9.14 of llie Spvkane County Code. The fees will be baseci on actual salary cosls incurred

IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-834-93 ) CONCLUSIONS AND
DECISION
THIS MATTER, an applicarion for subdivision of land, from Vera Water and Power has
b n received and decided upon, pursuant to Sgokane County Subdivision regulations, on the
~day of April, 1993.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approxi.mately 2.6 acres into two lots for an existing public
well site and one lot for residential uses and those uses perno.itted in the underlying
zone.
3. The proposal is generally located south of Eighth Avenue approximately 300 feet west
of Sullivan Road in Section 23, Township 25 North, Range 44 E.W.M., Spokane
County, Washington.
' 4. The existing zoning of the property described in the applicataon is Urban Residential-
3.5 (UR-3.5), previously established as Agricultural (A) zoning in 1942 (60-42) and
redesignated to UR-3.5 on Ja.nuary 1, 1991 consistent with the Program to Implement
the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does
conform to the requirements of the existing UR-3.5 zone. The Urban Residential-3.5
zone does allow duplexes for lots which are twice the minimum lot size required for
single family units, or 20,000 square feet. A duplex would be permitted on Parcel B of
the proposed plat. Parcel A is currently developed and contains an existing public well
site.
5. The Spokane County Comprehensive Plan designates this area as Urban. 1'he
development and uses proposed are generally in accord with this category.
6. A portion of the site is developed and contains an existing public well site.
S urrounding uses incluae single family residences, duplexes, a church, and a public
high school.
7. The required public notice was provided for this proposal and agencies having a
potential interest in the project were norif'ied and recommendations solicited. A minor
error was discovered in the written descriptive location in the notice to adjacent property
owners however, the viciniry map showing the location of the proposed short plat was
correct.
8. No written comments were received from any adjoining property owners.
9. The site is located within the Public Transit Benefit Area (PTBA). Route 21, the
Valley/24th Avenue Feeder, provides connecting service to the Valley Transit Center.
10. The Spokane County Arterial Road Plan identifies Eighth Avenue as a Minor arterial i
with an existing width of 45 feet and a proposed width of 80 feet. The County
~
Engineer has requested addirional dedication of right-of -way on Eighth Avenue and an
8 foot reserve strip to be designated as a Future Acquisition Area. The County Engineer has also required sidewallcs along Eighth Avenue.
11. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
12. The Central Valley School District No. 356 has commented on the proposed short plat.
The I?istrict has indicated that existi.ng school facilities are inadequate to serve the
proposed short plat and wishes to negoriate with the owner to provide adequate capital
facilities as required by the Revised Code of Washington (RCW) 58.17.110. The
Planning Department must assume that the agency of jurisdiction, in this case thUSCEIVED
Central Valley School District, has made a reasonable request. Approval of this

plat should include conditions requi.ring that provisions for adequate facilities be in
place prior to recording this final plat in the form of a written agreement between the
owner and the school district.
13. The site is located 1 mile northeast of Temace View Park and 2 miles south of Sullivan
Park. Sullivan Park offers picnic facilities, playground equipment, and a radio controlled
car racetrack. On-site facilities at Terrace View Park include a public swimnung pool,
softball field and play area.
14. Recognizing the recommended conditions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health,
safety and general welfare and that the public use and interest will be served by platting
the short subdivision.
The short subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoring the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The Planning
Department has considered the provision of public facilities as cited in RCW 58.17.110
(2). More specifically:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d. transit
~ e. potable water
f. sanitary waste disposal
g. parks and recreation faciliries
h . playgrounds
i. schools and schoolgrounds
j . sidewalks
15. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-834-93 is hereby APPROVED until May 1, 1996, subject to condidons noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be bind.ing on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended. ~
3. The final plat sha11 be designed substantially in conformance with the preli.minary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
4. The Plann.ing DirectorJdesignee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for ttuw (3) years, specifically to
May 1, 1996. The applicant may request an extension of rime by submitting a wntten
request approximately forty-five (45) days prior to the above expiration date.

7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate udlity companies shall be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be furnished to the Planning Department prior
to filing the final plat.
9. The Spokane Counry Planning Department shall prepare and record with the County
Aud.itor a Title Notice specifying a future land acquisition area for road right-of-way
and utilities. The reserved future acquisition area Title Notice shall be released, in full
or in part, by the Planning Department. The notice should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 8 feet of reserved future acquisition area for road right-of-way and
urilities, in addition to the existing and/or newly ded.icated right-of-way along
Eighth Avenue. NOTE: The County Engineer has required dedication to equal
32 feet from centerline.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved futuxe acquisition area.
c. No requi.red landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and urilities. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as Iandscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the rime Spokane County makes roadway improvements after
acquiring said future acquisition area.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be determi.ned at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
11. A plan for water facilities adequate for domesric service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, Counry Building &
Safety Department and Counry Health District The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
12. The water purveyor shall certify that appropriate cantractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities I
prior to application for building permits within the final plat. The arrangements or agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a building pernut due to the failure
of the subd.ivision sponsor to satisfactorily complete the approved water system.
13. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Pla.n approved by county and state
health authorities, the local fire protection district, County Building & Safety
Department and water purveyar, shall be installed within this subdivision, and the
applicant shall provide for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."
14. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursutECE1VED

to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
15. The Water Plan and the above conditions of approval regardi.ng the Water Plan may be
waived by the Planning Director/designee upon receipt of letters from the appropriate
water purveyor and fire protection district stating that simple connections to an existing,
approved water system will provide adequate domestic and fire protecrion water to
ensure the public health, safety and general welfare.
16. A survey is required prior to the filing of a final plaG
17. The Owner shall negotiate with the Central Valley School District and submit a
recorded copy of the agreement making provisions for public schools prior to
finalization and recording of this short plat. The agreement shall provide a written
description of the subject properry to which the agreement applies and also state the
dollar amount and any other agreed to mitigating measure(s).
The Owner shall also notify any potential purchasers who have made an agreement to
purchase properry within said short plat pursuant to the Revised Code of Washington
(58.17.205), that adequate provisions for school facilities must be made conditioned on
a future agreement between the plattor and school district.
Voluntary agreements between the Owner and School District shall conform to the
requirements of the Revised Code of Washington Chapter 82.02.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record. `
2. No construction work is to be performed within the existing or proposed public right-
of-way until a pernut has been issued by the County Engineer. All work is subject to
inspection and approval by the Counry Engineer.
3. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
4. Dedication of additional right-of-way along Eighth Avenue shall equa132 feet from
centerline.
5. Existing county roads providing direct access to the plat shall be paved andior curbed to
Spokane County standards.
6. Sidewalks are required along the arterial on Eighth Avenue.
7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
8. To construct the road improvements stated herein, the applicant may; with the approval
of the County Engineer, join in and be a willing parricipant in any petition or resolurion
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sancrioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to exisang
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Eighth Avenue.
9. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the requued road improvements. At such time as an RID is
created or any Road Improvement Project is sancrioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heixs, grantees

10. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement I?istrict (RID) by the
petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)'
property, and further not to object, by the signing of a ballot, to the formation of an
RID by the resolurion method pursuant to Chapter 36.88 RCW, which resolufion
includes the owner(s)' property. If an RID is formed by either the petition or resolurion
method as provided for in Chapter 36.8$ RCW, the owner(s) or successor(s) further
agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation, exceed the
cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of an RID by either petition
or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners affirn.ing the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own expense, pay to
Spokane County the then estimated cost of the required improvements to enable the
County to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) providing
for or securing to the County the actual construction of the i.mprovements.
All of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s)." This provision is applicable to
Eighth Avenue.
11. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the improvement of Eighth Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 12-14 feet of
asphalt along the frontage of the development. The construcrion of curbing and
sidewalk is also required.
12. The proposed subdivision shall be unproved to the standards set forth in Spokane
County Board of Commissioners Resolurion No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
13. The County Engineer has exa.mined this development proposal and has determined that
the impact of this proposal upon the exisring county road system warrants the
dedication of additional right-of-way and the roadway unprovements herein specif'ied.
14. The County Arterial Road Plan identifies Eighth Avenue as a Minor arterial. The
existing right-of-way width of 45 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of property 8 feet in width along the Eighth Avenue frontage shall be
set aside in reserve. This property may be acquired by Spokane County at the time
when arterial improvements aze made to Eighth Avenue.
15. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition. RECE VED
Spokane County assumes no financial obligation for adjustments or relocation

regarding these utilities. Applicant(s) should check with the applicable utiliry purveyor
and the Spokane County Engineer to determine whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preli.minary plat of record and/or any
attached sheets as noted.
2. Appnopriate utility easements shall be indicated on copies of the preli.minary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane Counry.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.

6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat
8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that a suitable site for an on-site sewage disposal
system is available on Tract B.
9. Subject to specific application approval and issuance of permits by the health officer,
the use of an individual on-site sewage disposal system may be authorized.
10. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of pernuts by the Health Officer, the use of (an) on-site sewage system(s)
may be authorized."
11. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
12. The final plat dedication shall contain the following statement: "The public water
system, pursuant to the water plan approved by county and state health authorities, the
local fire protection district, County Building and Safety Department, and water
purveyor, shall be installed within this subdivision and the applicant shall provide for
individual domestic water service as well as fire protection to each lot/tract prior to sale
of each lotltract and prior to issuance of a building permit for each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The dedication shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a ULID by resolution method

3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connecrion to future areawide collection systems."
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Fire flows are applicable for this proposal. The minimum fire flow and flow durarion
will be based on a representative dwelling size for all floors not including the basement.
The maximum dwelling size needs to be submitted to the Department of Buildings.
2. An approveri water supply capable of supplying the required fire flow protection shall
be provided before any building permits are issued. The water system shall be installed
in accordance with an approved Water System Plan on fiie with the Department of
Buildings. Certification that the installed system complies with the requirements of the
plan and is operational shall be submitted to the Department of Buildings prior to permit
issuance.
