RE: SP-1040-95 - Drainage Analysis EXPIREe 2l211q7 The above referenced short plat is a proposed three (3) lot short plat off 9th avenue.
(Please reference the attached plat map and preliminary plat map.) The proposed action
will create three (3) lots out of an existing two (2) lot short plat. The existing lots are Tracts A and B of SP-84-310. There are homes and out buildings on the existing lots. The
preliminary plat map shows their locations. The proposed Tract C wi11 share the existing
gravel driveway that currently serves Tract B.
i'
I made a site visit on 12/12/95 to observe the existing conditions and the effects of the
proposed improvements. The addition of one home site (Tract C) will not significantly
effect the on-site drainage, nor will it significantly increase the runoff to adjacent
properties.
The southwest corner of the plat is in an area designated as a flood plain area and is
addressed in the plat dedication.
In summary, with respect to drainage, this proposed short plat will not have an impact on
sunounding properiies and no drainage improvements will be needed.

The requirement for Tract C in the above noted SP to address floodplain concerns will be
that the lowest floor including basement floor must be elevated 2 feet above highest
ground elevation on lot. A floodplain development permit will be required from this
office with that condition placed upon it. A$30.00 permit fee is required and a$300.00
bond must be posted to ensure the completion of an elevation certificate showing the
condition has been met. The elevation certificate must be stamped and signed by a
Washington licensed surveyor. This bond will be returned upon the completion and
submittal of the elevation certificate. Also, the mobile home planned on the lot must be
anchored per 3.20.320 (2) of the Spokane County Flood Ordinance. No future
development (this includes filling, grading, additional buildings, etc.) within the
floodplain will be allowed without a detailed flood analysis completed by a professional
engineer licensed in the State of Washington.
These conditions are in lieu of the requirement for a detailed engineering analysis of the
floodplain to delineate the floodplain and establish base flood elevations prior to the
finalization of the Short Plat. Any future plans for the floodplain will require this analysis
as outlined above.

RE: SP-1040-95, Floodplain This property is impacted by two separate flood hazard areas. A portion of the property is
affected by Zone A and a portion is affected by Zone B. These flood zones are defned as
follows: "Zone A- Areas of 100 year flood; base flood elevations and flood hazard factors not
determined, Zone B- Areas between the limits of the 100 year flood and the 500 year flood;
or certain areas subject to 100 year flooding with average depths less than one (1) foot To
ensure the protection of the future structures on these proposed lots a flood analysis to
delineate the boundaries of the floodplain and determine flood elevations will be required.
If any modifications of the floodplain are planned (filling, grading, etc.) are planned, these
activities will need to be addressed in the flood analysis and show no impact to the existing
100 year flood elevation.

RE: SP-1040-95 - Drainage Analysis EXPIRE8 2/21/q7 The above referenced short plat is a proposed three (3) lot short plat off 9th avenue.
(Please reference the attached plat map and preliminary plat map.) The proposed action
will create three (3) lots out of an existing two (2) lot short plat. The existing lots are Tracts A and B of SP-84-310. There are homes and out buildings on the existing lots. The
preliminary plat map shows their locations. The proposed Tract C Nvill share the existing
gravel driveway that currently serves Tract B.
I made a site visit on 12/12/95 to observe the existing conditions and the effects of the
proposed improvements. The addition of one home site (Tract C) will not significantly
effect the on-site drainage, nor will it significantly increase the runoff to adjacent
properties.
The southwest corner of the plat is in an area designated as a flood plain area and is
addressed in the plat dedication.
In summary, with respect to drainage, this prop4sed short plat will not have an impact on
surrounding properties and no drainage improvements will be needed.

page 48, as follows:
No more than one dwelling structure be placed on any one lot,
nor shall any lot be further subdivided for the p urposes of
creating additionsl lots or building sites without filing a replat.
Individual driveway access permits be required prior to issuance
of a building permit for driveway approaches to the County Road
systems.
The owners, their heirs, grantees and assigns, agree to join in
the formation of a County Road Improvement District pursuant to
the R. C. W. 36.88 at such time as a Road Inprovement District
is created or any Road Improvement Project is sanctioned by Spokane
County. The improvements required (curb, sidewalk, drainage
control and paving) will be at the sole expense of the owners,
their heirs, grantees and assigns.
WARTZING: Spokane County has no responsibility to build, improve,
maintain, or otherwise service the private roads contained within
or providing service to the property described in this plat. By
accepting this plat or subsequently by allowing a building permit
to be issued on property on a private road, Spokane, County assumes
no obligation for said private road and the owners hereby acknow-
ledge that the County has no obligation of any kind or nature
whatsoever to establish, examine, survey, construct, alter, repair,
improve, maintain, provide drainage or snow removal on a private
road. This requirement is and shall run with the land and shall be
binding upon the owner, their heirs, successors or assigns includ-
ing the obligation to participate in the maintenance of the private
road as provided herein.
Subject to specific application approval and issuance of nermits by
the Health Officer, the use of individual on-site sewage systems
may be authorized.
Use of private wells and water systems is prohibited.
The public water system as approved by County and State health
authorities and the local fire district and purveyor will be in-
stalled within this plat, and the subdivider will provide for
individual domestic water service as well as fire protection to
each lot prior to sale of each lot.
The owners or Successors in interest agree to authorize the
County to place their names on a petition for the formation of a
ULID by petition methol pursuant to RCW 36.94 which the petition
continued

THIS MATTER, an application for subdivision of land from Philip Watts, and John and
ed and decided upon, pursuant to Spokane County Subdivision
Terri Zalevits has been ;ce*
regulations, on the day of November, 1995.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Building and Planning.
2. The proposal is to divide approximately 2.0 acres into 31ots for single-family
residences and those uses permitted in the Urban Residential-3.5 (UR-3.5) Zone.
3. The proposal is located south of and adjacent to 9th Avenue, approximately 300 feet
west of Carnahan Street in the SW 1/4 of Section 23, Township 25 North, Range 43
E.W.M. Spokane County, Washington.
4. The existing zoning of the property ciescribed in the application is Urban
Residential -3.5. Tract "A" was previously established as Agricultural zoning in 1951
(File No. 238-49) and redesignated to Urban Residential-3.5 on January 1, 1991,
pursuant to the Program to Implement the Spokane County Zoning Code. Tracts "B"
and "C" were previously established as Mining zoning in 1959 (File No. 59-128) and
redesignated to Urban Residential -3.5 as part of an approved zone change in 1995
(File No. 15-95C). Pursuant to RCW 58.17.195 the proposal does conform to the
requirements of the existing zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses, as proposed and conditioned are in compliance with this
category.
6. Surrounding uses coclsist of single family residential, a mobile home park, and vacant
parcels.
7. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited.
8. No written comments were received from adjoining property owners.
9. The Spokane County Arterial Road Plan identifies Ninth Avenue as a Local Access
with a future right of way width of 60 feet. The existing right of way is 60 feet. The
County Engineer has designated a Local Access Roadway Section for the improvement
of Ninth Avenue. As a result, the County Engineer has required the addition of
approximately 27 feet of -asphalt along the frontage of the development.
10. The Spokane County Arterial Road Plan identifies a Principal Arterial with a future
right of way width of 100 feet traversing near the northwest corner of the subject
property. In order to implement the Arterial Road Plan, the County Engineer has
requested that the final plat shall depict which portions of the proposal will require area
to be set aside in reserve. This property may be acquired by Spokane County at the
time when Arterial Improvements are made to the Principal Arterial. Therefore, as
condition, the proposal confoi-ms to the Plan.
11. The proposed short plat has direct access to public right of way at Ninth Avenue.
Curbs and sidewalks are required by the County Engineer regarding this proposal, and
have been conditioned as pat-t of the fuh.ire formation of a Road Improvement District
(RID) project. It should be noted that 10th Avenue is not established due to grade
separation between lOth Avenue and Carnahan Road.
12. The site is located within the Public Transportation Benefit Area (PTBA).
13. The proposed short plat will be served by a public water system. Waste water disposal

14. No comrnents or conditions were provided by the Spokane County Parks Department
regarding this proposal. Presently, the Board of County Commissioners and the Parks
Department are in the process of reevaluating the continued use of Park and Recreation
Voluntary Mitigation Agreements while the Parks Plan is being updated.
15. No comments or conditions were provided by School District #81 regarding this
proposal.
16. The original preliminaiy shorC plat did not include Tract "B" of SP 84-310, which has
an existing house located within 15 feet of its west property line. To serve the two (2)
southern lots of the original preliminary shoi-t plat, the property owner of said Tract "B"
granted an access and utility easement along the 15 feet of iCs west property line. This
configuration resultcd in havinb a 12-t'oot driveway three (3) ieeC From the west of the
existing house on said Tract "B which does not comply with setback standards.
17. While negotiating with the applicant's representative, Wayne Hoff, and the County
Engineers to resolve the setback problem, it became evident that no other realistic
access to the two (2) southern lots of the original preliminary short plat was possible.
Tenth Avenue, which is Counly right-of-way to the east of the subject property, cannot
access Carnahan Road because of difference in grade. In addition, no road exists to the
south of the subject property for considerable distance. Also, the applicant's
representative attempted but was unable to obtain additional footage for the access and
utility easement from the adjacent property owner to the west.
18. To compensate for the setback, the prelim.inary short plat was revised to merge Tract
"B" of SP 84-310 with Tract "B" of the original preliminaiy short plat. The said
revision, referenced as "November 9, 1995, Revised Preliminary Short Plat," proposes
to eliminate one new building site since Tract "B" of SP 84-310 already contains an
existing house. As a result, Tract "C" will remain as the only new building site. This
was proposed as a means of reducing the amount of traffic on the 12-foot driveway
adjacent to the existing house on Tract "B". It should be noted that the attached garage
of the existing house is on the west end, which is adjacent to the 12-foot driveway.
To limit the amount of traffic on the 12-foot driveway to serve only one new building
site, Spokane County Planning shall prepare and record with the County Auditor a Title
Notice prohibiting further division of Tract "B" oi- "C" unless that portion of the access
and utility easement adjacent to the existing house on Tract "B" is realigned to the west
to improve the setback, or an alternate access is obtained.
19. For safety purposes, the applicant has agreed to install outdoor lighting at the northeast
comer of Tract "C" which will illuminate that portion of the access and utility easement
which is adjacent to the existing house on Tract "B".
In addition, the applicant has agreed to install a fence three (3) feet west of the existing
house on Tract "B" along the 12-foot driveway. The fence shall be constructed at least
three (3) feet in height and shall extend out five (5) feet north from the northside of the
house and 10 feet south from the southside of the house. The fence is intended to
prevent foot traffic from entering the driveway from the "blind" side of the house and
yard.
20. The adjacent property to the west has Che potential to be fLli-thei- divided into three lots.
In the evcnt that further division occurs, the access easement could be realigned thereby
inereasing the access and uCility easeinent seCback of the existing house on Tract "B".
21. The subject property is located in the URBAN Cate~ory of the Spokane County
Comprehensive Plan. The URBAN Category promotes "...fill-in development within
established development areas.„ Therefore, the division of this property for the
development of hi~her densities meets the intent of the Comprehensive Plan.
22. Recognizing the recommended conditions (outdoor lighting, 3-foot fence, limiting
traffic on the 12-foot driveway), and Spokane County development standards,
appropriate provisions should be made to ensure the public health, safety and general
welfare and that the public use and interest will be served by platting the subdivision.
23. The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety antl general welfare in
accordance with standards established by the state and Spokane County. The Division

of Planning has considered the provision of adequate public facilities as cited in RCW
58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities

d. transit i. schools and schoolgrounds
e. potable water j. sidewalks
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1040-95, referenced as November 9, 1995, Revised Preliminary Short Plat," is hereby
APPROVED until December l, 2000, subject to conditions noted below. Most of the
conditions of approval shall be accomplished by the applicant ancUor sponsor prior to
finalization of the short subdivision. This decision is final unless appealed in writing,
consistent with adopted appeal procedures.
COUNTY DIVISION OF BUILllING AND PLANNING CONDITIONS
1. All conditions imposed by Spokane Division of Planning shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with the UR-3.5 zone as ainended.
3. The final plat shall be designed substantially in conforniance with the preliminary plat
of record referenced as "November 9, 1995, Revised Preliminary Short Plat." No
increase of density or number of lots shall occur without a change of condition
application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. The preliminary plat is given conditional approval for three (5) years, specifically to
December 1, 2000. The applicant may request an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiration date.
6. Three (3) current certificates of title shall be furnished to Spokane Division of
Planning prior to filing the final plat.
7. Prior to final inspection (occupancy perm.it), outdoor lighting illuminating that portion
of the access easement wluch is adjacent to the existing house on "Tract B" shall be
installed.
8. Prior to final inspection (occupancy permit), the applicant shall install a fenee three (3)
feet west of the existing house on Tract "B" along the 12-driveway. The fence shall be
constructed at least three (3) feet in height and shall extend out five (5) feet noi-th from
the northside of the house and 10 feet south from the southside of the house. (See
"November 9, 1995, Revised Preliminary Short Plat").
9. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
10. Prior to filing of final plat, the appropriate road name(s) and street address(es) shall be
indicated.
11. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. Tract "B" of SP 84-310 will not include a
setback line. The dedication shall contain the following statement:
"Side yard and rear yard setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."

12. Spokane County Division of Planning shall prepare and record with the County Auditoi-
a Title Notice prohibiting further division of Tract "B" or "C" unless that portion of the
access easement adjacent to the existing house on Tract "B" is realigned to the west to
improve the setback or an alternate access is obtained. The purpose is to limit the
amount of traffic on the 12-foot driveway to serve only new building site. Title Notice
shall be released, in full or in part, by the Spokane County Division of Planning. The
notice should be recorded within the same time frame as an appeal.
13. A plan for water facilities adequate for domestic service and fu•e protection shall be
approved by the water purveyor, appropriate fire protection district, County Division of
Buildings and County Health District. The agencies will certify on the Water Plan,
prior to the filing of a final plat, that the plan is in conformance with their respective
needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
14. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
hai-mless from claimS by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
15. The final plat dedication shall contain the following statement:
"The public water systein, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, water purveyor and Spokane Counry
Division of Buildings, shall be installed within this subdivision, and the applicant shall
provide for individual domestic water service as well as fire protection to each [tractllot]
prior to sale of each [tract/lot] and prior to issuance of a building permit for each
[tract/lot]."
16. No building peiinit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-constructed" water system.
17. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general welfare.
18. A survey is required prior to the filing of a final plat.
COUNTY DIVISION OF ENGINEERING AND 120ADS CONDITIONS
1. That conditional approval of the plat by the County Engineer is given subject to approval
of the road system as indicated in the preliminary plat of record.
2. That drainage plans and design calculations showing the alignment of drainage facilities
be submitted to the County Engineer for acceptance prior to construction and/or the filing
of the final plat. DI-ainage plans to be pi-epared under the direction of a licensed
Professional Civil Engineer.
3. That the regulations of the National Flood Insurance Prograin be observed since the
proposed plat is affected by a Flood Hazard Zone. A development permit shall be
obtained from the County Engineer before construction or development begins within any
area of special flood hazard (reference Spokane County Ordinance 88-0521).
That the following statement shall appear within the dedicatory language of the plat:
"Development within this subdivision shall conform to the requirements of the National
Flood Insurance Program and Chapter 3.20 of the Spokane County Code. Purchasers of
the property within this subdivision are warned of possible flooding or ponding and the
potential requirement to purchase Flood Insurance. This warning shall be carried in each

and every deed drawn to transfer ownership of any and all property within the plat in the
area of Special Flood Hazard."
This condition is applicable to driveway approaches, driveways and private roads
constructed on the site for access.
4. The applicant should be advised that individual driveway access pei-mits are required
prior to issuance of a building permit for dxiveway approaches to the County road
system.
5. Existing County roads providing direct access to the plat shall be paved andlor curbed to
Spokane County standards.
6. The word "applicant" shall include rhe owner(s) of the property, his/her heirs, assigns
and successors.
7. To construct the road improvements stated herein, the applicant may, with the approval of
the Counry Engineer, join in and be a willing participant in any petition or resolution
which purposes is the formation of a Road Improvement District (RID) for said
improvements pursuant to RCW 36.88, as amended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane Counry, the improvements
required (curb, sidewalk, drainage control and paving to existing pavement) will be at the
sole expense of the undersigned owner, their heirs, grantees and assigns. This provision
is applicable to Ninth Avenue.
8. As an alternative method of constructing the road improvement stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project (CRP)
to the extent of the required road improvement. At such time as an RID is created or any
Road Inprovement Project is sanctioned by Spokane County, the improvements required
(curb, sidewalk, drainage control and paving to existing pavement) will be at the sole
expense of the undersigned owner, their heirs, grantees and assigns. This provision is
applicable to Ninth Avenue.
9. That the following statement shall appear within the dedicatory language of the final plat:
That in consideration of Mutual Benefits now or to be hereafter derived, do for
themselves, their heirs, grantees, assigns and successor (s) in interest hereby request and
authorize Spokane County to include the above described property in a Road
Improvement District (RID) and to support the formation of a Road Improvement District
for improvement of the road(s) described below by requesting and authorizing Spokane
County to place their name(s) on a petition for the formation of a Road Improvement
District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County
to cast their ballot in favor of a RID being formed under the resolution method pursuant
to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being
formed under the alternative resolution method provided for in RCW 36.88.065 and
Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s) further agree: (1) that the improvements or construction contemplated within
the proposed RID are feasible, (2) that the benefits to be derived from the formation of
the RID by the property included therein, together with the anount of any Counry
participation, exceeds the cost and expense of formation of the RID, and (3) that the
property within the proposed RID is sufficiently developed; provided, themselves, their
heirs, grantees, assigns and successoc-(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result of the improvements
called for in conjunction with the foi-mation of a RID by either petition or resolution
method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of
the Board of County Commissioners confirming the final assessment roll; provided
further, it is recognized that actual assessments may vary from assessment estimate so
long as they do not exceed a figure equal to the increased true and fair value
improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is created or any County
Road Improvement project is authorized by Spokane County, the improvements required
shall be at the sole expense of the owner(s) of property within the RID or served by the
improvements without any monetary pai-ticipation by Spokane County.

The RID waiver contained in this agreement shall expire after ten (10) years from the date
of execution below. This provision is applicable to Ninth Avenue.
10. The County Engineer has designated a Local Access Roadway Section for the
improvement of Ninth Avenue which is adjacent to the proposed development. This will
require the addition of approximately 27 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required.
11. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing County Road System warrants roadway
improvements herein specified.
12. The County Arterial Road plan identifies a 100-foot Principal Arterial traversing the
vicinity of the proposal. In order to implement the Ai-terial Road Plan using the best
information available, the final plat sha.ll depict which portions of the proposal will
require area to be set aside in reserve. This property may be acquired by Spokane
County at the time when Arterial Improvements are made to the Principal Arterial.
13. The applicant should be advised that there may exist utilities either underground or
overhead affecting the applicants property, including propei-ty to be dedicated or set aside
for future acquisition. Spokane County will assume no financial obligation for
adjustments or relocation regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to detei-mine whether the applicant or
utility is responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
14. The applicant shall grant applicable border easements adjacent to Spokane County R.ight of
Way per Spokane County Standards.
15. The private driveway shall be constructed per Spokane County Standards.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record andJor any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminaiy plat of
record for distribution by the Division of Planning to the utility companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Ciry of Spokane Public Works.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to sei-ve the plat.
8. A public sewer system will be made available for the plat/project, and individual service
will be provided to each lot/tract prior to sale. Use of individual on-site sewage
disposal systems shall not be authorized.
9. A statement shall be placed in the dedication to the effect that: "A public sewer system
will be made available for the plat/project, and individual service will be provided to
each [lotltract] prior to sale. Use of individual on-site sewage disposal systems shall
not be authorized."
10. The dedicatory language on the plat sha11 state: "Use of private wells and water
systems is prohibited."

for Spokane County, as amended.
COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS

vicinity of the proposal. In order to implement the Arterial Road Plan using the best
information available, the final plat shall depict which portions of the proposal will
require area to be set aside in reserve. This property may be acquired by Spokane
County at the time when Arterial Improvements are made to the Principal Arterial.

overhead affecting the applicants property, including property to be dedicated or set
aside future acquisition. Spokane County will assume no financial obligation for

This dept. is aware that the fifteen (15) foot wide easement providing access to lot "C" of sp
1040-95 will be limited to serving only the landowners of lots "B" and "C" and will in no way be serving
any future lots. We have been notified that: l. Within the fifteen (15) foot wide easement will be
maintained an access driveway twelve feet wide. 2. There will be a safety "buffer zone" three feet wide
immediately adjacent to and along the driveway side of the existing structure. 3. There will be installed a
barrier or fence installed along the length of the above described "buffer zone" which will provide a
separation from the driveway portion of the easement. The details of the fence will be worked out
between the short plat applicant and the County planning dept.. 4. A pole mounted street light will be
installed which will illuminate the access driveway area. After having reviewed the preliminary short plat
map, plans, and the site for short plat 1040-95 it has been determined that all requirements for this ~
department have been met and the plans for sp 1040-95 are acceptable to fire district #1.
