SP-804-92 CONCLUSIONS AND DECISION THIS MATTER, an application for subdivision of land, from Kerry and Patricia Farrar has been received and decided upon, pursuant to Spokane County Subdivision regulations, on the /31 day of September, 1993. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibiliry for rendering the decision by the Spokane CoLYnty Director of Planning. 2. The proposal is to divide approximately 4.2 acres into 41ots for single family dwellings and those uses pemlitted in the underlying zone. 3. The subject property is a replat of Lot "M" a►id a pomon of Lot "N" of Plat "A" of the Greenacres Irrigation District, which was approved as a final plat by the Board of County Commissioners of Spokane County on November 11, 1904. . 4. The proposal is generally located north of Riverway Road and south of the Spokane River, approxunately 130 feet east of Ederi Place in the NE 1/4 of Section 7, Township 25 North, Range 45 E.W.M., Spokane County, Washington. 5. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5), previously established as Agricultural (A) (file # 480-58) zoning in 1958 and redesignated to UR-3.5 on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing UR-3.5 zone. 6. The Spokane County Comprchensive Plan designates this area as Urbzin. The development and uses proposed are generally in accord with this category. 7. ~unounding uses are primarily single family residences and open space. 8. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 9. No written co.mments were received from any adjoining property owners. ; 10. The site is located within the Public Transportarion Benefit Area (PTBA). The Spokane Transit Authority (STA) Broadway Route #18 provides connecting services to the site. 11. The proposed short plat will be served by a public water system. Waste water disposal will be as authorized by the Director of Utilities, Spokane County. 12. The Spokane County Parks Department has commented on the proposed short plat. The Parks Department has requested a voluntary agreement be completed between the Parks Department and the property owner to mitigate impacts to the Counry Park system. County legal counsel has indicated such agreements may be required. The Spokane County Planning Department recommends the property owner negoCiate with the Spokane County Parks Department to provide for appropriate capital facilities as , required by the Revised Code of Washington (RCW) 58.17.110. Approval of this short plat should include conditions requiring that provisions for appropriate facilities be in place prior to recording tllis final plat in the foml of a written agreement between the owner and the Spokane County Parks Dcpartment 13. Recognizing the recommended conditions and Spokane County development standards, the proposed short subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. , I FINDINGS AND DECISION SP-804-92 Page 2 The subdivision proposal is generaliy consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and genera.l welfare in accordance with standards established by the state and Spokane County. The Planning Department has considered the provision of adequare public facilities as cited in RCW 58.17.110 (2). More specifically: . a.. open spaces b. drainage ways c. public and/or private rights-of-way d. transit - e. potable water f. sanitary waste disposal g. parks and recreation facilities h . playgrounds i. schools and schoolgrounds j . sidewalks 14. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). 15. The following fact is also relevant: The Spokane County Shorelines Master Probram designates a portion of this site as a Pastoral Area. However, Section IIT of the Spokane County Shoreline Program lists additiona] criteria in determining the Shoreline Designation (Section 3.2 (1)). Specifically; A11 shoreline areas within subdivisions or plats receivinb preliminary approval by December 13, 1974, shall be designated ta the Rural Area where such properties have not been designated Urban and Rural on the iiiap. Therefore, the shorelines designation is Rural. The Rural Area Designation is presently used for agricultural, recreational and low-dciisity suburban types af development and/or has the potential of becoming prime farm land. The purpose of designating the Rural Area in Spokane County is to protect agricultural land from urban expansion and to provide foi- extensive and intensive recreational uses where these recreational uses do not conflict with agricultural practices. This - environment is designated to preserve shorelines most suitable for agricultural uses and recreational pursuits. Urban and low-density suburban expansion in the future is not intended for the Rural Area even though some areas presently containing characteristically suburban developments may be contained with areas designated as Rural Areas. DECISION . . Based upon the above noted Findings of Fact and Conclusions, Short Plat Applicaaon SP-804-92 is hereby APPROVED until Octoher l, 1996,, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalizatioil of lhe short subdivision.
