THIS MATTER, an application for subdivision of land, from David Buckner has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the
day of May, 1995.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 2.4 acres into 41ots for residential lots and
those uses permitted in the Urban Residenrial - 3.5 (UR-3.5) zone.
3. The proposal is located south of and adjacent to 12th Avenue, approximately 500 feet
east of Pierce Road in the SW 1/4 of Section 21, Township 25 North, Range 44
E.W.M. Spokane County, Washington.
4. 'Z'he exisring zoning of the property described in the application is Urban Residential -
3.5 (UR-3.5), previously establi.shed as Agricultural zoning in 1950 (File No. 181-50)
and redesignated to UR-3.5 on January 1, 1991, pursuant to the Program to Implement
the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does
confornz to the requirements of the existing zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses, as proposed and conditioned are in compliance with this
• category.
6. Surrounding uses are primarily residential on parcels similar to or larger than the
proposed short plat. 7. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recom.mendations Solicited.
8. No written comments were received from any adjoining property owners.
9. The Spokane County Arterial Road Plan identifies 12th Avenue as a Local Access
with a future right of way width of 60 feet. The existing right of way width is 40 feet.
In order to implement the Arterial Road Plan, the County Engineer has requested 10
feet of dedication for the purpose of additional right of way and 8- 10 feet of asphalt in
width along the frontage on the development. Therefore, as conditioned., the proposal
conforms to the Plan.
10. The site is located within the Public Tra.risportation Benefit Area (PTBA).
11. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
12. The Spokane County Parks Department has commented on the proposed short plat.
The Parks Departnzent has requested a voluntary agreement be completed between the
Parks Department and the property owner to mitigate i.mpacts to the Counry Park
system. County legal counsel has i.ndicated such agreements may be required.
Spokane County Planning recoraamends the properry owner negotiate with the Spokane
County Parks Deparanent to provide for appropriate capital faciliries as required by the
Revised Code of Washington (RCW) 58.17.110. Approval of this short plat should
include conditions requiring that provisions for appropriate faciliries be i.n place prior to
recording this final plat in the form of a written agreement between the owner and the `
Spokane County Parks Department
13. The Central Valley School District has commented on the proposed Short Plat. The
, District has indicated that existing school facilities are inadequate to serve the proposed
short plat and wishes to negotiate with the owner to provide adequate capital facilities as
required by the Revised Code of Washington (RCW) 58.17.110. Review by County
legal counsel indicates the condition requested by the School District can be required for

, developments. Approval of this short plat should include conditions requiring that
provisions for appropriate facilities be in place prior to recording the final short plat in
the form of a written agreement between the owner and the school district.
14. The proposed shoxt plat has direct access to public right of way at 12th Avenue.
Sidewalks and curbing are required by the County Engineer along 12th Avenue
regarding this proposal and have been conditioned as part of the future formarion of a Road Improvement District (RID) project.
15. Recognizing the recommended conditions and Spokane County development standards,
appropriate provisions should be made to ensure the public health, safety and general
welfare and that the public use and interest will be served by platting the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with sandards established by the state and Spokane County. Spokane
County Planning has considered the provision of adequate public facilities as cited in
RCW 58.17.110 (2). .1Vlore specifically:
a. open spaces
b. drain age ways
c. public and/or private rights-of-way
d . rransit
e . potable water
f. sanitary waste disposal
g. parks and recrearion facilities
h . playgrounds
i. schools and schoolgrounds
j . sidewallcs

16. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 1.97-11-800 (6) (a).
DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1015-95 is hereby APPROVED until June 1,1998, subject to conditions noted below.
Most of the condi.tions of approval shall be accomplished by the applicant and/or sponsor prior
to finalization of the short subdivision. This decision is final unless appealed in writing,
consistent with adopted appeal procedures.
COUNTX PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by Planlung shall be binding on the "Applicant", which term
shall include the owner oz owners of the property, heirs, assigns and successors.
2. The proposal shall comply with the Urban Residential - 3.5 zone as amended.
3. The final plat shall be designed substantially in conformance with the prelurunary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. The prelinunary plat is given conditional approval for thzee (3) years, specifcally to
June 1, 1998. The applicant may request an extension of time by submitring a written
request approximdtely forty-five (45) days prior to the above expiration ciate.
. 6. Three (3) current certificates of title shall be furnished to Planning prior to filing the
final plat.

, 7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of urility easements by appropriate utiliry companies shall be received
with the submittal of the final plat.
8. Prior to filing of final plat, the appropriate road name(s) and street ad.dress(es) shall be
indicated.
9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contai.n the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
10. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County Division of
Buildings and County Health District. The agencies wi.ll certify on the Water Plan,
prior to the filing of a final plat, that the plan is in conformance with their respective
needs and regulations. The Water Plan and certi.fication shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
11. . The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building penmits withi.n the final plat. The arrangements or
agreements shall include a provision holding Spokane Counry and the purveyor harrnless from claims by any lot purchaser refused a building permit due to the fai.lure
of the subdivision sponsor to satisfactorily complete the approved water system.
12. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authoriaes, the local fire protection district, water purveyor and Spokane County
Division of Buildings, shall be installed within this subd.ivision, and the applicant shall
provide for individual domestic water service as well as fire protection to each lot prior
to sale of each lot and prior to issuance of a building permit for each lot"
13. No building pemzit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-constructed" water system.
14. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple conriections to
an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general welfare.
15. No water plan is required, and a simple tap is needed at the time of building permit
, release.
16. The owner shall negotiate with Central Valley School District and submit a recorded
copy of a voluntary agreement making provisions for public schools ,prior to
finalization and recording of the plat. The agreement shall provide a written description
_ of the subject property to which the agreement applies and also state the dollar amount
and any other agreed to mitigating measures. The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCW)
58.17.205, that adequate provisions for school facilities must be made cond.itioned on a
future agreement between the plattor and school district.
Voluntary agreements between the owner and school district shall conform to the
requirements of RCW Chapter 82.02.

17. A survey is requ.ired prior to the filing of a final plat.
COtTNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS
1. That condirional approval of the plat by the County Engineer is given subject to
dedication of Right-of-Way and approval of the road system as indicated in the
preliminary plat of record.
2. That plans, profiles and cross sections as designed to County standards showing
proposed street centerline and curb grades be submitted to the County Engineer for
approval prior to construction and/or the filing of a final plat; road plans to be prepared
under the direcp.on of a licensed Professional Civil Engineer.
3. That drainage plans and design calculations showing the alignment of drainage
facilities be submitted to the County Engineer for approval prior to construction and/or "
the filing of the final plat. Drainage plans to be prepared under the direction of a
licensed Professional Civil Engineer.
4.' No construction work is to be perfonned within the existing or proposed Public Right-
of-Way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
5. The applicant should be advised that individual driveway access permits are required
prior to issuance of a bu.ild.ing pernait for driveway approaches to the County road
system.
6. Dedicarion of 10 feet of additional Right-of-Way along 12th Avenue.
7. Existing County roads providing direct access to the plat shall be paved andJor curbed
to Spokane County standards.
8. The word "applicant" shall include the owner(s) of the property, his/her heirs, assigns
and successors.
9. To construct the road improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be a willing participant in any petition or
resolution which purposes is the formation of a Road Improvement District (RrD) for
said i.rnprovements pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner, their heirs, grantees
and assigns. This provision is applicable to 12th Avenue.
10. As an alternative method of constructing the road improvement stated herein, the
applicant may, with the approval of the County Engineer, accornplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvement. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner, their heirs, grantees
and assigns. This provision is applicable to ] 2th Avenue.
11. That the following statement shall appear within the ded.icatory language of the final
. plat: _
The owner(s) or successor(s) in interest agree to authorize Spokane County to place
theu name(s) on a petition for the formation of a Road Improvement District (RID) by
the petition method pu.rsuant to Chapter 36.88 RCW, which petition includes the
owner(s) property, and further not to object, by the signing of a ballot, the formation
of a RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution
includes the owner(s) property. If a RID is formed by either the petition or resolution
method, as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agree: (1) that the improvements or construction contemplated within the proposed
RID is feasible, (2) That the benefits to be derived from the formation of the RID by
the property included therein, together with. the amount of any Counry participation,
exceeds the cost and expense of formation of the RID, and (3) that the property within
the proposed RID is sufficiently developed. Provided, further, the owner(s) or

successor(s) sha11 retain the right, as authorized under RCW 36.88.090, to object to
any assessment(s) on the property as a result of the improvements called for in
conjunction with the formation of a RID by either petirion or resolution method under
Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of .
County Commissioners affuming the final assessment roll. It is further agreed that at
such ame as an RID is created or any Road Improvement project is sanctioned by
Spokane County, the improvements required (curb, sidewalk, drainage control and
paving) wi.ll be at the sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said
RID waiver expizes without construction of the required improvements, the owner(s)
or successor(s) agree to construct the required improvements at their own expense;
pay to Spokane County the then estimated cost of the required unprovements to enable
the County to.complete the same; or furnish a bond or other secure method suitable to
the County (which may include the execution of another RID wa.iver agreement), .
providing for or securing to the County the actual construction of the unprovements.
All of the requirements of this agreement shal.l run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s). This provision is applicable to
12th Avenue.
12. The County Engi.neer has designated Typical Roadway Section Number 2 Local
Access Standard for the improvement of 12th Avenue which is adjacent to the
proposed development. This will require the addition of approximately 8- 10 feet of
aspha.lt along the frontage of the development. The construction of curbing is also
required.
13. The proposed private road(s) as shown on the preliminary plat serving 4 lots is not
approved by the County Engineer.
14. That private road(s) be unproved to Spokane County standard for an Urban private
road standard serving 41ots.
15. All vested owners shall sign and record private road documents as prescribed by the
Spokane County Engineer. These documents shall be reviewed and approved by the
Spokane County Engineer prior to recording with the Spokane County Auditor.
Recording numbers shall be referenced i.n the dedicatory language of the plat.
16. That the following statement be placed in the plat dedication: WAIZNLNG: Spokane
County has no responsibility to build, improve, maintain or other wise sezvice the
private roads contained within or providing service to the property described in this
. plat. By accepting this plat or subsequently by allowing a building permit to be issued on property on a private road, Spokane County assumes no obligation for said private
road and the owners hereby acknowledge that the County has no obligarion of any
kind or nature whatsoever to establish, exannine, survey, construct, alter, repair,
improve, maintain, provide drainage or snow removal on a private road. This
requirement is and shall run with the land and shall be binding upon the owner, their
heirs, successors or assigns including the obligation to participate in the maintenance
of the private road as provided herein.
17. The proposed subdivision shall be i_m.proved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 95-0498, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new construction.
18. The Counry Engineer has examined this development proposal and has detemvuled that
the impact of this proposal upon the existing County Road System warrants the
dedication of addirional Right of Way and the roadway improvements herein specified.
19. That the following statement must be placed in the plat dedication: "The private road
as shown hereon is an easement which provides a means of ingress and egress for
those lots within the plat having frontage thereon."
20. The applicant should be advised that there may exist utilities either underground or
overhead affecting the applicants property, including property to be dedicated or set
aside for future acquisition. Spokane County will assume no financial obligation for

adjustments or relocation regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to determine whether the applicant or
utility is responsible for adjustment or relocation costs and to make arrangements for
any necessary work. .
21. The applicant shall provide documentation to the satisfaction of the County Engineer
that the local fire district will approve the proposed turn around as shown on the
preliminary plat. The County Engineer shall also review and approve the proposed
turn around.
COUNTX HEALTH DISTRICT CONDITIONS
,
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by Planning to the utility companies, Spokane County Engineer
and the Spokane County Health District. Written approval of the easements by the
utility companies must be received prior to the submittal of the final piat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the fina] plat, the sponsor shall demonsCrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to faling the final plat, the sponsoz shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. A plan for water facilities adequate for domestic use, domestic irrigation use and fire
protection use shall be approved by the water purveyor. Said water plan must have
been approved by the fire protection district and the appropriate health authorities. The
health authorities, water supplier (purveyor) and the fire protection district will certify,
prior to the filing of the final plat, on the face of said water plan that the plan is in
conformance with their requirements and will adequately satisfy their respective needs.
Said water plan and certification will be drafted on a transparency suitable for
reproduction.
9. The purveyor will also certify prior to filing the final plat on a copy of said water plan
that appropriate contractual arrangements have been made with the plat sponsor for
construction of the water system, in accordance with the approved plan and time
schedule. The time schedule will provide, in any case, for completion of the water
system and inspection by the appropriate health authorities prior to application for
building permits within the plat. The contractual arrangements will include a provi'sion
holding Spokane County, Spokane County Health District and the purveyor harmless
from claims by any tract purchaser refused a building permit due to failure of the plat
sponsor to satisfactorily complete the approved water system.
10. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that suitable sites for on-site sewage di.sposal systems
are available on all lots within the short plat.
11. Subject to specific application approval and issuance of permits by the Health Officer,
the use of individual on-site sewage disposal systems may be authorized.
12. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of pemuts by the Health Officer, the use of individual on-site sewage
systems may be authorized."
13. The dedicatory ]anguage on the plat shall state: "Use of private wells and water
systems is prohibited."

14. The plat dedication shall contain a statement to the effect that: "The public water
system, pursuant to the Water Plan approved by county and state health authoriries, the
local fire protection district, water purveyor and County Division of Buildings, shall be
installed within this plat, and the applicant shall provide for individual domestic water
service as well as fire protection to each lot prior to sale of each lot and prior to issuance
of a build.ing permit for each lot."
COUNTY DIVISION OF UTILITIES CONDITIONS.
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is condirioned
in compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
pennits by the Health District.
2. The Dedication shall state: The owner(s) or successor(s) in interest agree to authorize
the County to place their name(s) on a petition for the fonnation of ULID by pee.tion
method pursuant to RCW 36.94, which petition includes the owner(s)' property; and
further not to object by the signing of a protest petition against the formation of a ULID
by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s)
from objecring to any assessment(s) on the property as a result of improvements called
for in conjunction with the formation of a ULID by either perition or resolution undez
RCW Chapter 36.94.
3. Each dwelling unit shal,l be double-plumbed for corulection to future areawide collection
systems.
4. Sewer easement shall be shown on the face of the plat as "Sewer and Utilities
Easement".
5. A dry sewer connection to the future areawide Sewerage System is to be constructed.
6. Public Sanitary Sewer easement shall be shown on the face of the plat and the
' dedication shall sta.te: "The perpetual .(exclusive) easement granted to Spokane County, its' successors and
assigns is for the sole purpose of construcCing, installing, operating, maintaining,
repairing, altering, replacing, removing, and all other uses or purposes which are or
may be related to a sewer system. Spokane County, its' successors and assigns at all
times hereinafter, at their own cost and expense, may remove all crops, brush, grass or
trees that may interfere with the constructing, installing, operating, maintaining,
repairulg, altering, replacing, removing and all other uses or purposes which are/may
be related to a sewer system.
The grantor(s) reserves the right to use and enjoy that property which is the subject of
this easement for purposes which will not interfere with the County's full enjoyment of
the rights hereby granted; provided, the Grantor(s) shall not erect or construct any
building or other structure or drill on the easement, or diminish or substantially add to
the ground cover over the easement.
The easement described hereinabove is to and shall run with the land."
7. Applicant shall submit expressly to Spokane County Utilities Department "under
separate cover", only those plan sheets showing sewer plans and specifications for:
Public Sewer/Double Plumbing/Private Sewer or Dry Sewer connections for review
and approval by the Utilities Department prior to issuance of permit to connect.
8. Security shall be deposited with the Utilities Department for construction of public
facilities/double plumbing/private connection/dryline.
9. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.

PARKS DEPARTMENT CONDITIONS
1. To satisfy the requirements of RCW-58-17-110 that a subdivision make appropriate
provisions for public parks, recreation and playgrounds, the owner, at his/her option,
shall either ded.icate land within the subdivision or enter into a voluntary agreement with
Spokane County to mitigate the direct impacts that the subdivi.sion has on public parks,
open spaces and recrearional facilities within the unincorporated areas of Spokane
County.
If the owner opts to enter into a voluntary agreement, the agreement shall be executeti
prior to the finalization and recording of the plat and recorded in conjunction therewith.
the agreement shall be consistent with RCW 82.02.020 an substantially the same as the
standardized agreement prepared by the Spokane County Parks, Recreation and Fair
Department. Prior to finalization of the plat, the owner shall advise any purchaser of
property, as authorized under RCW 58.17.205, of the obligarions within the voluntary
agreement. Additionally, the owner shall submit a recorded copy of sa.id voluntary
agreement to Spokane County Planning prior to finalization.
COUNTY DIVISION OF BUILDINGS CONDITIONS
1. The applicant shall contact the Division of Buildings at the earliest possible stage in
order to be informed of code requirements administered/enforced as authorized by the
State Building Code Act. Design/development concerns include: ADDRESSING,
FIRE A.PPARA.TUS ACCESS ROADS; FiRE HYDRANT/FLOW; APPROVED
WATER SYSTEMS; BUII.DING ACCESSIBILITY; CONSTRUCTION TYPE;
OCCUPANCY Q,ASSIFICATION; EXIT'ING; EXTERIOR WALL PROTECTION;
AND ENERGY CODE REGULATTONS. (Note: The Division of Buildings reserves
the right to confirm the actual address at the time of building permit.)

SUBJECT: SHORT PLAT # 1018-95 / BUCKNER, DAVID
The following "Conditions of Approval" for the above referenced subdivision
are submitted to the Spokane County Planning Department for inclusion in the
"Findings and Order" should the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer is given
subject to dedication of Right-of-Way and approval of the road system as
indicated in the preliminary plat of record. '
E 2 That plans, profiles and cross sections as designed to County standards
showing proposed street centerline and curb grades be submitted to the
County Engineer for approval prior to construction and/or the filing of
a final plat; road plans to be prepared under the direction of a
licensed Professional Civil Engineer.
E 3 That drainage plans and design calculations showing the alignment of
, drainage facilities be submitted to the County Engineer for approval
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
E 6 No construction work is to be performed within the existing or proposed
Public Right'-of-Way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval py the County
Engineer.
E12 The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
approaches to the County road system.
E13 Dedication of 10 feet of additional Right-of-Way along 12th Avenue.
E16 Existing County roads providing direct access to the plat'shall be paved
and/or curbed to Spokane County standards.
E19 The word "applicant" shall include the owner(s) of the property, his/her
heirs, assigns and successors.
E20 To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant 'in any petition or resolution whicr purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to kCW 36.88, as amended. At such time as an RID is created or
any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersianed owner,
their heirs, grantees and assigns. This provision is applicable to 12th
Avenue.
E21 As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish- the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane -County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to 12th
Avenue.
E22 That the following statement shall appear within the dedicatory language
of the f inal plat :

The owner(s) or successor(s) in interest agree to authorize Spokane
County to place their name(s) on a petition for the formation of a
Road Improvement District (RID) by the petition method pursuant to
Chapter 36.88 RCW, which petition includes the owner(s) property, and
further not to object, by the signing of a ballot, the formation of
a RID by the resolution method pursuant to Chapter 36.88 RCW, which
resolution includes the owner (s) property. If a RID is formed by
either the petition or resolution method, as provided for in Chapter
3 6. 8 8 RCW, the owner ( s) or successor ( s) f urther agree :1 (1) that the
improvements or construction contemplated within the proposed RID is
feasible, (2) That the benefits to be derived from the fortilation of
the RID by the property included therein, together with the amount
of any County participation, exceeds the cost and expense of formation
- of the RID, and (3) that the property within the proposed RID is
sufficiently developed. Provided, further, - the owner(s) or
successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result
of the improvements called for in conjunction with the formation of
a RID by either petition or resolution method under Chapter 36.88 RC'fnT,
and to appeal to the Superior Court the decision of the Board of
County Commissioners affirming the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement project is sanctioned by Spokane County, the irrtprovements
required (curb, sidewalk, drainage control and paving) will be at the
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County. , .
The RID waiver contained in this agreement shall expire after ten
(10) years, f rom the date of execution below. However, the owner ( s)
or successor(s) agree that if said RID waiver expires without
construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County•(which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements.
All of the*requirements of this agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to 12th Avenue.
E24 The County Engineer has designated Typical Roadway Section Number 2
Local Access Standard for the improvement of 12th Avenue which is
adjacent to the proposed development. This will require the addition of
approximately 8-10 feet of asphalt along the frontage of the
development. .The construction of curbing and sidewalk is also required.
E26 The proposed private road as shown on the preliminary plat serving 4
lots is not approved by the County Engineer.
E27 That private road(s) be improved to Spokane County standard for a urban
private road standard serving 4 lots.
E30 Al1 vested owners shall sign and record private road documents as
prescribed by the Spokane County Engineer. These documents shall be
reviewed and approved by the Spokane County Engineer prior to recording
with the Spokane County Auditor. Recording numbers shall be referenced
in the dedicatory language of the plat.
E31 That the following statement be placed in the plat dedication: WARNING:
Spokane County has no responsibility to build, improve,, maintain or
other wise service the private roads contained within or providing
service to the property described in this plat. By dccepting this plat
or subsequenfily by allowing a building permit to be issued on property
on a private road, Spokane County assumes no obligation for said private
road and the owners hereby acknowledge that the County has no
obligation of any kind or nature whatsoever to establish, examine,

survey, cor_struct, alter, repair, improve, maintain, provide drainage or
snow removal on a private road. This requirement is and shall run with
the land and shall be binding upon the owner, their heirs, successors or
assigns including the obligation to participate in the maintenance of
the private road as provided herein.
E32 The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E33 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
E35 That the following statement must be placed in the plat dedication:
"The private road as shown hereon is an easement which provides a means
of ingress and egress for those lots within the plat having frontage
thereon." _
E90 The applicant should be advised that there may exist utilities
either underground or overhead affecting the applicants
property, including property to be dedicated or set aside future
acquisition. Spokane County will assume no financial obligation
for adjustments or relocation regarding these utilities. The
applicant should check with the applicable utilities and Spokane
County Engineer to determine whether the applicant or. utility is
responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
SPECIAL CONDITION: The applicant shall submit to the County Engineer from
the applicable fire district written approval for the proposed turn
around. The County Engineer shall also review the proposed turn around.
