SP-1050-96 ) CONCLUSIONS AND 11o Apples I- Spokane L.L.C. ) DECISION THIS MATTER, an application for subdivision of land, from No Apples I- Spokane L.L.C. and decided upon, pursuant to Spokane County Subdivision regulations, on the ~ ~ ~ . day of February, 1996. ' FINDINGS OF FACT AND CONCLUSIONS 1. The indiuidual si~ning below has further been properly delegated the responsibility for renderina the decision by the Spokane County Director of Building and Planning. 2. The pi-oposal is to divide approximately 2 acres into 21ots for commercial uses and those uses permitted in the Regional Business (B-3) zone. There is cui-i-enlly an existin~ building on Parcel A. 3. The proposal is located at the Northeast corner of Sullivan Road and Spi-ague Avenue in the SW 1/4 of Section 13, Township 25 North, Range 44 E.W.M. Spokane County, Washincrton. 4. The existin'c, zoning of the property described in the application is Regional Business (B-3). The subject property was previously established Commercial in 1953 (File No. 31 1-53) and redesignated to Regional Business (B-3) on January l, 1991, pui•suant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the r-equirements of the e,ristin~ zone. 6. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses, as proposed and conditioned are in compliance with this categ~i•y. 7. Surroundin~ uses consist of commercial uses. 8. The i-equired public notice was provided for this proposal and agencies havinc, a potenCial interest in the project were notified and recommendations solicited. No COI11IZle'nts were received from adjacent property owneis. 9. The Spokane County Arterial Road Plan identifies Sullivan Road as a Pi-incipal Ai-tei-ial with a fl1CUl'e I'lght of way width of 100 feet. The existing right of way is 110 feec. Therefore, the proposal confoi-ms to the PlaIl. 10. The Spokane County AI-terial Road Plan identifies Sprague Avenue as a Principal Arterial with a future right of way width of 130 feet. The existing right of way width is 85 feet, with an offset centerline at 55 feet. In order to implement the Plan, the County Engineer has i-equested that a strip of property 10 feet in width along the Sprague Avenue frontaoe be set aside in resei-ve. This property may be acquired by Spokane County at the time when Arterial Improvements are made to Spi-a~ue Avenue. 1 1. The site is located within the Public Transportation Benefit Area (PTBA). 12 The proposed short plat will be sei-ved by a public water systein, i•eqLiit•inc, only tiiinPle connections. Waste water disposal will be as aurhoi-ized by the Director of Utilities. 13. Recoanizing the cecommencied conditions and Spokane CounCy development standards, appropriate pi-ovisions should be made to ensure the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. 14. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision re~ulations, protnotin~ the public health, safety and genei-al welfare in accoi-dance with standards established by the state and Spokane County. The Division of Plannin~ has considered the provision of adequate public facilities as cited in RCW 58.17.1 10 (2). More specifically: a. open spaces b. drainage ways c. public and/or private rights-of-way d. transit e. potable water ~ FINDINGS AND DECISION SP-1050-96 Page 2 f. sanitary waste disposal cr . parks and recreation facilities h. playgrounds i. schools and schoolgrounds j . sidewalks DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-1050-96 is hereby APPROVED until March l, 2001, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the lpplicant and/or sponsor prior to finalization of the short Subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. Ide, ASLA 0 Re: Short Plat 10i206 ~ ~ Bill- We are in the process of fiiializing a two-lot short plat for the owners of the property on which Petco is situated at the northeast corner of Sprague Avenue and Sullivan Road (formerly American Red Cross Bingo and Two Swabbies). There is discussion in the conditions relative to the preparation of drainage plans to be completed -prior to final short plat approval. As the following survey shows, drainage for the existing building is currently accommodated via drainage swales and drywells. The owner of the property will, at some point in the future, construct a new building on the new easternmost lot. He will be required at that time to prepare detailed drainage plans prior to issuance of his building permit. In the meantime, we propose to prepare a blanket drainage easement across the easternrnost lot until the new building and its associated drainage facilities are constructed.
