The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following

THIS MA.TI'ER, an application from Ted Gunning/Northwood .Properties has ~Ge~n received and
decided upon, pursuant to Spokane County Subdivision regulations, on the day of July,
1992. The individual signing below has been properly delegated the responsibility for rendering the
decision by the Spokane County Director of Planning.
FINDINGS OF FACT AND CONCLUSIONS
1. The proposal is to divide 22.2 acres into 19 lots for the development of industrial use lots.
2. The proposal is located in the Spokane Valley, south of and adjacent to Jackson Avenue
and north of and adjacent to the B.N.R.R., 2200 feet east of University Road in Section 9,
Township 25 North, Range 44 EWM., Spokane County, Washington.
3. The current zoning of the property is Light Industrial (1-2). The proposed lot sizes,
frontage and intended uses are allowed withi.n this zone. The property is also covered by
the Airport Overlay Zone, and is within the Conical Area (CA), which has specific land use
limitations for the property.
4. The Spokane County Conzprehensive Plan designates this area as Industrial. The
development and uses proposed are generally in accord with this planning categozy. The
proposal as submitted with its environmental checklist and proposed mitigating measures
will effecrively accomplish the intent of the Comprehensive Plan. The Transportation
Section of the Comprehensive Plan, in the Azterial Road Plan, indicates a need to plan for
Montgomery Avenue as a Minor Arterial. The review by the County Engineers indicates
dedication of roadway(s) is neede,d now, while the Comprehensive Plan indicates the need
for additional future right-of-way, with srructure and improvement setbacks from the future
right-of-way widths.
5. The required norice was provided for this proposal and no one in the area commented upon
the proposal. Agencies having a potential interest in the project were notified and their
conditions are contained hereinafter.
6. With the recommended conditions of approval and Spokane Counry development
standards, the proposal: is not detrimental to the public health, safety and general welfare;
implements the underlying zoning as well as the Comprehensive Plan; and complies wi th
the adopted Binding Site Plan Chapter 4 of the County's Subdivision Regulations, Board
of County Commissioners Resolution 89-0511. 7. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Rule (WAC 197-11) and
the Spokane Environmental Ordinance, a Detern-dnation of Nonsignificance has been issued
at least fifteen (15) days prior to this date. The Determination of Nonsignificance was
issued and circulated to eight agencies and no comments as to the proposal's likely
signif'icant adverse impacts were received.
DECYSION
Based upon the above Findi.ngs of Fact and Conclusions, Preliminary Binding Site Plan
BSP-32-92 is hereby APPROVED, subject to the following conditions, which shall be complied
wich by the applicant, sponsor and/or successors in interest prior to finalization of all or a portion
of the Binding Site Plan. This approval is granted until August l, 1995, at which time an
excensiojl of time may be granted pending receipt of a qualifying request.

PLA\'NING DEPARTMENT CONDITIONS
1. The final binding site plan be designed substantially in conformance with the preliminary
bind.ing site plan of record as legally described and advertised. No iricrease in the number
of lots shall occur without a change of condition application submittal and approval.
However, the final binding site plan shall be flexible within the terms of the conditions of
approval, and lot lines may be adjusted in a manner prescribed by procedures established
by the Planning Department.
2. The Planning Department shall review/approve any proposed final binding site plans to
insure compliance with the conditions o£ approval. .
3. The preliminary binding site plan is given conditional approval for three (3) years, to
August 1, 1995. The applicant may request an extension of time by submitting a written
request at least forty-five (45) days prior to the above expiration date.
4. A final bind.ing site plan number shall be approved before the final bind.ing site plan is filed,
such number to be approved by the County Planning DirectorjDesignee. Phasing of the
final binding site plan shall be allowed if appropriate iinprovements and intent of this
approval is met, as determined by the Planning Director and reviewing agencies.
5. Appropriate road names shall be indicated on the final binding site plan.
b. Appropriate utility easements shall be ind.icated on copies of the proposed final binding site
plan. Written approval of utility easements by utility companies must be received prior to approval of final binding site plan(s).
7. Three current certif'icates of title shall be furnished the County Planning Deparnnent prior to
filing the final binding site plan. 8. The following statement be placed in the final binding site plan dedication: "No lot shall be
further subdivided for the purpose of creating additional lots, ownerships or leased parcels
without first filing a replat or altering the final binding site plan."
9. The final binding site plan map shall indicate by a dashed line the required setbacks from all
private, Tract X or public roads. The dedication shall contain the following statement:
"Side yard and rear yard setbacks shall be deternuned at the rime building permits are
requested, except that some judgements may be made on this final binding site plan

, document as to side or rear yard status. The setbacks indicated on this subdivision may be
varied from if proper zoning or variance approvals are obtained." See Arterial Road Plan
Section for special setbacks related to arterial roads.
10. A plan for water facilines adequate for domesac service and fire protecaon be approved by
the water supplier, fire protection district, Spokane County Build.ing & Safety Department
and county health authorities. The agencies will certify on the WATER PLAN, prior to the
filing of the final binding site plan or any phase of the preliminary bind.ing site plan, that the
plan is in conformance with their respective needs and regulations. The WATER PLAN
and certification will be drafted on a transparency suitable for reproducdon and be signed
by the sponsor. 11. The purveyor wiil also certify on the Water Plan that appropriate contractual arrangements
and schedule of improvements have been made with the sponsor for construction of the
water system in accordance with the approved WATER PLAN. The time schedule for
improvements will provide for completion of the water system and inspection by the .
appropriate health authorities prior to application for building permits within the final
binding site plan. The arrangements or agreements will include a provision holding
Spokane County and the purveyor hatmless from claims by any lot purchaser refused a
building permit-due to the failure of the sponsor to satisfactorily complete the approved
water system. •
12. The final binding site plan dedication will contain the following statement: "The public
water system, pursuant the WATER PLAN approved by County and State Health
authorities, the local fire district, County Building & Safety Department, and water
purveyor, will be installed within this Binding Site Plan, and the subdivider/sponsor will
provide for individual domesric water service as well as fire protection to each lot prior to
sale of each lot and prior to issuance of a building permit for each lot."
13. No building permit will be issued for any lot within the final binding site plan unril certified
by a Washington state-licensed engineer that "the water system has been installed pursuant
to the approved WATER PLAN for the final binding site plan," signed and stamped by
said engineer. The certificaaon may be in'the form of a letter, but is preferred to be
certif'ied on a copy of the WA1'ER PLAN as a schematic map showing the "as-built" water
system. 14. A survey is required prior to the filing of a final bind.ing site plan.
15. The final binding site plan shall comply with Secrions 8.030, 8.050 and 8.055 of the
Binding Site Plan chapter of the Subdivision Ordinance.
16. No certificate of occupancy pemut or use of the parcel or lease area(s) being created by the
final bi.nding site plan shall be issued or allowed until all necessary improvements and
requirements as specified by this decision and this binding site plan chapter have been
satisfied.
17. Any future development on the subject site will comply with the Light Industrial (I-2) zone
as amended.
a. A landscaping plan for the site perimeter along Montgomery Drive and Jackson -
Avenue shall be submitted and approved by the Planning Department prior to
finalization of the ~'inal binding site plan. The landscape plan should utilize as many
existing trees as possible and provide screening and buffering to Montgomery Drive
and Jackson Avenue and the 35 foot setback areas can be included in this landscape
area. The landscaping plan shall, by reference in the dedication, be a binding portion
of the final binding site plan.
18. Prior to final binding site plan approval the sponsor shall provide the Planning Department
with a copy (auditor stamped) of "Restrictive Covenants" which includes acceptable
wording that communicates clearly to owners and/or potential buyer(s)/lessee(s) that
County enforceable restrictions/condirions exist and run with the property, which
restricdons provide, but are not limited to:
a. Required maintenance and/or replacement of landscape plants of the approved
landscaping plan;
b. Screening of exisring or future truck/load.ing docks, truck/heavy equipment parking (exterior storage of same is prohibited) including temporary storage, except as
provided for in the Planning Department's Condition #18-e., below;

3,' Drainage plans and design calculations showing the aligntnent of drainage facilities shall be
submitted to the County Engineer for approval prior to construction and./or the filing of the
final binding site plan. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
4. Construction within the proposed public streets and easements shall be performe.d under the
direct supervision of a licensed engineer/surveyor, who shall furnish the County Engineer
with "as-built" plans and a certificate in writing that all improvements were installed to the
lines and grades shown on the approved construction plans and that all disturbed
monuments have been replaced.
5. No construction work is to be performed within the existing or proposed public right-of-
way until a pernut has been issued by the County Engineer. AlI work is subject to
inspection and approval by the County Engineer.
6. All construction within the existing or proposed public right-of-way is to be completed
prior to filing each final bind.ing site plan, or a bond in the amount estimated by the County
Engineer to cover the cost of construction of improvements, construction certification, "as-
built" plans and monumenting the street centerlines shall be filed with the County Engineer.
7. Individual driveway access pennits are required prior to issuance of a building permit for
driveway approaches to the county road system.
Dedication of 2 feet on both the north and south Montgomery Avenue frontage, where
applicable, of additional right-of-way along Montgomery Avenue which shall equa164 feet, .
is required.
9. Existing county roads providing direct access to the binding site plan shall be paved and/or
curbed to Spokane County standards.
10. Sidewalks are required along the arterial(s) on Montgomery Avenue.
1 The word "applicant" shall include the owner or owners of the property, his hezrs, assigns
and successors.
✓ 12. The County Engineer has designated Typical Roadway Section Number One, Local Access
standard for the improvement of Jackson flvenue, which is adjacent to the proposed
development. This will require the addition of varying amount of asphalt along the
frontage of the development. The construction of curbing and sidewalk is also required.
13. The County Engineer has designated Typical Roadway Section Number One, Local Access
standard for'the improvement of Bowdish Road, which is adjacent to the proposed
development. This will require the addition of approximately 32 feet of asphalt along the
frontage of the development. The construction of curbing and sidewalk is also required.
14. The proposed private road(s) as shown on the binding site plan serving less than 8 lots
each, is approved by the County Engineer.
15. Private road(s) shall be improved to Spokane County standard for a private road
Urban/Suburban standard serving 8 or less lots each, and are subject to approval under
Section 10.207 of the Spokane County Fire Code.
16. All vested owners shall sign and record private road documents as prescribed by the
Spokane County Engineer. These documents shall be reviewed and approved by the
Spokane County Engineer prior to recording with the Spokane County Auditor. Recording
numbers shall be referenced in the dedicatory language of the binding site plan.
17. The following statement shall be placed in the binding site plan ded.ication:
"WARNING: Spokane County has no responsibility to build, improve, maintain or
otherwise service the private roads contained within or provide service to the property
described in this binding site plan. By accepting this binding site pian or subsequently by
allowing a building permit to be issued on property on a private road, Spokane Counry
assumes no obligation for sa.id private road, and the owners hereby acknowledge that the
County has no obiigation of any kind or nature whatsoever to establish, examine, survey,
construct, alter, repair, improve, maintain or provide cirainage or snow removal on a
private road. This requirement is and shall run with the land and shall be bi.nding upon-the
owner(s), their heirs, successors or assigns, including the obligation to participate in the
maintenance of the private road as provided herein."

18. The proposed subdivision shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 80-1592, as amended, which resolution
establishes regulations for roads, approaches, drainage and fees in new construction.
19. The County Engineer has exami.ned this development proposal and has detemlined that the
impact of this proposal upon the existing county road system warrants the dedication of
additional right-of-way and the roadway improvements herein specified.
20. The following statement shall be placed in the final binding site plan dedication: "The
private road as shown hereon is an easement which provides a means of ingress and egress
for those lots within the subdivision having frontage thereon."
21. The County Arterial Road I'lan identifies Montgomery Avenue as a Minor arterial. The
existing right-of-way width of 60 feet is not consistent with that specified in the Plan. I.n
order to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of property 8 feet in width along the Montgomery Avenue frontage shall
be set aside in reserve. This property may be acquired by Spokane County at the rime
when arterial improvements are made to Montgomery Avenue. 22. There may exist urilities, either underground or overhead, affecting the subject property,
including property to be dedicated or set aside for future acquisition. Spokane County
assumes no financial obligation for adjustments or relocarion regarding these utilities.
Applicant(s) should check with the applicable utility purveyor and the Spokane County
Engineer to deterndne whether applicant(s) or the utility is responsible for adjustment or
" relocation costs and to make arrangements for any necessary work.

23. ~ Applicant shall demonstrate to the satisfaction of the County Engineer that safe
sight/stopping distance can be met at the private roads and Montgomery Avenue
~ intersecrions.

1. The final binding site plan shall be designed as indicated on the preliminary binding site

2. Appropriate utility easements shall be indicated on copies of the preliminary binding site
plan of record for distribution by the Planning Department to the utility companies,
Spokane County Engineer and the Spokane County Health District. Written approval of
the easements by the utility companies must be received prior to the subnutta.l of the final
binding site plan. I
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through che Director of Utilides, Spokane County.
5. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health.
6. Prior to filing the final binding site plan, the, sponsor shall demonstrate to the satisfaction of
the Spokane County Health District that an adequate and potable water supply is available
to each lot of the binding site plan.
7. Prior to filing the final binding site plan, the sponsor shall present evidence that the binding
site plan lies within the recorded service area of the water system proposed to serve the
binding site plan.
8. A plan for water facilities adequate for domestic use, domestic irrigation use and fire
protection use shall be approved by the water purveyor. Said water-plan must have been
approved by the fire pratection district and the appropriate health authorities. The health
authorities, water supplier (purveyor) and the fire protection district will certify, prior to the
filing of the final binding site plan, on the face of said water plan that the plan is in
conformance with their requirements and will adequately satisfy their respective needs.
Said water plan and certification will be drafted on a transparency suitable for reproduction.
9. The purveyor will also certify prior to filing the final binding site plan on a copy of said
water plan that appropriate contractual arrangements have been made with the binding site
plan sponsor for construction of the water system, in accordance with the approved plan
and time schedule. The time schedule will provide, in any case, for completion of the

water system and inspection by the appropriate health authorities prior to applicarion for
building permits within the binding site plan. The contractual anangements will include a
provision holding Spokane County/City of Spokane, Spokane County Health District and
the purveyor harniless from claims by any lotltract purchaser refused a building permit due
to failure of the binding site plan sponsor to satisfactorily complete the approved water
system.
10. A public sewer system will be made available for the bind.ing site plan/project, and
individual service will be provided to each lot/tract prior to sa1e. Use of individual on-site
sewage disposal systems sha11 not be authorized.
11. A statement shall be placed in the dedication to the effect that: "A public sewer system will
be made available for the binding site plan, and individual service will be provided to each lot prior to sale. Use of individual on-site sewage disposal systems shall not be
authorized."
12. The dedicatory language on the binding site plan shall state: "Use of private wells and
water systems is prohibited."
13. The final binding site plan dedication shall contain a statement to the effect that: "The
public water system, pursuant to the Water plan approved by county and state health
authorities, the local fire disti-ict, County $uilding and Safety and water purveyor, shall be
installed within this bind.ing site plan, and the subdivider shall provide for ind.ividual
domestic water service as well as fire protection to each lot prior to sale of each lot and
prior to issuance of a building permit for each lot."
COUNTY UTILITIES DEPARTMENT
1. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
2. Applicant shall make connection to public sewer system. Sewer connection pernut is
required. Plans and specificaaons are to be reviewed and approved by the Utilities
Department.
COUNTY BUILDING AND SAFETY DEPARTMENT
1. The applicant shall contact the Department of Building and Safery at the earliest possible
stage of design/development in order to be informed of code requirements
admi nistered/en forced by the department, e.g., State Building Code Act regularions, such
as requirements for fire hydrant/flow, fire apparatus access roads, street address
assignment, bamer-free regulations, energy code regulations and general coordination with
other aspects of project implementation.
2. Requirements of Fire District No. 1 need to be satisfied during the building pernut process.
SPOKANE COUNTY AIR POLLUTYON CONTROL AUTHORITX
1. All air pollution regulations must be met. This includes but is not limited to the following:
2. Air pollution regularions require that dust emissions during demolition, construction and
excavation projects be controlled. This may require use of water sprays, tarps, sprinklers
or suspension of activity during certain weather conditions. Haul roads should be treated,
and emissions from the transfer of earthen material must be controlled, as well as emissions
from all other construction-related activiries.
3. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces
onto paved surfaces. If tracking or spills occur on paved sur.faces, measures must be talcen
immediately to clean these surfaces.
4. All debris that results from this project must be disposed of by means other than open
burning.
5. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved and kept
clean.
6. SCAPCA Regulation I Section 6.04 addresses odors and nuisances. Effective control
apparatus and measures must be taken to reduce aiors being emitted to a reasonable
minimum.

Dear Mr. Micken:
A review of the site/drainage plan for the above mentioned project has been completed. The following
list is a summary of what needs to be addressed before release of a building permit. Please refer to
sheet A-1 for complete comments.
1. Please indicate on the drawing what drainage basins exists. Each swale should be sized
according to the area it will be responsible for draining. There are four swales shown, °
but only three calculations.
✓2. Is there a curb along the landscape areas on the north that prevents runoff from going there
instead of the swale? The northwest area is of most concern. I believe a 6" protective
curbing is required around landscaping, please check with the Planning Department for this
requirement. If this is the case, please indicate on the plan.
3 Provide a cross-section of the swales that meets Spokane County Standards.
✓ 4. What is the drywell near the northwest corner of the building being used for? Provide type
of drywell, type of lid and elevation of lid. If this is for roof runoff, please show pipe
and location of downspouts similar to the south side.
5. The northern swale is shown as 8" deep and the calculations indicate only 6". What is your
intentions?
6. Label all curb cuts as new or existing. If new approaches, please call out as Spokane

County Standard Cement Concrete Approach.

What is preventing the runoff from flowing across the southern property line towards the
east? Contours indicate the runoff will flow off of the property.

Specifically, pursuant to the Findings and Order dated April 5, 1984, the
Spokane County Hearing Examiner Committee approved a zone reclassification
from Agricultural to Restricfied Industrial (I-2) for the purpose of developing a
business park. The Findings and Order were not recorded with the Spokane
County Auditor. One of the conditions of approval specifically provided:

4. That the buildings be set back a minimum of 60-feet from the
front property line along Jackson, Bowdish, Ermina, Wilbur and
Montgomery Drive. Subsequent to the zone change, a Binding Site Plan was submitted and approved for
the same parcel of property. For whatever reason, neither the sponsor/applicant for
the BSP nor the Planning Department staff reviewed the above referenced condition.
The BSP was approved consistent with the minimum yard setbacks for the I-2 zone;
namely 35 feet.
A building permit is now being requested for Lot 1, Block 1, within the BSP.
Upon learning of the inconsistency between the 1984 condition and the Binding Site
Plan, the Planning Department agreed to expedite a change of condition Hearing
before the Hearing Examiner Committee. That hearing is now tentatively scheduled
for August. Additionally, the Planning Department has indicated that as a result of
changed zoning and uses to the north of the area included within the BSP, the
Planning Department report, with regard to the change ot: condition, would
recommend approval.
Although willing to apply for a change of condition, Mr. Gunning requested that the
Board of County Commissioners consider (1) allowing the issuance of building permit
No. 98-93 prior to formal consideration of the change of condition; and (2) waiving
the fees for processing the change of condition.
In support of Mr. Gunning's request, he suggested that the Planning Department was
somewhat responsible for not familiarizing itself with the 1984 condition in
conjunction with the BSP approval. Additionally, he confirmed thart the property to
the north had changed since the 1984 condition and he could not foresee any
objection to the change of condition request. Moreover, Mr. Gunning indicated that
only footings and foundations would be completed on Lot 1, Block 1, prior to the
hearing on the requested change of condition.
As a result of Commissioner Hasson's and Chilberg's discussion with Mr. Gunning,
the Board members determined:
1. The County would issue building permit (BP-98-93) recognizing
the setback on BSP-32-92, as opposed to the 1984 condition referenced
hereinabove, even though the change of condition application will not be
heard until the August Hearing Examiner Committee Meeting.
