PLAT NO. SP-796-92 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land, from Clara Hepton has been rece'v d and decided upon, pursuant to Spokane County Subdivision regulations, on the
day of December, 1992.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 76 acr;,s into three (3) lots for residential uses
and those uses permitted in the underlying zone. The application, as submitted, depicted
only two (2) of the three (3) lots. The remaining portion of the original tract is counted as -
tract C of the preliminary plat. • 3. The proposal is general.ly located east of Barker Road approximately 3/4 mile south of
Eighth Avenue in the SW 1/4 of Section 20, Township 25 North, Range 45 E.W.M.
Spokane County, Washington.
4. The existing zoning of die property described in the application is Urban Residential-3.5
(UR-3.5), previously established as Agricultural (A) zoning in 1957 and redesignated to
Urban Residential-3.5 (UR-3.5) on 3anuary 1, 1991 pursuant to the Program to
Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal
does conform to the requi,rements of the.existing Urban Residential-3.5 (UR-3.5) zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. T'he
development and uses proposed are generally in accord with this category.
6. Surrounding uses are primarily residential uses associated with agriculture. Some
smaller urban sized lots are located within the area from previously approved and
finalized short subdivisions.
7. The requu-ed public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.
8. A single letter of support was received from an adjoining property owner. No other
comments were received.
9. Recognizing the recommended conditions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health, safety
and general welfare and that the public use and interest will be served by platting the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. The proposal as
conditioned dces provide adequate public facilities as cited in RCW 58.17.110 (2). More
specifically:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d. potable water
. e. sanitary waste disposal
f. parks and recreation faciliries
g. playgrounds
h . schools and schoolgrounds
i. sidewalks
The abave improvements are either existing facilities or will be provided by the applicant
upon finalization of this short subdivision as conditioned by the Planning Department and
implemented by the various County agencies.

10. The Spokane County Arterial Road Plan identifies Barker Road as a Principal arterial
with an existing width of 60 feet and a proposed width of 100 feet. To implement the .
Arterial Road Plan the County Engineer has requested dedication of an additional2 feet of right-of -way on and a Future Acquisition Area of 18 feet along Barker Road.
11. The proposed short_ plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utiliries. .
12. Spokane County Wetlands Maps indicate the presence of a seasonal stream on Tract C of
the proposed short Plat The stream, known as Saltese Creek, runs in a northwesterly
d.irection and was verified during site inspection.
13. The project is exempt from environmental review under the State Environmental Policy .
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat AppliCation
SP-796-92 is hereby APPROVED until January 1, 1996 subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended.
3. The final plat shall be designed substantially Li conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
January 1, 1996. The applicant may request an extension of time by subrrutting a
written request approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the subm.ittal of the final plat.
8. Three (3) current certificates of title shall be furnished to the Planning Department prior
to filing the final plat. .
9. The Spokane County Planning Department shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way
and utiliries. The reserved future acquisition area Title Notice shall be released, in full
or in part, by the Planning Department. The notice should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 18 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along

Barker Road. NOTE: The County Engineer has required 2 feet of new
dedication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. If
any of the above improvements are maue within this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
unprovements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedicarion shall contain the following statement:-
"Side yard and rear yard setbacks shall be determined at the time build.ing pernuts are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
11. No water plan is required, and a simple tap is needed at the time of building permit
release.
12. A survey is required prior to the filing of a final plat COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record. - 2. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
irispection and approval by the County Eng-ineer.
3. Ind.ividual driveway access pernuts are required prior to issuance of a building permit
for driveway approaches to the county road system.
4. Dedication of 2 feet of additional right-of-way along Barker Road is required..
5. A statement shall be placed in the plat dedication providing for future slope easements
as required by Spokane County along Barker Road.
6. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
7. Sidewallcs are required along the arterial on Barker Road.
8. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors. , '
9. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Barker Road.

10. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joi.ning and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Sgokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Barker Road
11. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the fonnation of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which perition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolution includes the owner(s)' property. If an RID is
formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the fo:mation of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID; and
,
(c) that the property within the propo~ed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the
formation of an RID by either petition or resolution method under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an R.ID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said RID waiver expires without construction of the required
improvements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County the then
esti.mated cost of the required improvements to enable the County to
complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execurion of another RID waiver agreement)
providing for or securing to the County the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to Barker Road.
12. The County Engineer has designated Typical Roadway Section Number Two. Minor
Arterial standard for the improvement of Barker Road, which is adjacent to the
proposed development. This will require the addition of approximately 13-15 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required. . 13. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
Tesolution establishes regulations for roads, approaches, drainage and fees in new
construction.

14. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified..
15. The County Arterial Road Plan identifies Barker Road as a Principle arterial. The
existing right-of-way width of 60 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addition to thc required right-of-way
dedication, a strip of property 18 feet in width along the Barker Road frontage shall be
set aside in reserve. This property may be acquu-ed by Spokane County at the time
when arterial improvements are made to Barker Road.
16. There may exist utilities, either underground or overhead, affecting the subject
property, includ.ing property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these uti.lities. Applicant(s) should check with the applicable utiliry purveyor
and the Spokane County Engineer to detennine whether applicant(s) or the urility is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
COUNTY HEALTH DISTRICT CONDITIONS 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Frior to filing the final plat, the sponsor shaIl demonstrate to the satisfaction of the
Spokane County Health Dismict that an adequ:ite and potable water supply is available
to each tract of the plat
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that a suitable sites for on-site sewage d.isposal systems
are available on Tract B and C.
9. Subject to specific application approval and issuance of permits by the health officer,
the use of individual on-site sewage disposal systems may be authorized.
10. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of permits by the Health Officer, the use of on-site sewage systems may
be authorized."
11. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited." .
12. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by county and state health authorities, the local fire district and purveyor,
will be installed within this plat, and the subdivider will provide for individual domestic
water service as well as fire protection to each tract prior to sale of each tract"

1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
perm.its by the Health District.
2. The detiication shall state:
"The owner(s) or successor(s) in interest agrP° to authorize the County to place their
name(s) on a petition for the formation of ULiD by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecring to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94." 3. Any water service for this project shall be provided in accordance with the Coordinated '
Water System Plan for Spokane County, as amended.
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Requirements of Fire District No. 1 need to be sarisfied during tlle build.ing permit
process.

SUBJECT: Standard Drainage LanguaLye for the Dedication on .
1) Drainage easements, as platted and shown hereon, which are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities to dispose of runoff, are hereby
granted. The County of Spokane is hereby granted the right of ingress and egress to all drainage
easements adjacent to the public right of way. The property owner shall maintain the drainage
swale with a permanent live cover of lawn turf, with optional shrubbery and/or trees, which do
not obstruct the flow and percolation of storm drainage water in the drainage swale as indicated
by the approved plans.
2) The owners of Lots & , of Block , and Lots
, , & , of Block , shall be held responsible for
keeping open and maintaining the path of the natural or man-made drainage flow over and across
the property.
3) The property owner or his representative shall inform each succeeding purchaser of all drainage
easements on the property and his responsibility for maintaining drainage facilities within said
easements. 4) Spokane County does not accept the responsibility of maintaining the drainage course on private
lots within drainage easements or floodplain areas, nor the responsibility for any drainage,
whatsoever, including but not limited to inverse condemnation to any properties due to deficient

Spokane County Flood Zone regulations in effect at the time a building permit is issued. Purchasers of property in this subdivision are warned of possible flooding or ponding and the
potential requirement to purchase Flood Insurance. This warning shall be carried in each and
every deed drawn to transfer ownership of any and all property within this plat in the Area of
Special Flood Hazard.

1) Drainage easements, as platted and shown hereon, which are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities to dispose of runoff, are hereby
granted. The County of Spokane is hereby granted the right of ingress and egress to all drainage
easements adjacent to the public right of way. The property owner shall maintain the drainage
swale with a permanent live cover of lawn turf, with optional shrubbery and/or trees, which cio
not obstruct the flow and percolation of storm drainage water in the drainage swale as indicated
by the approved plans.
