Re 9514 East Montgomery - Non-conforming status
Dear Mr Wyatt
In response to your request for a review of the provisions for reconstruction of the building at
9514 East Montgomery that was destroyed by fire, we contacted the various county agencies that
would be reviewing the proposal when subnutted for a permit
As you may be aware, the question is "What non-conforming nghts does this property have?"
Ac,cordingly, we offer the following
Division of Buddings - Any reconstruction must comply with the current bwlding codes
adopted by Spokane County and/or Washington State including
Barrier-Free Design and the Non-Residential Energy Code A
separate permit and review for each occupant/tenant will be
required
Division of Engineenng - Upgrades to exxisting site drmnage would not be required provided
construcaon is witiun exisang foot pnnt and reconstruction does
not alter exusting drainage requirements
Plantung Department - As with the Engineers, the building could be re-constructed withui
the existtng footprmt provided the previous size and height are
muncmned and the proposed use is similar in nature to the one
onginally permitted Any expansion of a non-conforming use
would require a conditional use permit
Environmental Health - Information provided by Daryl Way with the Health Distnct
indicates that the existing septic system is sized for 400 gallons per
day This would equate to 27 person shifts per day As long as
these levels are m2untauned upgrades to the existing system would

not be required It should be noted that all uses wiU be reviewed
for cntical materials as defined in Title 3 of County Code and a
sampling agreement may be requued
Fue Distnct - Exisung hydrants are adequate Knox box entry systems will be
required
These deternunatrons would be valid for one year from the date of the fire as stated in the
Spokane County Zorung Code and other policies in effect as of this date
