1) Drainage easements, as platted and shown hereon, which are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities to dispose of runoff, are hereby
granteci. The County of Spokane is hereby granted the right of ingress and egress to all drainage easements adjacent to the public right of way. The property owner shall maintain the drainage
swale with a permanent live cover of lawn turf, with optional shrubbery and/or trees, which do
not obstruct the flow and percolation of storm drainage water in the drainage swale as indicated
by the approved plans.
2) The owners of Lots & , of Block , and Lots
& , of Block , shall be held responsible for
keeping open and maintaining the path of the natural or man-made drainage flow over and across
the property.
3) The property owner or his representative shall inform each succeeding purchaser of all drainage
easements on the property and his responsibility for maintaining drainage facilities within said
easements. 4) Spokane County does not accept the responsibility of maintaining the drainage course on private
lots within drainage easements or floodplain areas, nor the responsibility for any drainage,
whatsoever, including but not limited to inverse condemnation to any properties due to deficient
construction and/or maintenance of drainage courses in drainage easernents on private property.
1 5) The lowest building opening, including basement opening, for any building on .L~
1 1_3 $L9&shall be high enough to allow a minimum slope of 3%
away from the building in 10 feet. All drainage shall be routed away from the building to natural
drainages or other lawful drainage features.
6) Development within this subdivision shall conform to the requirements of the National Flood
Insurance Program and Chapter 3.20 of the Spokane County Code. The lowest floor, including
basement floor, for any structure shall be constructed according to the requirements of the
Spokane County Flooci Zone regulations in effect at the time a building permit is issued. Purchasers of property in this subdivision are warned of possible flooding or ponding and the
potential requirement to purchase Flood Insurance. This warning shall be carried in each and
every deed drawn to transfer ownership of any and all property within this plat in the Area of
Special Flood Hazard. .
7) An approved lot grading plan exists for Lots and ,

Grading must conform to said plan on file in the County Engineer's Office.
8) Spokane County shall not be responsible to maintain ingress or egress across the flood plain area.

for service or benefit obtained by the planning, design, constructing, maintaining, or operation

As there is a very insignificant amount of water to consider,
only regrading for -3% slope away from the foundations is

The County's BM at Vista Road and Euclid Avenue has been

This is a very insignificant amount of water to consider. Other
alleviating factors are:
1. A drywell within the County's South Riverway Drive adja-
cent to the northeast corner of Lot A.
2. The alluvial ground is rocky and sandy, and
3. The north side of South Riverway Drive slopes toward the
Spokane River.
Recommend regrading around the perimeter of the proposed founda-
tions of the houses. This is believed to b e needed to assure 3%
grade f or 15 f t. f rom the f oundations of the houses.
In addition, one house and garage has been removed from this tract,
and one of the three houses and garages above will replace it.
Theoretically this will reduce the quantity of water by approxi-
mately one third.

DECISION
THIS MATTER, an application for subdivision of land, from C.H.D. Inc. has been~gceived
and decided upon, pursuant to Spokane County Subdivision regularions, on the 1~~`~ -Yl
day of March, 1993.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately .68 acres into 31ots for single family dwellings
and those uses permitted in the underlying zone.
3. The proposal is generally located west of Vista Road between South Riverway and
Glass Avenue in the SW 1/4 of Section 6, Township 25 North, Range 44 E.W.M.,
Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5), previously established as Agricultural zoning in 1956 and reclassified to
Urban Residential-3.5 on January 1, 1991 pursuant to the Program to Implement the
Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform
to the requirements of the existing Urban Residential-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. Surrounding uses are primarily single family dwellings.
7. The required public norice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited.
8. No comments were received from any adjoining property owners.
9. Recognizing the recommended condirions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health,
safety and general welfare and that the public use and interest will be served by platting
the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regularions, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The Planning
Department has considered the provision of adequate public facilities as cited in RCW
58.17.110 (2). More specifically:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d. transit
e. potable water
f, sanitary waste disposal
g. parks and recreation facilities
h , playgrounds
i. schools and schoolgrounds
j . sidewalks
The above improvements are either existing facilities or will be provided by the
applicant upon finalization of this short subdivision as condidoned by the Committee
and implemented by the various County agencies.
10. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.

11. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-500 (6) (a).
12. The subject property and adjacent parcel owned by the applicant and described as
assessors parcel number 45063.9040 were the subject of a lot line adjustment through
the Certificate of Exemprion process to modify the respective boundaries of each parcel.
This lot line adjustment was approved by the Spokane County Planning Department on
March 19, 1993 (see Certificate of Exemprion file CE-714-92).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-798-92 is hereby APPROVED until April 1, 1996, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant andJor
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval appty to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) as amended.
3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Condidons of Approval.
5. Appropriate road name(s) shall be indicated.
6. ary plat is given condidonal approval for three (3) years, specifically to

r approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate urility companies shall be received
with the submittal of the final plat.
8. Three (3) current certificates of dtle shall be furnished to the Planning Department prior
to filing the final plat.
9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building pernuts are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
10. A plan for water facilities adequate for domestic service and fire protecdon shall be
approved by the water purveyor, appropriate fire protection district, County Building &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.

11. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for complerion of the water system and inspection by the appropriate health authorities
prior to application for build.ing permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
hannless from claims by any lot purchaser refused a building pernut due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
12. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Building & Safety
Department and water purveyor, shall be installed within this subdivision, and the
applica.nt shall provide for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."
13. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
14. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general welfare.
15. A survey is required prior to the filing of a final plat,
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the County Engineer for approval prior to construcdon and/or the
filing of the final plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
3. No construction work is to be performed within the exisring or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
4. Individual driveway access pernuts are required prior to issuance of a building pernut
for driveway approaches to the county road system.
5. Dedication of 7.75 feet of additional right-of-way along Glass Avenue is required.
6. Exisring county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
8. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any peririon or resolution
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to exisring
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to South Riverway and Glass Avenue.
9. As an alternative method of construcring the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
.

improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements requiretl (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to South Riverway and Glass Avenue.
10. The following statement shall be placed in the plat dedicarion:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formarion of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formarion of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolution includes the owner(s)' property. If an RID is
formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the
fonnation of an RID by either petition or resolution method under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners affirnung the final assessment roll.
It is further agreed that at such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said RID waiver expires without construction of the required
improvements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvements to enable the County to
complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execudon of another RID waiver agreement)
providing for or securing to the County the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to South Riverway and Glass Avenue.
11. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the improvement of South Riverway and Glass Avenue, which is
adjacent to the proposed development. This will require the addition of approximately
9- 11 feet of asphalt along the frontage of the development. The construction of
curbing is also required.
12. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction. 13. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified.

14. 'There may exist utilides, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obliga[ion for adjustments or relocation
regarding these utiliaes. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to deternune whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
15. The applicant is advised to consult with the Ciry of Millwood to discuss any required
dedicaaon or necessary road improvements for Vista Road.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Deparnnent to the utility companies, Spokane
County Engineer and the Spokane County Health DistricL Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utiliries, Spokane
County.
4. Water service shall he coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that a suitable site(s) for on-site sewage disposal
systems are available on all tracts.
9. Subject to specific applicarion approval and issuance of permits by the Health Officer,
the use of individual on-site sewage disposal system(s) may be authorized. Special
construction techniques may be required.
10. The dedicatory language of the plat sha11 state: "Subject to specific application approval
and issuance of permits by the health officer, the use of (an) individual on-site sewage
disposal system(s) may be authorized."
11. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
12. The plat dedicadon shall contain a statement to the effect that: "The public water
system, pursuant to the Water plan approved by county and state health authorities, the
local fire district, County Building and Safery and water purveyor, shall be installed
within this plat, and the applicant shall provide for individual domestic water service as
well as fire protection to each tract prior to sale of each tract and prior to issuance of a
building permit for each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorizarion is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific applicarion approval and issuance of
permits by the Health District.

2. The dedication shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which petirion includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formarion of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Fire flows are applicable for this proposal. The minimum fire flow and flow duration
for dwellings not exceeding 3600 square feet for all floors shall be 1000 g.p.m. for
thirty minutes.
2. An approved water supply capable of supplying the required fire flow protection shall
be provided before any building permits are issued. The water system shall be installed
in accordance with an approved Water System Plan on file with the Department of
Buildings. Certificadon that the installed system complies with the requirements of the
plan and is operational shall be submitted to the Department of Buildings.
3. Hydrant location, number and type capable of delivering the required fire flow for
residential development shall be provided in accordance with required design
specifications. The average distance between hydrants shall be 600 feet and shall not
exceed 700 feet.
4. Existing vacant structures will need to be removed to avoid conflict with proposed
property lines.

5. Appropriate road name(s) shall be indicated.
b. The preliminary plat is given conditional approval for three (3) years, specifically to
April 1, 1996. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date. 7. Appropriate utility easements shall be indicated on copies of the proposed fina.l plat.
Written approval of utility easements by appropriate utility campanies shall be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be furnished to the Planning Department prior
to filing the final plat.
9. The final plat map shall indicate by a clear, dashed line the requiz-ed yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the rime building pem~ts are
requested unless these setbacks are specifically drafted on thi_s final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
10. A plan for water faciLities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County Building &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.

11. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
12. The finai plat dedicauon shall contain the following statennent:
"'The public water system, pursuant to the Water Plan approved by county and state
heatth authorities, the local fire protection district, 'County Building & Safety
Department and water purveyor, shall be installed within this subd.ivision, and the
applicant shall provide for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a bui.lding permit for each lot."
13. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the fonn of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
14. The Water Plan and the above four (4) condirions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fise protection district stating that simple coruiections to
an existing, approved water system will provide adequate domestic and fire protecrion
water to ensure the public health, safety and general welfare.
15. A survey is required prior to the filing of a final plat. -
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The cond.itional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the County Engineer for approval prior to construction and/or the
filing of the final plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
3. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
4. Individual driveway access pernuts are required prior to issuance of a building permit
for driveway approaches to the county road system.
5. Dedication of 7.75 feet of additional right-of-way along Glass Avenue is required.
6. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
8. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the formarion of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such rime as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewallc, drai.nage control and paving to exisring
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to South Riverway and Glass Avenue. .
9. As an alternative method of constructing the road irnprovements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road

improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sancaoned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to South Riverway and Glass Avenue.
10. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of a Road Improvement District
(RID) by the petition method pursuant to Chaptex 36.88 RCW, which petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolurion includes the owner(s)' property. If an RID is
formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed
RID is feasible;
(b) that the benefits to be derive,d from the formation of the RI.D by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the irnprovements called for in conjunction with the
formation of an RID by either petition or resolution method under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participation by Spokane County.
The RID waiver contained in this agre.ement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said RID waiver expires without construction of the required
iznprovements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County t.he then
estimated cost of the required improvements to enable the County to
complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement)
providing for or securing to the County the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to South Riverway and Glass Avenue.
11. The Caunty Engineer has designated Typical Roadway Secrion Number Two, Local
Access standard for the improvement of South Riverway and Glass Avenue, which is
adjacent to the proposed development. This will require the addition of approxi.nlately
9- 11 feet of asphalt along the frontage of the development. The construction of
curbing is also required.
12. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulatians for roads, approaches, dra.inage and fees in new
construction.
13. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified..

14. There may exist utiliries, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regardi.ng these utilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant(s) or the utility is
responsible for adjusanent or relocarion costs and to make an-angements for any
necessary work.
15. The applicant is advised to consult with the City of Millwood to discuss any required
dedication or necessary road improvements for Vista Road.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District Written approval of the
easements by the utility campanies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utiliries, Spokane
County. 4. Water service shall be coordinated through the I?irector of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is avai.lable
to each tract of the plat. 7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfacrion of the
Spokane County Health District that a suitable site(s) for on-site sewage disposal
systems are available on all tracts.
9. Subject to specific application approval and issuance of permits by the Health Officer,
the use of individual on-site sewage disposal system(s) may be authorized. Special
construcrion techniques xnay be required.
10. The dedicatory language of the plat shall sta.te: "Subject to specific applicarion approval
and issuance of permits by the health officer, the use of (an) individual on-site sewage
disposal system(s) may be authorized."
11. The dedicatory language on the plat shall sta.te: "Use of private wells and water
systems is prohibited."
12. The plat dedication shall contain a statement to the effect that: "The public water
system, pursuanx to the Water plan approved by county and state health authorities, the
local fue district, County Build.ing and Safety and water purveyor, shall be installed

COUNTX UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolurion No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
pennits by the Health District.

pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plu.mbed for
connection to future areawide collection systems."
BUILDING AND SAFETY DEPARTMENT CONDITI4NS
1. Fire flows are applicable for this proposal. The minimum fire flow and flow duration
for dwellings not exceeding 3600 square feet for all floors shall be 1040 g.p.m. for
thirty minutes.
2. An approved water supply capable of supplying the required fire flow protection shall
be provided before any building permits are issued. The water system shall be installed
in accordance with an approved Water System Plan on file with the Department of
Buildings. Cerrification that the installed system complies with the requirements of the
plan and is operational shall be submitted to the Department of Buildi.ngs.
3. Hydrant locarion, number and type capable of delivering the required fire flow for
residential development shall be provided in accordance with required design
specifications. The average distance between hydrants shall be 600 feet and shall not
exceed 700 feet.
4. Existing vacant structures will need to be removed to avoid conflict with proposed
property lines.
