1) Drainage easements, as platted and shown herevn, which are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities to dispose of runoff, are hereby
granted. The County of Spokane is hereby granted the right of ingress and egress to aIl drainage
easements adjacent to the public right of way. The property owner shall maintain the drainage
swale with a permanent live cover of lawn turf, with optional shrubbery andlor trees, which do
not obstruct the flow and percolation of storm drainage water in the drainage swale as indicated
by the approved plans.
2} The owners of Lots & , of Block , and Lots
, , & , of Block , shall be held responsible for
keeping open and maintaining the path of the natural or man-made drainage flow over and across
the property.
3) The property owner or his representative shall inform each succeeding purchaser of all drainage
easements on the property and his responsibility for maintaining drainage facilities within said
easements. 4) Spokane County does not accept the responsibility of maintaining the drainage course on private
lots within drainage.easements or floodplain areas, nor the responsibiIity for any drainage,
whatsoever, including but not limited to inverse condemnation to any properties due to deficient
construction and/or maintenance of drainage courses in drainage easements on private property.
5) The lowest building opening, including basement opening, for any building on Lots 14 .5;~

potential requirement to purchase Flood Insurance. This warning shall be carried in each and
every deed drawn to transfer ownership of any and all property within this plat in the Area of
Special Flood Hazard.

The following "Conditions of Approval" for the above referenced subdivision
are submitted to the Spokane County Planninq Department for inclusion in the
"Findinqs and Order" should the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer is given
subject to dedication of Right-of-Way and approval of the road system as
indicated in the preliminary plat of record.
E 6 No construction work is to be performed within the existing or proposed
Public Right-of-Way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
Engineer.
E12 The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
approaches to the County road system.
E13 Dedication of ten feet of additional Right-of-Way along Broadway Avenue.
E16 Existing County roads providing direct access to the plat shall be paved
and/or curbed to Spokane County standards.
E18 That sidewalks are required along the arterial(s) on Broadwav Avenue.
E19 The word "applicant" shall include the owner(s) of the property, his/her
heirs, assigns and successors.
E20 To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 3 6. 88 , as amended. At such time as an RID is created or
any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to
Broadway Avenue. i
E21 As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to
Broadway Avenue.
E22 That the following statement shall appear within the dedicatory language
of the f inal plat :
The owner(s) or successor(s) in interest agree to authorize Spok.-r.E
County to place their name(s) on a petition for the formation of a
Road Improvement District (RID) by the petition method pursuant to
Chapter 36.88 RCW, which petition includes the owner(s) property, and
further not to object, by the signing of a ballot, the formation of
a RID by the resolution method pursuant to Chapter 36.88 RCW, which
resolution includes the owner(s) property. If a RID is formed by

either the petition or resolution method, as provided for in Cliapter
36.88 RCW, the owner(s) or successor(s) further agree: (1) that the
improvements or construction contemplated within the proposed RID is
~ feasible, (2) That the benefits to be derived from the formation of
the RID by the property included therein, together with the amount
of any County participation, exceeds the cost and expense of formation
of the RID, and (3) that the property within the proposed RID is
sufficiently developed. Provided, further, the owner(s) 0. r
successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result
of the improvements called for in conjunction with the formation of
a RID by either petition or resolution method under Chapter 36.88 RCW,
and to appeal to the Superior Court the decision of the Board of
County Commissioners affirming the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. However, the owner ( s)
or successor(s) agree that if said RID waiver expires wit.hout
construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the impravemerts.
Al1 of the requirements of this agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to Broadway Avenue.
E24 The County Engineer has designated Typical Roadway Section Number Two,
Minor Arterial standard for the improvement of Broadway Avenue which is
adjacent to the proposed development. This will require the addition of
approximately 5-7 feet of asphalt along the frontage of the development.
The construction of curbing and sidewalk is also required.
E32 The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592 as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E33 The County Engineer has examined this development proposal and has .
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified. E61 The County Arterial Road plan identifies Broadway Avenue as a Minor .I
Arterial. The existing right of way width of 40 feet is not Consistent
with that specified in The Plan. In order to implement the Arterial
Road Plan it is recommended that in addition to the required right of ~
way dedication, a strip of property ten feet in width along the Broadwav ~
Avenue frontage be set aside in reserve. This property may be acquired
by Spokane County at the time when Arterial Improvements are made to
Broadway Avenue.
E90 The applicant should be advised that there may exist utilities
either underground or overhead affecting the applicants property,
including property to be dedicated or set aside future acquisition.
Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should
check with the applicable utilities and Spokane County Engineer to '
determine wYiether the applicant or utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work.

DECISION THIS MATTER, an application for subdivision of land, from Fred A. Mithoug has been
rece vSd and decided upon, pursuant to Spokane County Subdivision regulations, on the
/day of February, 1993.
FINDINGS OF FACT AND CONCLUSIONS
1. T'he individual signing below has further been properly delegated the responsibility for '
rendering the decision by the Spokane County Di.rector of Planning.
2. The proposal is to divide approximately .38 acres into two lots for single family
residences and those uses perniitted in the underlying zone. , .
3. The proposal is generally located.on the south side of and adjacent to Broadway
Avenue approximately 160 feet east of Greenacres Road in the SE 1/4 of Section 18,
Township 25 North, Range 45 E.W.M., Spol:ane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5), previously established as Agricultural (A) zoning in 1979 and reclassified to
Urban Residential-3.5 (UR-3.5) on January l, 1991 pursuant to the Program to
Implement the Spokane County Zoning Code. Pursuant to RCVV 58.17.195 the proposal
does conform to the requirements of the existing Urban Residential-3.5_ (UR-3.5) zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are genera.lly in accord with this category.
6. Surrounding uses are primarily single fanuly residences with large animal keeping on
the lots directly to the north, south, east and west of the proposed site. The
nonconfornung status of this use has not yet been determined.
7. The requireti public notice was provideci for this proposal and agencies having a
potential interest in the project were notified and recoroumendations solicited.
8. No comments were received from any adjoining property owners.
9. Recognizing the recommended condirions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health,
safety and general welfare and that the public use and interest will be served by platting
the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spo.kane County. The Planning
Department has considered the provision of adequate publiG facilities as cited in RCW
58.17.110 (2). More specif.ically:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d. transit '
e. potable water
f. sanitary waste disposal
g. parks and recreation faciliries
h, playgrounds
i. schools and schoolgrounds
j . sidewalks
The above improvements are eit!ler existing facilities or will be provided by the
applicant upon finalization of thzs short subdivision as conditioned by the Committee
and implemented by the various County agencies.

10. Broadway Avenue is a minor arterial with an existing width of 40 feet. The County
Engineer has requested dedication of an additional lU feet of right-of -way and also a
10 foot reserve strip to be designated as a Future Acquisition Area on Broadway Avenue. 11. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
12. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Baseti upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-795-92 is hereby APPROVED until March 1, 1996, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department sha11 be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residenrial-3.5 (UR-3.5) zone as amended.
3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or nunlber of lots sha11 occur without a change of
condirion applxcation submittal and approval.
4. The Planning D'u-ector/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
March 1, 1996. The applicant naay request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of util.ity easer:lents by appropriate utility companies shall be received
with the submittal of the final plat. ,
8. Three (3) current certificates of title shall be furnished to the Planning Depar[ment prior
to fili.ng the final plat.
9. The Spokane County Planning Department shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way
and utilities. The reserved future acquisition area Title Notice shall be released, in full
or in part, by the Planning~Department. The notice should be recarded within the same
time frame as an appeal and shall provide the following:
a. At least 10 feet of reserved fiiture acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Broadway Avenue.NO'r'E: The County Engineer has required 10 feet of new
dedicafion.
b. Future building and other setbacks requi_red by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.

c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway improvements are made. -
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drai,nfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
10. The final plat map shall indicate by a cl.ear, dashec] line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following statement:
"Side yard and rear yard setbacks shall be detemlined at the time build.ing permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained." ' 11. A plan for water facilities adequate for domestic service and fire protection shall be
. approved by the water purveyor, appropriate fue protection district, County Building &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
12. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for const-tiction'of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a buildirig permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
13. The final plat ded.ication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Building & Safety
Department and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for individual domesac water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."
14. No building pernut will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the foma of a letter, but is preferred to be certified on a copy of
the Water Plan as a schemaric map showing the "as-built" water system.
15. The Water Plan and the above conditions of approval regarding the Water Plan may be
waived by the Planning Director/designee upon receipt of letters from the appropriate
water purveyor and fiz-e prc,tecaon district stdting that simple connections to an existing,
approved water system will provide adequate domestic and fire protection water to
ensure the public health, safety and general welfare.
16. A survey is required prior to the filing of a final plat.
COUNTY ENGINEER'S DEPARTMENT CONDITZONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.

2. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
3. Inclividual driveway access pernuts are required prior to issuance of a building pernzi t
for driveway approaches to the county road system.
4. Dedication of 10 feet of additional right-of-way along Broadway Avenue is required.
5. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
6. Sidewalks are required along the arterial(s) on Broadway Avenue.
7. The word "applicant" sha11 include the owner or owners of the property, his heirs,
assigns and successors.
8. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such rime as an RID is
created or any Road Improvement Project is sancrioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Broadway Avenue.
9. As an alternative method of constnicting the road improvements stated herein, the
applicant may, with the approval of the Counry Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such rime as an RID is
created or any Road Impxovement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to -existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Broadway Avenue.
10. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation o£ an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolution includes the owner(s)' property. If an RZD is
fonned by either the petinon or resolution method as provided for in Chapter
36.88 RCW, the owner(;) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the formation of the RIOD by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further tJiat the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the
formation of an RID by either petition or resolution methal under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners af~'irming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participation by Spokane County.

The RID waiver conta.ined in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said RID waiver expires without construction of the required
improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvements to enable the County to
complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement)
providing for or securing to the County the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to Broadway Avenue.
11. The County Engineer has designated Typical Roadway Section Number Two, Minor
Arterial standard for the improvement of Broadway Avenue, which is adjacent to the •
proposed development. This will require the addition of approximately 5-7 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required.
12. The proposed plat shall be improved to the standards set forth in Spokane County
' Board of Commi.ssioners Resolution No. 80-1592, as amended, which resolution
establishes regulations for roads, approaches, drainage and fees in new construction.
13. The Counry Engineer has examined this development proposal and has determined that
the i.mpact of this proposal upon the existing county road system warrants the
dedication of addirional right-of-way and the roadway improvements herein specified.
14. The County Arterial Road Plan identifies Broadway Avenue as a Minor arterial. The
existing right-of-way width of 40 feet is not consistent with that specified in the PlWi.
In order to implement the Arterial Road Plan, in addition to the required-right-of-way
dedication, a strip of property 10 feet in width along the Broadway Avenue frontage
shall be set aside in reserve. This property may be acquired by Spokane County at the
time when arterial improvements are made to Broadway Avenue.
15. There may exist uti.lities, either, underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisiaon.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make axrangements for any
necessary work.
COUNTY HEALTH DISTRICT CONDZTIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County engineer and the Spokane County Health District. Written approval of the
easements by the urility companies must be received prior to the submittal of the finai
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional engineer (Spokane), State Depcinment of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County HEalth District that an adequate and potable water supply is available
to each tract of the plat.

7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat
8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that suitable sites for on-site sewage disposal systems
are available on both tracts.
9. Subject to specific application approval and issuance of permits by the health officer,
the use of individual on-site sewage disposal systems may be authorized.
10. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of permits by the Health Officer, the use of individual on-site sewage
systems may be authorized."
11. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
12. The plat dedication shall contain a statement to the effect that: "The public water
system, pursuant to the Water Plan approved by county and state health authorities, the
local fire protection district, County Building and Saf.ety Department and water
purveyor, shall be installed within this plat, and the applicant shall provide for
individual domestic water service as well as fire protection to each tract prior to sale of '
each tract and prior to issuance of a building pernut for each rract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Cominissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to speci.fic application approval and issuance of pernuts by the Health District. -
2. The dedicarion shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the fomlation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a UL.CD by either petition or resolution method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water Systern Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Fire flows are applicable for this proposal. The minimum fire flow and flow duration
for dwellings not exceeding 3600 square feet foz all floors shall be 1000 g.p.m. for
thirty minutes.
2. Verification that the existing water system is capable of supplying the required fire flow
needs to be submitted to the Department of Buildings.
