SCOP'FJPROJECT DESCRIPTION:
1. General Overview - The owner, Gloria 7ean's Gourmet Coffee, is proposing to construci a
new building consisting of 1,836 square feet. Proposed will not be a full service restaurant.
There will be ao food preparation on the site. Praposed will offer a drive through windvw
plus inside seating and will specialize in the retail sale of coffee, coffee beans, tea,
milkshakes, cremosa, soda, flavorings, cookies, and pastries. Proposed will not be a full
service restaurant and no food preparation will take place on the site. All groundskeeping will
be contracted out. The applicant is anticipating that plans will be submitted for plan review by
the end of June.

. I. Planning Department (456-2205) - Francine Shaw
A. Discussion Items
1. The proposed is located in a B-3 zone. The proposed use is allowed in the
zone.
2. The proposed is located on parcel number 16543-0523 and 0524. The site is
effected by Zone Change ZE-119-84 for which there are conditions that must be
met.
3. Please contact the Assessor's office and obtain the parcel creation date for the
above parcels. In 1988 a parc,el boundary adjustment was apparently completed.
P1e,ase verify the exact nature of wbat took place with that boundary adjusumt
so that the Planning Department can establish the parcels as buildable.
4. Please aggregate the two pazcels into one parcel through a Certificate of
Exemption whieh can be completed adrainistraavely through the Planning
Department.
5. Requireci setbacks on the flanking street (Gillis Road) are 35 feet from the
property luie or 65 feet from the center of the road, whichever is greater. In
order for this requireraent to be met the applicant may: (1) move the proposed
building five (5) feet to the east or (2) apply for an Administrative Exception for
the flanking street setbacks. The Admirustrative Exception wouid not require a
public heauring, and could posubly be basel on the requured setbacks fot the site
at the time that the parcel was created. The apphcant was told that the previous
setbacks for the fronting street were 20 feet from the property li.ne or 50 feet
from the center of the r+oad. Application for an Adnunistrative Exception
requires that a copy of the Assessor's map be filed with the request.

6. Parking as illustrated is adequate. Nineteen (19) parking stalls are required
and 24 are illustrat,ed. Please illustrate traffic control devices on the revised site
plan and note that all pazking and travel lanes will be paved.
7. The height of the proposed sign as illustrated (35 feet) is allowable. Please
illusfte all dimensions of the proposed sign on the revised site plans.
8. Outdoor refuge storage areas are required to be surrounded by apite
obscuring fence that is a mirumum of 5-1/2 feet in height. ;
9. The applicant stated that they may construct an outdoor storage area. It was
noted that this must be enclosed by a site obscuring fence up to 8 feet in height
and may not be located within the required setback area for flanking or fronting
streets.
10. A site obscuring fence (a maximum of 8 feet in heighi) is required along the
north property line and the portion of the east properiy line that adjoins
residenbal zorung. The applicant was givea a copy of the zonmg map for the
sitie.

11. Please submit a lighting plan for review and approval illustraang the location
and direction of illumination of all proposed exterior lights.
12. The applicant was given a copy of the requirements for projects locat,ed
within the Aquifer Sensitive Overlay Zone.
13. A five (5) foot wide strip of Type III landscaping is required along Sprague
and Gillis. The six (6) foot wide stnp illustrated on the site plans is adequate,
however, please extend a portion of the landscaping beyond the north aucaess
lane.
Landscaping as illustrated for the parking lot is adequate.
Landscaping strips along the north and east property hnes are required by the
Zone Change as a buffer from the adjacent residential zones. Neither the vindth
of ttus required Iaadscaping strip nor the type of landscaping required are
specified, therefore it is at the landowner's discretion. The applicant asked if
this Iandscaping could be installed along the parking lot. Francine Shaw will
discuss this with her supervisor and contact the applicant this afternoon with their
determination.

of landscaping, itemized cost of the imigation system, and the cost of lator along
with a promissory letter from the owner stating the landscaping will be installed.
B. Percnit Release Requirements
1. Please submit an estimate from a nursery including size, type, curbing,
quantity of landscaping, itemized cost of the irrigation system, and the oost of
labor along with a promissory letter from the owner stating the Iandscaping will
be installed.
2. Please submit documentation verifying the parcel creation date. °
3. Please aggregate the panaels into one p0rcel through a Certificate of
Exemption.
4. Please submit a revised site plan illustrating traffic oontrol devives, paving,
sigaage, lighting, exterior refuge storage area fencing, landscaping, fencing, and
setbacks for review and approval.
U. Spokane County Air Pollution Control Authority (456-4727) - Kelle Vigeland ~
A. Discussion Items
1. Comments were given to the Department of Buildings by Kelle Vigeland and
were presented at the meeting by Tom Davis who summanz,ed the following:
- Proposed must meet all air pollution regulations, including those dealiag
with dust emissians during aonstraction and excavadon projects.
- Measures must be talcen to avoid the deposition of dirt and mud from
unpaved surfaoes onto paved surfaces.

III. Division of Engineering & Roads (456-3600) - Bob Turner
A. Discussion Items
1. Comments were given to the applicant and the Department of Buildings by
Bob Turner.
2. Please submit a drainage plan for the site that is in compliance with Spokane
County Guidelines for Stormwater Management as detailed in the handout given
to the apphcant at the meeting and attached tro the applicant's copy of these
minutes.
3. Please submit road and drainage plans prepsared by an engineer for road
improvements to Gillis. Gillis shall be improved to 'I`ypical Roadway Section
No. 1, Access Standard. All required road vonstrucu4n (sidewalk, curing,
pavemeat) shall be oompletsd prior to permit issuance or a bond in an amount
estimated by the County Engineer to cover the oost of oonstruction shall be
submitted. The applicant was advised to submit the road and drainage plans as
soon as possible so tbat permit issuance would not be delayed.
This requirement applies to the enttre frontage of both parcels along Gillis.
Forty (40) fee.t of asphalt is required. Please ideutify the width of the right of ,
way on the revised site plans. If the asphalt is 40 feet wide, then the existing
curbs and sidewalks can be al.lowed to remain.
4. Approach permits shall be obtained for aew and/or altered driveway
approaches along connty right of wg. If any of the. existing approaches are
re,moved or are not going to be utilized, thert the e~usting approach must be
replaced with curbing and sidewalks. Please identify the existing curb cuts on

2. Proposed must oonnect to the available sewer. Please contact Spokane
Counfiy Utilities Department at 456-3604 for the location of the sewer stub
serving the PI'aPertY-
Please properly abandon the old on-site sewage disposal site if it is located during
oonstruction.
3. Since the proposed is a food service, a permit from the Health District will be
required. Please submit a complete set of plans and specifications detailing the
room finish schedules and equipment schedules (meeting NSF staadards) for
review and appmval.
4. Please submit a critical materials list to the Department of Buildings for
review.
5. All construction debris shall be tak+en to a licensed landfill. ~
6. Please maintain the north portion of the property in a weed free and tcash free

2. The proposed building is being classified as a B-2 occupancy, Type VN
construction.
3. Please submit a criticai materials list for review.
4. The proposed shall meet the minimum requirement of the Regulations for
Barrier Free Facihties. Proposed should also comply with the provisions of the
American Disabilities Act. The Department of build.ings will aot be requiring
complianoe with this act until it is adopted as part of the Washington State

5. Structural calculations and design specifications prepared by an engineer will
be required tio jusfiify the adequacy of the structural system. Specifically, please
justify how the diagonal bracing in the dining are,a where glazing is indicated will
be maintained.
The applicant questioned the submittal of engi.neer prepared structural
calculations. This will not be requir+ed if the applicant can substantiate and
illustrate adequate bracing.
6. Proposed must cornply with the requirements of the Washington State Energy
Code.
7. Pleasa submit an equipment list for rreview. Catalog cuts will be adequate.
Specifically, an equipment list for the fixed seating will be required so a
determinahon can be made on the occupancy load of the proposed.

Please illustrate the type of seating for the pmposed (i. e. , tables, chairs,
combination of those, etc.). The occupancy load is fifty (50) and anything over
that may effect exiting from the proposed. If all of the proposed seating is single
seating, then the occupancy load as illustrated will be 46.
8. On the revised site plans please identify the location of the old building. Soil
comgaction tests may be required if any portion of the praposed building is
located over the basement of the old building. The applicant stated that the
proposed will not be constructed in the vicinity of the old buiiding. Records that
the applicant had ideatify the old building as being located 33'8" from the
property line and approximately 70 feet from Gillis.
9. The front page (cover sheet) of the construction drawings shall contain, at a
minimum, the professional stamp with an ~ri inal dated signature. This cover

4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.

Order" and the "Conditions of Approval" for the following

not be completed until this document is executed. This

For Gloria Jean's RestaurAitt
Project Description:
Gloria Jean's Restaurant is a proposed commercial installation at the northeast corner of
Gillis and Sprague. The improvements consists of a new 30' x 70' building with an
asphalt parking lot to the east, and a concrete drive along the north, west and south
sides of the building. Site grading was completed to accommodate site development
and drainage, and an asphalt driveway access from the west and south sides of the site.
The endre site, except for approximately che nonh 70 feet, wiil be improved.
Site drainage is pianned, by sheet flow, to be clepositecl witliin four 208 drainage swales
designed in compliance witli Spokarie CUUiity requiremenls Tlie 208 swales ue
planned for the mtddle and tlie coutli bnrcler ot tlie sile, as indicated on the enclosai
plan. Future roofing is ptanned lo bc: batli asplialtic and metal and has been included
for 208 sizing.
Soils:
In accordance with "Soil Survev, Spokane County, WashingtonT 1968" the soil is
identified and categonzed as:
GgA - Garrison gravelly loam, classified as gravelly, medium textures, somewhat
excessively drained soils formed in gravelly glacial deposits.
This soil is Type "B" as classified in the "Guidelines for Stormwater Management".
ToQ°graphic Data:
The existing site slopes gently towards the southwest with about 3 feet differential
elevation in approximately 300 feet (190). Surrounding terrain is typically level and
similar to that encountered within the Spokane Valley.
DemograQhic Data:
The site is located in a hght to nioderate commercial and industnal area.

Data used is in accordance with Figure 2, page 6-3 of the "Guidelines fox Stormwater
Management", by Spokane County Engineers. A 10 year return frequency event is
used smce the basins are contained within the site
Methods of Runoff Control:
Runoff control of the new dcvelaprnent is by overland flow into new grassed
percolation areas with overflow into drywells All three basins will flow overland
duectly into the respecuve 208 swales.
Methods of Disposal:
Disposal will be by single depth drywells. They shall be Spokane County Standard
Type "A", as called out vn the plans with standard grates. Inlet capacity calculations
are shown on sheet 10.
Peak Flow. Volume. and DisQosat Calculation:
a. Hydrology Computauons•
The grassed percolation "208" areas were sized to accommodate 1/2-inch of
runoff from all required surfaces within the site. The impervious surfaces
accounted for included asphalt parlung areas, concrete drives, sidewallcs, and
the new structure's roof.
i I Z. The site was divided into asins, "A", "B", and "C". Drywells were mzed
to handle the total runoff >in their respective basins. The Bowstring method
was used to analyze the runoff in determining numbers and size of drywelts.
See calculations on sheets 4 through 9.
b. Inlet Capacities:
A Spokane County Standard grate will be used on all drywells Inlet cagacittes
are calculated to be 1 6 CFS fnr a flow depth of 2 feet See calculations on
sheet 10.
The inlet capacity was also analyzed for the curb cuts used. Basin "A"
produced the largest flowrate, .96 CFS. This flowrate ponds to a depth of .22
with a 3 foot curb cut. Therefore this size curb cut should be acceptable for
each of the three basins.

Grass percolation areas were calculated to hold the first 1/2-inch of runoff
generated by the new required impervious surfaces within the site limit,s. The
area provided wlll be slightly larger than required.

Remarks:
The above described system of stormwater control will provide the necessary quantity

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
February 7, 1985, and the members of the Conanittee present being
Jane E. Myers, Chairperson and Richard L. Skalstad.
B. PROPnSAI
The sponsor, Melross, Inc., is requesting approval of a zone
reclassification, File No. ZE-119-84, Multiple Family Suburban to
Conxnerci al , for the purpose of devel oping Office and Retai 1 Uses.
C. FINDINGS OF FACT
l, That the existing land use in the area is residential, offices and
commercial.
2. That the Comprehensive Plan designates this area as appropriate for
Major Commercial development.
3. That the existing zoning of the property described in the application
i s h1u1 ti pl e Fami ly Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Ueclaration of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been ful fi 11 ed.
6. That the land in this area is suitable for the proposed use, or
uses within the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone is justified.
8. That the proposed use is compatible with existing uses in the
area.

a) COUNTY PLANNIwG OEPARTMENT
1. All current standards of the Commercial Zone, as amended, shall
be complied with in the development of this site.
2. That the project is subj ect to Section 4.16A.050, the Aquifer
Sensi ti ve Area Overl ay Zone of the Spokane County Zoni ng
Ordinance, which sets forth various measures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.
3. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of buildinq permits.
4. That the provisions of SEPA's WOTICE OF ACTION pursuant to
Chapter 43.21C.U80 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements.
In addition to the above, the following conditions shall be complied
with prior to issuance of building permits:
5. Approval by the Zoning Administrator of a specific lighting and
signing pl an for the described property pri or to the rel ease of
any building permits.
6. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County toning
Administrator shall be submitted with a performance bond for the

b) CUUNIY ENGINEERING DEPNRTMENT
Prior To The Issuance Of A Building Permit:

radius on Gillis Road and Sprague Avenue for right-of-way prior
to any use of the property.
2. Access permits for approaches to the County Road System shall be

2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an individual on-site sewage
system may be authorized.
4. Water service shall be coordinated through the nirector of
Utilities, Spokane County.
5. Water service shall be by an existtng public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Nealth Services.
6. Use of pri vate wel 1 s and water systems i s prohi bited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibi ted.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District # 1.
2. Reclassification of an exlsting building shall require an
application for change of occupancy permit and subsequent
inspection for approval.
3. lrash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.

4. Fire Hydrants which meet the fire flow are required to be
installed prior to any construction. These hy drants shall be
placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of
the hydrant shall be no less than 18 inches above grade. A
water plan showing each fire hydrant (specifying the gallons per
mi nute for each fi re hydrant) and meeti ng the requi rements i n
Chapter 10.04 of the Uni form Fi re Code i s requi red prior to
construction of the water service. All required fire protection
facilities shall be installed and made serviceable prior to and
during the time of construction.
f) WATER PURYEYOR
1. Water Purveyor is Modern Electric Water Company, and they will
supply the si te wi th adequate water for domesti c, fi re and
irrigation uses; however, satisfactory arrangements have not
been made to serve the proposal.
g) CUUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water spray s, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. 14easures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
3. Al1 travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. All air pollution regulations must be met.
