That the individuals and parties named herein as having an interest in the above described property or project
, agree to the following:
1. Reimburse Spokane County for project review and inspection fees as specified in Chapter
9.14 of the Spokane County Code. The fees will be based oil actual salary costs incurred
by Spokane County for project reviews and / or inspections plus a ten percent administrative charge, and will be billed monthly as accrued. Any billing amounts due,
. including any expenses incurred in the collection of an overdue account, must be paid
prior to the County's acceptance of the project for filing. If a project is approved and/or
filed with a balance still owing, the unpaid balance shall be paid within 30 days of the
invoice date.
2. The undersigned agrees thai these fees are due and payable upon receipt of the billing as
specified above.
3. Any invoices not paid witliin 30 days of the invoice date will be considered delinquent.
If any outstanding balance on the account for this project is not paid within 30 days of
the invoice clate, no further reviews of the project documents will be conclucted until the
entire account balance is paid. Any balance on the account for this project not paid
within 65 days af the invoice date may result in legal action or the initiation of other
. collection procedures, including referral to a collection agency. The Sponsor will be
liable for any arid all expenses incurred by the County for the collection of overdue
accounts.

' l. Drainage easements, as platted and shown hereon, which are for the purpose of
installing, operating and maintaining drainage swales and drainage facilities, as conditions
of plat approval, are hereby granted to~the public.
Spokane County and its authorized agents are.hereby jranted the right of ingress and
. egress to, over, and from said easements for che purpose of inspection and emergency
maintenance of water qualiry treatment swales ("208 swales and other drainage
facilities, if not properly maintained by the property owner. Spokane County does not
accept the responsibility to inspect or maintain the drainage easements or drainage
swales, nor does the County accept any liabiliry for any failure by the lot owner(s) to
proAeriy maintain such areas.
' 3. The property owners within this Plat shall be held responsible for keeping open and
maintaining the surtace Path of natural or man-made drainage flow over and across their

respective properties.
4. The property owners within this Plat shall maintain a11 water qualiry treatment swales
("?08 swales and drainage ditches situated on their respective properties, and any
ponion of a?08 swale situated in the public right-of-way adjacent to their respective
properties, with a permanent ground cover as speciTied on the current approved pians on
file at the County Engineer's Office. The properry owners may insrall approved
shrubbery and/or trees which do not obstruct the tZow and percolation of storm drainage
water in the 208 swale and drainage ditches, as indicated by the current approved plans
on file with the County Engineer's Office.
5. T'he properry uwner or his representative shall inform each succeeding purchaser of all
drainage easements on the property and or' his responsibiliry for maintaining surface
drainage paths and swales within said easements.
6. Spokane Countv does not accept the responsibility of maintaining the drainage course on
private lots wiLhin drainage easements or floodpiain areas, nor the responsibiliry for any
damage whatsoever, including, but not limited to, inverse condemnation to any prooerties
due to deticient construction and or maintenance of drainage courses in drainage
easements on private property.

7• If the properry owner fails to maintain the surface path of natural or man-inade drainage
flow, or the drainage swale, a notice of such failure may be aiven to the properry owner.
If not corrected within the period indicated on said noace, Spokane Counry has the right
to correct the maintenance failure, or have it corrected, at the expense of the property
owner.

Any building that is constructeri on a lot in this Plat shall be set at such an elevation so

y~ as to provide positive drainage away from any drainage entry point to the bui4ng
(including but not limited to a window.well, a window unpror,ected by a window well,
or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from
the building for a distance of at least 10 feet from the building. The lots shall be araded
so that either a) all runoff is routed away from the building, and conveyed over the lot
to a natural drainage swale or approved drainage faciliry, or b} drainage intercepted on
the lot is disposed of on the lot in an approved drainage facility. The approved drainage
faciliry shall be constructed in accordance with the aoproved plans on file at the County
Engineer's Office. Any revisions to the approved drainage plans must be approved by
the County Engineer's Office prior to construction of said revisions.
If there are continuous swales for water quaiity treatment (208 strip swales) on the Parcel:
9. Driveway access permits for driveway approaches to the Counry road system are required
prior to issuance of a building permit. This approach shall be constructed in accordance
with the approved pian on file in the Counry Enginee:'s Office.
If a floodpiain occurs on the Parcel:
10. Development within this Plat shall conform the re4uirements of the National Flood
Insurance Program, and Chapter 3.20 of the Sookane Counry Code. The lowest floor,
inciuding basement t7oor, for any scructure shall be constructed in accordance with the
requirements of the Spokane County Flood Zone Regulations in effect at che time a
building permit is issued. Purchasers of properry in this subdivision are warned- of
possible flooding or ponding and the of the potenrial requirement co purchase Flood
Insurance. This warning shall be carried in each and every deed to transfer ownership

SHORT PLAT NO. SP-1033-95 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land from Dee McGonigle - Park Place
General Partnership has been received and decided upon, pursuant to Spokane County
Subdivision regulations, on the 23rd day of August, 1995.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Building and Planning.
2. The proposal is to d.ivide approximately 12.2 acres into 2 lots for 1 existing group of
retirement apartments and 1 new additional residential lot and those uses perm.itted in
the Urban Residential-22 (UR-22) zone.
3. The proposal is located east of and adjacent to Park Road and approximately 1/4 mile
south Sprague Avenue in the NW 1/4 of Section 19 Township 25 North, Range 44
E.W.M. Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-22
(UR-22), which was the subject of an approved zone change from Urban Residential-
~ 3.5 (UR-3.5) and General Agricultural (GA) to UR-22 (file # ZN-56-94) zoning in
1995. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of
the existing UR-22 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses, as proposed and conditioned are in compliance with this
category.
6. Surrounding uses are primarily single and multifamily residences, commercial and open
space.
7. The Spokane County Arterial Road Plan identifies Park Road as a Principal Arterial
without controlled access with a future right of way width of 100 feet. The existing
right of way width is 60 feet. In order to implement the Arterial Road Plan, the Counry
Engineer has requested a dedication of 2 feet of additional right of way and a strip of
property 18 feet in width along the Park Road frontage is to be set aside as a Future
Acquisition Area. Therefore, as conditioned, (such as improvements, dedication,
sidewalks and acquisition areas) the proposal conforms to the Road Plan.
8. The site is located within the Public Transportation Benefit Area (PTBA). The Spokane
Transit Authority (STA) East Sprague Route # 9 provides connecting services to the
site.
9. The proposed short plat will be served by a public water system. Waste water disposal
, will be as authorized by the Director of Utilities.
10. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited. No
comments or conditions were provided by the County Parks Department regarding this
proposal. Presently, the Board of County Commissioners and the Parks Department
are in the process of reevaluating the continued use of Park and Recreation Voluntary
Mitigation Agreements.
11. No written comments were received from any adjoining property owners.
12. Recognizing the recommended conditions and Spokane County development standards,
the proposed short plat makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safery and general welfare in

accordance with standards established by the state and Spokane Counry. The Building
and Planning Division has considel•ed the provision of adequate public facilities as cited
in RCW 58.17.110 (2). More specifically:
a. open spaces
b. drainage ways

13. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-
1033-95 is hereby APPROVED for five (5) years, specifically to September 1, 2000 and
subject to conditions noted below. This decision is final unless appealed in writing, consistent
with adopted appeal procedures.
COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS
1. All conditions imposed by the Build.ing and Planning Division shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with ZN-56-94 and the Urban Residential-22 (UR-22) zone,
as amended.
3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots sha11 occur without a change of
condition application submittal and approval.
4. The Building and Planning Director/designee shall review any proposed final plat to
ensure compliance with these Findings and Conditions of Approval.
5. The preliminaty plat is given conditional approval for five (5) years, specifically to
September 1, 2000. The applicant may request an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiration date.
6. Three (3) current certificates of title shall be furnished to the Building and Planning
Division prior to filing the final plat.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utiliry companies shall be received
with the submittal of the final plat.
8. Prior to filing of final plat, the appropriate road name(s) and street address(es) shall be
indicated.
9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
10. The Spokane County Division of Building and Planning shall prepare and record with
the County Auditor a Title Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall be

released, in full or in part, by the Building and Planning Division. The notice should
be recorded the same time as the final plat and shall provide the following:
a. At least 18 feet from the existing right of way is reserved for future acquisition
area for additional road right-of-way along Park Road
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area; they shall
be relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) sha11 be
considered interim uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisiCion area.
11. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, apprapriate fire protection district, County Division of
Buildings and County Health District. The agencies will certify on the Water Plan,
prior to the filing of a final plat, that the plan is in conformance with their respective
needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
12. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule sha11 provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane CounCy and the purveyor
harrnless from claims by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
13. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, water purveyor and Spokane County
Division of Building and Planning sha11 be installed within this subdivision, and the
applicant shall provide for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."
14. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-constructed" water system.
15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letfers from the
appropriate water purveyor and fire protection district stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general welfare.
16. A survey is required prior to the filing of a final plat.
17. The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be informed of code requirements administeredlenforced as authorized
by the State Building Code Act. Design/development concems include:

1. The conditional approval of the plat is given by the County Engineer subject to dedication
of right-of-way and approval of the road system as indicated in the preliminary plat of
record.
2. Plans, profiles, and cross-sections as designed to County standards showing proposed
street centerline and curb grades shall be submitted to the County Engineer for acceptance

impact of this proposal upon the existing county road system warrants the dedication of
additional right-of-way and the roadway improvements herein specified.

16. The County Arterial Road Plan identifies Park Road as a 100 foot Principal Arterial. The
existing right-of-way width of 60 feet is not consistent with that specified in the Plan. In
order to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of property 18 feet in width along the Park Road frontage shall be set
aside in reserve. This property may be acquired by Spokane County at the time when
arterial improvements are made to Park Road.
17. There may eacist utilities, either underground or overhead, affecting the subject property,
including property to be dedicated or set aside for future acquisition. Spokane County
assumes no financial obligation for adjustments or relocation regarding these utilities.
Applicant(s) should check with the applicable utility purveyor and the Spokane County
Engineer to determine whether applicant(s) or the utility is responsible for adjustment or
relocation costs and to make arrangements for any necessary work.
18. The applicant shall granC applicable border easements adjacent to Spokane County Right of
WaY Per SPokane CountY Standards.
COUNTY DIVISION OF UTILITIES CONDITIONS
d 1. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the Counry to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a ULID by either petition or resolution under RCW Chapter
36.94." .
2. A wet (live) sewer connection to the existing area wide Public Sewer System is to be
constructed. Sewer connection permit is required.
3. The applicant/owner shall submit expressly to the Division of Utilities "Under separate
cover", only those plan sheets showing sewer plans and specifications for: Public
Sewer connections for review and approval by the Utilities Division prior to issuance of
a permit to connect.
4. Arrangements for payments of additional sewer charges must be made for prior to
issuance of sewer connection permit.
5. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
COUNTY HEALTH DISTRICT CONDI'ICIONS
1. The final plat shall be designed as indicated on the preliminary plat of record andlor any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Building and Planning Division to the utility companies,
Spokane County Engineer and the Spokane County Health District. Written approval
of the easements by the utility companies must be received prior to the submittal of the
final plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each lot of the plat.

7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. A public sewer system will be made available for the plat, and individual service will be
provided to each lotltract prior to sale. Use of individual on-site sewage disposal
systems shall not be authorized.
9. A statement shall be placed in the dedication to the effect that: "A public sewer system
will be made available for the plat, and individual service will be provided to each lot
prior to sale. Use of ind.ividual on-site sewage disposal systems shall not be
authorized."
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
11. The plat dedication shall contain a statement to the effect that: "The public water
system, pursuant to the Water Plan approved by county and state health authorities, the

Planning shall be installed within this plat, and the applicant sha11 provide for individual

HEARING EXAMINER COMMITTEE
FINDINGS OF rACT, CONCLUSIONS AND ORDER
YNTRODUCTION
This matter has come before the Hearing Examiner Committee on January 26,
1995. The members of the Committee present axe: Harry Gibbons, Chair, Verona
Southern and Jane Myers.
PROPOSAL The sponsor, Park Place General Partnership, c% Dee McGonigle, requests
approval of a Zone Reclassification, ZE-56-94, from General Agricultural (GA) and
Urban Residential-3.5 (UR-3.5) to Urban Residential-22 (LJR-22) for an assisted
care facility and those uses allowed in the Urban Residential-22 (UR-22) zone.
Sixty (60) assisted living units and a thirty (30) bed special care facility is
proposed.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located east of and adjacent to Park Road, north of 8th
Avenue and approximately 2,000 feet south of Sprague Avenue in the NW 1/4 of
Section 19, Township 25 North, Range 44 EWM, Spokane County, Washington.
2. The Comnaittee adopts the Planning Department Report as a part of this record.
3. The existing land uses in the area include vacant undeveloped land, Dishman H.ills
Natural Area, single family residences, a retirement facility and Edge Cliff Park.
4. The proposed use is compatible with existing uses in the area.
5. The property is located within the Urban (4.47 acres) and Rural (.12 acre/5,000 square
feet) categories of the Comprehensive Plan with the majority of the site situated in the
Priority Sewer Service Area (PSSA).
The Urban category is intendeti to provide the opportunity for development of a
"citylike" envixonment which includes various land uses, intensive residential
development and public facilities and services. Multi-family structures should be
located with direct or near di.rect access to the major arterial road systems rather than on
interior neighborhood streets. Access to public transportarion should also be
considered.
The "Rura1 Category" is intended to provide the opportunity for development of
agricultural, timber or open environments in a"countrylike" setting. Most urban, major
commercial and industrial activities would be incompatible in the Rural Category.
Urban, suburban, and some senu-rural intensity residential subdivisions not related to
agriculture would also be out of place. The aesthetic setting of the Rural Category will

be open space. Large cultivated fields, pastures and timber aild natural areas will
consume most of the land.
6. The proposed zoning does implement and conform to the Comprehensive Plan.
7. The Spokane County Arterial Road Plan identifies Park Road as a Principal Arterial
with an existing right-of-way width of 60 feet and a recommended right-of-way
width of 100 feet. In order to implement the Arterial Road Plan, the Spokane
County Engineer is requesting two (2) feet of dedication and that a strip of property
eighteen (18) feet in width along Park Road be designated as Future Acquisidon
Area (FAA). Structure setbacks should be established from the eighteen (18) foot
Future Acquisition Area (FAA) as recommended by the Comprehensive Plan.
Building/structure setbacks are recommended by the Comprehensive Plan to be 35
feet from the Future Acquisition Area. Improvements to Park Road will be
determined and specified by the Spokane County Engineer.
8. The existing zoning of the property described in the application is Urban
Residential-3.5 (UR-3.5) previously established as Agricultural (A) (File no.
16-59) zoning in 1959 and redesignated to Urban Residential-3.5 (UR-3.5) on
January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning
Code. The proposal does conform to the requirements of the proposed zone.
9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Determinarion of Nonsignificance (DNS) was issued. The
Committee, after independent review, hereby adopts the DNS.
10. The legal requirements for public notice have been fulfilled.
11. The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use.
12. The applicant has demonstrated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassificarion is
justified. Specifically, changed conditions include the adoption of the Spokane
County Generalized Comprehensive Plan, the adoption of the Spokane County
Zoning Code, the adoption and implementation of the Spokane County Arterial
Road Plan and the renovation of the Edge Cliff Sanitarium, including the zone
reclassif'ication, Planning Department File No. ZE-47-91 of which this proposal
constitutes an expansion of the renovated facilities.
13. The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing
agencies.
14. The Committee additionally findslconcludes:
a. That the area (.12 acre) designated Rura1 on the Comprehensive Plan is a
transitional area as defined by the Spokane County Generalized
Comprehensive Plan.
b. The applicant agrees with and accepts all recommended conditions of
approval.

SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Urban Residential-22 (LTR-22) zone and
Aquifer Sensitive Area (ASA) Overlay Zones, as amended.
2. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be permitted, including, but not limited to building
location, landscape plans and general allowable uses of the permitted zone. All
variations must conform to regularions set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintained.
3. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.
Signs shall conform to the requirements of Chapter 14.804 of the Zoning Code of
Spokane County, Washington.
4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be subnutted with a performance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
impaired.
5. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
6. The Planning Department shall prepare and record with the Spokane County
Auditor a Title Norice noting that the property in question is subject to a variety of
special conditions imposed as a result of approval of a land use action. This Title

Notice shall serve as public notice of the conditions of approval affecting the
property in question. The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Notice shall generally provide as follows:
The parcel of property legally described as [ ] is the subject of a
land use action by a Spokane County Hearing Body or Administrative
Official on [ imposing a variety of special development
conditions. File No. [ ] is availabte for inspection and copying
in the Spokane County Planning Department.
7. The Spokane County Plarining Department shall prepare and record with the
County Auditor a Title Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Tide Notice shall be
released, in full or in part, by the Planning Department. The notice should be
recorded within the same time frame as an appeal and shall provide the following:
a. At least 18 feet of reserved future acquisition area for road right-of-way and
utiliries, in addition to the existing and/or newly dedicated right-of-way along
Park Road. NOTE: The County Engineer required a dedication of two (2)
feet of additional right of way along Park Road;,
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfeld, signs or others) shall be
considered interim uses.
8. Parking shall be provided pursuant to Chapter 14.802 of the Spokane County Zoning
Code. A deed restriction shall he filed against the property limiting use of the site to
retirementJelderly housing such restriction shall be filed and recorded and a copy of the
recorded restriction provided for the Planning Departtnnent File #ZE-56-94 prior to
issuance of a Building Pernut
9. Provisions for outdoor storage shall be submitted at time of building pemut and sha.ll
conform to the provisions of Chapter 14.622.360 of the Zoning Code of Spokane
County, Washington. _

SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior to issuance of a buildinr permit or at the reQUest of the Countv Enpineer in coniuncrion
with a Countv Road Proiect/Road Improvement District, whichever action comes first:
1. Applicant shall dedicate 2 feet on Park Road for right of way and slope easements as
necessary.
Prior to release of a building permit or use of the property as proposed:
2. Access pernuts for approaches to the county road system shall be obtained from the
Spokane County Engineer.
3. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
4. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
5. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
6. The County Engineer has designated Typical Roadway Section Number One,
Minor Arcerial standard for the i.mprovement of Park Road, which is adjacent to the
proposed development. This will require the addition of approximately 10 - 12 feet
of asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required.-
7. All required improvements shall conform to the current State of Washington
Standard Speci.fications for Road and Bridge Construction and other applicable
County standards andJor adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
8. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
9. No construction work shall be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
10. All required construction vcrithin the existing or proposed public right-of-way is to
be completed prior to the release of a building permit, or a bond in an amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer.

11. The County Arterial Road Plan identifies Park Road as a Principal arterial. The
existing right-of-way width of 60 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addition to the required
right-of-way ded.ication, a strip of property 18 feet in width along the Park Road
frontage shall he set aside in reserve. This property may be acquired by Spokane
County at the time when arterial improvements are made to Park Road.
12. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligarion for adjustments or relocation ~
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane Counry Engineer to detennine whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any-r.ecessary work.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
2. The owner(s) or successor(s) i.n interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to
RCW 36.94, which petition includes the owner(s)' property; and further not to
object by the signing of a protest petition against the fomlation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED, this condition shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a ULID by either
petidon or resolution method under RCW Chapter 36.94.
3. A wet (live) sewer connection to the existing area wide Public Sewer System is to be
constructed. Sewer connection perrnit is required.
4. Applicant shall submit expressly to Spokane County Utilities Department "under
separate cover" only those plan sheets showing sewer plans and specifications for
public sewer/private sewer connections for review and approval by Utilities Department
prior to issuance of pemut to connect
5. Security shall be deposited with the Utilities Department for construcrion of public
facilities private connection.
SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal methal shall be as authorized by the Director of Urilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), Sta.te Department of Health.

4. A public sewer system will be made available for the project. Use of individual on-
site sewage disposal systems shall not be authorized.
5. Use of private wells and water systems is prohibited.
SPOKANE COUNTY DIVISION OF BUILDINGS
1. The applicant shall contact the Division of Buildings at the earliest possible stage in
order to be informed of code requirements administered/enforced as authorized by
the State Building Code Act. Design/development concerns include: addressing;
fire apparatus access roads; fire hydrant/flow; approved water systems; building
. accessibility; construction rype; occupancy classificarion; exiting; exterior wall
protection; and energy code regulations. (Note: The Division of Buildings reserves
the right to confirm the actual address at the time of building permit.)
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.
3. SCAPCA strongly recommends that all traveled surfaces (ingress, egress, parking
areas, access roads) be paved and kept clean to minimize dust emissions.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e., construcrion waste, etc.)

care faciliry and those uses allowed in the Urban Residential-22 (UR-22) zone.
Sixty (60) assisted living units and a thirty (30) bed special care facility is
proposed, as described in the applicarion ZE-56-94.
