1'HIS MATTER, an application for subdivision of land, from Henry Sanderson for Pacific
Metal Co., Inc. and decided upon, pursuant to Spokane County Subdivision regulations, on
the ` . day of December, 1995.
FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Building and Planning.
2. The proposal is to divide approximately 4.18 acres into 21ots for industrial uses and
those uses permitted in the Light Industrial (I-2) zone.
3. The proposal is located east of and adjacent to Dollar Road and approximately 600 feet
north of Trent Avenue in the SW 1/4 of Section 12, Township 25 North, Range 43
E.W.M. Spokane County, Washington.
4. The existing zoning of the p1-operty described in the application is Light Industrial (I-2).
The subject property was previously established as Restricted Industrial in 1956 (File
No. 203-56) and redesignated to Light Industrial (I-2) on January 1, 1991, pursuant to
the Program to Implement the Spokane County Zoning Code. Pursuant to RCW
58.17.195 the proposal does conform to the requirements of the existing zone.
5. A cursory evaluation for conformance to development standards was conducted based
on information submitted by the applicant. It appears that the lots, as proposed and
conditioned, are in compliance with current standards for the Light Industrial (I-2)
zone.

development and uses, as proposed and conditioned are in compliance with this
category. '
7. Surrounding uses consist of industrial uses and vacant parcels.
8. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited. No
comments were received from adjacent property owners.
9. The Spokane County Arterial Road Plan identifies Dollar Road as a Local Access with a
future right of way width of 60 feet. The exisring right of way is 60 feet. The County
Engineer has designated a Local Access Roadway Section for the improvement of
Dollar Road. Therefore, the addition of approximately 11-13 feet of asphalt, as well as
the construction of curbing and sidewalk along the frontage of the development has
been requested. As conditioned, the proposal conforms to the Plan.
10. The site is located within the Public Transpoi-tation Benefit Area (PTBA).
11. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities. .
12. No comments or conditions were provided by the Spokane County Parks Department
regarding this proposal. Presently, the Board of County Commissi,oners and the Parks
Department are in the process of reevaluating the continued use of Park and Recreation
Voluntary Mitigation Agreements while the Parks Plan is being updated.
13. Recognizing the recommended conditions and Spokane County development standai-cis,
appropriate provisions should be made to ensure the public health, safety and general
welfare and that the public use and interest will be served by platting the subdivision.
14. The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The Division
of Planning has considered the provision of adequate public facilities as cited in RCW
58.17.110 (2). More specifically:

DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1044-95 is hereby APPROVED until January 1, 2001, subject to conditions noted below.
Most of the conditions of approval shall be accomplished by the applicant andlor sponsor prior
to finalization of the short subdivision. This decision is final unless appealed in writing,
consistent with adopted appeal procedures.
The following conditions shall be binding on the "Applicant", which term shall include the
owner or owners of the property, heirs, assigns and successors.
COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS
1. The proposal and future development of this property shall comply with the Light
Industrial (I-2) zone, as amended.
2. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submitta] and apnrovaI.
3. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
4. The preliminary plat is given conditional approval for five (5) years, specifically to
January 1, 2001. The applicant may request an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiration date.
5. Three (3) current certificates of title shall be furnished to Spokane Division of
Planning prior to filing the final plat.
6. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utiliry companies shall be received
with the submittal of the final plat.
7. Prior to filing of final plat, the appropriate roaci name(s) and street address(es) shall be
indicated.
8. The final plat map shall indicate by a clear, dashed line the requic-ed yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following .
statement:
"Side yard and rear yard setbacks shall be determined at the time building pernuts are
requested unless these setbacks are specifically drafted on this final plat. The setblcks
indicated on this plat may be varied from if proper zoning approvals are obtained."
9. A plan for water facilities adequate for domestic service and fii•e protection shall be
approved by the water purveyor, appropriate fire protection district, County Division of
Buildings and County Health District. The agencies will certify on the Water Plan,
prior to the filing of a final plat, that the plan is in conformance with their respective
needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
10. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide

for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harn-iless from claims by any lot purchaser refused a building pernzit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
11. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, water purveyor and Spokane County
Division of Buildings, shall be installed within this subdivision, and the applicant shall
provide for individual domestic water service as well as fire protection.to each [tractilor.]
prior to sale of each [tracb'lot] aild prior to issuance of a building permit for each
[tract/lot]." 12. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-constructed" water system.
13. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be wlived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to

14. A survey is required prior to the filing of a final plat.

Spokane County Health District that the existing system serving the structure located on
Tract B is wholly located wichin the boundaries of the tract. Any portion of the on-site

12. Subject to specific application approval and issuance of permits by the Health Officer,
the use of individual on-site sewage disposal systems may be authorized.
13. The dedicatoiy language on the plat shall state: "Subject to specific application approval
and issuance of permits by the Health Officer, the use of individual on-site sewage

accordance with the approved plans on file at the

approved drainage plans must be approved by the
County Engineer's Office prior to construction of
said revisions.

SUBJECT: SHORT PLAT # 1044-95 / SANDERSON, HENERY
The following "Conditions of Approval" for the above referenced subdivision
are submitted to the Spokane County Planning Department for inclusion in the
"Findings and Order" should the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer is given subject to
approval of the road system as indicated in the preliminary plat of record.
E 2 That plans, profiles and cross sections as designed to County standards showing
pr.oposed street centerline and curb grades be submitted to the County Engineer for
acceptance prior to construction and/or the filing of a final plat; road plans to be
prepared under the direction of a licensed Professional Civil Engineer.
E 3 That drainage plans and design calculations showing the alignment of drainage
facilities be submitted to the County Engineer for acceptance prior to construction
and/or the filing of the final plat. Drainage plans to be prepared under the
direction of a licensed Professional Civil Engineer.
E 5 Construction within the proposed public streets and easements shall be performed under
the direct supervision of a licensed engineer/surveyor, who shall furnish the County
Engineer with "As Built" plans and a certificate in writing that all improvements were
installed to the lines and grades shown on the approved construction plans and that all
disturbed monuments have been replaced. E 6 No construct~on work is to be performed within the existing or proposed Public
Right-of-Way until a permit has been issued by the County Engineer. All work is
subject to inspection and approval by the County Engineer.
E 7 All construction within the existing or proposed Public Right-of-Way is to be completed
prior to filing the final plat or a bond in the amount estimated by the County Engineer
to cover the cost of construction of improvements. construction certification, "As
Built" plans and monumenting the street centerlines shall be filed with the County
Engineer.
E12 The applicant should be advised that individual driveway access permits are required
prior to issuance of a building permit for driveway approaches to the County road
system.
E16 Existing County roads providing direct access to the plat shall be paved
and/or curbed to Spokane County standards.
E19 The word "applicant" shall include the owner(s) of the property, his/her heirs, assigns
and successors.
E24 The County Engineer has designated a Local Access Roadway Section for the improvement
of Dollar Road which is adjacent to the proposed development. This will require the
addition of approximately 11-13 feet of asphalt along the frontage of the development.
The construction of curbing and sidewalk is also required.
E32 The proposed plat shall be improved to the standards set forth in Spokane County Board
of Commissioners Resolution No. 95-0498, as amended, which establishes regulations for
roads, approaches, drainage and fees in new construction.
E33 The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing County Road System warrants the roadway
improvements herein specified.
SPECIAL CONDITION: The applicant shall grant applicable border easements adjacent to Spokane

The Spokane County Standards for Road and Sewer Construction specify that sidewalk is to be located
within a border easement separated from curb. The sidewalk may be located adjacent to the curb at such
time specific approval is granted by the County Engineer through a Design Deviation request. The actual .
location of the sidewalk is best determined at the tune road and drainage plans are submitted for
acceptance. I have enclosed a copy of sheet A-1 and of the section detailing submission of road and drainage plans.
Please be advised that the County Engineer cannot authorize the use of adjacent private property for
driveway purposes. However if you obtain an easement on the adjacent property for the use of the driveway, an approach permit must be obtained from the County Engineer prior to the construction of
the driveway approach.

Summary of estimated charges:
1.5 hours testing and calibration.
2.0 hours data analysis and reduction.
2.0 hours report preparation.
Regular time rate: $58.45 per hour (for equipment and man hours).
Overtiine rate: $65.00 per hour (for equipment and man hours).
If we were to do the testing in an overtime status, we could probably
complete the testing and have the results back to you by 7/11/96
depending on how quiclc we get the go ahead. If were to do the testing at
regular time it probably would not be completed till the end of next week
or mid week the following week. Timing is critical because of our
schedule, so the sooner a response the better, These rates are subject to
change. If you have any questions please call me.

Gentlemen:
Your Design Engineer, Adams & Clark, has requested that the County Engineer's Office utilize its
"Road-Rater" equipment to conduct in-situ testing and to provide information about the strength of the
native soils, so that the requireti pavement section improvments for pollaz Road may be desigaed. They
apparently are of the opinion that this process will have at least somewhat less impact to the design
schedule than will the process of sending a soil sample from the site to a materials testing laboratory.
This work was not contemplated in the "Agreement to Pay Fees" which you signed in February of 1996
for this project. We will need your authorization in order to proceed with the scope of work noted below.
We anticipate that this work can be accomplished within 6 weeks of the date of authorization. As the data
provided by this testing procedure is sensitive to the elevation at which it is conducted, the area to be
tested should be excavated and graded to the intended subgrade elevation. Please instruct your design
engineer that he will need to meet our representatives on site to verify that the testing is conducted in the
desired location, and at the correct subgrade elevation.
This work will be conducted on a time & materials basis. Upon completion of the data analysis, we will
inform you of the costs incurred by the County. Upon payment of these costs, we will provide a copy
of the test results to you and to Adams & Clark. As the County is merely providing test data which
reflects a physical property of the in-place soils, the responsibility for using the data in an appropriate
fashion lies solely with the Design Engineer; Spokane County assumes no responsibility for the
effectiveness of any pavement design utilizing this data, nor for the performance of any pavement section
based on the data provided by the County.

SCOPE OF WORK:
a. Conduct non-destructive in-situ testing (NDT) of native soils, along the frontage of Short Plat
SP-1044 and collect data for use in pavement section design for pollar Road. Location & elevation of
testing to be verified on site by the Engineer responsible for the project design from Adams & Clark.
Spokane County will provide not less than 24 hours notification of the expected arrival on site. Owner
to ensure that test location is graded to subgrade elevation.
b. Provide digital and hard-paper copy of (NDT) data to Adams & Clark, upon reimbursement
by the project Sponsor for costs incurred by the County.
ESTIMATED COST - T&M: $300.00 to $400.00

Gentlemen:
We have reviewed this correspondence. We would like to note the following:
1. Use of the County road-rater equipment:
At the pre-design conference, this was discussed as a possible alternative to laboratory
testing to determine the subgrade modulus of the subgrade material. At no time were any
promises made that the County would agree to perform this testing.
2. Any calculations, reports, etc., are required, by State Law, to bear the dated stamp
& signature of a Washington State-licensed Professional Engineer.
3, Our Pavement Engineer indicates that he is unable to arrive at the conclusions
presented in this correspondence, given the information presented. Calculations for the design
life ESAL loadings were not included in this correspondence.
4. Where did the ADT =400 originate? One page uses 600, another uses 400 for ADT.
5. Where did the value for percentage of traffic as trucks come from?
6. Soils characteristics can vary widely in a given area, especially since the SCS soils
map indicates the general type of soil to be expected. The soils at these locations will need to
be compared in order to determine whether the WSDOT modulus values appear to be reasonable
for use at the project site. Laboratory analysis of the soils at the project site, and at the location
of the WSDOT testing will be needed. A map indicating the location of the WSDOT test, as well
as the raw data and data calculations for the subgrade modulus value from the WSDOT test
should also be included.
7. If the procedure noted in item #6 is pursued, you will need to submit a Design
Deviation request, with sufficient justification, for the County Engineer's consideration. The
request may or may not be approved; approval may be contingent upon compliance with certain
conditions which are unforeseeable at this time.

As an alternative, the County Engineer would consider this method:
a. Laboratory analysis results and the Unified Soils Classification of the soils at the
project site would be provided to the County Engineer's Office.
b. The County Engineer's Office would provide a subgrade modulus value to the Design
Engineer, based on the USCS classification
c. The Design Engineer determines the pavement section based on the AASHTO method,
. to include calculations for overall traffic count (ADT) and proportion of truck traffc over the
design life, given build-out of the contributing area. An additional2" of gravel would be added
to the base underlying the asphalt pavement, for the section resulting from the calculations.
d. The Design Engineer would need to submit a Design Deviation Request for the County
Engineer's consideration. The request may or may not be approved; approval may be contingent
upon compliance with certain conditions, which are unforeseeable at this time.
