IN THE MATTER OF ) FINDINGS OF FACT, SHORT PLAT NO. SP-805-92 ) CONCLUSIONS AND
' DECISION
THIS MATTER, an applicarion for subdivision of land, from Fire District No. 1 has been
received and deciaed upon, pursuant to Spokane County Subdivision regulations, on the
~ ?441 day of January, 1993.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 38,000 square feet into 21ots for a Fire
Station, one single family dwelling, and those uses permitted in the underlying zone.
3. The proposal is generally located at the northeast corner of Twelfth Avenue and
Evergreen Road, in the SW 1/4 of Secrion 23, Township 25 North, Range 44 E.W.M.,
Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5), previously established as Agricultural (A) zoning (60-42) in 1942, and
reclassified to UR-3.5 on January 1, 1991 pursuant to the Program to Implement the
Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform
to the requirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. Surrounding uses are primarily single family residences on lots of various sizes. Many
of the lots have animal keeping facilities such as barns, comals and pastures. A child
care center, a junior high school, two elementary schools, and two churches are located
within a one mile radius of the subject property.
7. The required public norice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited.
8. Comments were received from one adjoining property owner who opposes the
preliminary shoz-t plat. The property owner was concern about potential accidents,
noise and property devaluation. Also a concern was the limited sight distance and size
of Evergreen Road
9. Recognizing the recommended conditions and Spokane County development standards,
the proposed short subdivision makes appro, :)riate provisions for the public health,
safety and general welfare and that the public use and interest will be served by platting
the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoring the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The proposal
as condiaoned does provide adequate public facilities as cited in RCW 58.17.110 (2).
More specifically: '

The above i.mprovements are either existing faci.lities or will be provided by the
applicant upon finalization of this short subdivision as conditioned by the C:ommittee
and implemented by the various County agencies. _
10. Evergreen Road is a Principal Arterial with an existing right-of-way width of 60 feet.
To implement the future Arterial Road Plan, the County Engineer has requested
dedication of an additional4 feet of right-of -way on Evergreen Road. _
11. Twelfth Avenue is a local access road with an existing right-of-way width of 40 feet.
To implement the future Arterial Road Plan, the County Engineer has requested
dedication of an addirional 10 feet of right-of -way on Twelfth Avenue.
12. The proposed short plat wifl be served by a public water system prov'ided by the Vera
Water and Power Company. Waste water disposal will be as authorized by the Director
of Utilities.
13. The applicant agrees to provide adequate screening and landscaping around the
proposed property that will be appropriate in Urban Residential-3.5 (UR-3.5) zone,
and serve as a barrier to lessen any potenrial noise impacts to the neighborhood.
14. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (b) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-805-92 is hereby APPROVED until February 1, 1996, subject to conditions noted
below. Most of the conditions of approvai shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITZONS
1. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with the Urban Residenrial-3.5 (UR-3.5) zone as amended.
3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
4. The Planning Director/designee shall revYew any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
February 1, 1996. The applicant may request an extension of tune by submitting a
written request approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility compames shall be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be furnashed to the Planning Deparnment prior
to filing the final plat.
9. T'he Spokane County Planning Department shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way

and utilities. The reserved futwe acquisition area Title Notice shall be released, in full
or in part, by the Planning Department. The notice should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 16 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Evergreen Road. NOTE: The County Engineer has required 4 feet af new .
dedication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved fiiture acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when r.oadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
10. The final plat map shall indicate by a clear, dashed line the requi,red yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building permi.ts are
requested unless these setbacks are specificCy drafted on this final plat. The setbacks
ind.icated on this plat may be varied from if, proper zoning approvals are obtained."
11. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection d.istrict, County Building &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a fina.l plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
12. The water purveyor shall certify that appropriate contractual arrangements and schedule
of irnprovements have been made with the plat sponsor for construcrion of the water
y tem in accordance with the approved Water Plan. The time schedule shall provide
for compleuon of the water system and inspection by the appropnate health authonties
prior to application for building permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a building pernut due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
13. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protecdon district, County Building & Safety
Departznent and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."
14. No building perm.it will be issued for any lot within the final plat unril certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license staxnp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schennatic map showing the "as-built" water system.
15. The Water Plan and the above four (4) condirions of approval regarding the Water Plan
may be wa.ived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safery and general welfare.

16. A survey is required prior to the fihng of a final plat
17. The applicant shall provide type I landscaping strip with a minimum width of ten (10) feet along the side and rear properry lines that are not abutting any public,street, as cited
in the Spokane County Zoning Caie. In addition, a six (6) foot high, sight obscuring
fencing will be provided along the side and rear proposed property lines.
18. The applicant shall provide type III landscaping strip with a minimum width of five (5)
feet along Evergreen Road and Twelfth Avenue, as citeri in the Spokane County Zoning
Code.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. No construction work is to be performed wV'hin the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
3. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
4. Dedication of 4 feet of additional right-of-way along Evergreen Road is required.
. 5. Dedication of 10 feet of additional right-of-way along Twelfth Avenue is required.
6. A sta.tement shall be placed in plat dedication that no direct access be allowed from lot
"A" to Evergreen Road. -
7. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
8. Sidewalks are required along the arterial on Evergreen Road.
9. The word "applicant" sha11 include the owner or owners of the property, his heirs,
assigns and successors.
10. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petirion or resolurion
which purpose is the fonnation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (cwrb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, g.rantees
and assigns. This provision is applicable to Evergreen Road and Twelfth Avenue.
11. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CR.P) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sancrioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Evergreen Road and Twelfth Avenue.
12. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the forrration of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolution includes the owner(s)' property. If an RID is
formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:

(a) that the i.mprovement(s) or construction contemplated within the proposed
RID is feasible; ,
(b) that the benefits to be derived from the formarion of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of fonnation of the RID; and _
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) sha11 retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the
fonnation of an RID by either p°tition or resolution method under Chapter
36.88 RCW, and to appeal to t~ic, Superior Court the decision of the Board
of County Commissioners aff'uming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road _
Improvement Project is sanctioned by Spokane County, the i.mprovements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said. RID waiver expires without construction of the required
improvements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvements to enable the County to
complete the same, or furnish a bond or other secure method suitable to the
Counry (which may include the execution of another RID waiver agreement)
providing for or securing to the County the actual construction of the
improvements. All of the requ.irements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to Evergreen Road and Twelfth Avenue.
13. The County Engineer has designated Typical Roadway Section Number Two, Principal
Arterial standard for the improvement of Evergreen Road, which is adj acent to the
proposerl developmern. This will require the addition of approximately 13-15 feet of
asphalt along the frontage of the development. The construcrion of curbing and
sidewalk is also required.
14. The Counry Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the improvement of Twelfth Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 8-10 feet of
asphalt along the frontage of the development. The construction of curbing is also
required.
15. The proposed subd.ivision shall be improved to the staridards set forth in Spokane
County Board of Commissioners Resolurion No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
16. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
~ dedication of additional right-of-way and th° roadway improvements herein specif'ied.

,17. The applicant shall dedicate the applicable radius on Evergreen Road and Twelfth
Avenue.
. The County Arterial Road Plan identifies Evergreen Road as a Principal arterial. The
eacisting right-of-way width of 60 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of property 16 feet in width along the Evergreen Road frontage shall
be set aside in reserve. This property may be acquired by Spokane County at the tirne
when arterial impxovements are made to Evergreen Road.

19. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation .
regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to detern:ine whether applicant(s) or the utility is
responsible for adjustrnent or relocation cos'Ls and to make arrangements for any
necessary work.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Deparoment to the utility companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat. 3. Sewage disposal method shall be as authorized by the Directcr of Utilities,Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that the existing on-site sewage disposal system(s)
serving tracts A and B are wholly located within the boundaries of the tracts.
8. Subject to specific application approval and issuance of pennits by the health officer,
the use of (an) ind.ividual on-site sewage disposal system(s) may be authorized.
9. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of permits by the Health Officer, the use of individual on-site sewage
system(s) may be authorized."
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
11. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by county and state health authorities, the local fire district and purveyor,
will be installed within this plat, and the subdivider will provide for individual domesric
water service as well as fire protection to ea::h tract prior to sale of each tract."
12. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer d.isposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific applicarion approval and issuance of
permits by the Health District.
2. The dedication shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their

BUYLDING AND SAFETY DEPARTMENT CONDITIONS
1. The required fire flow for any building or subdivision is determined by building size,
type of construction and proxi.mity of exposures. Based on information presented to this office regarding this subdivision, the minimum fire flow established by code of
500 gallons per minute for 30 minutes is being required.

1) Drainage easements, as platted and shown hereon, which are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities to dispose of runoff, are hereby
granted. The County of Spokane is hereby granted the right of ingress and egress to all drainage
easements adjacent to the public right of way. The property owner shall maintain the drainage
swale with a permanent live cover of lawn turf, with optional shrubbery and/or trees, which do
not obstruct the flow and percolation of storm drainage water in the drainage swale as indicated
by the approved plans.

keeping open and maintaining the path of the natural or man-made drainage flow over and across
the propercy.
3) The property owner or his representative shall inform each succeeding purchaser of all drainage

4) Spokane County does not accept the responsibility of maintaining the drainage course on private _
lots within drainage easements or floodplain areas, nor the responsibility for any drainage,
whatsoever, including but not limited to inverse condemnation to any properties due to deficient
construction and/or maintenance of drainage courses in drainage easements on private property.

away from the building in 10 feet. All drainage shall be routed away from the building to natural
drainages or other lawfiil drainage features. 6) Development within this subdivision shall conform to the reguirements of the National Flood
Insurance Program and Chapter 3.20 of the Spokane County Code. The lowest floor, including
basement floor, for any structure shall be constructed according to the requirements of the
Spokane County Flood Zone regulations in effect at the time a building permit is issued. Purchasers of property in this subdivision are warned of possible flooding or ponding and the
potential requirement to purchase Flood Insurance. This warning shal( be carried in each and
every deed drawn to transfer ownership of any and all property within this plat in the Area of
Special Flood Hazard.
7) An approved lot grading plan exists for Lots and ,

Grading must conform to said plan on file in the County Engineer's Office.
8) Spokane County shall not be responsible to maintain ingress or egress across the flood plain area.

for service or benefit obtaineci by the planning, design, constructing, maintaining, or operation

pprmits be reguired prior to issuance of a building permit for driveway approaches to the County
road system. This approach shall be constructed in accordance with the approved plan on file
in the County Engineer's office.

The followinq "Coaditions of Approval" for the above referenced subdivision
are submitted to the Spokane County Planninq Department for inclusion in the
"Findings and Order" should the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer is given
subject to dedication of Right-of-Way and approval of the road system as
indicated in the preliminary plat of record.
E 6 h'o coi'lstruction work is to be performed within the existing or propo5cd
Public Right-of-Way until a permit has been issued by the County
Engineer. Al1 work is subject to inspection and approval by the County
Engineer. E12 The applicant should be advised that individual driveway access permits

required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to
Evercxreen Road and Twelfth Avenue.
E22 That the following statement shall appear within the dedicatory language

County to place their name(s) on a petition for the formation of a

Road Improvement District (RID) by the petition method pursuan~ to
Chapter 36.88 RCW, which petition includes the owner(s) property, and
further not to object, by the signing of a ballot, the formation of
a RIp by the resolution method pursuant to Chapter 36.88 RCW, which
resolution incltides the owner(s) property. If a RID is formed by
either the petition or resolution method, as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree: (1) that the
improvements or construction contemplated within the pz•oposed RID is
feasible, (2) That the benefits to be derived from the formation of
the RID by the property included therein, together with the amount
of any County participation, exceeds the cost and expense of formation
of the RID, and (3) that the property within the proposed RID is
sufficiently developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment~(s) on the property as a result
of the improvements called for in conjunction with the formation of
a RID by either petition or resolution method under Chapter 36.88 RCW,
and to appeal to the Superior Court the decision of the Board of
County Commissioners affirming the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. However, the owner(s)
or successor(s) agree that if said RID waiver expires without
construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements.
All of the requirements of this agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to Evercreen Road and Twelfth Avenue.
E24 The County Engineer has designated Typical Roadway Section Number Twoi
Principal Arterial Standard for the improvement of Evercxreen Road which
is adjacent to the proposed development. This will require the addition
of approximately 13-15 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required.
E24 The County Engineer has designated Typical Roadway Section Number Twot
Local Access standard for the improvement of Twelfth Avenue which is
adjacen-t to the proposed development. This will require the addition of
approximately 8-10 ft. of asphalt along the frontage of the development.
The construction of curbing is also required.
E32 Z'he proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E33 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
E38 Applicant shall dedicate the applicable radius on Everqreen Road and
Twelfth Avenue.
E61 The County Arterial Road plan identifies Everqreen Road as a Principal
Arterial. The existing right of way width of 60 feet is not consistent

Road Plan it is recommended that in addition to the required right of

way dedication, a strip or property 16 feet in width along the Evercxreen
Road frontage be set aside in reserve. This property may be acquired by
Spokane County at the time when Arterial Improvements are made to

E90 The applicant should be advised that there may exist utilities
either underground or overhead affecting the applicants property,
including property to be dedicated or set aside future acquisition.
Spokane County will assume no financial obligation for adjustments
or relocation regarding these utilities. The applicant should
check with the applicable utilities and Spokane County Engineer to
determine whether the applicant or utility is responsible for
adjustment or relocation costs and to make arrangements for any
necessary work.
