If additional right of way is required, the owners, their heirs and/or assigns agree to deliver to Spokane County a properly.si$ned and executed Right of Way Deed covering the required additional right of way. . , The owners or successors in interest agree to authorize Spokane County to include the below described property . in a Road Improvement District (RID) and to support the formation of a Road Improvement District for improvement of the road(s) described below by requesting and authorizing Spokane County to place their name on . a petition for formation of a Road Irnprovement District pursuant to RCW 36.88.050, or by requesting and , authorizing Spokane County to cast their ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being formed under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW. , If a RID is proposed for improvement of the road(s) described below, said owners and successors further agree: (1) : that the improvements or construction contemplated within the proposed RID are feasible, and (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID, and (3) that the property within the proposed R.ID is sufficiently developed; provided, the owners or successors shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the superior court the decision of the Board of County Commissioners confirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estimate so long as they do not exceed a Fgure equal to the increased true and fair vatue the improvement add to the property. By allowing a building permit to be issued on property having access from an unmaintained County road, Spokane County assumes no obligation for said road, and the owners hereby acknowledge that the County has no obligetion of any kind or nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain, provide drainage or snow removal on said road. SP-1046-95 ) CONCLUSIONS AND Kenneth and Dorothy Emert ) DECISION ~ THIS MATTER, an application for subdivision of land, from Kenneth and Dorothy Emert and decided upon, pursuant to Spokane County Subdivision regulations, on the 17 -r day of January, 1996. . FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Building and Planning. 2. The proposal is to divide approximately 1.5 acres into 41ots for residential uses and those uses permitted in the Urban Residential - 3.5 (UR-3.5) zone. There is currently an existing house on Tract 1. 3. The proposal is located between Progress Road and 13th Avenue in the SE 114 of Section 23, Township 25 North, Range 44 E.W.M. Spokane County, Washington. 4. The existing zoning of the property described in the application is Urban Residential - 3.5 (UR-3.5). The subject property was previously established Agricultural in 1942 (File No. 60-42) and redesignated to Urban Residential - 3.5 (UR-3.5) on January 1, 1991, pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing zone. 6. The Spokaile County Comprehensive Plan designates this area as Urban. The development and uses, as proposed and conditioned are in compliance with this category. 7. Surrounding uses consist of residential uses. 8. The requ.ued public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. No comments were received from adjacent property owners. 9. The Spokane Counry Arterial Road Plan identifies Progress Road as a Local Access with a future right of way width of 60 feet. The existing right of way is 50 feet. In order to implement the Plan, a strip of property 5 feet in width along the Progress Road frontage is to be set aside as Future Acquisition Area (FAA). In addition, the County Engineer has designated a Local Access Roadway Section for the improvement of Progress Road which is adjacent to the proposed development. This will require the addition of approximately 4-6 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk on one side is also required. Therefore, as conditioned, the proposal conforms to the Plan. 10. The Spokane Counry Axterial Road Plan identifies Thirteenth Avenue as a Local Access with a future right of way width of 60 feet. Thirteenth Avenue has an e3cisting right of . way width of 50 feet, and terminates at the east plat boundary of the proposal. The Spokane County Arterial Road Plan identifies St. Charles Street as a Local Access with a future right of way width of 60 feet. St. Charles Street has an existing 1l2 right of way widfih of 25 feet, and terminates at the south plat boundary. The County Engineer has requested that no direct access be allowed from Tract 2 and 3 to the St. Charles 1/2 right-of-way at the south plat boundary until St Charles Street is constructed to County Standards and established as a County Road. As a result, the.County Engineer has requested dedication of 25 feet of right of way for the extension of St. Charles Street along the east plat boundary. The County Engineer has also designated a Roadway Section for the improvement of the St. Charles 1i2 right of way at the south plat boundary. This will require the addition of approximately 27 feet of asphalt along the east plat boundary of the development. The construction of curbing and sidewalk on one side is also required. As conditioned, the proposal conforms to the Plan. 11. The site is located within the Public Transportation Benefit Area (PTBA). 12 The proposed short plat will be served by a public water system. •Waste water disposal will be as authorized by the Director of Utilities. ~ , . FINDINGS AND DECISION SP-1046-95 Page 2 13. No comrnents or conditions were provided by the Spokane County Parks Department regarding this proposal. Presently, the Board of County Commissioners and the Parks Department are in the process of reevaluating the continued use of Park and Recreation Voluntary Mit' ation Agreements while the Parks Plan is being updated. ~ 14. The Central Valley School District has commented on the proposal. The District has indicated that existing school facilities are inadequate to serve the proposed short plat and wishes to negotiate with the owner to provide adequate capital facilities as required by the Revised Code of Washington (RCW) 58.17.110. Review by County legal counsel indicates the condition requested by the School District can be required for developments. Approval of this short plat should include conditions requiring that provisions for appropriate facilities be in place prior to recording the final short plat in the form of a written agreement between the owner and the school district. 15. Recognizing the recommended conditions and Spokane County development standards, appropriate provisions should be made to ensure the public health, safety and general welfare ancl that the public use and interest will be served by platting the subdivision. 16. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. The Division of Planning has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces b. drainage ways c. public andlor private rights-of-way d. transit e. potable water f. sanitary waste disposal g. parks and recreation facilities h. playgrounds i. schools and schoolgrounds j . sidewalks llECISI4N Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-1046-95 is hereby APPROVED until February l, 2001, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. The following conditions shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS 1. The proposal and future development of this propei-ry shall comply with the Urban Residential - 3.5 (UR-3.5), as amended. 2. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 3. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Finciings and Conditions of Approval. 4. The preliminary plat is given conditional approval for five (5) years, specifically to February 1, 2001. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiration date. 5. Three (3) current certificates of title shall be furnished to Spokane Division of Planning prior to filing the final plat. S FINDINGS AND DECISYON SP-1046-95 Page 3 6. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies shall be received with the subm.ittal of the final plat. 7. Prior to filing ~ final plat, the appropriate road name(s) and street address(es) shall be indicated. 8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 9. The Spokane County Division of Planning shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Title NoCice shall be released, in full or in part, by the Division of Planning. The notice should be recorded with the final plat and shall provide the following: a. A strip of property 5 feet in width from the existing right of way along the Progress Road frontage is to be set aside as Future Acquisition Area (FAA) for additional road right of way. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition area. 10. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Division of Buildings and County Health District. The agencies will certify on the Water Plan, prior to the filing of a final plat, that the plan is in conformance with their respective needs and regulations. The Water Plan and certification shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. 11. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application'for bui]ding pernuts within the final plat. The arrangements or agreements shall include a provision holding Spokane Counry and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 12. The final plat dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, water pui-veyor and Spokane County Division of Buildings, shall be installed within this subdivision, and the applicant shall provide for individual domestic water service as well as fire protection to each [tractllot] prior to sale of each [tractllot] and prior to issuance of a building permit for each [tract/lot]." 13. No building permit will be issued for any lot within the final plat until certified by a Washington state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat" including a signed license stamp. The , t FINDINGS AND DECISION SP-1046-95 Page 4 certification may be in the form of a letter, bul is prefen-ed to be certified on a copy of the Water Plan as a schematic map showing the "as-constructed" water system. 14. The Water Pla and the above four (4) conditions of approval regarding the Water Plan may be waive~y the Planning Director/designee upon receipt of letters from the appropriate water purveyor and fire protection district stating that simple connections to an existing, approved water system will provide adequate domestic and fire protection water to ensure the public health, safety and general welfare. 15. The owner shall negotiate with the Central Valley School District and submit a recorded copy of a voluntary agreement making provisions for public schools prior to finalization and recording of the plat. The agreement shall provide a written description of the subject property to which the agreement applies and also state the dollar amount and any other agreed to mitigating measures. The owner shall also notify any potenrial purchasers who have made an agreement to purchase property within said plat pursuant to the Revised Code of Washington (RCW) 58.17.205, that adequate provisions for school facilities must be made conditioned on a future agreement between the plattor and school district. Voluntary agreements between the owner and school district shall conform to the requirements of RCW Chapter 82.02. 16. A survey is required prior to the filing of a final plat. 17. The applicant shall contact the Division of Building and Planning at the earliest possible stage in order to be informed of code requirements administeredlenforced as authorized by the State Building Code Act. Design/development concerns include: ADDRESSING, FIRE APPARATUS ACCESS ROADS; FIRE HYDRANT/FLOW; APPROVED WATER SYSTEMS; BUILDING ACCESSIBILITY; CONSTRUCTTON TYPE; OCCUPANCY CLASSIFICATION; EXITING; EXTERIOR WALL PROTECTION; AND ENERGY CODE REGULATIONS. To construct the r ad improvements stated herein, the applicant may, with the approval of the County Enginr, join in and be a willing participant in any petition or resolution which purposes is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to St. Charles Street and Progress Road. 11. As an alternative method of constructing the road improvement stlted herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to St. Charles St1-eet and Progress Road. 12. The applicant should be advised that thet-e may exist utilities either underground or overhead affecting the applicants property, including property to be dedicated or set aside for future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. RE: Emert SP at Progress & 13th Drainage Analysis Dear Bill, This letter is in regards to the stormwater runoff flowing across the referenced short plat (SP). The SP is bordered on the west by Progress Road and on the east by a proposed private driveway at the end of 13th Avenue. The existing condition within the short plat boundary in the area of the two undeveloped lots consists of mixed meadow and landscaped areas. The general topography of the area slopes from the north to the south. The site is generally flat with grades varying from 1% to 5%. A topographic survey was not performed for the project, however, a walker map was utilized to obtain the general features. The procedures as outlined in "Guidelines for Stormwater Management" published by the Spokane County Engineers were followed. It appears that the majority of the drainage will be sheet flow. Of the three (3) lots within this plat, one is already developed (existing home). The other two lots were assumed to have an impervious area of about 3,250 s.f. per lot, once developed. The remaining area on these lots was assumed to be lawn. Presently, these thxee lots are partially landscaped. To estimate the existing and developed run-off rates, the Rational Method was used with a 50- year return frequency as some of the property to the north drains across this plat. The basin encompassing this plat has an approximate area of 4.1 acres, with an existing run-off rate of 3.04 c.f.s. Once this plat is developed, the basin's run-off rate is calculated to be 3.33 c.f.s. This slight increase in runoff is due to additional imperious area once the lots are developed and the existing high retention of the partially landscaped lots. 106 W. The lot development should not cause any significant negative impacts beyond the existing condition considering that the increase in runoff is less than 10% and will most likely be spread out along the south boundary.
