his heirs, asslgns, and successors.
7. The construction of the road improvements stated hereln shall De
accomplished as approved by the Spokane County Engineer.

Washington Standard Specifications for Road and Bridge
Construction, and other appaicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
9. Roadway standards, typical roadway sections and drainage pian
requi rements are found i n Spokane Board of County Commi ssioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
c) COUNTY UTILITIES OEPARTMENT
1. No new recommendations.
d) COUNTY NEALTN DISTRICT
1. A combined surfatce water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer and the Spokane
. County Heal th District prior to the i ssuance of any bui 1 di ng
` • Rermit for thi s project.
2. Sewage disposal method shall be as authorized by the Director of
• Utilities, Spokane County.
3. Subject to speciftc application approval and issuance of pemits
by the Health Officer, the use of an on-site sewage dlsposal
system may be authori zed.
4. Water service shall be coordinated through the Director of
Util ities. Spokane County.
5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Oepartment of
Social and Nealth Services.
6. Use of private aells and water systems is prohibited.
7. Disposal of sewage eff]uent beneath paved surfaces is currently
prohibited.
Note: The sponsor has not reserved sufflcient space for a
rep'facement on-site sewage dtsposal system when the original
fai 1 s to function properly.

construction or underneath windows or nonprotected eaves.

5. Fi re iydrants which meet the fi re f1 ow are requi red to be
1 nstal l ed Pri or to any constructi on. These hydrants sha11 be
pl aced so that no porti on of the bui 1 di ng exteri or 1 s more than
115 feet from the hydrant. The bottom of the lowest outlet of
the hydrant shall be no less than 18 inches above grade. A
water plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10.04 of the Uni fonn Fi re Code i s requi red prior to
construction of the wate r serwice. All requlred fire protection
facilities shall be installed and made servlceable prior to and

1. water Purveyor is Modern Electric water Company. and they will
supply the site with adequate water for d(xmestlc, fire and
frrigation uses, but satisfactory arrangements have not been
made to serve this proposal.
g) COUNTY AIR POILUTION CON7ROL AUTHORITY
1. Air pol l uti on regut ati ons requi re that dust em1 ssi ons duri ng
demolitlon, excavation and construction projects be controlled.
Thi s may requi re use of water sprays, tarps, spri nkt ers. or
suspenslon of activity during certain weather conditlons. Haul
roads should be treated and emissions from the transfer of
earthen materl al must be control l ed as wel l as em1 ssions from
a11 other constructlon related activitles.
2. Measures must be taken to avoi d the depositi on of di rt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
