A threshold determiniation is required to be issued by the Department of Buildings after circulation of an Environmcntal Checklist to
agencies of jurisdietion. Action upon the proposal will not commence until the 15 day public comment period. A $75.00 fee is
required to initiate the environmental review. ne SEPA f(ed through the Binding Site Plan deals with division of properties only.
PROJECT OVERVIEW
Property lines of the site are still flexibic and square footagcs are approzimate. Proposed is a generaUcommercial printer employing
16 people. Process involvoes taking raw materials, printing them, and returning them to the customer. Non -flammable intcs are used.
Proposed will contain a lunchroom/training room area. Maintenance is contracted out. No me2zanines or basements are proposed.
Proposed height is 20'. Office activities include sales, accounting, bookkeepin& No exterior storage or loading ramps are proposed.
Canstruction will probably being in late winter/early spring wilh accupancy expected in June 1993.

• Ezterior refuge areas must bc screened on 3 sides with 5 -1/2' minimum high fence and site obscurring gate.

INTRODUCTIQN
. This matter having come before the Hearing Examiner Committee on August 24,
1989, and the members of the Committee present being Jane Myers, Chairman, Phil
Harris and Lunell Haught.
PROYUSAL
The sponsor, Joe Postell, requests approval of a zone reclassification from
Agricultural (A) to Light Industrial (I-2)., File No. ZE-23-89, for the purpose of
developing warehouse and light industrial uses.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located south of and adjacent to Montgomery Drive in the
Spokane Valley, approximately 1900' ft. east of University Road in Section 9,
Township 25 N., Range 44 EWM, Spokane County, Washington.
2. The committee adopts the Planning Departrnent Repart as a part of this record..
3. The existing land use(s) in the area are retail space, offices, mini storage warehouse,
wnecking yard, grocery warehouse, ternunal.
4. The Comprehensive Plan designates this site as Industrrial. The Industrial category is
for the purpose of Industrial Use. -
5. The Arterial Road Plan designates Montgomery I?rive as a minor arterial, with a ~
recommended right of way width of 80' fe.et.
6. The existing zoning of the praperty described in the applicarion is Agricultural,
previously established in 1942.
7. The provisions of RCW 43.21C (T'he State Environmental Policy Act) have been
complied with and a Detenmination of Nonsignificance was issued.
8. The proper legal requirements for advertisement and notice have been fulfilled. -
9. The owners of adjacent lands eacpressed neither apprn'val and d.isapproval of the
proposed use.
10. The Committee additionally finds: a. The proposal is surrounded by Industrial Zoning and Railroad Right of Way.
11. The proposed use is compatible with existing uses in the area.
12. The proposed zoning dces implemcnt and conform to the Comprehensive Plan.

CONDITIONS OR CONTINGENCIES AFPLIED TO THIS APPROVA]L
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
COUNTY PLANNING DEPARTMENT
1. The legal description of the subject property is:
That portion of Section 9, Township 25N, Range 44 E.W.M. being the North 1/2
of the SW 1/4lying northerly of raikoad rights-of-way and southerly of
Montgomery Drive, together with the East one acre of a portion of the NE 1/4 of the
SW 1/4-lying south of the north 433.5 feet and north of the SIRR rights-of-way.
Commonly known as Tax Parcels 45093.9018 and 45093.9050.
2. The applicant shall develop subject property generally in accordance within the
concept presented to the Heari.ng Examiner Committee. Variations, when approved
by the Planning I?irector/designee, will be pernlitted, including, but not limited tA
the following changes: building location, landscape plans, and general allowable
uses of the pennitted zone. All variations must conform to regulations set forth in
the SPOR:ANE COUNI'Y 7UNING CODE. The ariginal int,ent of the development
plans shall be maintained.
3. All cur,rent standards of the Light Industrial (I-2) Zone, as amended, shall be
complied with in the development of tl-as site.
4. The present proposal is not detailed enough to deternune whether or not the use of
or materials stored on the site are in oompliance with Section 14.706 (Aquifer
Sensitive Area Overlay Zone) of the ZONING CODE FOR SPOK:ANE COUNTY.
Accordingly, as a condition of approval, the sponsor/applicant shall be required to
file with the Spokane County Auditor, within thirty (30) days of the signing of
Findings and Order of the final decision in this matter, a"Notice to the Public"
which shall provide in material as follows: PRIOR TO TBE ISSUANCE OF ANY BUII.DING PERMIT OR CERTIFICATE
OF OCCUPANCY FOR ANY BUII.DING OR ANY USE ON TT-IE PROPERTY
DESCRIBED HEREINAFIER, THE APPLICANT SHALL BE RESPONSIBLE
FOR COMPLYING WITH THE PROVISIONS OF THE ZOIVING CODE FOR
SPOKANE COUNTY SECTION 14.706 (AQUIFER SENSTITVE AREA
OVERLAY ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS
NOTICE IS MORE PARTICULARLY DESCRIBED AS FOLLOWS:....".
5. Applicant shall comply with 708' recommendations concerning stormwater runoff
and provide necessary landscaping for runoff.

6. Any division of land for the purpose of sale, lease or transfer, shall comply with
RCW 58.17 and the Spokane Counry Placting Qrdinances prior to issuance of
building permits.

right of way and utilities to run with the land The future acquisition area reservation
shall not be removed without prior approval by the Spokane County Planning
Deparnnent. The notice shall be recorded prior to the issuance of a buildi.ng permit
and shall provide the following:

a. At least 8' feet of future acquisition area for road right of way and utiliries, in
addition to the existing right of way, along Montgomery Drive.
b. Building and other setbacks required by the Spokane County Zoning Code shall be
measwreti from the future acquisition area reserved for road right of way and
utilities.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs shall be
within the future acquisirion area for road right of way and utilities. If any of the
above unprnvements are made within this area, they shall be relocateri at the
applicant's expense when roadway impmvements are made.
d. The future acquisition area, until acquired by Spokane Counry, shall be private
property and may be used as allowed in the zone except any imprnvements (such as
landscaping, parking, surface drainage, drainfields, signs, or others) shall be
considered "interim" uses. .
e. The property owner shall be responsible for relocating such "interim"
i.mprovements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area. f. This "Title Notice" shall be signed by the applicant to serve as official notice and
acknowledgrnent of said future acquisition area for road right of way and urilities.
8. The Spokane County Planning Department shall prepare and recard with the
Spokane County Aud.itor a"Title Notice" noting that the property in quesaon is
subject to a variety of special conditions imposed as a result of approval of a land
use action. This "Title Notice" shall serve as official public notice reganding
conditions of approval affeeting the property in question. The "Title Notice" shall
be recorded within fifteen (15) days of final disposition of the approved land use
action and shall only be exringuished by the Spokane County Planning Department.
The "Title Notice" shall generally provide as follows:

number) is the subject of a land use action, imposing a variety of
special devetopment conditions, by a Spokane County Hearing Body
or Administrative Official on (date) and as maybe amended, altered or

in the Spokane County Planning Department.

COUNTY ENGINEERING DEPARTMENT
Prior To The IUuance Of A Building Permit Or L1se Of The Propertv As Pmwsed:
1. Applicant shall dedicate 2 feet on Montgomery llrive for right of way.
2. Access permits for approaches to the County Road System shall be obtained from
the Spokane County Engineer.
3. Applicant shall submit for approval by the Spokane County Engineer road,
drainage, and access paans.
4. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project or any portion thereof, if the
development is to be phased.
5. A parking plan and uaffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, locarion, and an~ulgement of parking stalls
shall be in accorriance with standard traffic engineering pra,ctices. Paving or
surfacing as appmved by the County Engineer, will'be requireci for any portion of
the project which is to be occupied or traveled by ve'hicles.
6. The construction of the road 'unprovements stated herein shall be accomplished as
approved by the Spokane County Engineer.
7. The County Engineer has designated Typical Roadway Section Number One,
Secondary Arterial. Standard for the unprovement of Montgomcry Drive which is to
constructed within the proposed developmenL This will require the installation of 8
to 10 feet of asphalt Curbing and sidewalk must aiso be constructed.
8. All required improvements shall conform to the current State of Washington
Standand Specifcations for Road and Bridge Construction, and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
9. Roadway standands, typical roadway sections and dra.inage pian requirements are
found in Spokane Board of County Commissioners' Resolution No. 80-1592 as
arilended and are applicable to this proposal. ~

10. No construction work is to be perfonned within the existing or proposed public
right-of-way until a pernut has been issued by the County Engineer. All work is
subject to inspection and apprnval by the County Engineer.
11. All required constructibn within the existing or proposed public right of way is to
be completed prior to the release of a build.ing pemut or a bond in the amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer.
12. The County Arterial Road plan identifies Montgomery Drive as a Minor Arterial.
The exisring right of way width of 62 fG is not consistent with that specified in The
HEC Order for Page 5
Plan. In order to implement the Arterial Road Plan it is recommended that in
addition to the required right of way dedication, a strip of property 8 ft. in width
along che Mon[gomery Drive frontage be set aside in reserve. This properry may be
acquired by Spokane County at the time when Arterial Improvements are made to
Montgomery Drive.
COUNTY UTILITIES DEPARTMENT
1. Pursuant to the Board of County Commissioners Resoludon No. 80-0418, the use
of on-site sewer disposal systems is hereby Quthorizcd. This authorization is
conditioned on compliance with all nules and regulations of the Spokane County
Health District and is further conditioned and subject to specific application
approval and issuance of permits by the Health District
2. 'The owner(s) or successor(s) in interest agree to authorize the County to place
- their name(s) on a petition for the formadon of ULID by petition method pursuant
to RCW 36.94, which the petition includes the owner(s)' property; and further not
to object by the signing of a protest petition against the formation af a ULID by
resolution method pursuant w RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED this oondition shall not prohibit the owner(s) or successor(s)
from objecting to any assessment(s) on the property as a result of improvements
called for in conjunetion with the formation of a ULID by either petition or
resolution method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in ac,,andance with the
Coordinated Water System Plan for Spokane County, as amended.
4. A dry sewer connection to the future areawide sewerage system is to be
constructed. Plans and specifications for the dry sevver connection are to be
reviewed and approved by the Utilities Deparnnent
COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall be approved by
the County Engineer and the Spokane County Health District prior to the issuance
. of any building pernut for this project.
2. Sewage disposal method shall be as authorized by the Director of Utilides, Spokane
County.
3. Water service shall be coordinated through the Director of Utilities Spokane
County.
4. Water service shall be by an eacisting public waier supply when approved by the
Regional Engineer (Spokane), State Department of Social & Health Senrices.
5. Disposal of sewage effluent beneath paved surfaces;is currently prohibited.
6. Subject to specific application approval and issuanee of pernuts by the health
officer, the use of (an) individual on-site sewage disposal system(s) may be
authorized.

7. Use of private wclls and water systems is prohibited.
COUNTY BUILDING AND SAFETY DEPARTMENT
1. The applicanc shall contact the Department of Building and Safety at the earliest
possible stage of design/development in order to be informed of Code requirements
administered/enforced by the department, e.g., State Building Code Act regulations
such as requirements for fire hydrant/flow, fire apparatus access roads, street
address assignment, barrier-free regulations, energy code regulations, and general
coordination with other aspects of project implementation.
2. Requirements of Fire District No. 1 need to be satisfied during the building pernlit
process. WATER PURVEYOR
1. Water Purveyor is Water District No. 6, and they will supply the site with adequate
water for domesric, fire and irrigation uses.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
All air pollution regulations must be met. This includes but is not limited to the
following:
1. Air pollution regulations require that dust emissionsi-during demolition, excavation
and construction projects be controlled. This may require use of water sprays,
tarps, sprinklers, or suspension of acrivity during certain weather conditions. Haul
roads should be meated and emissions from the transfer of earthen material must be
controlled as well as emissions from all other construction related activities.
2. Measures must be taken to avoid the deposition of dist and mud from unpaved
surfaces onto paved surfaces. If traclang or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.

Indusrrial zoning of the area has been occurring since the mid 1970's and subsequent to
adoption of the Comprehensive Plan. Proposed, and previous zone changes to
Resaicted Industrial have served to implement the Industriai category of the
Comprehensive Plan. Accord.ing to the program to implement the new Zoning Code of
Spokane County, all existing zones in the County are scheduled to cross-over to new
zones in 1991, based upon a best fic criteria. For this general area, the cross-over will

I V. SITE DEVELOPMENT RECOMMENDATIONS .

Montgomery Drive, is consistent with standards of the Spokane County Zoning Code.
Detailed landscape plans are to be reviewed prior to building permit approval.
Signage: Sign standards of Spokane County Zoning Code will allow adequate identification
of property consistent with adjoining industrial uses.
Critical Materials/Use Activity: Site development is subject to provisions of the Aquifer
Sensitive Area Overlay Zone as they specifically address storage and handling of cntical
materials. Future development will be reviewed for critical materials at building permit
stage.

V. SEPA ENVIRC)NMEN'I'AL REV1EW
An Environmental Ciiecklist was submitted by the sponsor and was reviewed by the
Counry Planning Department. The revicw considered the specifics of the proposal, other
available information, County ordinances, other regulations and laws, possible standard
Conditions of Approval, ehe Generalized Comprehensive Plan, and other County policics
and guidelines. The Zoning Administrator has dctermined that "No probable significant
adverse impacts" woutd result from the proposal being developc;d and has issued a
Determination of Non-Significance ("DNS").
The "DNS" was circulated to 8 other agencies of jurisdiction a.nd ocher
agencies/departments affected by the future development for review and commenL The
"DNS" comment period ends August 22nd, 1989, and was advertised 15 calendar days
before said date in the newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by norice on a sign posted on the proposal site. The Hearing Examiner
may consider addicional environmental related testimony and the "DNS" at the public
hearing.
VI. PLANNING DEPARTMENT SUMMAIZY
Approval is recommended for the following reasons: a. The proposed Light Industrial (I-2) zone is consistent with, and implements the
. Industrial category of the Comprehensive Plan.
b. The proposed site plan indicates conformance to Light Industriai (I-2) standards of
the Spokane Counry Zoning Code.
c. The proposed zone change is consistent and compatible with land use and zoning
trends in the area, as evidenced by adjoining Restncted Industrial zones.
VII. CONDITIONS OF APPROVAL
All Conditions imposed by the Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.
COUNTY PLANNING DEPARTMENT
1. The applicant shall develop subject property generally in accordance within the concept
presented to the Hearing Examiner Committee. Variarions, when approved by the
Planning Director/designee, will be permitted, including, but not limited to the
following changes: building location, landscape plans, and general allowable uses of
the pemlitted zone. All variations must conform to regulations set forth in the
SPOKANE COUNTY ZONWG CODE. The original intent of the development plans
shall be maintained. 2. All current standards of the Light Industrial (I-2) Zone, as amended, shall be complied
with in the development of this site.
3. The present proposal is not detailed enough to determine whether or not the use of or
materials stored on the site are in compliance with Section 14.706 (Aquifer Sensitive

2. Access permits for approaches to the County Road System shall be obtained from the
Spokane County Engineer.

4. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan and
surface water disposal plan for the entire project or any portion theneof, if the
development is to be phased.
5. A parlang plan and traffic circulation plan shall be submi.tted and approveti by the
Spokane County Engineer. The design, location, and airangement of parking stalls
sha.ll be in accordance with standard tiraffic engineering practices. Paving or surfacing
as approved by the County Engineer, will be required for any portion of the project
which is to be occupied or traveled by vehicles.
6. The construction of the road improvements stateti herein shali be accomplished as
approved by the Spokane County Engineer.
7. The County Engineer has designated Typical Roadway Section Number One,
Secondary Arterial Standard for the improvement of Montgomery Drive which is to
constructed within the proposed development, This will requine the installation of 8 to
10 feet of asphalt. Curbing and sidewalk must aiso be constructed.
8. All required improvements shall conform to the current State of Washington Standard
. Specificarions for Road and Bridge Construction, and other applieable County
standards and/or adopted resolutions pertaining to Road Standards and Stormwater

9. }:o.iciway standards, typical roadway sections and drainage plan requirements are found
in Spokane 13oard of County Commissioners' Resolution No. 80-1592 as anlecided and
are applicable to this proposal.
10. No construccion work is to be perfornied within the existing or proposed public right-
of-way until a pcrmit has been issued by the County Engineer. All work is subject to
- inspection and approval by the County Engineer.
11. All required eonstruction wichin the existing or proposed public right of way is to be
completed prior to the release of a building permit or a bond in the amount esrimated by
the County Engineer to cover the cost of construetion of improvements shall be f led
with the Counry Engineer.
12. The County Anerial Road plan idenafies Montgomery Drive as a Minor Arterial. The
existing righc of way width of 62 ft. is not consistent with that specified in The Plan.
In order to implement the Arterial Road Plan it is recommended that in addition to the
required right of way dedication, a strip of property 8 ft. in width along the
Montgomery Drive frontage be set aside in reserve. This property may be acquired by
Spokane County at the time when Arterial Improvements are made to Montgomery
Drive.
COUNTY UTILYTIES DEPARTMENT
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on campliance with all rules and regularions of the Spokane County Health District and
is furcher conditioned and subject to specific application approval and issuance of
pemuts by the Health District
2. "The owner(s) or successor(s) in interest agree to authorize the Counry to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which the petition includes ihe owner(s)' property; and further not to object by
the signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which ineludes the owner(s)' property. PROVIDED
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the properry as a result of improvements called for in conjunction
with the formation of a ULID by either petidon or resolution method under RCW
Chapter 36.94." -
3. Any water service for this project shall be provided in accordance with the Coordinated
Warer System Plan for Spokane County, as amended.
4. A dry sewer connection to the future areawide sewerage system is to be constructed.
Plans and specifications for the dry sewer connection are to be reviewed and approved
by the Utilities Department.

Regional Engineer (Spokane), State Department of Social & Health Services.
5. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
6. Subject to specific application approval and issuance of permits by the health officer,
the use of (an) individual on-site sewage disposal system(s) may be authorized.
7. The dedicatory language on the plat shall state: "Use of private wells and water

COUNTY BUILDING AND SAFETY DEPARTMENT
1. The applicant shall contact the Department of Build.ing and Safety at the earliest possible
stage of design/development in order to be informed of Code requirements
administered/enforced by the department, e.g., State Building Code Act regulations
such as requirements for fire hydrant/flow, fire apparatus access roads, street address
assignment, barrier-free regulaaons, energy code regulations, and general coordination
with other aspects of project implementation.
2. Requirements of Fire District No. 1 need to be satisfied during the building pennit
process.
WATER PURVEYOR
1. Water Purveyor is Water District No. 6, and they will supply the site with adequate water
for domestic, fire and irrigation uses.
. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
All air polluaon regulations must be met. This includes but is not limited to the
following:
1. Air pollution regulaaons require that dust emissions during demolition, excavation and
construction projects be conrnolled. This may require use of water sprays, tarps,
sprinklers, or suspension of activity during certain weather conditions. Haul roads
should be treated and emissions from the transfer of earthen material must be controlled
as well as emissions from all other construction related activities.

A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
April 5, 1984, and the members of the Committee present being

B. PROPOSAL
The sponsor, Northwood Properties, Inc., is requesting approval of a zone
reclassification, File No. ZE-104-83, Agricultural to Restricted
Industrial, for the purpose of developing a 8usiness Park.
C. FINDINGS OF FACT
1. That the existing land use in the area is- residential, industrial,
and vacant.
2. That the Comprehensive Plan designatzs this area as appropriate f or
Urban and Industrial de velopment.
3. That the existing zoning of the property described in the application
is Agricultural.
4. That the provisions of RCtiY 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Declaration of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda

6. That the land in this area is suitable for the proposed use, or uses
within the proposed Zone Classif ication.
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and

provided around the site's perimeter f or site-screening adjacent
to the single family areas and a 10-foot landscape strip along

6. That access on Bowdish Road be controlled on both sides;
location of said access to be within the south 300 feet of
Dowdish. There shall be no access to Ermina or Wilbur. The
Engineer's Off ice shall advise whether there is a possibility that an exit can be allowed at the northwest corner of the site
onto Jackson Avenue; said access to be signed which would not
permit a right turn as a vehicle would exit the site, nor a left
turn when entering the site as vehicles travel west along
Jackson.
7. That the project is subject to Section 4.16A.050, the Aquifer
Sensitive Area Overlay Zone of the Spokane County Zoning
Grdinance, which sets forth various measures f or Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.
8. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of
such lighting. (Such plan shall attempt to confine illumination
to the area with full consideration to adjacent properties).
9. That signing of the site shall be generally in substantial
conf ormance, as determined by the Zoning Administrator, with
those standards of the Local Business Zone.
10. A specif ic landscape plan, planting schedule and provisions f or
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond f or the
project, or phases of the project, prior to release of building
pArmits.
11. The applicant shall develop subject property generally in

application, and prior to any on-site improvements, or f ile
appropriate documents to the effect that the NOTICE OF ACTION is ,
waived in accordance with Spokane County Commissioners'
Resolution #82-0458 dated May 4, 1982.
16. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance has
been issued at least fifteen (15) days prior to this date; the
off icial f ile, written comments and/or public testimony contain
inf ormation regarding assessment of the proposal's adverse
impacts to the physical environment; a finding is hereby made
that no potentially significant adverse impacts upon the
physical environ ment are anticipated as a result of the
project; and a f inal declaration of non-significance is hereby
to be issued.

1) COP1PREHENSIVE PLAN: The property lies within two Comprehensive Plan
Categories; i.e., "Urban" and "Industrial" and can be considered as a
"Transition Area" and, therefore, a Comprehensive Plan Ainendment is
not necessary.
The Urban category suggests screening or other performance standards
to help make differing land uses compatible. This concept at a
minimum should be utilized for those properties along Jackson,
Bowdish, and Montgomery. Another "Decision Guideline" suggests
multi-family structures be located adjacent to arterials; near public
transit routes and be used to improve or maintain the consistency of
adjacent single family areas.
Another alternative would be to landscape heavily along Jackson,
Bowdish and hlontgomery, in conjunction with a greater front yard
setback along these streets.

milliamperes flourescent tubing behind plexiface, spaced on
seven (7) inch or more centers, or of exposed neon not exceeding _
thirty (30) milliamperes.
9. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits.
10. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
May 6, 1982, and the members of the Committee present being
Ronald L. McVicker, Chairman, Jerry Williams and Richard L. Skalstad.
B. PROPOSAL The sponsor, Irvin Water District #6, is requesting approval of a zone reclassifi-
cation, File No. ZE-152-81, Agricultural to Restricted Industrial, with no pro-
posed development at this time.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
Urban/Industrial development.
3. That the existing zoning of the property described in the application is
Agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with, and the Committee concurs with the Declaration of
Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses within

a) COUNTY PLANNING DEPARTMENI"

and Airport Overlay Zone, shall be complied with in the development of
this sifie.
2. The Zoning Administrator shall approve a specific exterior lighting
plan for the approved area prior to insrallation of such lighting. (Such
plan shall atfiempt to confine illumination to the area with full considera-
tion to adjacent properties).
3. The specific development plan including interior circulation and park-
ing will be submitted for Zoning Administrator review and approval
prior to issuance of building permits. Any development shall be
site-screened or buffered from residential areas to the north and east
of the site.
4. Signs for this project shall conform to standards as set forth in
Section 4.09.125 Signs.
S. Applicant shall comply with '208' recommendations concerning storm-
water runoff and provide necessary landscaping for runoff.
6. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County Commis-
sioners Resolution #77-1392 be inifiiated by the project applicant within
thirty (30) days of final disposition of this application, and prior to
any on-site improvements.
7. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guide-
lines (WAC 197-10) and the Spokane County Environmental Ordinance
(SCEO), a proposed declaration of non-significance has been issued at
least fifteen (15) days prior to this date; the official file, written
comments and/or public testimony contain information regarding assess-
. ment of the proposal's adverse impacts to the physical environment; a
finding is hereby made that no potentially significant adverse impacts
upon the physical environment are anticipated as a result of the
project; and a final declaration of non-significance is hereby to be
issued.

1. Access permits shall be obtained from the Spokane County Engineer
prior to the issuance of a building permit or any use of the property.
2. Applicant shall improve Bowdish Road in a manner consistent with
Spokane County TYPICAL roadway section No. 1 minimum paving width
access standard. 3. Applicant shall submit for approval by the Spokane County Engineer
road, drainage, and access plans prior to the issuance of a building

Engineer and the Spokane County Health District a detailed combined

accomplished as approved by the Spokane County Engineer.
6. All required improvements shall conform to the current State of Wash-
ington Standard Specifications for Road and Bridge Construction, and
other applicable county standards and/or adopted resolutions pertain-
ing to Road Standards and Stormwater Management in effect at the
date of consfiruction, unfess otherwise approved by the County
Engineer.
c) COUNTY UTI LI-rl ES DEPARTMENT
1. Pursuant to Board of County Commissioners Resolution No. 80-0418,
the use of on-site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance with all rules and regulations
of the Spokane County Health District and is further conditioned and
subject to specific application approval and issuance of permits by the
Health District. 2. The owner, his heirs or successors shall join and participate in
any petition or resolution which purpose is the formation of a
utility local improvement district (ULID) pursuant to RCW,
Chapter 36.94, as amended. The owner, his heirs and suc-
cessors shall further agree not to oppose or protest any legal
assessments for any utility local improvement district (ULID)
established pursuant to RCW Chapter 36.94, as amended.
3. .Any water service for this project shall be provided in accord-
ance with the Coordinated Water System Plan for Spokane
County.
4. Each unit shall be double plumbed for connection to future area-
wide collection system.
d) COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
2. Water service shall be coordinated through the Director of Utilities,
Spokane County.
-3. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.

111. BACKGROUND/ANALYSIS
A. COMPREHENSIVE PLAN - The proposal is locateci oil the bounclai-y
line between an Urban and an Industrial category. As such the
- proposal is consistent and appropriate with the Plan. However,
since the rezone proposal rests adjacent' to a residential development,
future industrial development plans should include buffering tech-
niques appropriate for the developmen't.
B. SITE CONSIDERATIONS - Probably the most important factors of
the site that warrant consideration are the surrounding industrial
development activities to the West and the residential activities to the
North and West. Existing industrial activities west of the site sug-
gest such a proposal is conducive to the area. Yet the residential
activity immediately adjacent to the proposal suggests need for ade-
quate bufifering bettiveen existing residential acfiivity and the proposal.
Potential traffic problems may exist with this proposal, depenciing
upon specific site developmenfi plans. The residential firaffic and
future industrial traffic could create need for traffic facility improve- ment. '
The site is located within the designated conical airfield overlay near
Felts Field.
C. HISTORY OF OTHER LAND USE ACTIONS - Rezoning actions have
occurred over the past ten (10) years in the areas north and west of
the proposal. Most of the rezone actions taken north of the proposal
have been from Agricultural to "R-1" residential zones. An area
located to the northeast of the proposal was rezoned from Agricultural
to Multiple Family Suburban (MFS) in 1978. The area west* of the
proposal on the other hand has been rezoned from "Agricultural" to
"Restricted Industrial" in 1972 and 1978. The proposal 'site falls be-
tween these zoning and development activities.
D. CONCLUSION - The requested zoning is consistent with the Com-
prehensive Plan and development activities to the West. The compati-
bility of the zone change with land use to the north and east could
be greatly increased by the use of buffering techniques and careful
site planning. Specific site plan review shoulci be necessary when
such a site plan is completed. .

a. This project li.es over the Spokane Aqua.fer.
b. Tt is within Critical Water Supply Service Area No. 19 and within the
service area of Trvin Water District #b.
c. The project is inside the Spokane County Comprehensive Wastewater Manage-
ment Area; and inside the Priority Sewer Service Area recommended in the
'201' Study. The method of sewage disposal is subject to approval of the
Director of Utilities pursuant to County Resolution 80.0418 adopted March 24,
1980. The topography and soils in the area are generally suitable for use
of individual on-site sewage systems.
d. The project lies in a relatively flat area west of Bowdish Road and south
of Carlisle Avenue. Local drainageways are insignificant.
e. Surface soils are classed as Garrison gravelly loam with 0% to 5% slopes.
They have a septic tank filter field Iimitation of slight. There is also
possible contaminatioa of groundwater.
f. Geologically, the soils are glaciofluvial deposits. These geological
structures generally yield moderate to very large amounts of water.
Data from wells in the area shows they are from 95' to 142' deep. The
highest nitrate level was found to be 1.1 parts per million. The Irvin
Water District #6 has indicated that it can supply domestic use water
for the project.

FINDZNGS OF FACT AND CONCLUSrONS
1. The proposal is to divide 22.2 acres into 19 lots for the development of industrial use lots.
2. The proposal is located in the Spokane Valley, south of and adjacent to Jackson Avenue
and north of and adjacent to the B.N.R.R., 2200 feet east of University Road in Section 9,
Township 25 North, Range 44 EWIvi., Spokane County, Washington.
3. The current zoning of the property is Light Industrial (I-2). The proposed lot sizes,
frontage and intended uses are allowed within this zone. The property is also covered by
the Airport Overlay Zone, and is within the Conical Area (CA), which has specific land use
limitations for the property. -
4. The Spokane County Comprehensive Plan designates this area as Industrial. The
development and uses proposed are generally in accord with this planning category. The
proposal as submitted with its environmental checklist and proposed mitigating measures
will effectively accomplish the intent of the Comprehensive Plan. The Transportation
Secaon of the Comprehensive Plan, in the Arterial Road Plan, indicates a need to plan for
Montgomery Avenue as a Minor Arterial. 7'he review by the County Engineers indicates
dedication of roadway(s) is needed now, while the Comprehensive Plan indicates the need
for additional future right-of-way, with structure and improvement setbacks from the future
right-of-way widths.
5. The requireti notice was provided for this proposal and no one in the area commented upon
y the p. )posaI. Agencies having a potential interest in the project were notified and their
condiaons are contained hereinafter.
6. With the recommended condidons of approval and Spokane County development

PLANNING DEPARTMENT CONDITrONS
1. The final binding site plan be designed substantially in conformance with the preliminary
binding site plan of record as legally described and advertised. No increase in the number of lots shaU occur without a change of condition application submittal and approval.
However, the final binding site plan shall be flexible within the terms of the conditions of
approval, and lot lines may be adjusted in a manner prescribed by procedures established
r by the Planning Depardment.
2. The Planning Department shall review/approve any proposed final binding site plans to
insure compliance with the conditions of approval.
3. The preliminary binding site plan is given conditional approval for three (3) years, to
August 1, 1995. The applicant may request an extension of time by subnutting a written
request at least forty-five (45) days prior to the above expiration date.
4. A final bind.ing site plan number shall be approved before the final binding site plan is filed,
such number to be approved by the County Planning Director/Designee. Phasing of the
final binding site plan shall be allowed if appropriate improvements and intent of this
approval is met, as deternuned by the Planning Director and reviewing agencies.
5. Appropriate road names shall be indicated on the final binding site plan.
6. Appropriate utility easements shall be indicated on copies of the proposed final binding site
plan. Written approval of utility easements by utility companies must be received prior to
approval of final binding site plan(s).
7. Three current certificates of title shall be furnished the County Planning Deparnnent prior co
filing the final binding site plan.
8. The following statement be placed in the final binding site plan dedication: "No lot shall be
further subd.ivided for the purpose of creating additional lots, ownerships or leased parcels
without first filing a replat or altering the final binding site plan."
9. The final binding site plan map shall indicate by a dashed line the required setbacks from all
private, Tract X or public roads. The dedication shall contain the following statement:
"Side yard and rear yaxd setbacks shall be determined at the time building permits are
requested, except that some judgements may be made on this final binding site plan

document as to side or rear yard status. The setbacks indicated on this subdivision may be
varied from if proper zoning or variance approvals are obtained." See Arterial Road Plan
Section for special setbacks related to arterial roads.
10. A p1FLn for water facilities adequate for domestic service and fire protection be approved by
the v-ater supplier, fire protection district, Spokane County Build.ing & Safery Department
and county health authorities. The agencies will certify on the WATER PLAN, prior to the
filing of the final bind.ing site plan or any phase of the preliminary binding site plan, that the
plan is in conformance with their respective needs and regulations. The WATER PLAN
and certification will be drafted on a transparency suitable for reproduction and be signed
by the sponsor.
1 1. The purveyor will also certify on the Water Plan that. appropriate contractual arrangements
and schedule of improvements have been made with the sponsor for consa-uction of the
water system in accordance with the approved WATER PLAN. The time schedule for
improvements will provide for completion of the water system and inspection by the
appropriate health authorities prior to application for building permits within the final
binding site plan. The arrangements or agreements will include a provision holding
Spokane County and the purveyor ha.rrnless from claims by any lot purchaser refused a
build.ing permit due to the failure of the sponsor to satisfactori.ly complete the approved
water system. '
12. The final binding site plan dedication will contain the following statement: "The public
water system, pursuant the WATER PLAN approved by County and State Health
authorities, the local fire district, County Building & Safety Department, and water
purveyor, will be installed within this Binding Site Plan, and the subdivider/sponsor will
provide for ind.ividual domesric water service as well as fire protection to each lot prior to
sale of each lot and prior to issuance of a building permit for each lot."
13. No building permit will be issued for any lot within the final binding site plan until certifiecl
by a Washington state-licensed engineer that "the water system has been installed pursuant
to the approved WAT'ER PLAN for the final binding site plan," signed and stamped by
said engineer. The certif~ication may be in the form of a letter, but is preferred to be
certified on a copy of the WATER PLAN as a schematic map showing the "as-built" water
system.
14. A survey is required prior to the filing of a final binding site plan.
15. The final binding site plan shall comply with Sections 8.030, 8.050 and 8.055 of the
Binding Site Plan chapter of the Subdivision Ordinance.
r 16. No certificate of occupancy pernlit or use of the parcel or lease area(s) being created by the
final binding site plan shall be issued or allowed until a11 necessary improvements and
requirements as specified by this decision and this binding site plan chapter have been
satisfied. .
17. Any future development on the subject site will comply with the Light Industrial (I-2) zone
as amended. .
a. A landscaping plan for the site perimeter along Montgomery Drive and rackson
Avenue sha11 be submitted and approved by the Planning Department prior to
finalization of the final binding site plan. The landscape plan should utilize as many
existing trees as possible and provide screening and buffering to Montgomery Drive
and Jackson Avenue and the 35 foot setback areas can be included in this landscape .

18. Prior to final binding site plan approval the sponsor shall provide the Planning Department
with a copy (auditor stamped) of "Restrictive Covenants" which includes acceptable

Counry enforceable restrictions/condirions exist and run with the property, which
restrictions provide, but are not limited to:
a. Required maintenance and/or replacement of landscape plants of the approved
landscaping plan;
b. Screening of exisring or future truck/loading docks, rruck/heavy equipment parking
(exterior storage of same is prohibited) including temporary storage, except as
provided for in the Planning Department's Condition #18-e., below;

c. All on-site manufacturing or industrial activities (including temporary activities) that do
not conform to the Aestheac Comdor policies, shall be located wichin building(s),
except as may be provided in the Planning Department's Conditions of Approval;
d. Any restrictive covenant shall be binding and enforceable by Spokane Counry at its
d.iscretion and perpetually run with the title(s) of the property except when
extinguished by Spokane County (an extinguishing statement shall be included in said
covenants);
e. Temporary storage, building truck docks, truck load.ing, truck or heavy equipment
parking and storage areas shall be screened from view of the freeway and the proposed
collector arterial by buildi.ngs, berms with landscaping including evergreen E-ees or •
fencing and that said screening shall be to a height that effectively screens the above
and shall be maintained to provide a campus-like appearance at all rimes; and
f. Conrrol the use and storage of potentially hazardous materials for the entire site.
19. The Spokane County Planning Department shall prepare and record with the Spokane
County Auditor a"Title Notice" notzng that the property in question is subject to a variety
of special conditions imposed as a result of approval of a land use action. This "Title
Nodce" shall serve as official public notice regarding conditions of approval affecting the
prc,perty in question. The "Title Notice" shall be recorded within fifteen (15) days of final
disposition of the approved land use action and shall only be extinguished by the Spokane
County Planning Deparmzent. The "Title Notice" shall generally provide as follows:
The parcel of property legally described as (legal description and tax parcel
number) is the subject of a land use action, imposing a variety of special
development conditions, by a Spokane County Hearing Body or
Administrative Official on (date) and as maybe amended, altered or
supplemented by official action or as aIready changed. File No. (Planning
Department File Number) is available for inspection and copying in the
Spokane County Planning Department.
20. The Spokane County Planning Department shall prepare and record with the County
Auditor a Title Nouce specifying a future land acquisition area for road right-of-way and
utilities. The reserved future acquisition area Title Notice shall be released, in full or in
pan, by the Planning Department. The notice should be recorded within the same time
frame as an appeaj and sha11 provide the following:
a. At least 8 feet of reserved future acquisirion area for road right-of-way and utilities, in
addition to the exisang and/or newly ded.icated right-of-way along Montgomery
Avenue. NOTE: The County Engineer has required dedication of 2 feet on both the
nonh and south Montgomery Avenue frontages, where applicable, of additional right
of way along Montgomery Avenue which shall equal 64 feet.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be meastu-ed from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be
located within the future acquisition area for road right-of-way and utiliries. If any of
the above improvements are made within this area, they shall be relocated at the
applicant's expense when roadway improvements are made.
d. The future acquisidon area, until acquired, shall be private property and may be used
as allowed in the zone, except-that any improvements (such as landscaping, parking,
surface drainage, drainfield, signs or others) shall be considered interim uses.
e. The property owner shall be responsible for relocating such "interim" improvements
at the cime Spokane County makes roadway improvements after acquiring said future
acquisition area.
CO UNTY ENGINEER'S CONDITIONS
1. The conditional approval of the binding site plan is given by the County Engineer subject to
dedicarion of right-of-way and approval of the road system as indicated in the preliminary
binding site plan of record.
2. Plans, profiles, and cross-sections as designed to County standards showing proposed
sa-eet centerline and curb grades shall be submitted to the County Engineer for approval
pnor to construction and/or the filing of each final binding site plan; road plans to be '
prepared under the direcdon of a licensed Professional Civil Engineer.

3. Drainage plans and design calculations showing [he alignment of drainage facilities shall be
submitted to the County Engineer for approval prior to construction and/or the filing of the
final ~inding site plan. I?ra.inage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
4. Conscruction within the proposed public streets and easemeiits shall be performed under the
direct supervision of a licensed engineer/surveyor, who shall furnish the County Engineer
with "as-built" plans and a certificate in writing that a11 improvements were installed to the
lines and grades shown on the approved construction plans and that all disturbed
monuments have been replaced.
5. No construction work is to be performed within the existing or proposed public right-of-
way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
6. All construction within the existing or proposed public right-of-way is to be completed
prior to filing each final binding site plan, or a bond in the amount estimated by the County
Engineer to cover thE: cost of constr-uction of improvements, construction certification, "as-
builc" plans and monumendng the street centerlines shall be filed with the County Eng-ineer.
7. Individual driveway access pemuts are required prior to issuance of a building permit for
driveway approaches to the county road system.
8. Dedicarion of 2 feet on both the north and south Montgomery Avenue frontage, where
applicable, of additional right-of-way along Montgomery Avenue which shall equa164 feet,
is required.
9. Existing county roads providing d.irect access to the binding site plan shall be paved and/or
curbed to Spokane County standards.
10. Sidewall:s are required along the arterial(s) on Montgomery Avenue.
1 The word "applicant" shall include the owner or owners of the property, his heirs, assigns
and successors.
12. The County Engineer has designated Typical Roadway Section Number One, Local Access
standard for the improvement of Jackson Avenue, which is adjacent to the proposed
development. This will require the addition of varying amount of asphalt along the
frontage of the development. The construction of curbing and sidewalk is also required.
13. The County Engineer has designated Typical Roadway Section Number One, Local Access
r scandard for'the improvement of Bowdish Road, which is adjacent to the proposed
development. This will require the addition of approximately 32 feet of asphalt along the
frontage of the development. The constrtiction of curbing and sidewalk is also required.
14. The proposed private road(s) as shown on the binding site plan serving less than 8 lots
each, is approved by the County Engineer.
15. Privace road(s) shall be improved to Spokane County standard for a private road
Urbari/Suburban standard serving 8 or less lots each, and are subject to approval under
Seccion 10.207 of the Spokane CQunty Fire Code.
16. All vested owners shall sign and record private road documents as prescribed by the
Spokane County Engineer. These documents shall be reviewed and approved by the
Spokaiie County Engineer prior to recording with the Spokane County Auditor. Recording
ilUR1bC°s shall be re;erenced in the dedicatory language of the binding site plan.
17. The following stateinent shall be placed in the bind.ing site plan dedication:
"WARNING: Spokane County has no responsibility to build, improve, maintain or
otherwise service the private roads contained within or provide service to the property
described in this binding site plan. By accepting this binding site plan or subsequently by
allowing a building pernut to be issued on property on a private road, Spokane County
assumes no obligation for said private road, and the owners hereby acknowledge that the
County has no obligation of any kind or nature whatsoever to establish, examine, survey,
construct, alter, repair, improve, maintain or provide drainage or snow removal on a
private road. This requirement is and shall run with the land and shall be binding upon,the
owner(s), their heirs, successors or assigns, including the obligation to participate in the
maintenance of the private road as provided herein."

18. The proposed subdivision shal.l be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 80-1592, as amended, which resolution
escablishes regulations for roads, approaches, drainage and fees in new construction.
19. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the exisring county road system warrants the ded.icarion of
additional right-of-way and the roadway improvements herein specified.
20. The following statement shall be, placed in the final binding site plan dedication: "The
private road as shown hereon is an easement which provides a means of ingress and egress
for those lots within t tie su bdivision having frontage thereon."
21. The Counry Arterial Road Plan identifies Montgomery Avenue as a Minor arterial. The
exiscing right-of-way width of 60 feet is not consistent with that specified in the Plan. In
order to implement the Arterial Road Plan, in addition to the required right-of-way
de~dication, a strip of property 8 feet in width along the Montgomery Avenue frontage shall
be set aside in reserve. This property may be acquired by Spokane County at the time
when arcerial improvements are made to Montgomery Avenue.
22. There may exist uriliees, either underground or overhead, affecting the subject property,
including property to be dedicated or set aside for future acquisition. Spokane County
assumes no financial obligation for adjustments or relocarion regarding these utilities.
Applicant(s) should check with the applicable utility purveyor and the Spokane County
Eng7neer to determine whether applicant(s) or the utility is responsible for adjustinent or
rela;;ation costs and to make arrangements for any necessary work.
23. Applicant shall demonstrate to the satisfacaon of the County Engineer that safe
sight/stopping distance can be met at the private roads and Montgomery Avenue
intersections.
24. Drivev/ays to individ«al lots shall also meet applicable site/stopping distance criteria.
CDUNTY HEALTH DISTRICT CONDZ"rYONS
1. The final binding site plan shall be designed as indicated on the preliminary binding site
plan of record and/or any attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary binding site
plan of record for disa-ibution by the Planning Department to the utility companies,
Spokane County Engineer and the Spokane County Health District. Written approval of
10 the easements by the utility companies must be received prior to the submittal of the final
binding site plan.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County. .
4. Water service shall bc; coordinated through the Director of Ualities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the Regional
Eng-ineer (Spokane), State Depanment oC Health.
6. Prior to filing the final binding site plan, the sponsor shall demonstrate to the satisfaceon of
the Spo~kane County Health District that an adequate and potable water supply is available
to eac}~ lot of the binding site plan.
7. Prior to filing the final binding site plan, the sponsor shall present evidence that the binding
site plan lies within the recorded service area of the water system proposed to serve the
binding site plan.
8. A plan for water facilities adequate for domesric use, domestic irrigation use and fue
protection use shall be approved by the water purveyor. Said water plan must have been
approved by the fue protection district and the appropriate health authorities. The health
authorities, water supplier (purveyor) and the fire protection district will certify, prior to the
filing of the final bind.ing site plan, on the face of said water plan that the plan is in
confornlance with their requirements and will adequately satisfy their respective needs.
Said water plan and certification will be drafted on a transparency suitable for reproduction.
9. The purveyor will also certify prior to filing the final binding site plan on a copy of said
wacc r plan that appropriate contractual arrangements have been made with the binding site
plan sponsor for construction of the water system, in accordance with the approved plan
and time schedule. The time schedule will provide, in any case, for completion of the

10. A public sewer system will be made available for the binding site plan/project, and
individual service will be provided to each lot/tract prior to sale. Use of individual on-site
sewage disposal systems shall not be authorized.
11. A stacement shall be placed in the dedicarion to the effect that: "A public sewer system will
be made available for the binding site plan, and individual service will be provided to each
lot 1-: ior to sale. Use of ind.ividual on-site sewage disposal systems shall not be
aucnorized."
12. The deciicatory lanvuage on the binding site plan shall state: "Use of private wells and
water systems is prohibited."
13. The final binding site plan dedication shall contain a statement to the effect that: "The
public water system, pursuant to the Water plan approved by county and state health
authorities, the local fire district, County Building and Safety and water purveyor, sha11 be
installed within this binding site plan, and the subdivider shall provide for individual
dornestic water service as well as fire protection to each lot prior to sale of each lot and
prior to issuance of a building permit for each lot."
COUNTY UTILIT'IES DEPARTMENT
1. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amendcd.
2. Applicant shall make connection to public sewer system. Sewer connection permic is
required. Plans and specifications are to be reviewed and approved by the Utilities
Depar-.ment.

excavation projects be controlled. This may require use of water sprays, tarps, sprinklers
or suspension of activity during certa.in weather conditions. Haul roads should be treated,
and emissions from the transfer of earthen material must be controlled, as well as emissions
from all other construction-related activities.
3. Measures must be taken to.avoid the deposition of oirt and mud from unpaved surfaces
onto paved surfaces. If tracking or spills occur on paved surfaces, measures musc be ta.ken
immediately to clean these surfaces.
4. All debris that results from this project must be disposed of by means other than open
burning.
5. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved and kept
clean.
6. SCAPCA Regulation I Section 6.04 addresses odors and nuisances. Effecave control
apparatus and meastires must be taken to reduce odors being emitted to a reasonable
minii-num.
