This 1.9-acre site is located at the Intersection of Ruby and Hastings Roads in the Northwest Quarter of Section 8-T26N-R43 East Willamette Meridian. My s i te i nspect i on of test ho 1 es i nd i cate so i 1 s of coarse sands, grave 1 s and cobbles to depths of greater than 5 feet. The site has grades of less than 2 pe~r~,~nt and s 1 opes gent 1y to the southeast from lRast ings Road. rhe s i te i s very dry with no definable drainaQe course or erosion evident. Hastings Road i s paved w i th cu bs and7"drywe -ns, but Ruby Road and Mayf a i r Road, east of the site, are both gravel with no ditches or drainage structures evident. Based upon my s i te i nspect i on and the attached cal cu lat i ons, I conclude that the development of thjs site, as 2000 sq ft duplex lots, creates no s ic n if i cant i ncrease ~ stor„~ water runoff or storm watp r ha7aras ~,7'~n in'i,h'~ area. The ca 1 cu 1 at i ons do i nd i cate a potent i a 7 0.2 to 0.4 cf s. add i t i ona T 'Pl'unoff is possible during froZen conditions, however since this would occur over a broad width it would be unmeasurable. Continued incremental development of the vacant property within the area, though individually insignificant, could pose a combined impact to storm water runoff which would be best solved by area participation as the remaining area develops. This all being considered, I conclude that no individual drainage structure or site grading is needed for this project at this time. The following standard Spokane County Drainage Language is applicable to this plat and should be added to the dedication: Item 5). - dealing with lowest building opening and drainage away from the building. The County of Spokane is hereby granted the right of ingress anci egress to all drainage easements adjacent to the public right of way. The site is located within the Public Transportation Benefit Area (P1BA), which the Spokane Transit Authority (STA) provides public transportation services. However, service to the site is not available at this time. A STA Park and Ride facility is located approximately 1/4 mile from the site at the Fauwood Shopping Center. 11. The proposed short plat will be served by' a public water system. Waste water disposal will be as authorized by the Director of Utilities. 12. This proposal is not exempt from review under the State Environmental Policy Act. An Environmental Checklist was submitted by the sponsor and was reviewed by the Counry planning Department. The review considered the specifics of the proposal, other available informarion, County ordinances, other regulations and laws, possible - standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Planning Department has detennined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Detemlination of Nonsignificance ("DNS"). The "DNS" was circulated to 8 other agencies of jurisdiction and other agencies/departrnents affected by the future development for review and comment. The "DNS comment period ends March 31, 1993 and was advertised 15 calendar days' before said d.ate by letter to adjacent property owners. The Planning Department has not received additional comments. 13. The Mead School District No. 354 has commented on the proposed short plat. The District has indicated that existing school facilities are inadequate to serve the proposed short plat and has requested a voluntary financial contribution to assist in providing adequate capital facilities as required by the Revised Code of Washington (RCW) 58.17.110. The Planning Department must assume that the agency of jurisd.iction, in this case the Mead School District, has made a reasonable request. Approval of this short plat should include condirions requiring that provisions for adequate facilities be i.n place prior to recording this final plat in the form of a written agreement between the owner and the school district. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-833-93 is hereby APPROVED until May 1, 1996, subject to cond.itions noted below. Most of the cond.itions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. All conditions imposeri by the Planning Department shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The preli.minary plat is given conditional approval for three (3) years, specifically to May 1, 1996. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiration date. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies shall be received with the submittal of the final plat. 8. Three (3) current certificates of title shall be furnished to the Planning Department prior to fili.ng the final plat. 9. The Spokane County Planning Department shall prepare and record with the Counry Auditor a Title Notice specifying a future land acquisition area for road right-of way and utilities. The reserved future acquisition area Title Notice shall be released, in fu11 or in part, by the Planning Department. The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least 7 feet of reserved future acquisition area for road right-of-way and utilities, in addition to the exisring right-of-way along Hastings Road. - b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring saidfuture acquisition area. 10. The final plat map shall i.ndicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedicarion shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final plat. The setbacks iridicated on this plat may be varied from if proper zoning approvals are obtained." 11. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection d.istrict, County Building & Safety Department and County Health District. The agencies will certify on the Water Plan, prior to the filing of a final plat, that the plan is in conformance with their respective needs and regulations. The Water Plan and certification shall be drafted on a transparency suitable for reproducrion and be signed by the plat sponsor. 12. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the final plat. The arrangements or agreements shall include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building pennit due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 13. No building permit will be issued for any lot within the final plat unti.l certified by a Washington state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat" including a signed license stamp. The certification may be in the form of a letter, but is preferred to be certified on-a copy of the Water Plan as a schematic map showing the "as-built" water system. 15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan may be waived by the Planning Director/designee upon receipt of letters from the appropriate water purveyor and fire protection district stating that simple connections to an existing, approved water system will provide adequate domestic and fire protection water to ensure the public health, safety and general welfare. 16. The Owner shall negotiate with the Mead School District and submit a recorded copy of . the agreement making provisions for public schools prior to finalization and recording of this short plat. The agreement shall provide a written description of the subject property to which the agreement applies and also state the dollar amount and any other agreed to mitigating measure(s). 17. A survey is required prior to the filing of a final plat. COUNTY ENGINEER'S DEPARTMENT CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. _ 2. Drainage plans and design calculations showing the alignment of drainage facilities shall be submitted to the County Engineer for approval prior to construction and/or the filing of the final plat. As an alternative method of constructing the road improvements sta.ted herein, the applicant may, with the approval of the Counry Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sancrioned by Spokane County, the _ improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Ruby Road. 10. (b) that the benefits to be derived from the formabon of the RID by the property included therein, together with the amount of any County participarion, exceed the cost and expense of fonnation of the RID; and (c) that the property within the proposed RI1D is sufficiendy developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of an RID by either perition , or resolurion methai under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affuming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the i.mprovements requireri (curb, sidewalk, drainage control and paving) wi11 be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without participation by Spokane County. The RID waiver contained in this agreement shal,l expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to Spokane County the then estimated cost of the requixed improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement) providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to ' Ruby Road. 11. The County Engineer has designated Typical Roadway Section Number Two Local Access stand.ard for the improvement of Ruby Road, which is adjacent to the proposed developrnent. This will require the addition of approximately 30 feet of asphalt along the frontage of the development. The construction of curbing is also required. 12. The proposed subdivision shall be unproved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regularions for roads, approaches, drainage and fees in new construction. 13. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of additional right-of-way and the roadway improvements herein specified. 14. The County Arterial Road Plan identifies,Hastings Road as a Principal Arterial. The existing right-of-way width of 73 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way ded.icarion, a strip of property 7 feet in width along the Hastings Road frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to Hastings Road. 15. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. . Spokane County assumes no financial obligation for adjustments or relocation regaT-ding these utilities. Written approval of the easements by the utility companies must be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utiliries, Spokane County. 4. Water service shall be coordinated through the Di.rector of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that an adequate and potable water supply is available to each tract of the p1aG 7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. . 8. If the proposed insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure to so disclose such know- ledge. If the proposed insured shall disclose such knowledge to the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other matter, the Company at its option may amend Schedule 6 of this Commitment accordingly, but such amendment shall not relieve the Company from liability previously incurred pur- suant to paragraph 3 of these Conditions and Stipulations. 3. Liability of the Company under this Commitment shall be only to the named proposed insured and such parties included under the definition of insured in the form of policy or policies committed for and only for actual loss incurred in reliance hereon in undertaking in good faith, (a) to comply with the requirements hereof, or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon covered by this Commitment. In no event shall such liability exceed the amount stated in Schedule A for the policy or policies committed for and such liability is subject to the insuring provisions, the Conditions and Stipulations, and the Exclusions from Coverage of the form of policy or policies committed for in favor of the proposed insured which are hereby incorporated by reference and are made a part of this Commitment except as expressly modified herein. 4. Any action or actions or rights of action that the proposed insured may have or may bring against the Company arising out of the status of the title to the estate or interest or the status of the mortgage thereon covered by this Comrnitment must be based on and are subject to the provisions of this Commitment.
