A. The applicant requests that Condition No. 1 of ZE-40-73 be amended
to allvw substantially different development than ie now cequired.
Condition No. 1 for ZE-40-73 cequires that the property be developed
in subetantial conformance with the appraved site plaa and elevatlon
drawinqs.
The ociqinal plan for ZE-40-73 proposed a 19,900 squere foot office
on a 75.400 square foot eite. On Apcil 21, 1978, the Planninq
Commission recommended approval of a Fast Gas opecation to
occupy the South 130 feet of the 75,400 square foot site. The
applicant wishes to oonstruct a 10-lviinute Lube and 011 Change
business on a 12,000 squace foot pa~cel adjacent to the Fast Gas
site and bordering on Acgonne Road.
II. FINDINGS OF FACT
a) Comprehe s v Plaq:
Pr+oposal is consistent with the Spokane County Comprehensive Plan
Map.
b) Environrnental Review:
Zone reclassification, ZE-40-73, had complied with SEPA.
ZE-40A-73 for the Fast Gas business also compiied with SEPA. It
is the conclusion of the staff that a DecZacation of Non-significance
be iseued on this application. However, evidence and findinqs
presented at the public hearing concerninq this cnattec should also be
considered.
C) Conditiena;
1. The site shall be developed in subatantial conformance with
the revised plan on file with this application.
N o t e: This approval shall be limited to the North 100' of
the South 230' of the site as shown in ZE-40-73.
2. Approoval of access by the Spokane County Enqineec's Office
prior to release of buildinq permits.

3. A specific landscape plan, plantinq schedule, and provisivns
for maintenance, for the proiect, shall be approved by the
Spokane County Zoning Admtnistrator prior to release of
building permits, includinq a gerformance bond to cover the
cos t of the required land s caping .
4. Sewaqe dlsposal shall be approved by the Spokane County
Health District prior to issuance of buildinq permits.
5. Any portion of the project which is to be occupied or traveled
by vehicles shall be maintained in hard surface paving.
6. An on-site storm drainage system shall be approved by the
Spokane County Enqineer's Office.
7. Subiect property shall be liqhted in such a manner which will
not produce glare on adioininq residential uses.
8. Installation (if necessary) of fire rants in accordance with
the require:nents of the Spokan Fire Marshal.

9. That the provisions of SEPA's Notice of Action pursuant to
43.21c.080 R.C.W. and the Board of County Commissioners'
Resolution No. 77-1392 , be accomplished by the proiect
applicant wi thin thirty (30) days of formal action by the 8oard

Department staff.

Mr. Quiqley moved, Mr. Kennedy seconded, that a public
hearinq be held for the County Planninq Commfssion to take some
action on the Evaluation of Plan "D" of Five Mile and that
testimony be taken. Mc. Main abstained fcnm votinq. Three
voted "Yes one voted "No". Mr. Culler did not vote. Motion
was cepeated and a second vote taken. Mr. Main abstained;
four voted "Yes"; one voted "No" . Motion carried. The staff
will set the date for the public hearinq.
g) Other Business
Jecry Litt read a letter addressed to him from Wells B. McCurdy,
requestinq postponement until July 21, 1978, of the Highlands
proiect at Libecty Lake, ZE-31-78 and ZE-32-78. The hearinq
would be readvertised and the pcoperty owners renotified.
Mrs. Byrne moved, Mr. Quigley seconded, that Zone Reclassi-
fication requests, ZE-31-78 and ZE-32-78, be continued to the
Planninq Commission's July 21st hearing, at the cost of
notification to the developer. Motion carried unanimously.

proposed Amendment to the Spokane County Zoninq Ordinance with the

Office Accessocy Uses", with the "s" dropped to the singular in "Use".
thereby the title becominq "Residential Office Accessory Use". Changinq
No. 1(b) under Conditional Standards to read as follows:" The total area
for all accessoiy uses shall not exceed ten (IO) percent of the floor area of
any residential office buildinq." Also, addinq to the last sentence, "In
