BSP-32-92 ) FINDINGS OF FACT, TED GUNNING/NORTHWOOD ) CONCLUSIONS AND PROPERTIES } DECISION THIS MA1'I'ER, an application from Ted Gunning/Northwood Properties has n received and decided upon, pursuant to Spokane County Subdivision regulations, on the - ~day of July, 1992. The individual signing below has been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. FYNDINGS OF FACT AND CONCLUSIONS 1. The proposal is to divide 22.2 acres into 19 lots for the development of industrial use lots. 2. The proposal is located in the Spokane Valley, south of and adjacent to Jackson Avenue and north of and adjacent to the B.N.R.R., 2200 feet east of University Road in Section 9, Township 25 North, Range 44 EWM., Spokane County, Washington. 3. The current zoning:of theproperty is Light Industrial (I-2). The proposed lot sizes, frontage and intended uses are allowed within this zone. The property is also covered by the Airport Overlay Zone, and is within the Conical Area (CA), which has specific land use limitations for the property. 4. The Spokane County Comprehensive Plan designates this area as Industrial. The development and uses proposed are generally in accord with this planning category. The proposal as submitted with its environmental checklist and proposed mitigating measures will effectively accomplish the intent of the Comprehensive Plan. The Transportation Section of the Comprehensive Plan, in the.Arterial Road Plan, indicates a need to plan for Montgomery Avenue as a Minor Artenal. The review by the County Engineers indicates dedication of roadway(s) is needed now, while the Comprehensive Plan indicates the need for add.itional future right-of-way, with structure and improvement setbacks from the future right-of-way widths. 5. The required notice was provided for this proposal and no one in the area commented upon the proposal. Agencies having a potential interest in the project were notified and their conditions are contained hereinafter. 6. With the recommended conditions of approval and Spokane County development standards, the proposal: is not detrimental to the public health, safety and general welfare; implements the underlying zoning as well a.s the Comprehensive Plan; and complies with the adopted Binding Site Plan Chapter 4 of the County's Subdivision Regulations, Board of County Commissioners Resolution 89-0511. . 7. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Rule ('VVAC 197-11) and the Spokane Environmental Ordinance, a Deternunation of Nonsignificance has been issued at least fifteen (15) days prior to this date. The Determination of Nonsignificance was issued and circulated to eight agencies and no comments as to the proposal's likely significant adverse impacts were received. DECISION Based upon the above Findings of Fact and Conclusions, Preliminary Binding Site Plan BSP-32-92 is hereby APPROVED, subject to the following conditions, which shall be complied with by the applicant, sponsor and/or successors in interest prior to finalization of all or a portion of the Binding Site Plan. This approval is granted until August l, 1995, at which time an extension of time may be granted pending receipt of a qualifying request. CONDrTIONS OF APPROVAL 1. Dear Chris: $ ~~terio~ We certainly appreciate your timeiy review of our plans. 55 ~~s► Listed below is our response to each of the comments listed in your n~d 104 plan review comments dated 9/1/93 : unc~ A-1 1. We have asked the developer to prepare the necessary Certificate of Exemption to aggregate the three parcels. 2. The site connects to Montgomery Drive with (2) 35' wide County Standard Urban Driveways. The developer has washi~t11 been asked to take out the necessary approach permits. 3. The swale areas have been coordinated on a11 plans. 4. The combined length of the southern boundaries of the 3 parcels being developed is 693.24' and the appropriate change has been made to A-1. ~t•16~ 5. The 50' turn-around was requested by Paul Chase, of Fire District #1 during the Pre-Application conference of 1/20/93. He indicated it needs to have a gravel FN~ surface as lndicated on A-1. A- 2 1. We are providing a separate, colored plan showing the drainage basins. This plan is a copy of the plan within each set of drawings but it has been colored to more clearly indicate the drainage basins. The roof drainage calculations were derived from the 1991 Uniform Plumbing Code, Appendix D, 3" rainfall. This may require the use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. Al1 travelled surfaces (i.e., ingress, egress, parking areas, access roads) should be paved and kept clean. * Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or , spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. . y SGAPCA Regulation I, Article V requires that a Notice of Construction and Application for Approval be submitted to and approved by our Agency prior to the construction, installationor establishment of an air pollution source. * Debris generated as a result" of this proj ect must be disposed of by means other than burning (i.e., construction waste, etc. ) . cc: Ken Spilker ~ ~.v% ori+tccl on RecyC►ed Paper HAHN ENGINEERING, INC.
