The County of Spokane is hereby granted the right of ingress and egress to all drainage easements adjacent to the public right of way. SP-829-93 ) CONCLUSIONS AND DECISION THIS MATTER, an application for subdivision of land, from Pauline G'irsberger Giordano has been z ceived and decided upon, pursuant to Spokane Counry Subdivision regulaaons, on the ~ C►'fg3 day of March, 1993. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide approximately .9 acres into three (3) lots for one existing single family residence and two new single family residences and those uses pernutted in the underlying zone. 3. The proposal is generally located at the northwest corner of Boone Avenue and Locust Road in the NW 1/4 of Section 17, Township 25 North, Range 44 E.W.M., Spokane County, Washington. 4. The existing zoning of the property described in the application is Urban Residentia.l-3.5 (UR-3.5), previously established as Agricultural Suburban (AS) zoning and reclassified to Urban Residential-3.5 (UR-3.5) on January 1, 1991 consistent with the Program to Implement the Spokane County Zoning Code. .Pursuant to RCW 58.17.195 the proposal generally confonns to the requirements of the UR-3.5 zone. Lots A and C of the preliminary plat show two existing structures which do not meet building setback standards. The structure on lot A labeled "frame garage" and the smlcture on lot C labeled "storage" should be moved or the lot lines should be adjusted on the final plat to meet setback standards of the UR-3.5 zone. Subdivision of property should not allow the creation of nonconforming setbacks for existing structures. A detailed site plan should be required to verify conformance with UR-3.5 building setback standards. The preliminary plat map- shows an accessory storage structure on Lot C which has no existing primary structure. Use of the storage structure should not be recognized until a primary use has been established on Lot C. 5. The Spokane Counry Comprehensive Plan designates this area as Urban. The development and uses proposed are gerierally in accord with this category. 6. The site contains an existing single family residence and accessory st-uctures. Surrounding uses are primarily residential. 7. The required public notice was provideti for this proposal and agencies having a potential interest in the project were notified and recomznend'ations solicited. 8. No written comments were received from any adjoining property owners. 9. The site is located within the Public Transit Feeder Benefit Area (PTBA). Route #17, -Broadway, or route #12, Mission provide downtown and connecting service. 10. Recognizing the recommended conditions and Spokane County developnaent standards, . the proposed short subdivisions makes appropriate provisions for the public health, safery and general welfare and that the public use and interest will be served by platting the short subd.ivision. The short subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. The Planning FINDINGS AND DECISION SP-829-93 Page 2 Department has considered the provision of public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces b. drainage ways c. public and/or private rights-of-way d. transit e. potable water f. sanitary waste disposal g. parks and recrearion faciliries h. playgrounds i. schools and schoolgrounds j . sidewalks The above improvements are either existing facilities and services or will be provided by the applicant upon finalization of this short subdivision as conditioned by the Planning Department and implemented by the various County agencies. 10. The Spokane County Arterial Road Plan identifies Boone Avenue and Locust Road as local access str-eets with existing widths of 40 feet. The County Engineer has requested dedication of an additional5 feet of right-of -way on both Boone Avenue and Locust Road. 11. The proposecl short plat will be served by a private water system. Waste water disposal will be as authorized by the Director of Utiliries. DECISION Baseti upon the above noted Findings of Fact and Conclusions, Short Plat Application- SP-829-93 is hereby APPROVED until April 1, 1996, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest to property. PLANNING DEPARTMENT CONDITIONS 1. All conditions imposed by the Planning Department shall be bind.ing on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zones as amended. - All build.ings will meet current setback standards. A site plan showing existing buildings and their setbacks from lot lines is required prior to finalization of the short plat. The site plan shall be stamped by a surveyor licensed in the State of Washing-ton. 3. A primary use shall be established on Lot C prior to establishing any recognized accessory use within the storage structure. 4. The final plat shall be designed substantially in confornzance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 5. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 6. Appropriate road name(s) shall be indicated. 7. The prelirninary plat is given conditional approval for three (3) years, specifically to April 1, 1996. The Water Plan and certification shall be drafted on a. transparency suitable for reproducrion and be signed by the plat sponsor. 12. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building peramits within the final plat. The arrangements or agreements shall include a provision holding Spokane Counry and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the subdivision sponsor to sarisfactorily complete the approved water system. 13. The final plat dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and sta.te health authorities, the local fire protection district, County Building & Safety Departinent and water purveyor, shall be installed within this subdivision, and the applicant shall provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." 14. No building permit will be issued for any lot within the final plat until certified by a Washington state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat" including a signed license sta.mp. The certification may be in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system. 15. The Water Plan and the above conditions of appraval regarding the Water Plan may be waived by the Planning Director/designee upon receipt of letters from the appropriate water purveyor and fire protection district stating that simple connections to an existing, approved water system will provide adequate domestic and fire protection water to ensure the public health, safety and general welfare. 16.
