SUBJECT: Standard DrainaQe LannaQe for the Dedication on
1) Drainage easements, as platted and shown hereon, which are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities to dispose of runoff, are hereby
granted. The County of Spnkane is hereby granted the right of ingress and egress to all drainage
easements adjacent to the public right of way. The property owner shall maintain che drainage
swale with a permanent live cover of lawn turf, with optional shrubbery and/or trees, which do
not obstruct the flow and percolation of storm drainage water in the drainage s~vale as indicated
by the approved plans.
2) The owners of Lots & , of Block , and Lots
, , & , of Block , shall be held responsible for
keeping open and maintaining the path of the natural or man-made drainage flow over and across
the property.
3) The property owner or his representative shall inform each succeeding purchaser of all drainage
easements on the property and his responsibility for maintaining drainage facilities within said
easements.
I 4) Spokane County does not accept the responsibility of maintaining the drainage course on private
lots within drainage easements or floodplain areas, nor the responsibility for any drainage,
whatsoever, including but not limited to inverse condemnation to any properties due to deficient
construction and/or maintenance of drainage courses in drainage easements on private property.
5) The lowest building opening, including basement opening, for any building on L&~
_00F and 8 91"~ shall be high enough to allow a minimum slope of 3%
away from the building in 10 feet. All drainage shall be routed away from the build'+ng to natural
drainages or other lawful drainage features. ,
6) Development within this subdivision shall conform to the requirements of the National Flood
Insurance Program and Chapter 3.20 of the Spokane County Code. The lowest tlaor, including
basement floor, for any structure shall be constructed according to the requirements of the.
Spokane County Flood Zone regulations in effect at the time a building permit is issued.
Purchasers of property in this subdivision are warned. of possible flooding or ponding and the ;
potential requirement to purchase Flood Insurance. This warning shall be carried in each and
every deed drawn to transfer ownership of any and all property within this plat in the Area of
Special Flood Hazard.
7) An approved lot grading plan exists for Lots and ,
Block , and Lots & , Block .
Grading must conform to said plan on file in the County Engineer's Office.
8) Spokane County shall not be responsible to maintain ingress or egress across the flood plain area.
9) The owner(s) or successor(s) in interest agree to join in any County approved Starmwater
Management Program and to pay such rates and charges as may be fixed through public hearings
for service or benefit obtained by the planning, deAgn, constructing, maintaining, or operation
of stormwater control facilities. '
10) A statement must appear in the dedicatory language of the plat that individual driveway access
permits be required prior to issuance of a building permit for driveway approaches to the County
road system. This approach shall be constructed in accordance with the approved plan on file
in the County Engineer's office. ~

THIS MATTER, an application for subdivision of land, from Liz Schultz has be~ r,eFeived A
and decided upon, pursuant to Spokane County Subdivision regularions, on the ~`f'r"1
day of December, 1992.
FINDINGS OF FACT AND CONCLUSIONS
l. The individual signing below has fu,rther been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 2.5 acres i.nto two lots for residential uses and
those uses gemutted in the underlying zone.
I 3. The proposal is generally located at the end of Van Marter Court approximately 1/4 mile -
south of 44th Avenue in the SE 1/4 of Section 5, Township 24 Noi-th, Range 44 E.W.M.
Spokane County, Washington.
4. The existing zoning of the property described in the application is Suburban Residential-1 -
(SR-1), previously established as Agricultural Suburban (AS) zoning in 1979 and
reclassified to Suburban Residential-1 (SR-1) on January l, 1991 pursuant to the
Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conforin to the requirements of the existing Suburban Residenaal-1
(SR-1) zone.
- 5. The Spokane County Comprehensive Plan designates this area as Suburban The
development and uses proposed are generally in accord with this category.
6. The site Previously contained a single family structure which has been destroyed by fire I
and is no longer present on the site. The site is located on a south/southwest facing slope
and contains moderate tree cover. The existing parcel was previously platted as Lot 4,
Block 1, of Ponderosa Hills. Surrounding uses are primarily residential. . .
7. The required public nodce was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.
S. No comments were received from any adjoining property owners.
9. Recognizing the recommended conditions and 3pokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health, safety ,
and general welfare and that the public use and interest will be served by platting the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accardance with standards established by the state and Spokane County. The proposal as
conditioned does provide adequate public facilities as cited in RCW 58.17.110 (2). More
specifically:
a. open spaces
b. drai.nage ways
c. public andJor private rights-of-way
d. potable water
e. sanitary waste disposal
f. parks and recrearion faciliries
9. playgrounds
h . schools and schoolgrounds
The above improvements are either existing facilities or will be provided by the applicant
upon finalizarion of this short subdivision as conditioned by the Planning Department and
implemented by the various County agencies.

10. Van Marter Court is designated as a Local Access Street with an existing improved width
, of 60 feet. The County Engineer has not requested improvements or dedication to Van
Marter Court. 11. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
12. On site topography includes slopes up to 37 % which may require special construction
techniques.
13. Spokane County's Wetland Maps do not indicate the presence of permanent or seasonal
wetlands on site.
14. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
B ased upon the above noted Findings of Fact and Conclusions, Short Plat Applicatian
SP-794-92 is hereby APPROVED until January 1, 1996, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with the Suburban Residential-1 (SR-1) zone as amended. 3. The final plat shall be designed substantially in conformance wiTh the prel'urunary plat
of record. No increase of density or number of lots shaU occur without a change of
condition.application submittal and approval.
4. The Planning Director/designee shaU review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated. 6. The preliminary plat is given conditional approval for three (3) years, specifically to .
January l, 1996. The applicant may request an extension of time by submitting a
written request approxunately forty-five (45) days prior to the above expiradon date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utiliry easements by appropriate unlity companies shaU be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be furnished to the Planning Departrnent prior
to filing the final plat.
9. The final plat shall indicate yard setback arc lengths on cul-de-sac lots which meet or
exceed the m.i.nimum frontage of the underlying zone of the final plat

10. The final plat map shaU indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following ,
statement:
"Side yard and rear yard setbacks shall be determined at the time building perniits are

requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
11. A plan for water facilities adequate for domestic service and fire protecrion shall be approved by the water purveyor, appropriate fire protection district, County Building &
Safety Department and County Health I?istrict The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted.on a
transparency suita.ble for reproduction and be signed by the plat sponsor.
12. The water purveyor shall certify that appropriate contra,ctual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building pernuts within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchasez refused a building pemut due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
13. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Building & Safety
Department and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."
14. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certif'ication may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection d.istrict stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general welfare.
16. A survey is requu-ed prior to the filing of a final plat.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
2. Ind.ividual driveway access pernlits are required prior to issuance of a builcling permit
for driveway approaches to the county road system.
3. Existing county roads providing direct access to the plat shall be paved andior curbed to
Spokane County standards.
4. The word "applicant" sha11 include the owner or owners of the property, his heirs,
assigns and successors.
5. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolurion No. 80-1592, as amended, which
resolution esta.blishes regulations for roads, approaches, dra.inage and fees in new
construction.
COUNTY HEALTH DISTRICT CONDITIONS
1. The f nal plat shall be designed as indicated on the preliminary plat of record andior any
attached sheets as noted.

2. Appropriate utility easements shall be indicated on copies of 'the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health I?istrict Written approval of the _
easements by the utility companies must be received prior to the subrruttal of the final -
plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the I?irector of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the °
Spokane County Health District that suitable sites for on-site sewage disposal systems
are available on both tr-acts.
9. Subject to specific application approval and issuance of permits by the health officer,
the use of individual on-site sewage disgosal systems may be authorized.
10. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of permits by the Health Officer, the use of an individual on-site sewage
system may be authorized."
11. The dedicatory language on the plat shall state: "Use of private wells and water -
systems is prohibited."
12. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by county and state health authorities, the local fire district and purveyor,
will be installed within this plat, and the subdivider will provide for individual domestic
water service as well as fire protection to each tract prior to sale of each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
l. . Pursuant to the Board of County Commissioners Resolurion No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is condirioned
on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of
pernuts by the Health District.
2. The dedicarion shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94." ,
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.

BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Requirements of Fire District No. 1 need to be satisfied during the building pernut
process. .
