INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on December 8, 1983, and the members of the Committee present being Richard L. Skal stad, Chairman, Jane E. N(yers and Jerry Wil l iams. B. PROPOSAL The sponsor, William W. Erickson, is requesting approval of a zone reclassification, File No. ZE-78-83, Local Business to Commercial, for the purpose of developing retail uses (No Specific Site Plan). C. FINDINGS OF FACT 1. That the existing land use in the area is residential, apartments, comercial, offices and vacant. 2. That the Comprehensive Plan designates this area as appropriate for Major Conmerci al devel opment. 3. That the existing zoning of the proNerty described in the application is Local 8usiness. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Conanittee concurs with the Declaration of Non-Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is justified. 8. That the proposed use is compatible with existing uses in the area. 1~ . ZONE RECLASSIFICATION NO.: ZE-78-83 C. FINDINGS OF FACT (continued) 9. That the owners of adjacent lands expressed disapproval of the proposed use. 10. The Hearing Examiner Comnittee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 11. The following are additional findings of fact considered by the Hearing Examiner Committee: ay That the site should be developed with adequate landscaping treatment around the proposed building, ad3oining the County roads, with special emphasis along the north property line adjoining the multi-family development. However, the site has limitations related to siie, location, and other County requirements (such as '208' designs, drainfield location, and access points), that prohibit the advanced planning of landscape areas prior to preparation of a detailed site plan. It is felt that the applicant should coordinate with the Planning Department staff and other County departments to combine all design standards into a detailed site plan that will provide as much green space and deciduous trees as feasib)e on the site. b) That development of the site should protect the adjoining multi-family development to the north from adverse impacts. Buffering of the site, along the north property line, should include fencing, landscaping, and restrictions on vehicle access to the northerly end of the site. Review of the buffering techniques should be administrative. D. CONDITIONS OR CONTIN6ENCIES APPLIED TO THIS APPROYAL aj COUNTY PLANNING DEPARTMENT 1. The Zoning Administrator shall approve a specific exterior lighting plan for the approved area prior to installation of such lighting. (Such pian shall attempt to confine illumination to the area with full consideration to adjacent properties). 2. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of aRy building permlts. 3. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator sha11 be submitted with a performance bond for the project prior to release of building permits. 2 + . ZONE RECLASSIFICATION NO.: ZE-78-83 a) COUN7Y PLANNING DEPARTMENT (continued) 4. Direct light from aRy exterior area lighting fixture shall not extend over the property boundary. 5. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permits. 6. Al1 current standards of the Commercial Zone, as amended, shall be complied with in the development of this site. 7. A 6-foot sight-obscuring fence to be the same elevation as the existing fence on the nokrtherly boundary, shall be provided along the northern boundary of this proposal to provide a buffer for the existinq residential use located immediately north of this site. 8. Applicant shall comply with '208' reconenendations concerning stormwater runoff and provide necessary landscaping for runoff. 9. The applicant shall comply with RCW 58-17 and the Spokane County Platting Ordinances prior to issuance of building permits. 10. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Comi s si oners Resol uti on #77-1392 be ini ti ated by the proj ect appl i cant wi th1 n thi rty (30) days of fi nal di sposi ti on of thi s application, and prior to any on-site improvements, or file appropriate documents to the effect that the NOTICE OF ACTION is waived in accordance with Spokane County Conmissioners' Resolution #82-0458 dated May 4, 1982. 11. Pursuant to the provisfons of Chapter 43.21C RCW, the SEPA GUIDELINES (WAC 197-10) and the Spokane County Environmental Ordinance (SCEO), a proposed declaration of non-significance has been issued at 1 east fifteen (15) days pri or to th i s date ; the official file, written conments and/or public testimony contain information regarding assessment of the proposal's adverse impacts to the physical environment; a finding is hereby made that no potentially significant adverse impacts upon the physical environment are anticipated as a result of the project; and a final declaration of non-significance is hereby to be issued. 3 Y ZONE RECLASSIFICATION NO.: ZE-78-83 a) COUNTY PLAHNING DEPARTMENT (continued) 12. The northern portion of the site, adjacent to the multi-family development, shall be restricted from public parking and be limited to service vehicle traffic for the building. There shall be no through traffic allowed between the north property line and the building, from the eastern side of the site to Sunderland Road. 13. Landscaping of the site shall be based on a cooperative design, incorporating generous amounts of green space and deciduous trees into requirements for '208' drainage control, drainfield location, and access points. Special attention shall be given to the northern property line to provide a landscape buffer along with the required sight-obscuring fence. Other areas to be considered for landscaping are ad,jacent to Sunderland Road, Sprague Avenue, and around the building. Review of the site plan shall be administrative. b) COUNTY ENGINEERING DEPARTMENT 1. Prior To The Issuance Of A Building Permit: 2. Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. 3. (A) Other specific improvements: Applicant shall construct Spokane County Standard Portland Cement concrete sidewalk along Sunder]and Road. 4. Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a building permit on the properCy. 5. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 6. A parking plan and traffic circulation plan sha11 be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 7. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 4 • l~, Y''• i~ r ~ b) COUNTY ENGINEERING DEPARTMENT (continued) 8. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 9. Al1 required improvements shall conforin to the current State of Washington Standard Specifications for Road and 6ridge Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwrise approved by the County Engineer. 10. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners'Resolution No. 80-1592 as amended. c) COUNTY UTILITIES DEPARTMENT 1. Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with al1 rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health Df strict. 2. The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULIO by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULIO by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROYIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4. The unit shall be double-plumbed for connection to future areawi de col l ecti on systems. 5. Plans and specifications for the double plumbing are to be reviewed and approved by the Utilities Department prior to constructing a septic tank and drainfield system. 5 r ' ♦ ZONE RECLASSIFICATION NO.: ZE-78-83 d) COUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal detailed plan shall • be approved by the County Engineer and the Health District prior to the i ssuance of any bui 1 di ng permi t for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 3. Subject to specific application approval and issuance of permits bythe Health Officer, the proposal is authorized the use of an individual on-site sewage system. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 6. Oisposal of sewage effluent beneath paved surfaces is currently prohibited. e) COUNTY BUILDING AND SAFETY DEPARTMENT 1. The site i s 1 ocated i n Fi re Di stri ct # 1. 2. Mains and fire hydrants will be required to be installed in accordance with the requirements of the Spokane County Department of Building and Safety. f) WATER PURYEYOR 1.
