DECISION 13 -7
THIS MATTER, an application for subdivision of land, from Dan O'Rourke has beenM" `'``~'Gi~~~'
received and decided upon, pursuant to Spokane County Subdivision regulations, on the
day of February, 1994.
FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately .52 acres into 21ots for 1 existing single family
dwelling and 1 additional residential lot and those uses pemutted in the underlying zone.
3. The proposal is generally located north of and adjacent to Fourth Avenue, approximately
950 feet east of Sullivan Road in the NW 1/4 of Section 24, Township 25 North, Range
44 E.W.M., Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-.
. 3.5), previously established as Agricultural (A) (File # 60-42) zoning in 1942 and reclassified
to UR-3.5 on January 1, 1991, pursuant to the Program to Implement the Spokane County
Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of
the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. Surround.ing uses are primarily single family residences and open space.
7. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.
8. No comments were received from any adjoining property owners.
9. The Spokane County Arterial Road Plan identif'ies Fourth Avenue as a Collector Arterial
with a future right-of-way width of 70 feeL The existing right-of-way width is 40 feet. In
order to implement the Arterial Road Plan, the County Engineer has requested dedicarion
of a strip of property 10 feet in width along the site's Fourth Avenue frontage. In addition
a strip of property 5 feet in width along Fourth Avenue frontage must be set aside as a
Future Acquisition Area.
10. The site is located within the Public Transportation Benefit Area (PTBA). Spokane
Transit Authority (STA) Valley/24th Avenue Route 21 pmvides connecting services to the
site.
11. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
12. The Spokane County Parks Department has commented on the proposed short plat. The
Parks Department has requested a voluntary agreement be completed between the Parks
Department and the property owner to mitigate impacts to the County Park system.
County legal counsel has indicated such agreements may be required. The Spokane
County Planning Department recommends the property owner negotiate with the Spokane
County Parks Departrnent to provide for appropriate capital facilities as required by the
Revised Code of Washington (RCV) 58.17.110. Approval of this short plat should
include conditions requiring that provisions for appropriate facilities be in place prior to
recording this final plat in the form of a written agreement between the owner and the
Spokane County Parks Department
13. The Central Valley School District No. 356 has commented on the proposed Short Plat.
The District has ind.icated that existing school facilities are inadequate to serve the
proposed short plat and wishes to negotiate with the owner to provide adequate capital
facilities as required by the Revised Code of Washington (RCVV) 58.17.110. Review by
County legal counsel indicates the condition requested by the School District can be
required for developments. Approval of this short plat should include conditions requiring

that provisions for appropriate facilities be in place prior to recording the final short plat in
the form of a written agreement between the owner and the school district. 14. The proposed short plat has direct access to public right of way at Fourth Avenue. No
sidewalks were required by the County Engineer regarding this proposal.
15. Recognizing the recommended conditions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health, safety
and general welfare and that the public use and interest will be served by platting the
subd.ivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance vvith standards established by the state and Spokane County. The Planning
Department has considered the provision of adequate public facilities as cited in RCW
58.17.110 (2). More specifically:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d. transit
e. potable water
f. sanitary waste disposal
g. parks and recreation facilities
h. playgrounds
i, schools and schoolgrounds
j. sidewalks 16. This proposal is not exempt from review under the State Environmental Policy Act. An
Environmental Checklist was subnutted by the sponsor and was reviewed by the County
Planning Department. The review considered the specifics of the proposal, other available
informadon, County ordinances, other regularions and laws, possible standard Conditions
of Approval, the Generalized Comprehensive Plan, and other Counry policies and guidelines. The Planning Department has detemiined that "No probable significant
adverse impacts" would result from the proposal being developed and has issued a
Deterinination of Nonsignificance ("DNS
The "DNS" was circulated to 8 other agencies of jurisdiction and other
agencies/departments affected by the future development for review and comment. The
"DNS" comment period ends March 31, 1993 and was advertised 15 calendar days before
said date by letter to adjacent property owners. The Planning Department has not received
additional comments.
17. The following fact is also relevant:
a. This proposal was received by the Planning Department on January 11, 1993. A
decision on this proposal was delayed because of the sponsor's engineer, Simpson
Engineering, difficulty in locating and ascertaining if an existing on-site sewage
disposal system serving the existing dwelling unit on tract "B" was wholly located
within the boundaries of that tracL
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-830-
93 is hereby APPROVED until March 1, 1997, subject to condirions noted below. Most of
the conditions of approval shall be accomplished by the applicant and/or sponsor prior to
finalization of the short subd.ivision. This decision is final unless appealed in writing,
consistent with adopted appeal procedures.
SPOKANE COUNTY PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be binding on the "Applicant",
which term shall include the owner or owners of the property, heirs, assigns and
successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended.

3. The final plat shall be designed substantially i.n conformance with the preliminary plat of
record No increase of density or number of lots shall occur without a change of cond.ition
application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure compliance
with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for ttuee (3) years, specifically to March
1, 1997. The applicant may request an extension of time by submitting a written request
approximately forty-five (45) days prior to the above expiration date.
7. Appropriate udlity easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat
8-. Three (3) current certificates of tide shall be furnished to the Planning Department prior
to filing the final plat,
9. The Spokane County Planning Department shall prepare and record with the County
Auditor a Tide Notice specifying a future land acquisition area for road right-of-way and
utilities. The reserved future acquisition area Tide Notice shall be released, in full or in
part, by the Planning Department The notice should be recorded within the same time
fia.me as an appeal and shall provide the following:
a. At least 5 feet of reserved future acquisirion area for road right-of-way and utilities, in
addition to the newly ded.icated right-of-way along Fourth Avenue. NOTE: The
County Engineer has required 10 feet of new dedication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be
located within the future acquisition area for road right-of-way and utilities. If any of
the above improvements are made within this area, they shall be relocated at the
applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be used
as allowed in the zone, except that any improvements (such as landscaping, parking,
surface drainage, drainfield, signs or others) shall be considered interim uses.
e. The property owner shall be responsible for relocating such "interim" improvements
at the time Sgokane County makes roadway improvements after acquiring said future
acquisition area.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all
private, "Tract X" or public roads. The dedication shall contain the following statement:
"Side yard and rear yard setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plaL The setbacks
uid.icated on this plat may be varied from if proper zoning approvals are obtained."
11. No water plan is required, and a simple tap is needed at the time of building permit release.
12. A suivey is required prior to the filing of a final plat. '
13. The owner shall negotiate with Central Valley School District and submit a recorded copy
of a voluntary agreement making provisions for public schools prior to finalization and
reconding of the plat. The agreement shall provide a written description of the subject
property to which the agreement applies and also state the dollar amount and any other
agreed to mitigating measures.
The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Reviseri Code of Washington (RCW)
58.17.205, that adequate provisions for school facilities must be made conditioned on a
future agreement between the plattor and school d.istricL

agreed to mitigating measures.
The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCV)
58.17.205, that adequate provisions for park facilides must be made conditioned on a
future agreement between the plattor and Spokane County Parks Department.
. Voluntary agreements between the owner and Spokane County Parks Department shall
conform to the requirements of RCW Chapter 82.02.
COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to dedication
of right-of-way and approval of the road system as indicated in the preliminary plat of
record.
2. No construction work is to be performed within the existing or proposed public right-of-
way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
3. Ind.ividual driveway access pernuts are required prior to issuance of a building pernut for
driveway approaches to the county road system.
4. Dedication of 10 feet of additional right-of-way along Fourth Avenue is required.
5. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
6. The word "applicant" shall include the owner or owners of the property, his heirs, assigns
and successors.
7. To constivct the road improvements stated herein, the applicant rnay, with the approval of
the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving to existing pavement) will be at the
sole expense of the undersigned owner(s), their heirs, grantees and assigns. This
provision is applicable to Fourth Avenue.
8. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project (CRP)
to the extent of the required road improvements. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the improvements required
(curb, sidewalk, drainage control and paving to existing pavement) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is
applicable to Fourth Avenue.
9. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement District (RID) by the
petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)'
property, and further not to object, by the signing of a ballot, to the formation of an RID
by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the
owner(s)' property. If an RID is formed by either the petition or resolution method as
provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;

(b) that the benefits to be derived from the fonnation of the RID by the property included
therein, together with the amount of any County participation, exceed the cost and
expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of
the improvements called for in conjunction with the formation of an RID by either
perition or resolution method under Chapter 36.88 RCW, and to appeal to the
Superior Court the decision of the Boazd of County Commissioners aff'mming the
final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving) will be at the sole expense of the undersigned
owner(s), their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agxee that if said
RID waiver expires without construction of the required improvements, the owner(s)
or successor(s) agree to construct the required improvements at their own expense,
pay to Spokane County the then estimated cost of the required improvements to
enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver
agreement) providing for or securing to the County the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be binding upon
the owner(s), their successor(s) or assign(s)." This provision is applicable to Fourth
Avenue.
10. The County Engineer has designated Typical Roadway Secdon Number Two, Local
Access Standard for the unprovement of Fourth Avenue which is adjacent to the proposed
development. This will require the addition of approximately 9-11 feet of asphalt along
the frontage of the developmenL The construcrion of curbing is also required.
11. The proposed plat shall be improved to the standards set forth in Spokane County Board
of Commissioners Resolution No. 80-1592, as amended, which resolution establishes
regulations for roads, approaches, drainage and fees in new construction.
12. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing county road system warrants the dedication of
additional right-of-way and the roadway improvements herein specified.
13. The County Arterial Road Plan identifies Fourth Avenue as a Collector Arterial. The
existing right-of-way width of 40 feet is not consistent with that specified in the Plan. In
order to unplement the Arterial Road Plan, in add.ition to the required right-of-way
ded.ication, a strip of property 5 feet in width along the Fourth Avenue frontage shall be set
aside in reserve. This property may be acquired by Spokane County at the time when
arterial i.mprovements are made to Fourth Avenue.
14. There may exist utilities, either underground or overhead, affecting the subject property,
includ.ing property to be dedicated or set aside for future acquisition. Spokane County
assumes no financial obligation for adjustments or relocation regarding these utilities.
Applicant(s) should check with the applicable utility purveyor and the Spokane County
Engineer to determine whether applicant(s) or the utility is responsible for adjustment or
relocation costs and to make arrangements for any necessary work.
SPOKANE COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the prelirninary plat of record and/or any
attached sheets as noted.
2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
3. Water service shall be coordinated through the Director of Utilities, Spokane County.

4. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health.
5. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health I?istrict that an adequate and potable water supply is available to
each tract of the plat.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the
recorded service area of the water system proposed to serve the plat.
7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal systems are
available on all tracts.
8. Subject to specific application approval and issuance of permits by the Health Officer, the use of individual on-site sewage disposal systems may be authorized.
9. The dedicatory language of the plat will state: "Subject to specific application approval and
issuance of permits by the Health Officer, the use of individual on-site sewage disposal
systems m.ay be authorized."
10. The dedicatory language on the plat shall state: "Use of private wells and water systems is
prohibited."
11. The plat dedication shall contain a statement to the effect that: "The public water system,
pursuant to the Water Plan approveri by county and state health authorities, the local fire
protection district, County Division of Buildings and water purveyor, shall be installed
within this plat, and the applicant shall provide for individual domestic water service as
well as fire protection to each tract prior to sale of each tract and prior to issuance of a
building permit for each tract."
12. The existing drainfield for the house on Tract "B" is located on Tract "A". The sponsor
must enlarge the easement to enclose all of the drainfield or relocate the drainfield.
13. Test holes are required on Tract "A" to prove that there is a suitable site for an on-site
sewage system for Tract "A".
SPOKANE COUNTY DIVISION OF UTILITIES CONDITIONS
1. Pursuant to the Board of County Comrnissioners Resolution No. 80-0418, the use of on-
site sewer disposal systems is hereby authorized. This authorization is conditioned on
compliance with all rules and regulations of the Spokane County Health District and is
further conditioned and subject to specific application approval and issuance of permits by
the Health District
2. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the forniation of ULID by petition method
pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to
object by the signing of a protest petition against the formation of a ULID by resolution
method pursuant to RCW Chapter 36.94 which includes the owner(s)' property.
PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objecting
to any assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a iJLID by either petition or resolution methai under RCW Chapter
36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."
SPOKANE COUNTY DIVISION OF BUILDINGS CONDITIONS
1. Fire flows are applicable for this proposal. The minimum fire flow and flow duration will
be based on a representative dwelling size for all floors not including the basement. The
maximum dwelling size needs to be submitted to the Division of Buildings.

2. An approved water supply capable of supplying the required fire flow protection and
domestic use shall be provided before any building pernuts are issued. The water system
shall be installed in accordance with an approved Water System Plan on file with the
Division of Buildings. Certification from the water purveyor that the installed system
complies with the requirements of the Plan and is operational shall be submitted to the
Division of Buildings prior to permit issuance.
3. Hydrant location, number and type capable of delivering the required fire flow for
residential development shall be provided in accordance with required design
specifications. The average distance between hydrants shall be 600 feet and shall not
exceed 700 feet.
