BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-826-92 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subci,ivision of land, from Phil Vigue has been receeiyed
and decided upon, pursuant to Spokane County Subdivision regulations, on the -3
day of March, 1993.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 1.3 acres into 31ots for one existing single
family residence, two additional residential lots, and those uses permitted in the underlyi.ng zone.
3. The proposal is generally located north of 12th Avenue approximately 1,000 feet west
of Pines Road in the SE 1/4 of Section 21, Township 25 North, Range 44 E.W.M.
Spokane County, Washington. ~
4. The existing zoning of the property described in the application is Urban Residential-
3.5 (UR-3.5), previously established as Agricultural Suburban (AS) zoning in 1955
(ZE-171-55) and redesignated to UR-3.5 on January 1, 1991 consistent with the
Program to Implement the Spokane County Zoning Code. Pursuant to RCW
58.17.195, the proposal generally conform to the requirements of the existing UR-3.5
zone.
The existing garage located on proposed Lot A may be located within, or near, the 25
foot front yard setback area. Subdivision of property should not create nonconformi.ng
setbacks for existing stzuctures. A detailed site plan should be required to verify
conformance with UR-3.5 setback standards.
5. The Spokane Counry Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. The site contains an existing single fam.ily residence and accessory structures.
Surrounding uses are primarily residential on small acreage lots. Some large animal
keeping is srill present in the area.
7. . The required public notice was providetl for this proposal and agencies having a
potential interest in the project were notif ed and recommendations solicited.
8. No written comments were received from any adjoining property owners.
9. The site is located within the Public Transit Benefit Area (PTBA). Route 21,
Valley/24th Avenue Feeder, provides connecting service to the Valley Transit Center.
10. The Spokane County Arterial Road Plan identifies Twelf.th Avenue as a Local Access
Street. The County Engineer has requested dedication of an additional five feet of
right-of-way on Twelfth Avenue. By adopted Spokane County standards, sidewalks
are not required for this proposal.
11. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utiliries.
12. Recognizing the recommended conditions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health,
safety and general welfare and that the public use and interest will be served by platting
the short subdivision.
The short subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with standaxds established by the state and Spokane County. The Planning

Department has considered the provision of public facilities as cited in RCW 58.17.110
(2). More specifically:
a. open spaces
b . d.rainage ways
c. public and/or private rights-of-way
d. transit -
e. potable water
f. sanitary waste disposal
g. parks and recreation faciliries
h , playgrounds
i. schools and schoolgrounds
j . sidewalks
The above improvements are either existing faciliries and services or will be provided
by the applicant upon finalization of this short subdivision as conditioned by the
Planning Department and implemented by the various County agencies.
13. An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Department. The review considered the specifics of the proposal,
other available informarion, County ordinances, other regularions and laws, possible
standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Departrnent has determined that "No
probable significant adverse impacts" would result from the proposal being developed
and has issued aDeterminltion of Nonsignificance ("DNS").
The "DNS" was circulated to eighr other agencies of jurisdiction and other
agencies/departrnents affected by the future development for review and comment. The
"DNS" comment period ends March 18, 1993 and was adverrised 15 calendar days by
letter to adjacent properry owners. The Planning Department has not received
additional comments.
DECISION
Based upon the above noted Findings of Fact and Conciusions, Short Plat Application
SP-826-92 is hereby APPROVED until April l, 1996, subject to condirions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
PLANNING DEPARTMENT CONDITIONS
1. All cond.itions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors. .
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended.
All buildings will meet current setback standards. A site plan showing existing
build.ings and their setbacks from lot lines is required prior to finalization of the short
subdivision.
3. The fi.nal plat shall be designed substantially in conformance with the preliminary plat
of record. No increase in density or number of lots shall occur without a change of
condition application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indiclted.
6. The preliminary plat is given cond.itional approval for three (3) years, speci.fically to
April 1, 1996. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.

7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Wntten approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be furn.ished to the Planning Department prior
to f~ling the final plat.
9. The final plat map shall indicate by a clear, dasheti line the required yard setbacks from
all private, "Tract X" or public roads. The dedicarion shall contain the following
statemerit:
"Side yard and rear yard setbacks sha11 be determined at the time building pernuts are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
10. A plan for water facilities adequate for domestic service and fire protection shall be
. approved by the water purveyor, appropriate fu-e protection district, County Building &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their -
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
11. The water purveyor shall cemfy that appropriate contractual an-angements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building pernuts within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to sarisfactorily complete the approved water system.
12. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Building & Safety
Department and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for individual domestic water 'service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building pemlit for each lot."
13. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be i.n the form of a letter, but ispreferred to be certified on a copy of
the Water Plan as a schematic map showing the ,as-built water system.
14. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protecrion district stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protecrion
water to ensure the public health, safety and general welfare.
15. A survey is required prior to the filing of a final plaL
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
C2. Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the County Engineer for approval prior to construction and/or the
filing of the final plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
3. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.

4. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
5. Dedication of 5 feet of additional right-of-way along Twelfth Avenue is required.
6. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
8. To construct the road 'unprovements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the fonnarion of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and -assigns. This provision is applicable to Twelfth Avenue. 9. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the requireti road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the -undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Twelfth Avenue.
10. The following statement shall be placed in the plat dedicarion:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petirion for the formation of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolution includes the owner(s)' property. If an RID is
formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the
formation of an RID by either petition or resolution methai under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road
Improvement Project is sancrioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said RID waiver expires without construction of the required
improvements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvements to enable the County to

complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement)
providing for or securing to the County the actual construction of the
improvements. All of the requirements of this agreement shall run with the land ajid shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to Twelfth Avenue. 11. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the improvement of Twelfth Avenue, which is adjacent to the
proposed development. This will require the add.irion of approximately 8-10 feet of
asphalt along the frontage of the development. The construction of curbing is also
required.
12. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
13. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of addirional right-of-way and the road'way improvements herein specified.
14. There may exist utilities, either underground or overhead, affecting the subject
property, including progerty to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustrnents or relocarion
regarding these utilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant(s) or the uti.lity is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utiliries, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane Counry.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District tliat an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the fi.nal plat, the sponsor -shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. A plan for water facilities adequate for domestic use, domestic irrigation use and fire
protection use shall be approved by the water purveyor. Said water plan must have
been approved by the fire protecrion district and the appropriate health authoriries. The
health authorities, water supplier (purveyor) and the fire protection district will certify,
prior to the fiiing of the final plat, on the face of said water plan that the plan is in
conformance with their requzxemerits and will adequately satisfy their respective needs.
Said water plan and certification will be drafted on a transparency suitable for
reproduction.

9. The purveyor will also certify prior to filing the final plat on a copy of said water plan
that appropriate contractual arrangements have been made with the plat sponsor for
construction of the water system, in accordance with the approved plan and-time
scherlule. The time schedule will provide, in any case, for completion of the water
system and inspection by the appropriate health authorities prior to application for
building pemiits within the plat. The contractual arrangements will include a provision
holding Spokane County/Ciry of Spokane, Spokane County Health District and the
purveyor harmless from claims by any lot/tract purchaser refused a building permit due
to failure of the plat sponsor to satisfactorily complete the approved water system.
10. Prior to filing the final plat, the sponsor shall demonstrate to the satisfacrion of the
Spokane Counry Health District that a suitable sites for on-site sewage disposal systems
are available on tracts B& C.

12. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of pemuts by the Health Officer, the use of on-site sewage systems may
be authorized.."
13. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
14. The final plat dedication shall contain the following statement: "The public water
system, pursuant to the water plan approved by county and state health authorities, the
local fire protection district, County Building and Safety Department, and water
purveyor, shall be installed within this subdivision and the applicant shall provide for
individual domestic water service as well as fire protection to each lot/tract prior to sale
of ea.ch lotltract and prior to issuance of a building permit for each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Comxnissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is cond.itioned
on compliance with all rules and regularions of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The dedication shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formarion of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjuncrion
with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coorda.nated Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. A private driveway road is being proposed. The driveway shall be constructed in
substanrial conformance with standards established by the Department of Buildings.
2. Fire flows are applicable for this proposal. The minimum fue flow and flow duration
will be based on a representative dwelling size for all floors not including the basement.
The maximum dwelling size needs to be submitted to the Department of Buildings.

a RID by the resolution method pursuant to Chapter 36.88 RCW, which

either the petition or resolution method, as provided for in Chapter
36.88 RCW, the owner ( s) or successor ( s)- f urther agree :(1) that the
improvements or construction contemplated within the proposed RID is
feasible, (2) That the benefits to be derived from the formation of
the RID by the property included therein, together with the amount
of any County participation, exceeds the cost and expense of formation
of the RID, and (3) that the property within the proposed RID is
sufficiently developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized under RCW
36. 88. 090, to object to any assessment (s) on the property as a result
of the improvements called for in conjur.ction with the formation of
a RID by either petition or resolution method under Chapter 36.88 RCW,
and to appeal to the Superior Court the decision of the Board of
County Commissioners affirming the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. However, the owner(s)
or successor(s) agree that if said RID waiver expires without
construction of the required improvements, the owner(s) or
successor (s) agree to. construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements.
All of the requirements of this agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to Twelfth Avenue.
E24 The County Engineer has designated Typical Roadway Section Number Twoi
Local Access Standard for the improvement of Twelfth Avenue which is
adjacent to the proposed development. This will require the addition of
approximately 8'-10 feet of asphalt along the frontage or the
development. The construction of curbing is also required.
E32 The proposed plat shall be improved to thP standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E33 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
E90 The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside future acquisition. Spokane
County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to determine whether

1) Drainage easements, as platted and shown hereon, which are for the purpose of installing,
operating ancl maintaining drainage swales and drainage facilities to dispose of runoff, are hereby
