The following information must be provided in order for us to proceed with our review. A) For any new hard surface area, for an asphaltic roof, or a roof containing HVAC machinery, a drainage plan for the site shall be prepared in compliance with Spokane County "Guidelines for Stormwater Management". At a minimum the plan must contain: 1. Drainage calculations for stormwater volumes generated on site. 2. Calculations for total impervious surfaces contained within the site. 3. Finished grade elevations for structures to be constructed on site. 4. Finished grade elevations at the top and bottom of the 208 swale. 5. A typical cross section of the 208 swale. 6. Calculations to justify the number and type of drywells proposed. 7. Elevation of drywell inlets where applicable. 8. Copy of the proposed landscape plan. B) The subject property is affected by the "Findings and Order" and the "Conditions of Approval" for the following land use action: Spokane County Zone Change No. ZE-50A-72 Binding Site Plan No. BSP-32-92 C) The following improvements within adjacent Right of Way are required prior to the release of a building permit: 1. Approach permits must be obtained, after a site plan has been approved, and before the issuance of a building permit, from the County Engineering Department for any new or improved driveway approaches to the following streets: a. Montgomery Avenue D) Insufficient information was submitted with the proposal. We are unable to proceed with our review. We will need the following before we can proceed: 1. Site Plan. • 2. Drainage plan as specified. 3. Other information: . ~ Page 2 a. A parking and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arranqement of parking stalls shall be in accordance with standard traffic engineering practices. Paving as required by the County Planning Ordinance, will be required for any portion of the project which is to be occupied or traveled by vehicles. b. The County Arterial Road Plan identifies Montgomery Avenue as a Minor arterial. The existing right-of-way . width of 60 feet is not consistent with that specif ied in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way dedication, a strip of property 8 feet in width along the Montgomery Avenue frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time arterial improvements are made to Montgomery Avenue. c. Applicant shall demonstrate to the satisfaction of the County Engineer that driveways to individual lots shall meet applicable safe site/stopping distance criteria. F) Utility Condition: Permittee is responsible for arranging for all necessary utility adjustments or relocation as required for completion of the improvement. G) The owner of the property or the authorized representative must complete and sign Spokane County Engineers "Agreement to Pay Fees". This document must be returned to the County Engineers Off ice. Plan review will not be completed until this document is executed. This document is attached to these comments. Please return the completed Agreement to your contact person at the Engineers Department. Only after all the information and requirements listed above are supplied or completed and the necessary review has been accomplished will your building permit be released. CONCLUSIONS AND ORDE$ INTRODUCTION This matter has come before the Hearing Examiner Committee on May 23, 1991. The members of the Committee present are Verona Southern, Chairperson, Bud Skadan and Harry Gibbons. 'PROPOSAL The sponsor, Super Value Stores, requests approval of a Change of Conditions File No. ZE-50A-72 to remove existing 20 foot high landscaping berm and replace with a new landscaping plan. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located south of Montgomery Drive between the railroad right of way and Montgomery Drive and east of University Road, in the NW 1/4 and the SW 1/4 of Section 9, Township 25 N., Range 44 EWM, Spokane Counry, Washington. 2. The committee adopts the Planning Department Report as a part of this record. 3. The existing land use(s) in the area are industrial and residential. 4. The Comprehensive Plan designates this site as Industrial. The Industrial category is for the purpose of industrial development and reserve land for industrial purposes. 5. The Arterial Road Plan designates Montgomery Drive as a Major Arterial, with a recommended right of way width of 80 feet, and also designates University Road as a Principal Arterial, with a recommended right of way width of 100 feet. 6. The existing zoning of the property described in the application is Light Industrial (I-2) previously established in 1991. The property was zoned Restricted Industrial (RI) prior to the implementation of the Spokane County Zoning Code on January l, 1991. 7. The provisions of RCW 43.21C ('I'he State Environmental Policy Act) have been complied with and a Determination of Nonsignificance was issued. 8. The legal requirements for public notice have been fulfilled. 9. The owners of adjacent lands expressed neither approval nor disapproval of the proposed use. 10. The proposed change of conditions is comparible with existing uses in the area. 11. The applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed change of condirions is justified. - 13. The proposed use will not be detrimental to the public health, safety, morals or welfare. 14. The Committee additionally finds/concludes: a. The proposed changes will improve the aesthetics of the surrounding area and not detract from the original intent to buffer the adjacent residential uses. b. The owners of the property are commended by their effort to improve their property which will reflect on the local community and surrounding neighborhood. c. The owners request to a11ow phasing of the project over a 3-8 year is reasonable considering the volume of soil and size of the existing berm. d. Approval of the proposed landscaping plan allows the property owner to install i.mprovements as generally shown on his plan based on a 3-8 year phasing. It is understood that once the project commences it will be completed on a schedule submitted by the owner. If the owner chooses not to install the new landscaping plan the original berm and associated landscaping shall remain. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL . 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The following Conditions of Approval apply to the real property described below: HEARING EXAMINER COMMITTEE 1. The Hearing Examiner Committee replaces Planning Department Condition No. 4 with the following: The owner/applicant shall install the proposed landscaping generally in accord with the plan submitted to the Hearing Examiner Comm.ittee. Variarions in the timing, type, and location of improvements shall be approved by the Director or his designee. In addition the owner/applicant shall: a) Install the improvements over a 3-8 year phasing period. The.phasing period begins upon initial application to the Planning Department for commencement of the project. b) Prior to installation of the proposed landscaping, the owner/applicant shall submit detailed landscape plans and a schedule for completion of the entire project or phase for Planning Department Department review . The phasing schedule is not required until the owner/applicant chooses to begin the project. a . ~ . ~ H EC Order for ZE-50A-72 Page 3 . . c) If the existing berm is removed without phasing, the landscaping shall be installeri or, if partially installed an appropriate guarantee shall be provided for the remainder ' of the required landscaping. d) Should the original berm be removed in phases the landscaping for each phase shal.l be installed as per the approved plan with a Planning Departinent approved . installarion schedule or with an appropriate guarantee. At no time shall add.itional phases begin until previous phases have been completed. e) If the owner chooses not to install the new landscaping as approved by Hearing Examiner Committee the original berm and landscaping shall remain. SPOKANE COUNTY PLANNING DEPARTMENT 1. All condirions imposed by the Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Light Industrial (I-2) zone(s) as amended. . 3. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or . impaired. 4. Should the original berm be removed in phases, landscaping per the site plan . submitted with this proposal shall be completed within 90 days or as weather pernuts as determi.ned by the Planning Director. NOTE: This condition was replaced by Hearing Examiner Committee Condition No. 1. 5. The Planning Deparnnent shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. T'his Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. The Tit1e Notice shall generally provide as follows: . The Spokane County Planning Department shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Planning Department. At least 10 feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing and/or newly dedicated right-of-way along Montgomery Drive. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisirion area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocateti at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. 7. The applicant shall develop subject property generally in accordance wnthin the concept presented to the Hearing Body. Variations, when approved by the Planning Director/designee, may be pernutted, including, but not limited to building . location, landscape plans and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Code, and the original intent of the development plans shall be maintained SPOKANE COUNTY, ENGINEER'S OFFICE Prior To The Issuance Of A Building Permit Or Use Of The Propertv As Proposed: 1. Access permiLs for approaches to the county road system shall be obtained from the Spokane County Engineer. 2. The applicant shall submit for approval by the Spokane County Engineer drainage plans for any areas affected by the alteration of the original Landscaping and Development site plan. 3. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project, or portion thereof, if the development is to be phased. 4. A parlang plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parlang stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. s • , H EC Order for ZE-50A-72 Page 5 . 5. Roadway standards, typical roadway secrions and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80-1592 as amenderi and are applicable to this proposal. 6. This subdivision or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's off'ice as having stormwater . runoff problems. Since this plat or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as rnay be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operarion of stormwater control facilities." 7. No construcrion work shall be performed within the existing or proposed public right-of-way until a pernut has been issued by the County Engineer. All work within the public road right-of-way is subject to inspection and approval by the County Engineer. 8. The County Arterial Road Plan identifies Montgomery Drive as a Minor Arterial arterial. The existing right-of-way width of 60 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way ded.ication, a strip of property 10 fe,et in width along the Montgomery Drive frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial unprovements are made to Montgomery Drive. g. The County Arterio Road Plan idenrifies University Road as a Principal arterial. - The existing right-of-way width of 60 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required - right-of-way dedication, a strip of property 10 feet in width along the University Road frontage shall be set aside in reserve. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regard.ing these utiliries. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to detemzine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 11. The Applicant shall demonstrate to the satisfaction of the County Engineer that a safe site distance can be provided for on Montgomery Drive. 12. The Health District has no comment on the change of conditions other than to state that George Schlender, Department of Health, should be contacted to see if change in landscaping would affect their permitted on-site sewage disposal system. . SPOKANE COUNTY BUILDING AND SAFETY DEPARTMENT 1. The applicant shall contact the Department of Building and Safety at the earliest possible stage of design/development in order to be informed of code requirements administered/enforced by the departrnent, e.g., State Building Code Act regulations, such as requirements for fire hydrantJflow, fire apparatus access roads, street address assignment, barrier-free regulations, energy code regulations and general coordinarion with other aspects of project implementation. 2. Requirements of Fire District No. 1 need to be satisfied during the building permit process. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY . 1. Air pollution regulations require that dust emissions during demolition, construction and excavarion projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads . should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construction-related activities. 2. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved . and kept clean. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. SCAPCA Regulation I, Article V, requires that a Notice of Construction and Application for Approval be submitted to and approved by our agency prior to the construction, installarion or establishment of an air pollution source. 4. Solid fuel heating device(s) shall meet provisions of SCAPCA Regulation I, Article VIII. 5. Debris generated as a result of this project must be disposed of by means other than burning (ie. construction waste, etc.) • ~ ' • ' . . The WATER PLAN and certiication wi11 be drafted on a transparency suitable for reproduction and be signed by the sponsor. 11. The purveyor will also certify on the Water Plan that appropriate contractual arrangemenls and schedule of improvernents have been made with the sponsor for construction of the water system in accordance widl the approved WATER PLAN. The time schedule for iznprovements will provide for completion of the water systerv and inspection by the appropriate health authorities prior to application for building perrnits within the final binding site plan. The arrangements or agreements will include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building pemut due to the failure of the sponsor to satisfactorily complete the approved water system. ' 12. The final binding site plan dedication will contain the following statement: "The public water system, pursuant the WATER PLAN approved by County and State Health authorities, the local fire district, County Building & Safety Department, and water purveyor, will be installed within this Binding Site Plan, and the subdivider/sponsor will provide for individual domestic water service as well as fire protection to each lot prior to sale of each ]ot and prior to issuance of a building permit for each lot." 13. No building permit will be issueri for any lot within the final binding site plan until certified by a Washington state-licensed engineer t}hat "the water system has been installed pursuant to the approved. The centerline of the driveway is at Montgomery _urive station l 22+28 so ttle driver of the merging vehicle is at about station 122+30 of Nrontgomery Drive, 38 feet left of centerline (based on PT 120+23.5). 2. Driver's eye is 16 feet behind the gutterline of Montgomery Drive. The gutrerline is 22 feet right, so the driver's eye is 38 feet £rom the centerline of Montgomery. . 3. Driver's eye assumed to be 3.5 feet above finislied grade, which is approximately 100.0, thus the eye elevation is 100.0 + 3.5 = 103.5. - 4.
