SP-1019-95 ) CONCLUSIONS AND t DECISION 1'HIS MATTER, an application for subdivision of land, from University City Inc. has been rece'ved and decided upon, pursuant to Spokane County Subdivision regulations, on the day of June, 1995. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide approximately 18.03 acres into 2 lots for 1 existing business and 1 new additional business and those uses permitted in the Regional Business (B-3) zone. 3. The proposal is located at the southwest corner of the intersection of University Road and Sprague Avenue in the NE 1/4 of Section 20, Township 25 North, Range 44 E.W.M. Spokane County, Washington. 4. The existing zoning of the property described in the application is Regional Business (B-3), which was the subject of an approved zone change from Commercial (C) to Regional Business (B-3) (file # ZE-18-89C) in 1989 and redesignated to B-3 on January l, 1991, pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing B-3 zone. 0 5. The Spokane County Comprehensive Plan designates this area as Major Commercial. The development and uses, as proposed and conditioned are in compliance with this category. 6. Surrounding uses are primarily commercial and open space. 7. The Spokane County Arterial Road Plan identifies Sprague Avenue as a Principal Arterial without controlled access with a future right of way width of 130 feet. The existing right of way width is 110 feet. In order to implement the Arterial Road Plan, the County Engineer has requested that a strip of property 10 feet in width along Sprague Avenue frontage be set aside as a Future Acquisition Area. In addition, the Spokane County Arterial Road Plan identifies University Road as a Principal Arterial without controlled access with a future right of way width of 100 feet. The existing right of way width exceeds 100 feet. Therefore, as conditioned, (such as improvements and acquisition areas) the proposal conforms to the Road Plan. 8. The site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA) East Sprague Route # 9 provides connecting services to the site. 9. The proposed short plat will be served by a public water system. Waste water disposal will be as authorized by the Director of Utilities. 10. The required public notice was provided for tlus proposal and agencies having a potential interest in the project were notified and recoinmendations solicited. 11. No written comments were received from any adjoining property owners. 12. Recognizing the recommended conditions and Spokane County development standards, the proposed short plat makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. The Planning Division has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP- 1019-95 is hereby APPROVED until July 1, 1998, subject to conditions noted below. This decision is final unless appealed in writing, consistent with adopted appeal procedures. COUNTY DIVISION OF PLANNING CONDITIONS 1. All conditions imposed by the Planning Division shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the existing conditions of ZN-18-89 and the Regional Business (B-3) zone, as amended. 3. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 4. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 5. The preliminary plat is given conditional approval for three (3) years, specifically to July l, 1998. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiration date. 6. Three (3) current certificates of title shall be furnished to the Planning Division prior to filing the final plat. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies shall be received with the submittal of the final plat. 8. Prior to filing of final plat, the appropriate road name(s) and street address(es) shall be indicated. 9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 10. The Spokane County Division of Planning shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Planning Division. The notice should be recorded the same time as the final plat and shall provide the following: a. Individual driveway access permits are required prior to issuance of a building permit for driveway approaches to the County road system. 5. The County Arterial Road Plan identifies Sprague Avenue as a 130 foot Principal A.rterial! The existing right-of-way width of 110 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, a strip of property 10 feet in width along the Sprague Avenue frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to Sprague Avenue. 6. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to determine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 7. Applicant shall comply with the existing conditions of ZE-18-89. COUNTY DIVISION OF UTILITIES CONDITIONS 1. A wet (live) sewer connection to the area wide Public Sewer System is to be constructed. Sewer connection permit is required. 2. The applicant/owner shall submit expressly to the Division of Utilities "Under separate cover", only those plan sheets showing sewer plans and specifications for: Public Sewer connections for review and approval by the Utilities Division prior to issuance of pernut to connect. 3. Arrangements for payments of additional sewer charges must be made for prior to issuance of sewer connection pern-ut. 4. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane Counry, as amended. COUNTY DIVISION OF BUILDINGS CONDITIONS 1. The applicant shall contact the Division of Buildings at the earliest possible stage in order to be informed of code requirements administered/enforced as authorized by the State Building Code Act. Design/development concerns include: ADDRESSING, FIRE APPARATUS ACCESS ROADS; FIRE HYDRANT/FLOW; APPROVED WATER SYSTEMS; BUILDING ACCESSIBII.ITY; CONSTRUCTION TYPE; OCCUPANCY CLASSIFICATION; EXITING; EXTERIOR WALL PROTECTION; AND ENERGY CODE REGULATIONS. (Note: The Division of Buildings reserves the right to confirm the actual address at the time of building permit.) COUNTY HEALTH DISTRICT CONDITIONS 1. The final plat shall be designed as indicated on the preliminary plat of record andlor any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the prel_iminary plat of record for distribution by the Planning Division to the utility companies, Spokane County Engineer and the Spokane Counry Health District. Written approval of the easements by the utiliry companies must be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that an adequate and potable water supply is available to each lot of the plat. 7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 8. A public sewer system will be made available for the plat, and individual service will be provided to each lot prior to sa1e. Use of individual on-site sewage disposal systems shall not be authorized. 9. A statement shall be placed in the dedication to the effect that: "A public sewer system will be made available for the plat, and individual service will be provided to each lot prior to sale. Use of individual on-site sewage disposal systems shall not be authorized." 10. The dedicatory language on the plat shall state: "Use of private wells and water systems is prohibited." 11. The plat dedication shall contain a statement to the effect that: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, water purveyor and County Division of Buildings, shall be installed within this plat, and the applicant-shall provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." The aommittse adapts thePlanning Department Report as a part of this record. , 3. The eacisting land use(s) in the area are University City Shopping Center, retail space, offices, fire station, Spokane Transit Authority ttansfer site, single fa.mily residenoes, auto sales. 4. The Comprehensive Plan designates this site as Major Comraercial and Urban. The proposal is for the putpose of remodel/expansion of the University City shopping Center. 5. The Artwrial Road PI'an has been vomplied with as conditioned by the Mitigated Determination of Nonsignificance. 6. The existing zoning of the pmperty described in the application is Commercial previously established in 1957 and 1961; Regional Business (B-3) previously established in 1987 and Multiple Family Suburban (IVFS) established in 1939. 7. The provisions of RCW 43.21C ('The State Environmental Policy Act) have been complied with and a Mitigated Determination of Nonsignificance was issued, which provides for roadway and cinulation requirements as mare specifically specified with the Cvunty Engineering Deparoments conditions of these Findings of Fact, Conclusions and Order. 8. The proper legal requirements for advertisement and nodce have been fulfilled. 9. The Committee additionally finds: a. That the parldng variancerequest is appravable in light of the conditions requiring bicycle racks andlor storage areas along with the requirement to work with Spokane Transit System (STA) to provide a pedestrian access to their site located to the south. b. The applicant has submitLed studies, contained within the Planning Deparnnent files, that indicated a mend towards calculating parldng demands based on gross leasable area rather than gross buildable area. The Committee concurs with this standard in light of the mixed uses and varying peak hours that are common in shopping centers of this size. Addirionally, the Cornmittee feels that due to the centers central location in the valley and being adjacent to STA's Transfer site, as well as the fact that the large number of employees will likely share rides and that retail uses generally stagger the number of employees worlang at any given time, the parkang varianoe reduction should not create a noticeable shortage. c. The parking calculations per grnss buildable area would include the covered common mall area, however, if this mall area were not covered, it would not be included in the required parldng calculations, thereby eliminating the need for a parking variance The Conrnittee finds a Covered Mall is desirable because of Spokane's wide range of temperatures and weather conditions. d. The project sponsor indicated at the public hearing that he has constructed, or is in the prooess of constructing, seveml shopping centers around the country, i.e., New York City, Los Angelos, Seattle, Bellingham, with similar parldng provisions as has been rcquested on this proposal. e. With the coaditions of approval set farth below, the variance will a) not constitute a granting of special privileges, b) ensnre that the intent and purpose of the Zoning Code is achieved, and c) protect the environment, public interest, and general welfare. f f. Granting the variance will not be materially detrimental to the public welfare nor injurious to property or improvements in the vicinity and zone. g. The strict application of the parldng standards would create a hardship to the project in light of the supporting-findings contained herein. h. That the approval of this proposal will enhance the environment and its aesthetics by the project now being subject to the cument Regional Business (B- 3) zone standards which will limit advertising sign(s) height and surface area, require compliance with "208" starmwater regulations, provide for building height limits adjacent to oertain residential zones, impose current landscaping standands and provide aqnifer protection by campiling with the Aquifer Sensitive Anea 4verlay Zone. 11. The proposed use is compatible with existing uses in the area. 12. The proposed zoning does implement and conform to the Comprehensive Plan. v 8-89 HEC Order for ZE-18-89 Page 3 _ 13. The applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed zone reclassification is justified. 14. The proposed use will not be detrimental to the public health, safety, or welfare. CONDTTIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions impvsed by the Hearing Examiner Committee shall be binding on the "Applicant", which terrn shall include the owner or owners of the property, heus, assigns, and successors-in-interest. 2. That the paridng variance request is approved for a ratio not to exceed 5 parldng spaces per 1000 sq. ft. of gross leasable area. Gross leasable area in this instance includes those special uses such as the food court. 3. That the applicant shall submit to the Planning Director, for review and detetmination, the necessary documentation as specified vvithin Section 14.802.140 Joint=Use Ppking Reauirements, priar to issuance of any building permits. 4. That prior to the release of any building permits for this site, the applicant shall submit, to the Planning Directar for review and approval, ar at his discretion at a public hearing before the Hearing Examiner Cammittee, a"Master Development Plan," which shall incorporate all conditions of approval and comply with the Regional Business (B-3) z,one of the Zoning Code. Said Master Development Plan will be utilized to detennine phasing of the project and required improvements. 5. The Master Development Plan shall also be in general:confarmance to the aesthetic concepts presented by the applicant at the public hearing. These aesthetics benefits shall include ardditional landscaping adjacent to all buildings, special landscaped tneatinents adjacent to majar eatranves to the buildings and parking lotslstructures which shall comply with fire and traffic requirements. 6. The applicant shall coordinate with the Spokane Transit System (STA) to incorparate into the rtaster Development Plan, a pedestrian access to the STA transfer site located to the south acrvss the Milwaukee Road right of way. In addition the "Plan" shall comply with the Zoning Code's requirement for bicycle racks/storage areas which shall be located at major enmnces to the shopping center. 7. All on-site lighting shall comply with the Regional Business (B-3) zone and the Airpart Overlay Zone. 8. This is simply a two lot short plat of an existing shopping center which already has expanded over the entire lot with pavement and commercial development. Surface runoff currently is collected on-site by an existing stormwater collection system of catch basins and drywells. Future development of "Parcel B" of this proposed short plat will require submittal of drainage modifications consistent with the proposed building at that time.
