The County Engineering Department has completed a review of
the above referenced project. The followinq information must be
provided in order for us to proceed with aur review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containinq HVAC machinery, a drainage plan
for the site shall be prepared in campliance with
Spokane County "Gufdelines for Sta=water Manageiaent". At
a minimum the plan must contain:
1. Drainage calaulations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations far structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of tbe 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected hy the "Findings and
Order" and the "Conditions of Approval" for the followinq
land use action:
Binding Site Plan No. 86-15
1. Approach permits must be obtained, after a site
plan has been approved, and before the issuance of
a building permit, from the County Engineering
Department for any new or iaproved driveway
approaches to the followinq streets:
a. Locust
C) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Site Plan.
2. Drainaqe plan as specified.
3. Other information:
a. A parking and traffic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parkinq stalls shall be in
accordance with standard traffic engineering practices. Paving as

required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles. It is illeqal to back out onto the Right of Way.
D) Utility Condition: Permittee is responsible for arranginq
for all necessary utility adjustments or relocation as
required for completion of the improvement.
E) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this docwaent is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.

THIS MATTER, an application from Max Spalding has been received and
decided upon, pursuant to Spokane County Blnding Site Plan policies and R.C.W.
58.17.020 (7) on the 1 st day of July, 1966.
The indlvidual signing below has further been properly delegated the
responsi bi 1 i ty for renderi ng the deci si on by the Spokane County Di rector of
P18nning. '
FINDINGS OF FACT AND CONCLUSION
1. The proposal is to divide approximately 21.2 acres into 18 lots for the
devel opment of 1 ndustri al si tes.
2. The proposal is located north of and acjacent to Montgomery Drive and
west of and adJacent to woodruff Road in Section 8, Township 25N, Range
44 E,M.M., Spokane County, Mashington.
3. The current zoning of the property is Restrlcted Industrial. The
proposed lot sizes, frontage and intended uses are allowed within this
zone.
4. The Spokane County Comprehensive P1an designates this area as
Industrial. The density and uses proposed are in accord with this
planning category.
5. That in consideration of the recomnended condltions and Spokane County
development standards, the proposal 1s not detrlmental to the public
heatth, safety and general welfare.
6. That the project is not exempt fram environmental review under the State
Environmental Polfcy Act.
(A Declaraton of Non-Significance was issued on June 3, 1966 and
circulated to 4 agencies for review and comment. There has not been a
recommendation for a more detailed environmental review).
7. That individual review of building locations and other requirements will
be established Mhen building permits are sought for on the individual
1 ots.
DECISION
Based upon the above noted Findings of Fact, Short P1at Application
6SP-15-86 is hereby APPROYED subject to conditions Nh1ch shall be complied
K1th by the appllcant and/or sponsor prior to finalization.

CONDITIONS OF APPROYAL FOR 8SP-15-86
PLANNING DEPARTMENT
1. That the preliminary Binding Site Plan be given conditional approval to
Jul y 1, 1989. The Subdi vi sion Admi ni strator may admi nistrativel y
approve a request for a one year extension of time if the sponsor
submits a written request forty-five (45) days prlor to the above
expiration date. A request for an Extension of Time may subject the
proposal to ner conditions required by reviewing agencies.
2. That the 8lnding Site Plan be designed as indicated on the preliminary
drawing of record and/or attached sheets as noted.
3. That the btnding site plan provide for right-of-way width for streets as
i ndi cated on tNe prel iminary Bi ndi ng Si te P1 an of record.
4. That appropriate street names be indicated.
5. That appropriate utility easements be lndicated on copies of the
approved binding site plan for distribution to the Planning Department
and the uti 1 i ty compani es . Wri tten approval of the easements by the
utllity company must be received prlor to the submittal of the final
binding site plan.
6. That a certificate of title be furnished the Planning Department prior
to the flling of the final binding site plan.
7. That the provisions of SEPA'S NOTICE OF ACTION pursuant to Chapter
43.21C.080 RCW and the Board of County Commissioners Resolution #77-1392
be accomplished by the project applicant within thirty (30) days of
formal action by the Administrator on or before the filing of the final
binding site plan, as lnstructed by the P1anning Department.
8. That a survey be required prlor to the filing of a final Binding Site
P1 an.
9. That individual parking, landscaping and other site improvements
required by the Spokane County Zoning regulations will be established
when development requests are made for the individual lots.
10. That a plan for water facilities adequate for domestic service and fire
protection be approved by the water supplier, fire protection district,
Spokane County Building b Safety Department and County health
authori t1 es. The agenci es wi 11 certi fy on the WATER PLAN, prior to the
filing of the final Binding Site Plan or any phase that the plan 1s in
conformance with thelr respective needs and regulations. The WATER PLAN
and certlficatlon will be drafted on a transparency suitable for
reproduction.
The purveyor wi11 also certify that appropriate contractual arrangements
and schedule of improvements have been made with the sponsor for
construction of the Nater system in accordance with the approved NATER
PLAN. The tlme schedule will provlde for completion of the water system
and inspection by the appropriate health authorities prlor to
application for building permits wlthin the final binding site plan.
The arrangements or agreements w111 include a provision holding Spokane
County and the purveyor harmless from claims by any lot purchaser
refused a bui 1 di ng perni t due to the fai 1 ure of the sponsor to
satisfactorily complete the approved Mater system.
The sponsor shall also sign the WATER PIAN to conftrm the contractual
arrangements or agreements.
The f i nal bi ndi ng site pl an dedi cati on wi 11 contai n the fol l owi ng
statement: pThe public water system, pursuant the WATER PLAN approved
by County and State Health authorities, the local fire distrlct, County
Building b Safety Department, and water purveyor, will be installed
within this binding site plan, and the sponsor will provide for
individual domestic water service as we11 as fire protection to each lot
prlor to sale of each lot and prior to issuance of a building permit for
each 1ot."

11. That no building permlt will be issued for any lot within the Binding
S1te P1an until certified by a washington State licensed englneer "that
the water system has been installed pursuant the approved WATER PLAN for
the 8inding Site Plan", signed and stamped by sald engineer. The
certi f i cati on may be i n the farm of a 1 etter but i s preferred to be
certified on a copy of the WATER PLAN as a schematic map showing the "As
Bu11 t" water system.
SPOKANE COUNTY ENGINEER DEPARTMENT
1. Applicant shall deed to Spokane County suffient right-of-way so as to
permit the construction of the cul-de-sac turn around depicted on the
preliminary plan at the terminus of Locust Road. Applicant shall also
deed a 20 ft, radius at Montgomery and woodruff.
2. That plans, profiles, and cross-sections as designed to County standards
showing proposed street centerline and curb grades be submitted to the
County Engineer for approval prior to construction and/or the filing of
each final plat; road plans to be prepared under the direction of a
licensed Professional Civil Engineer.
3. That drainage plans and design calculatlons showing the aligmnent of
drainage facilities be submitted to the County Engineer for approval
prior to construction and/or the filing of each final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Ci vi 1 Eng1 neer.
4. That road and drainage plans sha11 be submitted for review and approval
by the County Engineer for the roadway improvements which have been
specified for Montgomery Dr1ve, Woodruff Road and Locust Road and the
proposed private road.
5. That the private road as depicted on the preliminary site plan is
approved by the County Engineer. It shall be designated as a°Tract X"
future publ ic right-of-way tract.
6. That the following statement be placed on the face of the Binding Site
P1an:
wARNIN6:Spokane County has no responsibility to build, improve,
maintain, or otherwise service the private roads contained within or
providing service to the property described in this plat. 6y accepting
this plat or subsequently by allowing a bullding permit to be issued on
property on a private road, Spokane County assumes no obligation for
said private road and the owners hereby acknowledge that the County has
no obligation of any kind or nature Nhatsoever to establish, examine,
survey, construct, alter, repair, lmprove, maintain, provide drainage or
snow removal on a private road. This requirement is and shall run with
the land and shal) be binding upon the owner, their heirs, successors or
assigns including the obligation to participate in the maintenance of
the private road as provided herein.
7. That the applicant shall provide to Spokane County a surety acceptable
to the County Engineer whlch warrantles the construction of the
specified roadway improvements.

1. That the improvements for the private road shall at a minimum cortsist of
a paved strfp 24 ft, in width which is designed to accommodate the truck
traffic normally associated with industrial areas.
2. The County Eng1 neer has desi gnated typical roadway secti on number one,
access standard for the improvement of woodruff Road which is adjacent
to the Binding Site Plan. This will requlre the addltlon of
approxlmately 10 ft.+ of asphalt and the installation of curb and
sidewalk along the frontages on woodruff.

3. The County Engineer has designated typical roadway section number one,
access standard for Locust Road which is adfacent to the Binding Site
Pl an. Thi s wi 11 requi re the addi tion of approximately 30 ft. + of
asphalt and the installation of curb and sldeNalk along the frontages on

4. The County Engineer has designated typical roadway section number one,
major arterial standard for the improvement of Montgomery Avenue which
i s adjacent to the B9 ndi ng Si te P1 an. Thi s wi 11 requl re the addi ti on of
approximately 6 to 10 ft. + of asphalt and the installation of curb and
si dewal k al ong the frontages on Montgoraery.

5. The proposed Binding Site P1an sha11 be improved to the standards set
forth in Spokane County Board of Camissioners Resolution No. 80-1592,
as amended, which establishes regulations for roads, approaches,
drainage and fees in new construction.
COUNTY HEALTH DISTRICT
1. The final Binding Site Plan shall be deslgned as indicated on the
preliminary plan of record and/or any attached sheets as noted.
2. The dedicatory language of the plat will state that: "Subject to
specific apptication approval and issuance of permits by the Health
Off i cer, the use of i ndi vi dual on-si te seMage systems may be authori zed. "
3. Mater service shall be coordinated through the Director of Utilities,
Spokane County.
4. Nater service shall be by an existing public water supply when approved
by the Regional Engineer (Spokane), State Department of Social i Health
Servi ces.
5. Prior to filing the final plat, the sponsor shall present evidence that
the site 11es wlthin the recorded service area of the Mater system
proposed to serve the site. The dedicatory language on the binding site
plan shall state: "Use of private Kells and water systems is
prohibited."
6. The binding site dedicatlon will contain a statement to the effect
that: °The public water system as approved by County and State health
authorities and the local fire district and purveyor will be installed
wi thi n th1 s p1 at, and the subdi vi der Mi 11 provi de for i ndi vi dual
domestic Mater service as Nell as fire protection to each tract prior to
sale of each tract."
7. Dlsposal of seMage effluent beneath paved surfaces is currently
prohf bi ted.
8. Prior to filing the final binding site plan, the sponsor shall
demonstrate to the sati sfacti on of the Spokane Countjr Heal th Di stri ct
that suitabl e si tes for on-s1 te sewage di sposal systems i s avai 1 abl e on
all tracts.
COUNTIf UTILITIES
1 Pursuant to the 8oard of County Commissioners Resolution No.80-0418, the
use of on-site sewer disposal systems is hereby authoriaed. This
authorization is conditioned on compliance with all rules and
regulations of the Spokane County Health District and is further
conditioned and subject to speclflc applicaton approval and issuance of
permi ts by the Heal th Di strict.

resolution method pursuant to RCM Chapter 36.94 which includes the
Owner(s) property. PROYIDED, this condition shall not prohiblt the
owner(s) or successor(s) from objection to any assessment(s) on the the
property as a resul t of improvements cal l ed for i n conjuncti on M1 th the
formation of a ULID by elther petition or resolution method under RCw

5. A dry sewer connection to the future area-wide SeMerage System is to be
constructed to serve proposed Lots 5 through 13. Plans and

needed by Spokane County, described ae being:

adjoiniag eaid Tracte 6 and 7 of WARRENS FIVB ACRE TRACTS, ae per plat
thereof recorded in Volume "C" of Plata, Page 58; and

QUIT CLAIM DEED
THE GRANTOR, SPOKANE COUNTY, a politf.cat subdivision of the State of
Washington, finding that certain of the Storm Drainage Easements conveyed to
Spokaae County by Max Spalding and recorded under Auditor's File Ko. 8712210202, in
Volume 942, Page 1867, 'dated February 25, 1987, for purposes of Binding Site Plan
15-86, Eiled under Auditor's File No. 8709110304, 3n Book 1, Page 19, dated
September 11, 1987, are not in fact needed by Spokane County, does hereby convey
and quit claim to Max Spalding said drainage easements, more particularly deecribed
as:
The East 10 feet of ttie South 60 feet of Lot 14, Block 1; and
The Weat 10 feet of the South 60 feet of Lot 15, Block 1; and
The North 10 feet of the East 60 feet of Lot 16, Block 1; and
The South 10 feet of the East 60 feet; and the East 5 feet of Lot 17,

to Spokane County, a political subdivision of the State of Washington, and Easement
over, under, upon and across the hereinafter described lands situated in the County
of Spokane, State of Washington:
Drainage Easements over and acrosa that portion of the Northwest Quarter
(NW 1/4) of Section 8, Township 25 North, Range 44 East, W.M., in Spokane
County, Washington, for Blading Site Plan 86-15; f iled under Auditors File
No. 8709110304 , in Volume 1, Page 19 , dated 11 September
1987, described ae follows:
The North 10 feet of the West 39 feet of the East 51 feet of Lot 4, Block
1;
The South 10 feet of the West 39 feet of the Eaet 51 feet of Lot 5, Block

DRAINAGE EASEMENTS, as shown hereinabove are for the purpose of installing,
operating and maintaining drainage swales and drainage facilitiea to dispose of
runoff, are hereby granted. The County of Spokane is hereby granted the right of
ingtess and egreea to all drainage easements adjacent to the public right of way.
The property owner shall maintain the drainage swale with a permanent live cover of
lawn turf, with optional shrubbery snd/or trees, which do not obstruct the flow aad
percolatian of storm drainage water in the drainage swale as indicated by the
approved plans. '
The grantor(s) hereby releases Spokane CounCy, and all its officers, employees, and
agents from any responsibility or liability for any damage whatsoever including
inverse conclemnation by or to any and al:. persons or grorerty E:isino out of or in
any way incident to or attributable to the storm drainage within sai.d Easement.

The Easemeat described hereinabove is to aad shall run wiCh the land. Ido
modificatlon of the boundaries of said Easement caa be made without the prior
approval of Spokane County.
