SP-834-93 ) CONCLUSIONS AND DECISION THIS MATTER, an applicarion for subdivision of land, from Vera Water and Power has b n received and decided upon, pursuant to Sgokane County Subdivision regulations, on the ~day of April, 1993. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide approxi.mately 2.6 acres into two lots for an existing public well site and one lot for residential uses and those uses perno.itted in the underlying zone. 3. The proposal is generally located south of Eighth Avenue approximately 300 feet west of Sullivan Road in Section 23, Township 25 North, Range 44 E.W.M., Spokane County, Washington. ' 4. The existing zoning of the property described in the applicataon is Urban Residential- 3.5 (UR-3.5), previously established as Agricultural (A) zoning in 1942 (60-42) and redesignated to UR-3.5 on Ja.nuary 1, 1991 consistent with the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing UR-3.5 zone. The Urban Residential-3.5 zone does allow duplexes for lots which are twice the minimum lot size required for single family units, or 20,000 square feet. A duplex would be permitted on Parcel B of the proposed plat. Parcel A is currently developed and contains an existing public well site. 5. The Spokane County Comprehensive Plan designates this area as Urban. 1'he development and uses proposed are generally in accord with this category. 6. A portion of the site is developed and contains an existing public well site. S urrounding uses incluae single family residences, duplexes, a church, and a public high school. 7. The required public notice was provided for this proposal and agencies having a potential interest in the project were norif'ied and recommendations solicited. A minor error was discovered in the written descriptive location in the notice to adjacent property owners however, the viciniry map showing the location of the proposed short plat was correct. 8. No written comments were received from any adjoining property owners. 9. The site is located within the Public Transit Benefit Area (PTBA). Route 21, the Valley/24th Avenue Feeder, provides connecting service to the Valley Transit Center. 10. The Spokane County Arterial Road Plan identifies Eighth Avenue as a Minor arterial i with an existing width of 45 feet and a proposed width of 80 feet. The County ~ Engineer has requested addirional dedication of right-of -way on Eighth Avenue and an 8 foot reserve strip to be designated as a Future Acquisition Area. The County Engineer has also required sidewallcs along Eighth Avenue. 11. The proposed short plat will be served by a public water system. Waste water disposal will be as authorized by the Director of Utilities. 12. The Central Valley School District No. 356 has commented on the proposed short plat. The I?istrict has indicated that existi.ng school facilities are inadequate to serve the proposed short plat and wishes to negoriate with the owner to provide adequate capital facilities as required by the Revised Code of Washington (RCW) 58.17.110. The Planning Department must assume that the agency of jurisdiction, in this case thUSCEIVED Central Valley School District, has made a reasonable request. Approval of this APR 19 1993 sporuW covtmr mNm, . ~ i • FINDINGS AND DECISION SP-834-92 Page 2 plat should include conditions requi.ring that provisions for adequate facilities be in place prior to recording this final plat in the form of a written agreement between the owner and the school district. 13. The site is located 1 mile northeast of Temace View Park and 2 miles south of Sullivan Park. Sullivan Park offers picnic facilities, playground equipment, and a radio controlled car racetrack. On-site facilities at Terrace View Park include a public swimnung pool, softball field and play area. 14. Recognizing the recommended conditions and Spokane County development standards, the proposed short subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the short subdivision. The short subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoring the public health, safety and general welfare in accordance with standards established by the state and Spokane County. The Planning Department has considered the provision of public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces b. drainage ways c. public and/or private rights-of-way d. transit ~ e. potable water f. sanitary waste disposal g. parks and recreation faciliries h . playgrounds i. schools and schoolgrounds j . sidewalks 15. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-834-93 is hereby APPROVED until May 1, 1996, subject to condidons noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. PLANNING DEPARTMENT CONDITIONS 1. All conditions imposed by the Planning Department shall be bind.ing on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended. ~ 3. The final plat sha11 be designed substantially in conformance with the preli.minary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 4. The Plann.ing DirectorJdesignee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 5. Appropriate road name(s) shall be indicated. 6. The preliminary plat is given conditional approval for ttuw (3) years, specifically to May 1, 1996. The applicant may request an extension of rime by submitting a wntten request approximately forty-five (45) days prior to the above expiration date. Written approval of utility easements by appropriate udlity companies shall be received with the submittal of the final plat. 8. Three (3) current certificates of title shall be furnished to the Planning Department prior to filing the final plat. 9. The Spokane Counry Planning Department shall prepare and record with the County Aud.itor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Planning Department. The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least 8 feet of reserved future acquisition area for road right-of-way and urilities, in addition to the existing and/or newly ded.icated right-of-way along Eighth Avenue. NOTE: The County Engineer has required dedication to equal 32 feet from centerline. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved futuxe acquisition area. c. No requi.red landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and urilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d.
