The following information must be provided in order for us to proceed with our review. A) A drainage plan for the site shall be prepared in compliance with Spokane County "Guidelines for Stormwater Management". At a minimum the plan must contain: l. Drainage calculations for stormwater volumes generated on site. 2. Calculations for total impervious surfaces contained within the site. 3. Finished grade elevations for structures to be constructed on site. 4. Copy of the proposed landscape plan. 5. A typical cross section of the 208 swale. 6. Calculations to justify the number and type of drywells proposed. 7. Elevation of drywell inlets where applicable. 8. Finished grade elevations at the top and bottom of the 208 swale. B) The subject property is affected by the "Findings and Order" and the "Conditions of Approval" for the following land use action: Spokane County Zone Change No. ZE 7-92C C) The following improvements within adjacent Right of Way are required prior to the release of a building permit: 1. You must submit road and drainage plans for street improvements. These must be prepared by an engineer. Plans must be prepared for the following streets: a. Broadway Avenue All required construction (sidewalk/curbing/pavement) within the Public Road Right of Way is to be completed prior to the release r t r Page 2 of a building permit or a financial guaranty in an amount estimated by the County Engineer to cover the cost of construction or improvements shall be filed with the County Engineer. Required plans are to be submitted prior to estimating the amount of the financial guaranty or permit release. 2. Approach permits must be obtained, after a site plan has been approved, and before the issuance of a building permit, from the County Engineering Department for any new or improved driveway approaches to the following streets: a. Broadway Avenue 3. As an alternative to the required road improvements the County will accept an RID/CRP agreement "Notice to Public No. 6" on the property. 4. Please submit a copy of the recorded property deed from the Auditors office for the subject property. Upon receipt of the deed our staff will prepare the right of way deed and/or RID/CRP agreement. D) Insuf'Licient information was submitted with the proposal. We are unable to proceed with our review. We will need the following before we can proceed: 1. Site Plan. 2. Drainage plan as specified. 3. Other information: a. A parking and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving as required by the County Planning Ordinance, will be required for any portion of the project which is to be occupied or traveled by vehicles. It is illegal to back out onto the Right of Way. b. The County Arterial Road Plan identifies Broadway Avenue as a Principal Arterial. The existing right-of- way width of 55 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, a strip of property 6.5 feet in width along the Broadway frontage shall be dedicated to Spokane County. In addition to the dedication, a strip of property 16 feet in width shall be set aside for future acquisition by the County. This property may be acquired by . , . Page 3 Spokane County at the time arterial improvements are made to Broadway. E) Utility Condition: Permittee is responsible for arranging for alT necessary utility adjustments or relocation as required for completion of the improvement. F) The owner of the property or the authorized representative must complete and sign Spokane County Engineers "Agreement to Pay Fees". This document must be returned to the County Engineers Office. Plan review will not be completed until this document is executed. This document is attached to these comments. Please return the completed Agreement to your contact person at the Engineers Department. The applicant or their representative is responsible for including each item that is marked "Required By This Project" in their submittal in accordance with the checklist descriptions. Each item submitted that is to meet the checklist shall be checked off by the applicant or their representative. Submittals which do not conform to the above requirements will be returned for further items with no review being accomplished. This will prolong the review process. If changes occur in the requirements for the project because of further conversations with Spokane County representatives, please attach a note explaining the agreed upon change in requirements. When the applicants' submittal is finally approved, the Engineers department will release their portion of the Building Permit. As I told you earlier, we appreciate any leeway we can have on time of payment of these fees. Technically, these fees are to be part of the General Contractor's contract. However, he cannot sign his contract until HUD proceeds to "Initial Closing." Grace Court has virtually no free cash until that Initial Clasing to pick up fees such as this, so immediate payment would be difficult. On the positive side, HUD is very actively processing this praject, and I'm receiving very favorable feedback thus far, so I'm hopeful Initia.l Closing could still occur in early to mid February. (Assuming, of course, that HUD doesn't get furloughed again!) Reimburse Spokane County for project review and inspection fees as specified in Chapter 9.14 of the Spokane County Code. The fees will be based on actual salary costs incurred hy Spokane County for project reviews and / or inspections plus a ten percent adrninistrative charge, and will be billed monthly as accruecl. Any billing amounts due, including any expenses incurreci in the collection of an overdue account, must be paid prior to the County's acceptance of the project for filing. If a project is approved andior filed with a balance still owing, the unpaid balance shall be paid within 30 days of the invoice date. 2. The undersigned agrees that these fees are due and payable upon receipt of the billing as specified above. 3. Any invoices not paid within 30 days of the invoice date will be considered delinquent. If any autstanding balance on the account for this project is not paid within 30 days of the invoice date, na further reviews of the project documents will be conducted until the entire account balance is paid. Any balance on the account for this project not paid within '65 days of the invoice date may result in legal action or the initiation of other collection procedures, including referral to a collection agency. ON _I.T1STnN. AND ORDU INTRODUCTION This matter has come before the Hearing Examiner Committee on March 19, 1992. The members of the Committee present are Bud Skadan, Chairperson, Frank Yuse and Phil Harris. PROPOSAL The sponsor, Ed Klapp, requests approval of ZE-7-92, Zone Reclassification from Urban Residential-3.5 (UR-3.5) to Urban Residential-22 (UR-22) with the sewer bonus density to allow construction of 60 apartments for retired person on 2.4 acres. The proposal is within the Aquifer sensitive Overlay (ASA) Zone. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located adjacent to the north side of Broadway Avenue, approximately 320 feet west of Mc Donald Road in Section 15, Township 25 North, Range 44 EWM, Spokane County, Washington.. 2. The committee adopts the Planning Departnent Report as a part of this record. 3. The existing land use(s) in the area include churches, single family and multiple family residences. 4. The Comprehensive Plan designates this site as Urban. The Urban category is for the purpose of creating a"city like" environment. Multiple family dwellings should locate adjacent arterials, near public transit routes and should improve or maintain the consistency of single family area amenities. 5. The Arterial Road Plan designates Broadway Avenue as a Principal Arterial, with a recommended right of way width of 100 feet. The Counry Engineer Deparcment required dedication of a strip of land 6.5 feet wide along the site's Broadway Avenue frontage. In add.ition, a strip of land 16 feet wide along the site's Broadway Avenue frontage should be reserved for future acquisition by Spokane County for road improvement purposes. 6. The existing zoning of the property described in the applicarion is Urban Residential- 3.5 (UR-3.5), previously established on January 1, 1991. 7. The provisions of RCW 43.21 C(The State Environmental Policy Act) have been complied with and a Determination of Nonsignificance was issued. 8. The legal requirements for public notice have been fulfilled. HEC Qrder for ZE-7-92 Page 2 9. The owners of adjacent lands expressed both approval and disapproval of the proposed use. One area resident expressed concern that the project would result in increased ttaffic in the area. 10. The proposed use is compatible with existing uses in the area. 11. The proposed zoning does implement and conform to the Comprehensive- Plan. 12. The applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accord.ingly, the proposed zone reclassification is justified. 13. The proposed use will not be detrimental to the public health, safety, morals or welfare. 14. The Committee additionally finds/concludes: a. That the proposal is located within close proximity of the public sewer system and is required by the Spokane County Utilities Department to connect to the sewer system and that the proposal is located adjacent to the Spokane Transit Authority bus route and that convenience shopping facilities are located within wallang d.istance of the site. Accordingly, the proposal meets the requirements of the Spokane County Zoning Code Chapter 14.820 to allow for granting a sewer bonus density for up to 25 dwelling units per acre. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The following Conditions of Approval apply to the real property described below: The S 1/2 of the W 1/2 of Tract 80 of Opportunity Except for the West 10 feet of the South 215 feet, in Secrion 15, Township 25 North, Range 44 EWM, Spokane County, Washington. HEARING EXAMINER COMMITTEE 1. Prior to issuance of building permit, the Planning Department will require written verification from the Washington State Department of Transportation (WSDOT) that appropriate provisions have been made for mirigation of traffic impacts as per their letter dated March 16, 1992. 2. The cost of the traffic study and mitigating measures shall not exceed $1,000. SPOKANE COUNTY PLANNING DEPARTMENT 1. The proposal shall comply with the Urban Residential-22 (UR-22) zone as amended with the following limitation: Maximum structure height to top of roof HEC Order for ZE-7-92 Page 3 peak shall be 35 feet. The number of units on the site is approved to a maximum of 60 units allowing a bonus densiry for sewer hookup to approximately 25 units per acre. . 2. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Body. Variations, when approved by the Planning Director/designee, may be permitted, including, but not limited to building locarion, landscape plans and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane Counry Zoning Ordinance, and the original intent of the development plans shall be maintained.. 3. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaireti. 4. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 5. The Spokane County Planning Department shall prepare and record with the County Auditor a Title Norice specifying a future land acquisition area for road right-of-way and urilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Planning Department The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least 16 feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing andJor newly dedicated right-of-way along Broadway Avenue. NOTE: The County Engineer has required 6.5 feet of new dedication. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisirion area, until acquired, shall be private properry and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition area. 6. The Planning Department shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the 1 ' • • HEC Order for ZE-7-92 Page 4 property in question. The Tide Notice should be recorded within the same time . frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Deparnnent. The Title Notice shall generally provide as follows: - The parcel of property legally described as [ ] is the sub je,ct of a land use action by a Spokane County Hearing Body or Administrative Official on [ imposing a. variety of special development conditions. File No. ZE-7-92 is available for inspection and copying in the Spokane County Planning Department. 7. The Planning Department shall file with the Spokane Counry Auditor, within the same dme frame as allowed for an appeal from the final disposirion, including lapsing of appeal period, a Title Notice, which shall generally provide as follows: "Prior to the issuance of any building pennit for any building or any use on the property described herein, the applicant shall be responsible for complying with the provisions of the Zoning Code for Spokane County, Section 14.706 (Aquifer , Sensitive Area Overlay Zone). The property which is the subject of this norice is more particularly described as follows: . . . " SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior to issuance of a building permit or at the request of the Counry Engineer in conjunction with a County Road Project/Road Improvement District, whichever action comes first: 1. Applicant shall dedicate 6.5 feet to equa134 feet from the centerline on Broadway Avenue for right-of-way purposes Prior To Issuance Of A Build.inLy Permit Or Use Of The Pror)ertv As Pronosed: 2. Access permits for approaches to the county road system shall be obtained from the Spokane County Engineer. 3. The applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans. 4. A parldng plan and braffic circulation plan shall be submitted and approved by the Spokane Counry Engineer. The design, location and arrangement of parlcing stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 5. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 6. The County Engineer has designated Typical Roadway Section Number One, Principal Arterial standard for the improvement of Broadway Avenue, which is adjacent to the proposed development. 7. All required unprovements shall conform to the current State of Washington Standard Specificarions for Road and Bridge Construcrion and other applicable County standards and/or adopted resolutions pertaining to Road Standards and . HEC Order for ZE-7-92 Page 5 Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 8. Applicant shall construct a paved and delineated approach(es) to meet the existing pavement on Broadway Avenue. , 9. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80-1592 as amended and are applicable to this proposal. 10. No construction work shall be performed within the existing or proposed public right-of-way until a permit has been issued by the County Engineer. All work within the public road right-of-way is subject to inspection and approval by the County Engineer. 11. The County Arterial Road Plan idenrifies Broadway Avenue as a Principal arterial. The existing right of way width of 55 feet is not consistent with that specified in he Plan. In order to implement the Arterial road Plan it is recommended that in addition to the required right of way dedication, a strip of property 16 feet in width to equal not more than 50 feet from centerline along the Broadway Avenue frontage be set aside in reserve. This property may be acquired by Spokane county at the time when Arterial Improvements are made to Broadway Avenue. 12. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utiliries. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to deternune whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 5pecial Con &on: 13. The applicant designates a parlang area on the Northwest corner of the site plan, the ability to access this parking area shall be demonstrated through written documentation equating to a recorded easement. This access shall be considered a private road if more than two (2) lots are accessed from this private easement. SPOKANE COUNTY DIVISION OF UTILITIES 1. Applicant shall make connection to public sewer system. Sewer connection permit is required. Plans and specificarions are to be reviewed and approved by the Utilities Department- 2. "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formarion of ULID by petition method pursuant to RCW 36.94, which peririon includes the owner(s)' property; and further not to object by the signing of a protest petirion against the fonnation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of . ' HEC Order for ZE-7-92 Page 6• improvements called for in conjunction with the fonnation of a ULID by either petition or resolution method under RCW Chapter 36.94." SPOKANE COUNTY HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. A public sewer system will be made available for the platlproject, and individual service will be provided to each lotltract prior to sale. Use of ind.ividual on-site sewage disposal systems shall not be authorized. SPOKANE COUNTY DEPARTMENT OF BUILDINGS 1. The applicant shall contact the Deparament of Building and Safety at the earliest possible stage of design/development in order to be infonned of code requirements administered/enforced by the department, e.g., S tate Building Code Act regulations, such as requirements for fire hydrant/flow, fire apparatus access roads, street address assignment, bairier-free regulations, energy code regulations and general coordination with other aspects of project implernentation. 2. Requirements of Fire District No. 1 need to be satisfied during the build.ing pernlit process. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regularions must be met. This includes but is not limited to the following: 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of acrivity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen materiai must be controlled, as well as emissions from all other construction-related acrivities. 3. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken unmediately to clean these surfaces. 4. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 5.
