The following information must be provided in order for us to proceed with our review. A) For any new hard surface area, for an asphaltic roof, or a roof containing HVAC maChinery, a drainage plan for the site shall be prepared in compliance with Spokane County uGuidelines for Stormwater Management". At a minimum the plan must contain: l. Drainage calculations for stormwater volumes generated on site. 2. Calculations for total impervious surfaces contained within the site. 3. Finished grade elevations for structures to be constructed on site. 4. Finished grade elevations at the top and bottom of the 208 swale. 5. A typical cross section of the 208 swale. 6. Calculations to justify the number and type of drywells proposed. 7. Elevation of drywell inlets where applicable. 8. Copy of the proposed landscape plan. 8) The subject property is affected by the uFindings and Order" and the "Conditions of Approval" for the following land use action: Spokane County Zone Change No. ZE-20-91 C) The following improvements within adjacent Right of Way are required prior to the release of a building permit: 1. You must submit road and drainage plans for street improvements. These must be prepared by an engineer. Plans must be prepared for the following streets: a Arganne Road, Zypical Roadway Section No. 1, Major Arterial Standard. All required construction (sidewalk/CUrbing/pavement) within the Public Road Right of Way is to be completed prior to the release of a building permit or a financial guaranty in an amount estimated by the County Engineer to cover the cost of construction or improvements shall be filed with the County Engineer. Required plans are to be submitted prior to estimating the amount of the financial guaranty or permit release. ~ / Page 2 2. As an alternative to the required road iunproventents the County will accept an RID/CRP agreement "Notice to Public No. 6" on Argonne Road. 3. Applicant shall dedicate 3 feet on Argonne Road for Right of Way purposes. 4. Please submit a copy of a recorded property deed from the Auditors office for the subject property. Upon receipt of the deed our staff will prepare the right of way deed and the RID/CRP agreement. 5. Approach perm.its must be obtained, after a site plan has been approved, and before the issuance of a building permit, from the County Engineering Department for any new or improved driveway approaches to the following streets: a. Argonne Road, (obtained from the Washington State Department of Transportation.) D) Insufficient information was submitted with the proposal. We are unable to proceed with our review. We will need the following befare we can proceed: 1. Site Plan. 2. Drainage plan as specified. 3. Other information: a. A parking and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving as required by the County Planning Ordinance, will be required for any portion of the project which is to be occupied or traveled by vehicles. It is illegal to back out onto the Right of Way. b. The Washington State Department of Transportation appears to be an agency of jurisdiction on this project and should therefore have their own signature block on the permit. c. The County Arterial Road Plan identifies Argonne Road as a Principal arterial. The existing right-of-way width of 63 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way dedication, a strip of property 10 feet in width along the Argonne Road frontage shall be set aside in reserve. This property may be acquired by Spokane County at the ti.me arterial improvements are made to Argonne Road. d. Applicant shall be aware that no guarantee is given for continued left turns from the property. Future improvements to Argonne will only permit right-in and right-out turns only. ~ ~ . . Page 3 e. In conjunction with the approved Short Plat 88-532 the applicant shall provide for and siqn a Tract "Xu agreement and the corresponding required documents to dedicate for future right of way 25 feet along the proposals' east property line. This future public right of way will eventually connect to Knox Avenue and provide for access on a signalized intersection. E) Utility Condition: Permittee is responsible for arranging for all necessary utility adjustments or relocation as required for completion of the a.mprovement. F) The owner of the property or the authorized representative must complete and sign Spokane County Engineers "Agreement to Pay Fees". This document must be returned to the County Engineers Office. Plan review will not be completed until this document is executed. This docurnent is attached to these comments. Please return the completed Agreement to your contact person at the Engineers Department. The applicant or his representative has been given a minimum requirements list. This list is not inclusive of all the requirements needed but should be used as a minimum guideline. Without the "minimum" requirements the Engineers Department may not be able to perform a complete review of the project and could result in prolonging the period before permit issuance. Only after all the information and requirements listed above are supplied or completed and the necessary review has been accomplished will your building permit be released. The members of the Committee preseat are Phil Harris, Chauperson, Verona Southem and 7ane Myers. PROPOSAL The sponsor, Marlc Finch requests approval of a Zone Reclassificadon, ZE-20-91, from Urban Resideatial-22 (UR-22) and Community Business (B-2) to Regional Business (B-3). The proposal is witlun the Aquifer Sensitive Area (ASA) Overlay Zone. FIVDINGS OF FACT AND CONCLUSIONS 1. The prQperty is generally located north of I-90 in the northeast quadrant of the Mullan/Argonne - I-90 interchange adjacent and east of Argonne Road in Section 8, Townsbip 25 North, Range 44 EWM, Spokane County, Washington. 2. The committee adopts the Planning Department Report as a part of this record. 3. The exi,sting land use(s) in the area are restaurants, motel, retail and professional office. 4. The Comprehensive Plan deagnates chis site as Major Commercial. The Major Conunercial category is intended for development of cominercial uses, specifically commuaity and regional shopping centers and commercial uses du-ecdy related to major throughways. 5. The Arterial Raad Plan designates Argonne Road as a principal arterial, with a recominended right of way width of 100 feet. 6. The existing zoning of the property described in tMe application is Urban Residential-22 (UR-22) and Community Business (B-2), previously established m 1956 (UR 22) and 1946 (B-2). 7. The provisions of RCW 43.21C (1'he State Environmental Policy Act) have been complied with and a Deternunation of Nonsignificance was issued The legal requirernents for pubuc noace have been fulfilled. 9. The owners of adjacent lands expressed concern of the proposed use due to the high volume of conflicting tiraffic movements and the location of the dnveway to the north of the proposal which is aot indicated on the site plan. 10. The proposed use is companble with exisang uses in the area. • -i H EC Order for ZE-20-91 Page 2 11 The proposed zorung does implement and conform to the Comprehensive Plan 12. The applicant has demonstrated that condinons have substantially changed since the original zoning of this area and accordingly, the proposed zone reclassification is justified. 13. The proposed use will not be detrimental to the public health, safety, morals or welfare. 14. The subdivision proposal is generally consistent wnth RCW 58.17 and the County subdivision regulations, promoting the public healdl, safety aad general welfare in accorclance with standards established by the state and Spokane County. CONDITIONS OR CONTYNGENCIES APPLIED TO THIS APPROVAL 1. .All Condiaons imposed by the Hearmg Examiner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The following Conditions of Approval apply to the real property descnbed below: Withm Qpportumty Plat 2, the W. 300 ft. of the N 1l2 except N 173 ft. of Tract 360 and except street, aad the N 1/2 of the S 1/2 o f Tract 360 except the street, as per plat thereof ia Volume "O" of plats, page 41 situate in the County of Spokane, State of Washuigton. SPOKANE COUNTY PLANNIIVG DEPARTAZENT CONDITIONS 1. The proposal shall comply with the Regional Business (B-3) zone as amended. 2. The apphcant shall develop subject property generally m aucrordance within the concept presented to the Hearung Body and the follownng changes shall be reqwmd• (1) Twelve additional parking spaces (169 total requimd), (2) Twenty fiive foot future dedication for Tract "X" roadway on eastem parcel boundary and subsequent relocanon of septic system and drainfield; (3) Twenty foot driveway on north property line, for access to rear parcel (east of proposal) must be indicated on site plan. Vanations, when approved by the Planaing Director/designee, may be permitted, mcluding, but not linuted to building location, landscape plans and general allowable uses of the per,mutted zone. All variadons must confonn to regularions set forth in the Spokane County Zoning OrcLnance, and the original intent of the development plans shall be maintained. 3. Approval is required by the Planning Director/designee of a specific hghung and signing plan for the descrfbed property pnor to the release of any btulding pernuts. 4. A specific landscape plan, planting schedule and pmvisions for maintenance aoceptable to the Plannuig Directar/designee shall be subrrutted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and mantained so that sight distance at access points is not obscured or impaired ~i HEC Order for ZE-20-91 Page 3 5. The Planning Department shall prepare and record with the Spokane County Auditor a T'ide Notice noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded withm the same time frame as allowed for an appeal and shall only be relea.sed, in full or in part, by the Planning Deparmnent. The Tide Noace shall generally pmovide as follows: The parcel of property legally described as [ ] is the sabject of a land use action by a Spokane County Hearing Body or Administrative Official on June 27, 1991 imposing a variety of special development conditions. File No. ZE-20-91 is available for inspection and copyiag in the Spokane County Planning Department. 6. Tle Planning Department shall file with the Spokane County Auditor, within the same time frame as allowed for an appeal from the final disposiaon, including lapsing of appeal period, a Title Notice, which shall generally provide as follows. "Pnor to the issuance of any building permit for any building or any use on the praperty described herein, the applicant shall be responsible for complying with the provisions of the Zonuig Code for Spokane County, Section 14.706 (Aquifer Sensiave Area Overlay Zone) The properry which is the subject of this notice is more pamcularly descnbed as follows. 7. That a statemeat be recorded on the subject property with the Oty Auditor which indzcates that animal keeping eadsts on property to the north which may not be compatible vnth the proposal. SPOKANE COUNTY ENGINEER'S OFFICE CONDITIONS Pnor To The Issuance Of A Buildine Pernut Or Use 4f The Pronertv As Proposed: 1 Applicant shall dedicate 3 feet on Argonne Road for right-of-way purposes. 2. Aocess pernuts for approaches to the county road system shall be obtained from the Spokane County Engineer. 3. Access pernuts and improvements to Argonne Road must be appmved by the Washington State Department of Transportanon (WSDO'1). 4. The applicant shall submit for appmval by the Spokane County Engineer road, drainage and access plans. 5. The applicant shall submit for approval by the Spokanc County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surfaee water disposal plan for the entire project, or pornon thereof, if the development is to be phased. 6. A parlcing plan and a-affic cuculation plan shall be subnutted and appraved by the Spokane County Engineer The design, locaaon and airangement of parking stalls HEC Order for ZE-20-91 Page 4 shall be m accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any pordon of the project which is to be occvpied or traveled by vehicles. 7. To construct the roadway improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be willing to paracipate in any petition or resolution whiEh purpose is the fornaation of a Road Improvement District (RID) for said irnpmvement, pursuant to RCW 36.88, as amended. Spokane County will not participate in the cosc of these irnprovements. 8. As an alternative method of construcdng the mad improvements stated herein, the applicant may, widi the appmval of the County Engineer, accomplish the road improvemeats stated herein by joinuig and paracipating in a County Road Project (CRP) to the extent of the required improvement. Spokane County will not participate in the cost of these irnprovements. 9. The construction of the road unprovements stated herein shall be accomplished as approved by the Spokane County Engineer. 10 The County Engineer has designated Typical Roadway Section Number One, Ma1or Arterial standard for the improvement of Argonne Road, which is adjaceat to the proposed development This wnll require the adciition of approximately 6- 8 feet of asphalt along the frontage of the development. The construction of curbing and sidewaik is also required. 11 All reqwred improvements shall conform to the current State of Washington Standard Specifications for Road and Bndge Construcnon and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stonnwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 12 Applicant shall construct a paved and delineated approach(es) to meet the existing pavement on Argonne Road. 13 Roadway standards, typical roadway secaons and drau.nage plaa requimments are found m Spokane Board of County Comnussioners Resoludoa No. 80-1592 as amended and are apphcable to this proposal. 14 This subdivision or development proposal is located withm a drainage basui wtuch has been identified by the Spokane County Enguieer's office as having stoimwater runoff problems. Since this plat or development proposal is affected by or is a contnbutor to stormwater flows, property owners should participate in the planning and implementarion of a futune basinwide stormwater management system The following statement shali be placed in the plat dedication: "The owner(s) or successar(s) in interest agree to join in any County-approved stonnwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintauung or operation of stormwater control faciliaes." 15 No construction work shall be performed wnthin the exisang or proposed pubhc nght-of-way until a pezrnit has been issued by the County Engineer. All required construction within the existiag ar proposed public right-of-way is to be completed priar to the release of a buiIding pennit, or a bond in an amount esdmated by the County Engineer to cover the vost of construction of improvements shall be filed with the County Engineer. 17. Applicamt shail sign and record Spokane County Notice to the Public No. 6 which specifies the following: The owner(s) or succaessor(s) in interest agree to authorize the Counry tio place theu name(s) on a petition for the formation af a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petidon includes the owner(s) property, and further not to object, by the signing of a ballot, the formation of a RID by the nesolution method pursuant to Chapier 36.88 RCW, whicb r+esolution includes the ownez(s) property. If an RID is fornQed by either the perition or resolution method, as provided for ln Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the impmvement or construction contemplated within the proposed RID is feasible; (b) that the benefits to be denved from the fonnation of the RID by the property included therein, together with die amount of any County participation, exceeds the cost and expense of formation of the RID; and (c) that the pmperty within the proposed RID is sufficiently developed. Provided fi;rther that the owner(s) or successar(s) shall retain the right, as authonzed under RCW 36.88.090, to object to any assessment on the property as a result of the improvements called for in oonjuncaon with the formation of the RID by either petition or resoludon method under Chapter 36.88 RCW. 18. The County Arterial Road Plan identifies Argonne Road as a Principal artezial. The existing right-of-way width of 63 feet is not consistent with that specified in the Plan. In order to unplement the Arterial Road Plaa, in addition to the required nght-of-way dedication, a strip of property 14 feet in width along the Argonne Road frontage shall be set aside in reserve. This property may be acquared by Spokane County at the time when arterial improvements are made to Argonne Road. 19. There may exist utilities, either nnderground or overhead, affecting the subject property, including pr+openy to be dedicated ar set aside for future acquisitioa. Spokane County assumes no financial obligatian for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to determine whether applicant(s) or the utility is responsible for adjustment or relocaxion costs and to make anangements for any necessary work. 20. Applicant shall only be pemsitted right-in and/or right-out turning movements on Argonne Road. Applicant shall be financially responsible for construcdon of • ~ HEC Order for ZE-20-91 Page 6 approved draffic control facilides wluch would alleviate the possibility of left tums into the site from Argonne Road. These aaffic control facihdes shall be approved by the Couaty Engineer. 21. In conjnnction with the approved Short Flat 88-532 the apphcant shall provide for and siga a Tract "X" agreemeat and the cornesponding required documents to dedicate for fnture right of way 25 feet along the pmposals' east property luie. This future public right of way will eventually connect to Knax Avenue and provide for access on a signalized intersection. SPOKANE COUNTY UTILITIES DEPARTMENT CONDITIONS 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer dispasal systems is hereby authorized This authorizatton is conditioned on compiiance with all rules and regulations of the Spokane County Health District and is further condinoned and subject to specific application approval and issuance of pernuts by the Health Distnct 2. The dedication shall state: "The owner(s) or successor(s) in inter+est agree to authorize the County to place theu name(s) on a petition for the foanation of ULID by petieon method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest peaaon against the fonnation of a ULID by resolunon method pursuant to RCW Chapter 36 94 w}uch uicludes the owner(s)' property. PROVIDID, this condition shall not prohibit the owner(s) ar successor(s) from objecting to any assessment(s) on the property as a result of unprovements called for in conjunction with the formation of a ULID by eithear petition or resolation method under RCW Chapter 36 94." 3 Any water service for this project shall be provided in accotdance with the Coordinated Water System Plan for Spokane County, as amended. 4 The dedication shall state: "Eacb unit shall be double-plumbed for connection tv future azeawide collectivn systems." SPOKANE COUNTY HEALTH DISTRICT CONDITIONS 1. A combiaed surface water and sewage di.sposal detailed plan shall be approved by the Spokane County Engineer and the Spokane County Health District prior to the issuance of any on-sire sewage disposal permit or building permit for this projecG 2 Sewage clisposal method shall be as authonzed by the Director of Utdities, Spokane County. 3. Water service shall be coordinated thmugh the Dumctor of Uahties, Spokane County 4. Water service shall be by an exisang public water supply when approved by the Regional Engineer (Spokane), State Department of Health. - ~ HEC Order for ZE-20-91 Page 7 ~s- 5 Disposal of sewage effluent beneath paved surfaces is cuirendy prohibited. 6 Subject to specific application approval and issuance of perranits by the health officer, the use of individual on-site sewage disposal system(s) may be authorized. 7. Use of private wells and water systems is prohibited. 8. Due to property lying within the Aquifer Sensiave Area (ASA) Overlay zone, no more than 3,600 gallons of sewage flow per acre per day is allowed for an on-site sewage disposal system. SPUKANE COUNTY BUILDING AND SAFETY DEPARTMENT CONDITI0IVS 1. The applicant shall contact the I?epartment of Building and Safety at the earliest possible stage of design/development in onder to be infomaed of code requirements administered/enforced by the department, e.g., State Building Code Act regulations, such as requirements for fue hydrant/flow, fire apparatus access roads, street address assignment, barrier-free reguladons, energy code reguladons and general coorduiation with other aspects of project unplementation. 2. Requirements of Fire District No. 1 need to be satisfied during the buildwg pemnit process. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY CUNDITIONS 1. Aw poIludon regulations require that dust emissions during demohtion, construction and excavation projects be controlled. This may nequire use of water sprays, tarps, sprinklers or suspension of activity during certaui weather conditions. Haul roads should be treated, and enussions from the transfer of earthen material mnst be controlled, as well as emissions from all other construction-related activities. 2. Measures must be taken to avoid the deposidon of dut and mud from unpaved surfaces onto paved surfaces. If traclang or spills occur on paved surfaces, measures must be taken immediatrely to clean these surfaces. 3. All traveled surfaces (ingress, egr+ess, parkuig areas, access roads) must be paved and kept ciean. 4. Debns generated as a resuit of this proJect must be disposed of by means other trian bunung. 5. All demolidon and renovation activities must comply with CFR 44 Part 61, Subpart M. Intent to Demolish and Renovate fonns are avmlable at the SGAPCA office. WASHINGTON STATE DEPARTMENT OF ECOLOGY 1. Installation of new underground storage ta.Aks must meet the requuements of the new state uaderground storage tank regulations (Chapter 173-360 WAC). . HEC Order for ZE-20-91 Page 8 2. A notice of intent to install tanks must be filed with the Deparmnent of Ecology at least 30 days prior to installation. Withm 30 days after coming into service, the tanks must be registereci with the Department of Fc;ology on a state notification form. 3. All fircns providing tanlc-mstallation services must be hcensed by the Department of Ecology. The svpervisor on-site during installanon must be licensed by passing a state exam. 4. New tanks and any connected piping must be protected from corrosion by either a cathodic protection system, or by being constructed or coated with a noacorrosive material such as fiberglass. An a,cceptable method of leak detection must be employed, and the tanks must be equipped with spill prevention and overfill protection equipment. 5. State I vapor recovery equipment is required on new undergrouud starage tank installations with an aggregate volume greater than 10,000 gallons. In the near future, Stage II vapor recovery equipment will also be required in Western Washington connties. The appucant may wish to consider installing Stage II equipment during initial construcaon of new tank systems 6. Under the Unifor,m Fire Code, permits are required for the installation of underground storage tanks. The local official charged with administratioa of the Code should be contacted regarding the perinit requirements. WASHINGTON STATE DEPARTMENT OF TRANSPORTATION 1. WSDOT recomnaends consolidating the number of access poinLs onto Argonne Road to reduce the nnmbez of conflicang movements 2. When tiraff'ic conditions warrant, the access points onto Argonne Road be limited to a nght-in and right out only. This unprovement will be necessary in the future due to the high volume of conflicting traffic movements.
