The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site. .
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.

B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:

C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. Marietta Ave.
All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.

1. Site Plan.
2. Drainage plan as specified.
3. Other information:
a. A parking and traffic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles. It is-illegal to back out onto the Right of Way.
E) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
F} The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
The applicant or their representative is responsible for
including each item that is marked "Required By This Project" in
their submittal in accordance with the checklist descriptions.
Each item submitted that is to meet the checklist shall be
checked off by the applicant or their representative. Submittals
which do not conform to the above requirements will be returned
for further items with no review being accomplished. This will
prolong the review process. If changes occur in the requirements
for the project because of further conversations with Spokane
County representatives, please attach a note explaining the
agreed upon change in requirements. When the applicants'
submittal is finally approved, the Engineers department will
release their portion of the Building Permit.

connected to public utilities". This statement is incorrect, runoff for the entire
parcel will be contained on-site and managed in compliance with the "Guidelines
for Stormwater Management". This project is also subject to the conditions of
ZE-41 A-78. A pre-application conference was held on Sept 26, 1994; During the
meeting the applicant received information regarding these issues from the
Engineers Dept. If the applicant has any questions, we would encourage them

A. I NTRODUCT ION
This matfier having come before the Examiner Committee on February 28, 1980
and the members of the Committee present being Eldon Thomas, Chairperson,
Kathy Carstens, and Jane Myers and the Committee having personally visisted
the site of the proposal.
B. PROPOSAL
The sponsor, Walter A. Miller, is requesting approval of a preliminary plat,
PE-1365-80, Montgomery Commerce Center for subdivision of 9.7 acres into 14
lots for industria{ use with offices and there being present, the following
appiicant or representative:

C. FINDINGS OF FACT
1. That the existing land use in the area is vacant with one trailer on
property. 2. That the Comprehensive Pfan designates this area as industrial usage.
3. That the existing zoning of the property described in the application is
Restricted Industrial.

5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
7. That the proposed use is compatible with existing uses in the area.
8. The -Hearing Examiner Committee finds the proposed use is not detrimental
to the general purpose or otherwise *harmfull to the public health, safety,
and welfare.
9. That the owners of adjacent lands expressed approval of the proposed use.
10. The following are additional findings of fact considered by the Hearing
Examiner. Committee:
a) That the sponsors have proposed a very responsible and compatible
proposal.
D. SPECIAL CONDITIONS OR CONTIGENCIES APPLICAgLE TO THIS
SUBDIVISION APPROVAL:
If approval is granted, the following conditions are recommended.
1. That the plat be designated as indicated on the preliminary plat of record
and/or attached sheets as noted. ,
2. That a statement be placed in the dedication to the effect that no more
than one dwelling structure be placed on any one lot, nor shall any lot be
further subdivided for the purposes of creating additional lots or building
sites without filing a replat.

irr~igation and fire pratection be appr~oved by the water suppiier and fire
protection district. Said water plan must also have been apprcaued by the
appropriate health autharities. The health authoritiesr water supplier
. (purveyor), and fire protection district ►nrill certifY, prior to the filing of
the final plat, an the ~ar-e af 5aid water plan that the plan is in conforrr}°
ance wit#~ their requirements and will adequately satisfy their respective
- needs. Said water pIan and cer~tificatiori will be cirafted on a transparency
suitable for repr~oduction.
The purveyor will also certGfy prior to the filing of the fina€ plat on a
capy of said water plan that appropr}ate contractual ar~rangements have
been made with the plat sponsar for canstruction of the ►n+ater system, in
accordance with the approved plan r and in accordance rwith a time schedule.
The tim+e schedule will provide, in any case, for completivn of the water
system and inspectxon by the appropriate health authorities prior to
application for bui3ding perrnits within the plat. The contractual arrange-
ment-s wili include a pravrsion hoiding 5pokane County and the purveyor

harmless from ciaims by any lot purchaser refused a building permit due to
the failure of the plat sponsor to satisfactorily complete the approved
water system.
The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authorities and the
local fire district and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot.
7. That a certificate of title be furnished the Planning Department prior to
the filing of the final plat.
r 8. That the preliminary plat be given conditional approvaf to March 1, 1981.
9. That a declaration of Non-Significance be issued, in accordance with
Section 11.15.340 of the Spokane County Environmental Ordinance (SCEO)
prior to approval, or any approving action in accordance with SCEO
11.15.340.
NOTE: The official file contains an environmental checklist for the
proposal and a staff review of their check{ist as required by
wAC 197-1 0-320.
10. That conditional approval of the plat by the County Engineer is given
subject to dedication of right-of-way and approval of the road system as
indicated in the preliminary plat of record.
11. That plans, profiles, and cross-sections as designed to County standards
showing proposed street centerline and curb grades be submitted to the
County Engineer for approval prior to construction and/or the filing of a
final plat; road plans to be prepared under the direction of a licensed
Professional Civil Engineer.

drainage facilities be submitted to the County Engineer for approval prior
to construction and/or the filing of the final plat. Drainage plans to be
prepared under the direction of a licensed Professional Civil Engineer.

performed under the direct supervision of a licensed engineer/surveyor,
who shall furnish the County Engineer with "As Built" plans and a certifi-
cate in writing that all improvements were installed to the lines and grades
. shown on the approved construction plans and that all disturbed monu-
ments have been replaced.
14. No construcfiion work is to be performed within the existing or proposed

public right-of-way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
Engineer.

15. All construction within the existing or proposed public right-of-way is to
be completed prior to filing plat or a bond in the amount estimated by the
County Engineer to cover the cost of construction of improvements,
construction certification, "As Built" plans, and monumenting the street
centerlines shall be filed with the County Engineer.
16. That appropriate provision be made that the following described property
be held in trust until the continuation of the streets be dedicated or
deeded. A 1 foot strip at the ends or edges of all streets that terminate
or border the plat boundary. (Temporary cul de 'sacs are required when
str.eets terminate at the plat boundaries.)

17. Existing County roads providing direct access to the plat shall be paved
and/or curbed to the standards of the County Engineer; curbed on plat
side of road.

mended in the Water Quality Management Plan.
24. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessor and the Pfanning staff.
25. That the dedicatory language of the plat will state, "That each lot be
authoriZed for the use of individual on-site sewage disposal systems."
26. Prior to filing of the final plat, the sponsor shall present evidence that
the plat lies within the recorded service area of the proposed water district.
Special Conditions 27. That the provisions of SEPA'S NOTICE OF ACTION pursuant to 43.21C.080
RCW and the Board of County Commissioner's Resolution No. 77-1392 be
accomptished by the project applicant within thirty (30) days of formal
action by the Hearing Examiner Committee, with r-egard to the prelirninary
plat approval; as instructed by the Planning Department staff.

. 29. That the project sponsor is responsible for requesting an extension of time
to review any preliminary plat approval. Ail extensions applied for may

30. That the Hearing Examiner Committee sustain the issuance of a proposed
Declaration of Non-Significance and recommends issuance of a final Declara-
tion of Non-Significance.
31. That a public water system serviced by Irvin Water District, and including
fire fiows, serve each lot prior to the sale of the lot.
32. That final construction plans for on-site storm drainage facilities be
reviewed and approved prior to filing of the final plat by the County
Utilities Engineer and the County Health District.
33. That the plat dedication contain the statement: "Use of private we{Is and
water systems is prohibited.
34. The sponsor must comply with all conditions of zone change ZE-41-78 prior
to finalization of plat.
35. Bui{dings should be double plumbed to facilitate connection to an area-wide
sewer.
36. Owners, heirs and assigns obligate to a"no protest" to any petition and
assessments involving any future sewer (LID) and connection thereto.
This condition shal) be a covenant on the final plat and run with the land.
37. An internal pathway system to provide for pedestrian traffic within the
site must be prepared by the plat sponsor. This requirernent must be
addressed prior to filing of final plat.

category, they are adjoined on the west by an Industrial category.
Transitional policies for sites such as this, together with guidelines for
light industrial uses in an Urban category, suggest various techniques to
accommodate transition of use and insure compatibility between different
land uses. Buffering techniques generally include landscaping, fencing,
spatial separation, and change in land use intensity.

development and landscaping comparable with that in the industrial
park imnediately to the east (Montgomery Business Park).

Proposed Buffering Techniques: Site plan proposes: 1) 35' of

Other Site Plan Considerations: The proposed rezone site is planned

determine compliance with all Ordinance regulations and

III. SITE DEVELOPh1ENT RECOMMENDATIONS
Des iqn: Approva 1 of the Change of Cond i t i on, to remove the f ence and some
landscaping, is appropriate with approval of the rezone. The residential
use intended to be buffered by that.condition wiil be eliminated with
redevelopment under the new rezone.
Buffering: The proposed buffewing along the west and north property lines
meets the required landscape standards of the I-2 Zone.
Landscapinq: Some additional amount of landscaping may have to be
provided in the parking area of the rezone to meet standards of
landscaping in parking lots.
Si nage: The I-2 Zone contains specific sign standards which should be
a~equate for th i s area.
Circulation/Access: The County Engineer requires additional dedication
along University Road to create a right of way width of 39-feet easterly
of the centerline.
Critical Materials/Use Activity.: The Department of Building and Safety
will review for use of critical materials and implement protection
measures for such material per the Aquifer Sensitive Area Overlay Zone
standards.
IV. SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The review considered
the specifics of the proposal, other available information, County
ordinances, other regulations and laws, possible standard Conditions
of Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines. The Zoning Administrator has determined
that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Determination of ,
Non-S ign i f i cance ("DNS"

Prior To The Issuance Of A Building Permit:
l. Access permits for approaches to the County Road System shall be
ohtained f rom the Spokane County Engineer.
2. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans.
3. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surf ace water disposal
plan for the entire project or portion thereof, if development
is to be phased.
4. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design,
location, and arranqement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surf acing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
5. The word "applicant" shall include the owner or owners of the
property, his hei.rs, assigns, and successors.
6. The construction of the road improvements stated herein shall be
accomplTShed as approved by the Spokane County Engineer.
7. The County Engineer has designated Typical Roadway Section
Number One, Secondary Arterial standard for the irnprovement of
University Road which is adjacent to the proposed development.
This will require the addition of approximately 12 feet to
14 feet of asphalt, curb and sidewalk along the frontage of tflo
development.
8. Roadwa-y standards, typical roadway sections and drainage plan
requirements are-found in Spokane Board of County Commissioners'

9. The applicant should be advised that individual driveway access

c) COUNTY UTILITIES DEPARTMENT
l. Pursuant to Board of County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Health
District.
2. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition•includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which Ancludes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each new unit shaTl be double-plumbed for connection to future
areawide collection systems.
d) COUNTY HEALTH DISTRICT
l. A combined surf ace water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer prior to the issuance
of any on-site sewage disposal permit or building permit for
this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.

3. Subject to specific application approval and issuance of permits
by the Health Officer, the use of individual on-site sewage
disposal systems may be authorized.
4. Water service sha11 be coordinated through the Director of
Utilities, Spokane County.
5. Water service shall, be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health 5ervices.
6. Use of private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
8. The project shall not produce more than 3,600 gallons of
generated wastes per day for on-site sewage disposal.
e) COUNTY BUILDING AND SAFETY DEPARTh1ENT
1. The site is located in Fire District # l.
2. This project may involve the storage and handling of critical
materials. It is recommended that the applicant contact the
Department of Bui lding and Safety for material s identif ication
and containment requirements prior to the issuance of any
building permit.
3. The required f ire f low for any bui lding or property development
i s determi ned by bu i ld i ng s i ze, type of construct i on, and
proximity of exposures. Required fire flows shall be based on
an evaluation of each bui lding at the time of bui lding permit
application. The specific location of hydrants shall be
determined by the fire district.
4. Any proposed conditions relating to bui lding location, design,
and occupancy sha11 be reviewed by Building and Safety for
compliance with the Uniform Building and Fire Codes prior to
finalization of action.
5. Fire hydrants shall be located so as to be accessible to fire
apparatus and not be obstructed by any structure or vegetation
or have the visibility impaired for a distance of fifty feet in
the direction of vehicular approach to the hydrant.
6. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.

7. Depending on the extent of existing water mains and hydrant
locations, fire hydrants which meet the minimum fire flow
requirements as enumerated in Chapter 6, Title 3 of the Spokane
County Code, may be required to be installed prior to any
construction.
8. Approved numbers or addresses shall be placed on all new and
existing buildingsin such a position as to be plainly visible
and legible from the street or road fronting the property. Said
numbers shall contrast with their background.
9. The relocation of the existing building or the demolition of the
building shall comply with the provisions of Title 3, Spokane
County Code and that prior to the relocation or demolition, a
permit from the Department of Building and Safety is required.
f} WATER PURVEYOR
1. Water Purveyor is Irvin Water District, and they are able to
supply the site with adequate water for domestic, fire and
irrigation uses.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
Ail air pollution regulations must be met. This includes but is not
1 imited to the fol lowing:
l. Air pollution regulations require that dust emissions during
demolition, excavation and constructivn projects be controlled.
This may require use of water sprays,.tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions f rom the transfer of
earthen material must be controlled as well as emissions f rom
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors wi11 likely result during the
construction phase of the project and from motor vehicles using
the site following completion of the project and from occupants
of the proposed project.

5. SCAPCA Regulation I, Article IV requires registration with this
Agency.

approved by our Agency prior to the construction, installation
or establishment of an air pollution source.
7. SCAPCA Regulation I. Article VI and SCAPCA Regulation II,
