Gentlemen:
This letter will serve as my drainage report for Short Plat No. 833-93. This
1.9-acre site is located at the Intersection of Ruby and Hastings Roads in the
Northwest Quarter of Section 8-T26N-R43 East Willamette Meridian.
My s i te i nspect i on of test ho 1 es i nd i cate so i 1 s of coarse sands, grave 1 s and
cobbles to depths of greater than 5 feet. The site has grades of less than 2
pe~r~,~nt and s 1 opes gent 1y to the southeast from lRast ings Road. rhe s i te i s
very dry with no definable drainaQe course or erosion evident. Hastings Road
i s paved w i th cu bs and7"drywe -ns, but Ruby Road and Mayf a i r Road, east of the
site, are both gravel with no ditches or drainage structures evident.
Based upon my s i te i nspect i on and the attached cal cu lat i ons, I conclude that
the development of thjs site, as 2000 sq ft duplex lots, creates no
s ic n if i cant i ncrease ~ stor„~ water runoff or storm watp r ha7aras ~,7'~n in'i,h'~
area. The ca 1 cu 1 at i ons do i nd i cate a potent i a 7 0.2 to 0.4 cf s. add i t i ona T
'Pl'unoff is possible during froZen conditions, however since this would occur
over a broad width it would be unmeasurable. Continued incremental
development of the vacant property within the area, though individually
insignificant, could pose a combined impact to storm water runoff which would
be best solved by area participation as the remaining area develops.
This all being considered, I conclude that no individual drainage structure or
site grading is needed for this project at this time. The following standard
Spokane County Drainage Language is applicable to this plat and should be
added to the dedication: Item 5). - dealing with lowest building opening and
drainage away from the building. Item 9). - dealing with participation in
payment for any future County approved area Stormwater Management Programs.

1) Drainage easements, as platted and shown hereon, which are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities to dispose of runoff, are hereby
granted. The County of Spokane is hereby granted the right of ingress anci egress to all drainage
easements adjacent to the public right of way. The property owner shall maintain the drainage
swale with a permanent live cover of lawn turf, with optional shrubbery and/or trees, which do
not obstruct the flow and percolation of storm drainage water in (he clrainage swale as indicated
by the approved plans.
2) The owners of Lots & , of I31ock , and Lots
, , & , of Block , shall be held responsible for
keeping open and maintaining ttie patli of the natural or man-made clrainage flow over and across
t1ie property.
3) The property owner or his representative shall inform each succeeding purchaser of all drainage
easements on the property and liis responsibility for maintaining drainage facilities within said
easements. 4) Spokane County does not accept the responsibility of maintaining the drainage course on private
lots wittiin drainage easements or floodplain areas, nor the responsibility for any clrainage,
whatsoever, including but not limited to inverse condemnation to any properties due to deficient
construction and/or maintenance of drainage courses in drainage easements on rivat~operty.
S5)' The lowest building opening, including basement opening, for any huilding on
-ao! Bleok- shall be high enough to allow a minimum slope of 3%
away from the building in 10 feet. All drainage shall be routed away from the huilding to natural
drainages or other lawful drainage features.
6) Development within this subdivision shall conform to the requirements of the National Flood
lnsurance Program and Chapter 3.20 of the Spokane County Code. The lowest floor, including
basement floor, for any structLire shall be constnicted according to the requirements of the
Spokane County Flood Zone regulations in effect at the time a building permit is issued. Purchasers of property in this subdivision are warned of possible flooding or ponding and the .
potential requirement to purchase Flood Insurance. This warning shall be carried in each anci
every deed drawn to transfer ownership of any and ali property within this plat in the Area of
Special Flood Hazard.
7) An approved lot grading plan exists for Lots and ,

Grading must conform to said plan on file in the County Engineer's Office. .
8) Spokane County shall not be responsible to maintain ingress or egress across the flood plain area.
9) The owner(s) or successor(s) in interest agree to join in any County anproved Stormwater
Management Program and to pay such rates and charges as may be fixed through public hearings
for service or benefit obtained by the planning, design, constructing, maintaining, or operation
of stormwater control facilities.
10) A statement must appear in the dedicatory language of the plat that individual clriveway access
permits be requirecl prior to issuance of a btiilding permit for driveway approaches to the County
road system. This approach stiall be constructecl in accordance with tlie approved plan on file
in the County Engineer's office.

3. - T'he proposal is gencrally located at the sautheast corner of Ruby Roa,d, and Hastings
Road in the NW 1/4 of Section 8, Township 26 North, Range 43 E.W.M., Spokane
County, Washington.
4. The existing zoning of the property described in the application is U-Tban Residentia1,-3,5
CUR-3.5), previously established as Agricultura.1(A) (File 106-48) aoning in 1948 and
reclassifieri to UR.-3.5 on January 1, 1991 pursuant to the Pragram to xrnplement the
Spokane County Zoning Cvde. Pursuant to FCW 5$.17,195 the propvsal daes canforxx-t

6. Sunraunding uses are primarly single faraily residences on rnixed urban size lots and
open spaces. Fine Acres Golf Cau.rse is located approximately 1/4 mile southeast of
the site.

9. Recognizing the recommendei canditions and Spokarle County developmen-t standards,
the proposed short subdivision rnakes appropriate provisions far the public heaith,
safety and general welfare and, that the pub1ic use and interest will be serve.d by platting
the suhdivision.
The subdivasiori prqpvsaX is generally consistent with RCW 58.17 and the Caunty - -
subdivisxon regulations, p-romoting the pubIrtc health, safety and general welfa.re in
accord.ance with standards establishei by the state and Spokane County. The Planning

The above improvements are either existing facilities or will be provided as conditioned
by this decision, and/or implemented by the various County agencies.
10. The site is located within the Public Transportation Benefit Area (P1BA), which the
Spokane Transit Authority (STA) provides public transportation services. However,
service to the site is not available at this time. A STA Park and Ride facility is located
approximately 1/4 mile from the site at the Fauwood Shopping Center.
11. The proposed short plat will be served by' a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
12. This proposal is not exempt from review under the State Environmental Policy Act. An
Environmental Checklist was submitted by the sponsor and was reviewed by the
Counry planning Department. The review considered the specifics of the proposal,
other available informarion, County ordinances, other regulations and laws, possible -
standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has detennined that "No
probable significant adverse impacts" would result from the proposal being developed
and has issued a Detemlination of Nonsignificance ("DNS"). The "DNS" was circulated to 8 other agencies of jurisdiction and other
agencies/departrnents affected by the future development for review and comment. The
"DNS comment period ends March 31, 1993 and was advertised 15 calendar days'
before said d.ate by letter to adjacent property owners. The Planning Department has
not received additional comments.
13. The Mead School District No. 354 has commented on the proposed short plat. The
District has indicated that existing school facilities are inadequate to serve the proposed
short plat and has requested a voluntary financial contribution to assist in providing
adequate capital facilities as required by the Revised Code of Washington (RCW)
58.17.110. The Planning Department must assume that the agency of jurisd.iction, in
this case the Mead School District, has made a reasonable request. Approval of this
short plat should include condirions requiring that provisions for adequate facilities be
i.n place prior to recording this final plat in the form of a written agreement between the
owner and the school district.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-833-93 is hereby APPROVED until May 1, 1996, subject to cond.itions noted
below. Most of the cond.itions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. All conditions imposeri by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended.
3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be ind.icated.

6. The preli.minary plat is given conditional approval for three (3) years, specifically to
May 1, 1996. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be furnished to the Planning Department prior
to fili.ng the final plat.
9. The Spokane County Planning Department shall prepare and record with the Counry
Auditor a Title Notice specifying a future land acquisition area for road right-of way
and utilities. The reserved future acquisition area Title Notice shall be released, in fu11
or in part, by the Planning Department. The notice should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 7 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the exisring right-of-way along Hastings Road. -
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring saidfuture acquisition area.
10. The final plat map shall i.ndicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedicarion shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
iridicated on this plat may be varied from if proper zoning approvals are obtained."
11. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection d.istrict, County Building &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproducrion and be signed by the plat sponsor.
12. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a building pennit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
13. The final plat dedication shall contain the following statement: "T`he public water
system, pursuant to the Water Plan approved by county and state health authorities, the
local fire protection district, County Building & Safety Department and water purveyor,
shall be installed within this subdivision, and the applicant shall provide for individual
domestic water service as well as fire protection to each lot prior to sale of each lot and
prior to issuance of a building pernut for each lot."

14. No building permit will be issued for any lot within the final plat unti.l certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on-a copy of
the Water Plan as a schematic map showing the "as-built" water system.
15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general welfare.
16. The Owner shall negotiate with the Mead School District and submit a recorded copy of .
the agreement making provisions for public schools prior to finalization and recording
of this short plat. The agreement shall provide a written description of the subject
property to which the agreement applies and also state the dollar amount and any other
agreed to mitigating measure(s).
17. A survey is required prior to the filing of a final plat.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record. _ 2. Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the County Engineer for approval prior to construction and/or the
filing of the final plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
3. No construction work is to be performed within the existing or proposed public right-
of-way until a pernut has been issued by the County Engineer. All work is subject to
inspection and approval by the Counry Engineer.

7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
8. To construct the road improvements stated herein, the applicant may, with the approval .
of the County Engineer, join in and be a willing parricipant in any petition or resolution
whach pwpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such rime as an RID is
created or any Road Improvement Project is sancrioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and pav'ing to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Ruby Road.
9. As an alternative method of constructing the road improvements sta.ted herein, the
applicant may, with the approval of the Counry Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sancrioned by Spokane County, the _
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Ruby Road.
10. The following statement shall be placed in the plat dedication: "The owner(s) or
successor(s) in interest agree to authorize the County to place their name(s) on a petition
for the fornsation of a Road ImProvement I}istrict (RID) bY the Petition method

pursuant to Chapter 36.88 RCW, which.petition includes the owner(s)' property, and
further not to object, by the signing of a ballot, to the formation of an RID by the
resolution method pursuant to Chapter 36.88 RCW, which resolution includes the
owner(s)' property. If an RID is formed by either the petition or resolurion method as
provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible; .
(b) that the benefits to be derived from the formabon of the RID by the property
included therein, together with the amount of any County participarion, exceed the
cost and expense of fonnation of the RID; and
(c) that the property within the proposed RI1D is sufficiendy developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of an RID by either perition
, or resolurion methai under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners affuming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the i.mprovements requireri (curb, sidewalk,
drainage control and paving) wi11 be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agreement shal,l expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own expense, pay to
Spokane County the then estimated cost of the requixed improvements to enable the
County to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s)." This provision is applicable to
' Ruby Road.
11. The County Engineer has designated Typical Roadway Section Number Two Local
Access stand.ard for the improvement of Ruby Road, which is adjacent to the proposed
developrnent. This will require the addition of approximately 30 feet of asphalt along
the frontage of the development. The construction of curbing is also required.
12. The proposed subdivision shall be unproved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regularions for roads, approaches, drainage and fees in new
construction.
13. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified.
14. The County Arterial Road Plan identifies,Hastings Road as a Principal Arterial. The
existing right-of-way width of 73 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way
ded.icarion, a strip of property 7 feet in width along the Hastings Road frontage shall be
set aside in reserve. This property may be acquired by Spokane County at the time
when arterial improvements are made to Hastings Road.
15. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
. Spokane County assumes no financial obligation for adjustments or relocation regaT-ding these utilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engrneer to detennine whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work. ,

COUNTY HEALTH DISTRICT CONDITIONS -
1. The final plat shall be designed as indicated on the prel.iminary plat of record andlor any
attached sheets as noted.
2. Appmpriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Departrnent to the utility companies, Spokane
County engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utiliries, Spokane
County.
4. Water service shall be coordinated through the Di.rector of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that an adequate and potable water supply is available

7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat. .
8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that suitable sites for on-site sewage d.isposal systems
are available on all tracts.
9. Subject to specific application approval and issuance of permits by the health officer,
the use of individual on-site sewage disposal systems may be authorized.
10. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of permits by the Health Qfficer, the use of individual on-site sewage
systems may be authorized."
11. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited." 12. The plat dedication shall contain a statement to the effect that: "The public water
system, pursuant to the Water Plan approved by county and state health authoriries, the
local fire protection di.strict, County Building and Safety Department and water
purveyor, shall be installed within this plat, and the applicant shall provide for individual domestic water service as well as fue protection to each tract prior to sale of
each tract and prior to issuance of a building pemut for each tract."
13. Prior to filing the final plat, the two existing private wells shall be properly abandoned
in accordance with WAC 173-160.
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further condirioned and subject to specific application approval and issuance of
permits by the Health District.
2. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize
the County to place theix name(s) on a petirion for the formation of ULID by petition
method pursuant to RCW 36.94, which petirion includes the owner(s)' property; and
further not to object by the signing of a protest petition against the forniation of a ULID
by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s)
firom objecting to any assessment(s) on the property as a result of improvements called
for in conjunction with the formation of a ULID by either petition or resolution method
under RCW Chapter 36.94."

BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Fire flows are applicable for this proposal. The minimum fire flow and flow duration
will be based on a representative dwelling size for all floors not including the basement. The maximum dwelling size needs to be submitted to the Department of Buildings.
2. Hydrant location, number and type capable of delivering the required fire flow for
residential development shall be provided in accordance with required design
specifications. The average distance between hydrants shall be 600 feet and shall not
exceed 700 feet -
SPOKANE COUNTY FIRE DISTRICT NO. 9 .
1. A fire hydrant is to be installed at the southeast corner of Hastings and Ruby Roads.
This fire hydrant is to be installed prior to the sale of any parcels or the issuance of any
building permits i.n accordance with Spokane County Title I7I.
2. Any solid or liquid fueled heating device will have the chimney equipped with a spark
arrester, per Uniform Fire Code (tTFC) 10.505.
3. All timber slash that is generated during the construction of building(s) on any parcels
is to be removed from the property and hauled to an appropriate site, per UFC 87.103e.

E 1 That conditional approval of the plat by the County Engineer,is given

indicated in the preliminary plat of record.

successor(s) shall retain the right, as authorized under RCW

of the improvements called for in conjunction with the formation of
a RID by either petition or resolution method under Chapter 36.88 RCW,
and to appeal to the Superior Court the decision of the Board of
County Commissioners affirming the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the
sole expense of the undersigned owner, their heirs, granteES aiid
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. However, the owner(s)
or successor(s) agree that if said RID waiver expires without
construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own
expense; pay to Spokane County the -then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements. "
All of the requirements of this agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to Ruby Road.
E24 The County Engineer has designated Typical Roadway Section Number Twoi
Local Access Standard for the improvement of Rubv Road which is adjacent
to the proposed development. This will require the addition of
approximately 30 feet of asphalt along the frontage of the development.
The construction of curbing is also required.
E32 The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
arid fees in new construction.
E33 The County Engineer has examined this' development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
E61 The County Arterial Road plan identifies Hastinqs Road as a Principal Arterial. The existing right of way width of 73 feet is not consistent
with that specif ied in The Plan. In order to implement the Arterial
Road Plan it is recommended that in addition to the required right of
way dedication, a strip of property 7 feet in width along the Hastinqs
Road frontage be set aside in reserve. This property may be acquired by
Spokane County at the time when Arterial Improvements are made to
Hastinqs Road.
E90 The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside for future acquisition. Spokane
County will assume no financial obligation for adjustments or relocation

We have looked at the final plat plan submitted. In our meeting with Mrs. Jens we indicated that a fire
hydrant would be needed as a part of the plat. That hydrant is to be installed prior to the sale of a lot or
the issuance of any building permits.
It is to be Iocated at the southeast corner of Hastings Road and Ruby Road. We recognized that the
people have the right to private wells however the property is inside the coordinated water supply area
and in fact there is a water main in front of the lots at this time.

In as mush as this is not a water main extension for new water pipe it would be just as simple to include
the location for the new fire hydrant ss a part of the final plat map.

This Commitment shall be effective only when the identity of the proposed Insured and the amount
of the policy or policies committed for have been inserted in Schedule A hereof by the Company,
either at the time of the issuance of this Commitment or by subsequent endorsements and is
subject to the Conditions and Stipulations on the back of this cover.
This Commitment is preliminary to the issuance of such policy or policies of title insurance and all
liability and obligations hereunder shall cease and terminate six months after the effective date
hereof or when the policy or policies committed for shall issue, whichever first occurs, provided
that the failure to issue such policy or policies is not the fault of the Company.

C4MMITMENT CONDITIQNS AND STIPULATIQNS
1, The term mortgage, when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter affecting
the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof, and
shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved from liability for any loss or
damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure to so disclose such know-
ledge. If the proposed insured shall disclose such knowledge to the Company, or if the Company otherwise acquires actual
knowledge of any such defect, lien, encumbrance, adverse claim or other matter, the Company at its option may amend Schedule
6 of this Commitment accordingly, but such amendment shall not relieve the Company from liability previously incurred pur-
suant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed insured and such parties included under
the definition of insured in the form of policy or policies committed for and only for actual loss incurred in reliance hereon in
undertaking in good faith, (a) to comply with the requirements hereof, or (b) to eliminate exceptions shown in Schedule B, or
(c) to acquire or create the estate or interest or mortgage thereon covered by this Commitment. In no event shall such liability
exceed the amount stated in Schedule A for the policy or policies committed for and such liability is subject to the insuring
provisions, the Conditions and Stipulations, and the Exclusions from Coverage of the form of policy or policies committed for in
favor of the proposed insured which are hereby incorporated by reference and are made a part of this Commitment except as
expressly modified herein.
4. Any action or actions or rights of action that the proposed insured may have or may bring against the Company arising out of
the status of the title to the estate or interest or the status of the mortgage thereon covered by this Comrnitment must be based
on and are subject to the provisions of this Commitment.

STANDARD LOAN POLICY 1988
1. (a) Any law, ordinance or governmental regulation (inctuding but not limited to building or zoning laws, ordinances, or regulations) restricting, regulating,
prohibiting or relating to (i) the occupancy, use, or enjoyment of the land; (ii) the character, dimensions or location of any improvement now or hereafter
erected on the land; (iii) a separation in ownership or a change in the dirtensions or area of the land or any parcel of which the land is or was a part; or (iv)
environmental protection, or the effect of any violation of these laws, ordinances or governmental regulations, except to the extent that a notice of the
enforcement thereof or a notice of a defect, lien or encumbrance resulting from a violation or alleged violation affecting the land has been recorded in the
public records at Date of Policy.
(b) Any governmental policy power not excluded by (a) above, except to the extent that a notice of the exercise thereof or a notice of a defect, lien or
encumbrance resulting from a violation or alleged violation affecting the land has been recorded in the public records at Date of Policy.
2. Rights of eminent domain unless notice of the exercise thereof has been recorded in the public records at Date of Policy, but not excluding from coverage any
taking which has occurred prior to Date of Policy which would be binding on the rights of d purchaser for value without knowledge.
3. Defects, liens, encumbrances, adverse claims or other matters:
(a) whether or not recorded in the public records at Date of Policy, but created, suffered, assumed or agreed to by the insured claimant;
(b) not known to the Company, not recorded in the public records at Date of Policy, but known to the insured claimant and not disclosed in writing to the
Company by the insured claimant prior to the date the insured claimant became an insured under this policy;
(c) resulting in no loss or damage to the insured claimant;
(d) attaching or created subsequent to Date of Policy; or
(e) resulting in loss or damage which would not have been sustained if the insured claimant had paid value for the insured mortgage or for the estate or
interest insured by this policy.
4. Unenforceability of the lien of the insured mortgage because of the inability or failure of the insured at Date of Policy, or the inability ur failure of any
subsequent owner of the indebtedness, to comply with the applicable doing business laws of the state in which the land is situated.
5. Invalidity or unenforceability of the lien of the insured mortgage, or claim thereof, which arises out of the transaction evidenced by the insured mortgage and
is based upon usury or any consumer credit protection or truth in lending law.
