A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
December 5, 1985, and the members of the Committee present being
Gary N. Anderberg, Chairman, Jane E. Myers and Ron Odell.
B. P ROP OSAL
The sponsor, Metro Hauling, Inc., (Mike Chimenti), is requesting approval
of a change of conditions, File No. ZE-61A-83, Restricted Industrial Zone,
for the purpose of reviewing a new site development plan.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, West Coast
Grocery berm, Montgomery Commercial Center, commercial and vacant.
- 2. That the Comprehensive Plan designates this area as appropriate for
Urban development.
3. That the existing zoning of the property described in the application
is Restricted Industrial Zone.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Declaration of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled. ~
6. That the land in this area is suitable for the proposed use, or
uses within the existing Zone Classification.
7. That the applicant has demonstrated that conditions have .
substantially changed since the original zoning of this area and
accordingly, the proposed change of conditions is justified.
8. That the proposed use is compatible with existing uses in the
area.

10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
1. Delete Paragraph #3 in County Planning Department Condition #6, as
Tom ows: "If the additional northerly 78 feet is developed and only if it is
developed, landscaping shall be consistent with the rest of the
development; that there be a 15-foot yard setback to include
landscaping along the north property line. The boundary between the
existing residence on-site and storage yard need not be landscaped -
a 6-foot sight-obscuring fence would be satisfactory. That the area
to be landscaped along Montgomery and University be a minimum of
10-feet."

a) COUNTY PLANNING DEPARTMENT
1. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building permits.
2. Direct light from any exterior area lighting fixture shall not
extend over the property boundary.
3. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits.
4. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
. be maintained.
5. All current standards of the Restricted Industrial Zone, as
amended, shall be complied with in the development of this
site.
6. That a minimum 6-foot sight-obscuring fence on a two or three
foot berm (similar to the existing fence on the east property
line) be provided around all open storage yards.
That the east boundary shall have a 10-foot setback in terms of
the landscape area which may include the north swale area for
the '208' requirements and the north boundary.

7. Applicant shall comply with '208' recorranendations concerning
stormwater runoff and provide necessary landscaping for runoff.
8. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances, and the Spokane County Zoning Ordinance prior to
issuance of building permits.
9. That the paving shall be asphalt or other hard surfacing of a
depth suitable to support the weight of trucks.
10. That the adjacent land owner shall have the opportunity to
~ review and comment on the proposed landscaping plan submitted by
the applicant prior to approval by the Zoning Administrator.
11. Signs for this project shall conform to standards as set forth
in Section 4.09.125 Signs.
12. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners' Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements.
b) COUNTY ENGINEERING DEPARTMENT Prior To The Issuance Of A Building Permit:
l. Applicant shall dedicate a 20-foot radius on University Road
and Montgomery prior to any use of the property.
2. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer,
3. Applicant shall improve Montgomery Drive in a manner consistent I
with Spokane County TYPICAL roadway section No. 1 minimum paving
width Secondary Arterial Standard.
4. Applicant shall improve University Road in a manner consistent
with Spokane TYPICAL roadway section No. 1 minimum paving width ,
Secondary Arterial Standard.
5. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.

6. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any
building permit on the property.
7. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
8. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
9. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
10. Al1 required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
11. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County
Commissioners'Resolution No. 80-1592 as amended.
12. Applicant shall convey to Spokane County a sufficient amount of
road right of way so as to provide 39-feet east of the
centerline of University Road.
13. That the applicant shall provide a 2-foot wide easement for
utilities along University Road. ~
c) COUNTY UTILITIES DEPARTMENT .
1. Pursuant to Board of County Commissioners' Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
. application approval and issuance of permits by the Health
District.

2. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each unit shall be double-p-lumbed for connection to future
areawide collection systems.
5. Plans and specifications for the double plumbing are to be
reviewed and approved by the Utilities Department prior to
applying on an on-site sewer permit.
d) COUNTY HEALTH DISTRICT
Recommend all previously imposed conditions of approval be continued
(dated August 31, 1983) as follows:
l. Appropriate utility easements shall be indicated.
2. A combined surface water and sewage disposal detailed plan shall
be approved by the County Engineer and the Health District prior
to the issuance of any building permit for this project.
3. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
4. Subject to specific application approval and issuance of permits
by the Health Officer, the property is authorized the use of an
individual on-site sewage system. .
5. Water service shall be coordinated through the Director of
Utilities, Spokane County.
6. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social & Health Services.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.

I. General Overview - The proposed is the construction of.a
15,200 square foot building for wholesale distribution of finished hardwood products. The warehouse-portion contains 12,000 square
feet with an additional 1,000 square feet devoted to office use.
The loading dock will be under cover with a roof area of 2,200
square feet to accommodate all weather loading. It was stated that
there will be no sawing, staining or any processing of the hardwood products conducted within the building. .
It was noted that compliance with the State Environmental Policy
Act was achieved when the subject property was rezoned to
Restricted Industrial in 1983 (Reference to rezone file number
ZE-61A-83)0
The applicant stated that he would like occupancy by July 1, 1990 -
since he is relocating his business.

1. Comments regarding landscaping and parking - requirements were given to the applicant by Allan
deLaubenfals.
2. It was noted that the parcel number (09542-9011)
involved a larger parcel then what is being shown on the site
plan. The applicant was requested to submit a leqal
description of the property in order that a clarification can
be made.
3. The zone classification for the proposed is
Restricted Industrial which allows the proposed as a permitted use subject to conditions specified in the rezone file
numbered ZE-61-83.
4. Conditions imposed by the rezone involved the entire
parcel of land and before any building permits can be
released, conditions of the rezone would have to be satisfied.
The rezone file contained a specific development plan and
landscaping plan which need to be addressed and shown on a
revised site plan.
5. The applicant was informed of several options
available.should he wish to develop only that portion shown
on the proposed site plan. These options include submitting
an application for a Binding Site Plan to*divide the parcel.
into two lots and a Change of Conditions application to change
or delay any requirement pertaining to the portion of the
parcel not being developed at this time. Since these two
processes do involve considerable time and a public hearing,
the applicant was advised as an alternative that he may submit
landscaping and road plans for the entire parcel for review.
Upon approval, the building permit may be issued while an
application for a Binding Site Plan and/or Change of
• Conditions is pending. However, for the proposed project the.
applicant was made aware of that the entire parcel is being
considered as one and subject to compliance with_all
conditions of rezone ZE-61-83 before planning canrelease
their portion of tr.e building permit.
6. A total of nine parking stalls are being required .
for the proposal. Since six stalls were shown on the site
plan three additional stalls need to be illustrated on a
revised site plan. Parking was based on the following
standards: (1) For 12,000 square feet of area to be used for
warehousing, one space per 2,000 square feet for a total of
six spaces are required: (2) For 1,000 square feet for office
use, one space per 350 square feet for a.,total of three spaces
are required.

type and quantity of plant material along with a bond shall be
submitted. However, Allan deLaubenfels stated that the
applicant may request in writing a waiver from the Bond
requirement and file a Promissory letter in lieu of the Bond.
The Planning Department will make a determination.
3. Certificate of Exemption must be filed in regards to
Parcel number 0954.2-9011 verifying that the parcel has been
properly segregated.
II. Engineering Department (456-3600)
A. Discussion/requirements
1. Comments were given to the applicant and Building
and Safety by Scott Egger.
2. Please submit a drainage plan for the site, at a
minimum the plan shall contain following: drainage
calculations for stormwater volumes generated on site,
calculations for total impervious surfaces contained within
the site, finished grade elevations for structures to be
constructed on site, f inished grade elevations at the top and
bottom of the 208 swale, typical cross section of the 208
swale, calculations to justify the number and type of drywells
proposed, and elevation of drywells inlets where applicable.
3. The proposed site is affected by the "Findings and
Order" and the "Conditions of Approval" for the following land
use action: Spokane County Zone Change No. ZE 61A-83. - ,
4. Road and drainage plans prepared by an engineer for
street improvements along Montgomery Drive and University Road
are required to be submitted. Plans are to include sidewalk,
curbing, and paving.
5. An agreement to Pay Fees was given to the applicant
. . • ,
~ . during the meeting. The agreement is to be signed by the owner and returned to the Enginee-ring Department. Plan review
will not commence until this document is executed.
6. It was indicated that backing of trucks'on county road ways is not allowed. The applicant will need to redesign
the site plan to allow on-site circulation for unloading .
operations.
7. Due to future Right-of-Way needs for University
Road, the applicant shall dedicate 39 feet of property East of
the center line alignment in accordance with rezone ZE-61-83. B. Permit Release Requirements
1. Approach permits must be obtained from the County
Engineers for driveway approaches to Montgomery Drive..
2. Please submit a site plan and drainage plan
including agreement to pay fees as described above for review .
and approval.
3. Please submit a copy of a recorded property deed for
the proposed property. Upon receipt of-the deed our office
will prepare the right of way deed and/or the RID/CRP
agreement. 4. - All required road work with the public right-of-way
as described above shall be completed or a bond in an amount
estimated by the County Engineer to cover the costs of
improvements shall be filed. Bond,optionswere explained,
please-contact Jerry Sims (456-3600) for surety requirements.
III. Health District (456-6040)
A. Discussion/Requirements
1. It was reported that there are three people who will
be employed by applicant to operate the business. 2. A public sewer system may be available to the site
in the near future.
3. Until sewers are available-the applicant will need
to install a septic tank and drainf ield. Options'such as a
holding tank were also discussed.
4. Please submit an updated critical materials listing
to Building and Safety for review.

5. If it is determined the owner is a critical
materials user, a"Sampling Agreement" which involves sampling ,
of the effluent of the septic tank on an annual basis, shall_ .

6. Daryl Way suggested to the applicant to move the -
existing building back, and put in a loop driveway, and. .
install the drainfield in front of site for easier access for
the proposed. This would allow for proper placement of the
drainfield.
7. It was indicated that double plumbing to the street. '
will be required. The Health District will coordinate with Utilities Department for specifications and location when
application for a sewage permit is submitted.. Please contact
County Utilities at that time (456-3604).
B. Permit Release Requirements_. .
l. Please apply for a sewage disposal tank permit.
V. Fire District No. 1(928-2462)
A. Discussion/Requirements 1. One fire hydrant is required. The hydrant is to be
located at the curb cut entrance on*Montgomery Avenue. The hydrant location shall be as per an approved water plan. -
2. A lock (Knox) box containing access keys for fire
personnel is required.to be installed. A brochure was given
to applicant explaining the Knox box system. -
3. Fire Department access lane is required to be within_
150 feet of all portions of the exterior walls of a building.
VI. Building and Safety (456-3675)
. A. Discussion/Requirements
1. Plan review has been completed on preliminary plans
only by Ken Jeffrey.
2. Plan review was based on a Type II-N constructed V
building in reqards to the proposed. All proposed and.future _
construction must meet this requirement.

3. The proposed warehouse and office have been
classified as an B-2 occupancy. The covered parking area is
classified as a B-3 occupancy.
4. Exiting from the structure must be revised to meet
Chapter 33 Uniform Building Code. The exiting thru the
parking/loading structure is not permitted.
B. Permit Release Requirements
1. Two complete revised sets of plans addressing the
items discussed during and after the meeting and other items
from-the plan review letter needs to be submitted for review
and approval.
APPLICANT'S COMMENTS/ACKNOWLEDGEMENT:
The applicant acknowledged'that all comments/requirements were
understood and had no further questions at this time regarding
permit requirements.
CORRECTIONS:
To minutes or changes from what appears in the minutes., we should
be notified within one day of your receipt of these minutes.
To site plans as required by any or all of the above-listed
departments shall be submitted to Building and Safety who will then
distribute accordingly to those departments.

Benefits to them in hand paid, and receipt of which is hereby acknowledged, grants
to Spokane County, a political subdivision of the State of Washington, an Easement
over, under, upon and across the hereinafter described lands situated in the County
of Spokane, State of Washington:
The East 2 feet of the West 41 feet of that portion of the South Half (S#) of/the
Northwest Quarter (NWJ) described as follows:
"Beginning at the Northwest corner of the South Half (Sj) of said Northwest Quarter
(NWJ); thence South 641.3 feet; thence East 658.79 feet; thence North 641.3 feet to
a point 658.66 feet East of the point of beginning; thence West to the point of
beginning; EXCEPT the Nbrth 262.8 feet; AND ALSO EXCEPT those portions previously
dedicated for road purposes.
The Easement granted to Spokane County and its authorized agentsand/or ass~igns, is
for the sole purpose of construction, installation, operations, maintenance and
repair of public utilities, signs and road maintenance within said Easement.
The Grantor(s) hereby releases Spokane County, and all its officers, employees, and
agents and/or assigns from any responsibility of liability for any damage
whatsoever including inverse condemnation by or to any and all persons or property
arising out of or in any way incident to or attributable to the construction,
installation, operations, maintenance and repair of public utilities, signs and
road maintenance within said Easement.
This Easement also grants to Spokane County and its authorized agents and/or
assigns the rights of ingress and egress to, over and from said Easement for the
construction, installation, operations, maintenance and repair of public utilities,
signs and road maintenance installed or in the future installed in the Easement
area.
The Easement described hereinabove is to and shall run with the land. No
modificati'on of the boundaries of said Easement can be made without the pri'or
approvai of Spokane County. . ,

HEARING EXAMINER COMMITTEE
FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
December 5, 1985, and the members of the Committee present being
Gary N. Anderberg, Chairman, Jane E. Myers and Ron Odell.
B. P ROP OSAL
The sponsor, Metro Hauling, Inc., (Mike Chimenti), is requesting approval
of a change of conditions, File No. ZE-61A-83, Restricted Industrial Zone,
for the purpose of reviewing a new site development plan.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, West Coast
. Grocery berm, Montgomery Commercial Center, commercial and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
Urban development.
3. That the existing zoning of the property described in the application
is Restricted Industrial Zone.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Declaration of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area is suitable for the proposed use, or
uses within the existing Zone Classification.
7. That the applicant has demonstrated that conditions have .
substantially changed since the original zoning of this area and
accordingly, the proposed change of conditions is justified.
8. That the proposed use is compatible with existing uses in the
area.

9. That the owners of ad,jacent lands expressed neither approval nor
disapproval of the proposed use. .
10. The Hearing Examiner Comnittee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
l. Delete Paragraph #3 in County Planning Department Condition #6, as
fo-n ows: -
"If the additional northerly 78 feet is developed and only if it is
developed, landscaping shall be consistent with the rest of the
development; that there be a 15-foot yard setback to include
landscaping along the north property line. The boundary between the
existing residence on-site and storage yard need not be landscaped -
a 6-foot sight-obscuring fence would be satisfactory. That the area
to be landscaped along Montgomery and University be a minimum of
10-feet."
2. Delete County Planning Department Condition #10, as follows:
"That the adjacent land owner shall have the opportunity to review
and comment on the proposed landscaping plan submitted by the
applicant prior to approval by the Zoning Administrator."

a) COUNTY PLANNING DEPARTMENT
l. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building permits.
2. Direct light from any exterior area lighting fixture shall not
extend over the property boundary.
3. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits.
4. The applicant shall develop subject property generally in
accordance within the concept presented to the Nearing Examiner Committee. Yariations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
be maintained.
5. All current standards of the Restricted Industrial Zone, as
amended, shall be complied with in the development of this
site.
6. That a minimum 6-foot sight-obscuring fence on a two or three
foot berm (similar to the existing fence on the east property
line) be provided around all open storage yards.
That the east boundary shall have a 10-foot setback in terms of
the landscape area which may include the north swale area for
the '208' requirements and the north boundary.

a) COUNTY PLANNING DEPARTMENT (continued)
7. Applicant shall comply with '208' recommendations concerning
stormwater,runoff and provide necessary landscaping for runoff.
8. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances, and the Spokane County Zoning Ordinance prior to
issuance of building permits.
9. That the paving shall be asphalt or other hard surfacing of a
depth suitable to support the weight of trucks.
10. That the adjacent land owner shall have the opportunity to
~ review and comment on the proposed landscaping plan submitted by
the applicant prior to approval by the Zoning Administrator.
11. Signs for this project shall conform to standards as set forth
in Section 4.09.125 Signs.
12. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners' Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements.
b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit:
1. Applicant shall dedicate a 20-foot radius on University Road
and Montgomery prior to any use of the property.
2. Access permits for approaches to the County Road System shall be
obtained f rom the Spokane County Engineer,
3. Applicant shall improve Montgomery Drive in a manner consistent
with Spokane County TYPICAL roadway section No. 1 minimum paving
width Secondary Arterial Standard.
4. Applicant shall improve University Road in a manner consistent
with Spokane TYPICAL roadway section No. 1 minimum paving width ,
Secondary A rterial Standard.
5. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.

6. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any
' building permit on the property.
7. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
8. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
9. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer,
10. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
11. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County
Commissioners'Resolution No. 80-1592 as amended.
12. Applicant shall convey to Spokane County a sufficient amount of
road right of way so as to provide 39-feet east of the
centerline of University Road.
3. That the applicant shall provide a 2-foot wide easement for
6 utilities along University Road.
c) COUNTY UTILITIES DEPARTMENT ,
1. Pursuant to Board of County Comnissioners' Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
~ application approval and issuance of permits by the Nealth
District.

2. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
~ a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each unit shall be double-plumbed for connection to future
areawide collection systems.
5. Plans and specifications for the double plumbing are to be
reviewed and approved by the Utilities Department prior to
applying on an on-site sewer permit.
d) COUNTY HEALTH DISTRICT
Recommend ail previously imposed conditions of approval be continued
(dated August 31, 1983) as follows:
l. Appropriate utility easements shall be indicated.
2. A combined surface water and sewage disposal detailed plan shall
be approved by the County Engineer and the Nealth District prior
to the issuance of any building permit for this project.
3. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
4. Subject to specific application approval and issuance of permits
by the Health Officer, the property is authorized the use of an
individual on-site sewage system. .
5. Water service shall be coordinated through the Director of
Utilities, Spokane County.
6. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
~ Social & Health Services.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.

e) COUNTY BUILDING AND SAFETY DEPARTMENT
l. The site is located iri Fire District # l.
2. Each building constructed shall be accessible to fire department
apparatus by way of access roadways with all-weather driving
surface of not less than 20 feet of unobstructed width with
adequate roadway turning radius capable of supporting the
imposed loads of fire apparatus and having a minimum of 13 feet,
6 inches of vertical clearances. All roadway grades and access
to be approved by fire district.
3. The development shall be provided with at least two (2) points
to the public street. The access locations shall be
approximately on opposite ends of the development.
4, tipproved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible
and legible from the street or road fronting the property. Said
numbers shall contrast with their background.
5. Due to the sensitive storage requirements over the Aquifer, and
this site lies within the Waste Water Management area, we feel
that some language should address the possible storage of
flammable or critical materialswithin these structures.
6. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
7. Building permits will be required for each structure.
8. Adequate water for fire protection and distribution of such
water is required. A water plan is required to be submitted for
approval prior to any land development.
9. A plan for emergency equipment access is required to be
submitted prior to any land development.
10. Fire hydrants which meet the fire flow are required to be
installed prior to any construction. These hydrants shall be
placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of
the hydrant shall be no less than 18 inches above grade. A .
water plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10,04 of the Uniform Fire Code is required prior to
construction of the water service. Al1 required fire protection
facilities shall be installed and made serviceable prior to and
during the time of construction. ~

f ) WATER PURVEYOR
1. Water Purveyor is Irvin Water District, and they will supply the
site with adequate water for domestic, fire and irrigation
uses. Satisfactory arrangements to serve water are in process.
g) COUNTY AIR POLLUTION CONTROL AUTNORITY
l. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from ,
all other construction related activities.
'2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the
construction phase of the project and from motor vehicles using
the site following completion of the project and from occupants
of the proposed project.
5. All air pollution regulations must be met.
6. Additional Comments.
, Demolition of existing buildings may require filing of an Intent
to Demolish/Renovate form.

SCOPE/PROJECT DESCRIPTION:
I. General Overview - The proposed project was the subject of a
Pre-Application Conference held April 11, 1990. The project
description has not change from what was proposed , at the
Pre-Application Conference.
SIIMMARY OF DEPARTMENTAL REQUIREMENTB:
I. Planning Department (456-2205) A. Discussion/Requirements
1. Comments were given to the applicant and Building and
Safety by Al1an deLaubenfels.
2. The applicant stated that an Administrative-Short Plat
is being processed by the Planning Department and should
be complete in two to four weeks. .
3. .The proposal requires one 15 x 60 off-street loading
dock. Allan deLaubenfels stated that he has a concern
with the loading dock as it is shown on the site plan.

His concern is that the trucks may illegally back off from
Montgomery Avenue.
4. Allan deLaubenfels researched the Zoning Ordinance and
quoted Ordinance 4.17.064. The ordinance states that the .
loading dock may not encroach on the required 35 foot
front yard setback. Therefore, there is insufficient
. space in front of the building for the loading dock.
5. An option for the location of the loading dock would
be to place it on the west side of the building. Another
option of putting in an additional approach was also
discussed. The applicant needs to review the options
presented and get back to the departments.
6. The site lan shows landsca ing for the pntire parcel
The applican~ stated that l~ndscaping will oniy be
installed for the portion of the property being developed
at this time.

7. All parking stalls are to be located within 60 feet of
a landscape feature consisting of 32 square feet in area.
B. Permit Release Requirements
1. Please submit a revised site plan illustrating the
off- street loading dock and landscaping to be installed
at this time.
2. An estimate- from a nursery including size, type and
quantity along with a promissory letter/bond from the
owner stating the landscaping will be installed shall be
submitted.
II. Engineering Department (456-3600)
A. Discussion/Requirement
1. Comments were given to the applicant and Building and
Safety by Scott Egger.
2. The drainage check print was returned to the applicant
during the meeting. Please address the comments on the
check print and return it to the Engineering Department.
3. Scott Egger stated that the Engineering Department
will not approve the site plan as it was submitted because
of the location of the off street loading dock. The
Engineering Department fears that the trucks will
illegally back off of Montgomery Avenue.

4. Several options were discussed with the applicant
regarding the location of the off-street loading dock.
Scott Egger sugqested that the applicant set up a meeting
with a Traffic Engineer (Bob Bruggeman or Jack Finney) and
Al1an deLaubenfels of the County Planning Department to
resolve this matter. =
5. Please submit road and drainage plans for Montgomery

whether or not he ~eeded P4~~e~si~e at this time. Scott Egger told the applicant
to contact Gary Nelson with the Engineering Department for -
a decision on that matter.
6. All required road improvements within the right of way
is to be completed prior to the release of the building permit or a bond in an amount estimated by the The County
Engirieer to cover the cost of construction shall be f.iled
with the County Engineer. .

7. An approach permit shall be obtained for the driveway
approach along Montgomery Drive.
8. A right of way and easement agreement was given to the
applicant during the meeting. B. Permit Release Requirements l. The proposed must comply with the conditions of Zone
Change No. ZE 61A-83.
2. Please submit road plans for the proposed.
3. Please address the comments on the drainage check
print and return it to the Engineering Department. '
4. Resolvement of the off-street loading dock location.
5. The agreement for the dedication of right of way and
easements needs to be signed.
III. Health District -(456-6040)
A. Discussion/Requirements
l. Comments were given to the applicant and Building and
Safety by Daryl Way. .
2. Please submit a critical materials list to Building
and Safety for review.

3. All construction debris must be taken to a licensed
landfill.
B. Permit Release Requirements
l. Apply for a permit to install the proposed sewage
disposal system.
2. The Health District is ready to release their portion .
of the building permit when-the application is received.
IV. Fire District No. 1(928-2462) -
A. Discussion/Requirements
l. The fire district was not present at the meeting. However, comments were given to Tom Davis prior to the
meeting.
2. Th'e fire department will need access to the rear of
the building along the west property line.
V. Building and Safety (456-3675)
A. Discussion/Requirements
1. Plan review has been completed on preliminary plans
by Ken Jeffrey.
2. A condition of the final Certificate of Occupancy is
that a non buildable easement be recorded with the County
Auditor.
3. The proposed furnace is over-sized.
4. Please post the address on the face of the building.
5. Identify the handicap parking stalls. -
6. Identify what the area above the office will be used
for. This area will require a separate permit at time of
remodel.
7. Please submit a lighting budget for the proposed.
B. Permit Release Requirements
1. Two complete revised sets of plans addressing the
items discussed during and after the meeting and other
items from the plan review letter needs to be submitted
for review and approval.

r APPLICANT'B COMMENTS/ACRNOWLEDGEMENT:
The applicant acknowledged that all comments/requirements were
understood and had no further questions at this time regarding
permit requirements.
CORRECTIONS:
To minutes or changes from what appears in the minutes, we should be
notified within one day of your receipt of these minutes.
To sfte plans as required by any or all of the above-listed
departments shall be submitted to Building and Safety who will then
distribute accordingly to those departments.
ADJOIIRNMENT: There being no further business, Tom Davis thanked the
applicant and the departments for their participation and reminded
all that he should be contacted if there are any unforeseen problems
which may arise.

BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-638-90 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land, from Duane Cocking has been
recejv~td and decided upon, pursuant to Spokane County Subdivision regulations, on the
~ day of July, 1990.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to d.ivide 1.9 acres into 21ots for the development of indusaial use lots.
3. The proposal is located at the northeast corner of the intersecaon of University Road and
Montgomery Avenue.
4. The current zoning of the property is Restricted Industrial. The proposed lot sizes,
frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Industrial. The
development and uses proposed are generally in accord with this category/designation.
6. The required public notice was provided for this proposal and agencies having a potential
incerest in the project were notified and recommendations solicited.
7. No one in the area commented on the proposal.
8. This propeny is the subject of zone change ZE-61A-83.
9. Recognizing the recommended conditions and Spokane County development standards,
the proposed subd.ivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The project is exempt from environmenta.l review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Applicaaon
SP-638-90 is hereby APPROVED until July 1, 1993, subject to conditions noted
below. Most of the cond.itions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the shori subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The specific development plan will be submitted for Planning Department review and
approval prior to issuance of building permits.
2. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
3. The final plat shall be designed substanrially in conformance with the preliminary plat
of record as legally described and advertised. No increase of density or lot number
shall occur without a new application submittal and approval. '
4. The Spokane County Planning Director/designee shall review any proposed final plat to
ensure compliance w~th these Findings and Conditions of Approval.
5. The preliminary plat is given conditional approval for three (3) years, specifically to
July 1, 1993. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
6. A final plat number shall be indicated before the final plat is filed, such number to be
approved by the County Planning Director/designee.
7. Appropriate road name(s) shall be indicated.
8. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of udlity easements by appropriate udlity companies must be received
with the submittal of the final plat.
9. T}u-ee (3) current certificates of title shall be furnished the County Planning Department
prior to filing the final plat.
10. The following statement shall be placed in the final plat dedication: "No more than one
primary use shall be placed on any lot, nor shall any lot be further subdivided for the
purpose of creating additional lots, ownerships or building sites without first filing and
receiving approval of a replat."
11. The final plat map shall indicate by a clear dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement that: "Side yard and rear yard setbacks shall be determined at the time
building pernuts are requested. The setbacks indicated on this plat may be varied from
if proper zoning approvals are obtained."
12. A survey is required prior to the filing of a final plat.
13. Spokane Counry Planning Departinent is required to record with the County Auditor a
"Title Nodce," as prepared and signed by the applicant, for a future acquisition area for
road right-of-way and utilities to run with the land, and the future acquisition area
reservation shall not be removed without prior approval by the Spokane County
Planning Department. Notice shall be recorded prior to the issuance of a building
permit and shall provide the following:
a. 11 feet is to be set aside for future acquisirion area for road right-of-way and
utiliries, in addition to the exisdng right-of-way dedication required by the County
Engineer, along University Road.
A strip of property along Montgomery Drive frontage that would provide a right of
way width equal to 40 feet from the centerline of Montgomery Drive is to be set
aside for future acquisition area for road right-of-way and utilities, in addidon to the
exisang right-of-way dedicaaon required by the County Engineer, along
Montgomery Drive.
b. Building and other setbacks required by the Spokane County Zoning Code shall be
measured 35 ft. from the north edge of the Future Acquisition Area that is reserved
for road right-of-way and udlides along Montgomery Drive.
Building and other setbacks required by the Spokane County Zoning Code shall be
measured 20 ft. from the east edge of the Future Acquisition Area that is reserved
for road right of way and utilities along University Road.
c. The following minimum improvements necessary to support the use within the zone
classification as required by the Spokane County Zoniiig Code standards should not
be located within the Future Acquisition Area.
1. Landscaping
2. Surface drainage
3. Drainfields
4. Parking
5. Other
d. The 11 ft. Future Acquisition Area on University and a strip of property along
Montgomery I?rive frontage that would provide a right of way width equal to 40
feet from the centerline of Montgomery Drive Future Aquisition Area on Montgomery Drive, until acquired by Spokane County, shall be private property
and may be used as allowed in the zone, except any improvements (such as
landscaping, parking, surface d.rainage, drainfields, signs or others) shall be
considered "interim" uses.

The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said Future Acquisition Area.
e. This "Title Notice" shall be signed by the applicant to serve as official notice and
acknowledgement of said Future Acquisition Area for road right-of-way and
ualiaes.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS -
1. The condirional approval of the plat is given by the County Engineer subject to
dedicaaon of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards showing proposed
street centerline and curb grades shall be submitted to the County Eng-ineer for approval
prior to construction and/or the filing of each final plat; road plans to be prepared under
the direcaon of a licensed Professional Civil Engineer.
3. Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the County Engineer for approval prior to construction and/or the
filing of the final plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
4. Construction within the proposed public streets and easements shall be performed
under the direct supervision of a licensed engineer/surveyor, who shall furnish the
County Engineer with "as-built" plans and a certificate in writing that all irnprovements
were installed to the lines and grades shown on the approved construction plans and
that all disturbed monuments have been replaced.
5. No construction work is to be performed within the exisdng or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
6. All construction within the existing or proposed public right-of-way is to be completed
prior to filing each final plat, or a bond in the amount estimated by the County Engineer
to cover the cost of construction of improvements, construction certification, "as-built"
plans and monumenang the street centerlines shall be filed with the County Engineer,
7. Individua] driveway access pernlits are required prior to issuance of a building permit
for driveway approaches to the county road system.
8. Dedication of addidonal right-of-way along Montgomery Drive to provide for a
minimum of 32 ft. from the centerline of Montgomery Drive along the frontage of the
project and applicable radius on University Road and Montgomery Drive.
9. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
10. Sidewalks are required along the arterial(s) on Montgomery Drive and University
Road.
11. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
12. The County Engineer has designated Typical Roadway Section Number One,
Secondary Arterial standard for the improvement of University Road, which is adjacent
to the proposed development. This will require the add.iaon of approximately 10-12
feet of asphalt along the frontage of the development. The consrruction of curbing and
sidewalk is also required.
13. The County Engineer has designated Typical Roadway Secaon Number One,
Secondary Arterial standard for the improvement of Montgomery Drive, which is
adjacent to the proposed development. This will require the addition of asphalt along
the frontage of the development to meet the required 22 ft. of asphalt from the centerline
of Montgomery Drive. .
14. The proposed private road as shown on the preliminary plat serving 21ots with no
extension possible is approved by the County Engineer provided that the easement
width is a minimum of 30 ft.

15. That private road be improved to Spokane County standard for a private road
Urban/Suburban standard serving 21ots, and are subject to approval under Section
10.207 of the Spokane County Fire Code.
16 All vested owners shall sign and record private road documents as prescribed by the
Spokane County Engineer. These documents shall be reviewed and approved by the
Spokane County Engineer prior to recording with the Spokane County Auditor.
Recording numbers shall be referenced in the ded.icatory language of the plat.
17. The following statement shall be placed in the plat dedication:
"WARNING: Spokane County has no responsibility to build, improve, maintain or
otherwise service the private roads contained within or provide service to the property
described in this plat. By accepting this plat or subsecluently by allowing a building
permit to be issued on property on a private road, Spokane County assumes no
obligation for said private road, and the owners hereby acknowledge that the County
has no obligadon of any kind or na(ure whatsoever to establish, examine, survey,
construct, alter, repair, improve, maintain or provide drainage or snow removal on a
private road. This requirement is and shall run with the land and shall be binding upon
the owner(s), their heirs, successors or assigns, including the obligation to participate
in the maintenance of the private road as provided herein."
18. The proposed plat shall be improved to the standards set forch in Spokane County
Board of Commissioners Resolution No. 80-1592, as amended, which establishes
regulations for roads, approaches, drainage and fees in new construction.
19. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedicaaon of additional right-of-way and the roadway improvements herein specified.
20. The following statement shall be placed in the final plat dedication: "The private road as
shown hereon is an easement which provides a means of ingress and egress for those
lots within the plat having frontage thereon."
21. The County Arterial Road Plan identif'ies University Road as a Principle Arterial. The
exisring right-of-way width of 69 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, it is recommended that in addition to the
required right of way dedication, a strip of property 11 feet in width along the
Universiry Road frontage be set aside in reserve. This property may be acquired by
Spokane County at the time when arterial improvements are made to University Road.
22. The Counry Arterial Road Plan identifies Montgomery Drive as a Minor Arterial. The
existing right-of-way width of approximately 60 feet is not consistent with that
specifed in the Plan. In order to implement the Arterial Road Plan, it is recommended
that in addiaon to the required right of way dedication, a strip of property along
Montgomery Drive frontage that would provide a right of way width equal to 40 feet
from the centerline of Montgomery Drive be set aside in reserve. This property may be
acquired by Spokane County at the dme when arterial improvements are made to
Montgomery Drive.
23. The applicant shall comply with all conditions of ZE-61A-83 prior to the issuance of
any building pennits.
24. Applicant shall show all easements effecting Tract A and B of Short Plat 638-90, these
easements include but are not limited to no build build easements, ingress and egress
and truck turn-around access.
COUNTY HEALTH DISTRICT CONDITIONS
1. Appropriate utility easements shall be ind.icated on copies of the preliminary plat of
record for distribution by the Planning Department to the uality companies, Spokane
Counry Engineer and the Spokane County Health Disaict. Written approval of the
easements by the udlity companies must be received prior to the subnuttal of the final
plat.
2. A combined surface water and sewage disposal detailed plan shall be approved by the
Counry Engineer and the Spokane County Health District prior to the issuance of any
building pernut for this project.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
~
4. Water service shall be coord.inated through the Director of Utilities Spokane County.
5. Water service shall be by an exisang public water supply when approved by the
Regional Engineer (Spokane), State Department of Social & Health Services.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorderi service area of the water system proposed to serve the plat.
7. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane Counry Health District that suitable sites for on-site sewage disposal systems
are available on Tracts A&B.
9. Subject to specific application approval and issuance of permits by the health officer,
the use of individual on-site sewage disposal systems may be authorized. Note: The
maximum sewage flow allowed shall be 2700-3600 gallons per acre of gross land area.
10. The ded.icatory language of the plat will state that: "Subject to snecific application
approval and issuance of pernuts by the Health Officer, the use of individual on-site
sewage systems may be authorized."
11. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
12. The plat dedication will conta.in a statement to the effect that: "The public water system,
as approved by County and state health authoriries and the local fire district and
purveyor, will be installed within this plat, and the subdivider will provide for
individual domesric water service, as well as fire protection, to each tract prior to sale of
each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorizaaon is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further corjditionei and subject ro specific applicaaon approval and issuanee of
permits by the Health District.
2. The ded.ication shall state: "The owner(s) or successor(s) in interest agree to authorize
che County to place their name(s) on a petition for the formaaon of ULID by petition
method pursuant to RCW 36.94, which the petition includes the owner(s)' property;
and further not to object by the signing of a protest petition against the formation of a
ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' propeny. PROVIDED this condition shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a ULID by either petition
or resolution method under RCW Chapter 36.94."
3. Any water service for this project sha11 be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Tract A wrll need a fire access lane to the rear of the lot as per Fu-e District No. 1
requirements.
